K-1 Fiance(e) Visa Process & ProceduresShot in the dark...
US citizens can only petition relatives such as spouse, parents and/or children. Your partner doesn't qualify as any of these for your mom to apply for him.

K-1 Fiance(e) Visa Process & ProceduresTranslations
Anything that your fiancee writes in Spanish can be translatred by a certified translator here in the States.

Here's how it works. Your fiancee writes and/or signs any document that is in Spanish. You then take this document to a certified translator. The translator will write a new document with the translation and then put a note on the translated document saying it has been translated to the best of her/his knowledge. But your fiancee doesn't have to write or sign anything in English, it wouldn't make sense.

The best thing to do as to not confuse anybody is to wait for an RFE if they send one.

K-1 Fiance(e) Visa Process & ProceduresMisspelled middle name, kind of!!!
CSC should be looking at every piece of document you send in with your application. If they see a problem with her name they will send you an RFE and that is the easiest way to fix something, instead of doing it beforehand. If they see nothing wrong with it and send it to the embassy, then you can have it fixed at the time of the interview.

Which is faster, a turtle, a snail or CSC? I guess neither.

Welcome to VJ and good luck with your K-1 process. Just as an update, it seems that January filers are getting approved now, slowly but surely. You'll get your turn... some day. :D

You can check with your bank to see if your check cleared. If it hasn't, you can call USCIS customer service at 800.375.5283 to find out if they have it. They only give you information if it has been more than 30 days.

If your check has been cashed you can also ask for them to send you the NOA1. They some times don't send them out, I filed over 2 months ago and I still haven't received it.

Of course he's still young at heart, he's only 34 for crying out loud! It's not like us people who are in our 30s need a walker and a hearing aid at this age.

K-1 Fiance(e) Visa Process & ProceduresK1 Forms

Hi Tims, I looked at the Guides section and found it very helpful regarding the original submission. However, it is not really clear with respect to the balance of the forms needed at the interview and on arrival. For example, I cannot find where it makes mention of the 230 and fairly certain that is required. Hopefully someone can clarify exactly what forms in total are required for the entire process.

Hello Tin Man,

Like Timsdaisy suggested, there are several Colombian club threads on VJ filled with a ton of info. You can go there and start reading and be more informed.

As for now, try going to this link. It lists the documents needed for K-1 visas at the US embassy in Bogotá:

http://bogota.usemba...tructions.shtml

Make sure you click in the link "Instructions for K-1/K-2 Visa Applicants". Even though it's in Spanish, it lists the documents needed at the time of interview.

PM me if you need anything else.

Don't dwell on it, I really hope you don't have to pay the $170 fee again. BUT like the others said, be glad you're going through Vermont, so it could only take 2-4 weeks to be approved.

Best of luck.

K-1 Fiance(e) Visa Process & ProceduresJust Starting....Reading All The Info....
The only advice I can give you is to keep on reading all the material you can find here on VJ, and this includes the actual comments VJ members post in here. There are a lot of questions/answers that are similar to the ones you may have. Also, triple check everything you read and everything you fill out before sending it out to USCIS, this will save you a lot of time and headaches.

Wishing you the best!

K-1 Fiance(e) Visa Process & ProceduresFiance visa advice
Yes, the 90 day wait for CSC is also for K-3 visas. Unfortunately we've seen that number increase in the past month or so and you (as well as most of us) are looking to wait in line a bit longer.

I'm with everybody else. If you're already here and are able to adjust your status, might as well do it. The whole waiting game while being separated is not fun at all. Not only do you feel helpless and depressed, but it causes a lot of tension. I cannot even keep track of the arguments I've had with my husband over this, but there's nothing we can do about it.

Just one thing to keep in mind if you decide to file for a K-1 visa, I-129F petitions seem to be approved by VSC within a few weeks of filing vs. CSC which is taking over 90 days, some times 120.

K-1 Fiance(e) Visa Process & ProceduresDid they lose our petition packet?: UPDATE
CSC is on my you know what list. I can't stand their incompetence and there are way too many bad stories floating around because of CSC. And just think, we're a very small percentage of the total amount of petitioners, I don't even want to know what other people outside of VJ have to say.

K-1 Fiance(e) Visa Process & ProceduresHow long does it take 2 get ur NO2
Right. When a petition is filed at USCIS, it doesn't matter which country it is for. Right now the average wait for an approval for K-1, K-3 and CR-1 petitions at CSC is about 90-120 days. Mine was approved in 87 days from the day I filed at NSC.

K-1 Fiance(e) Visa Process & Proceduresrelatives in love?

I don't care how many scientific studies have been done to rule out the "discrepancies" of marrying a relative. In my opinion I'm 1 hair away from being my cousin's sister. Too much commom blood there. He's still easy on the eyes though.

K-1 Fiance(e) Visa Process & ProceduresOfficial NOA1
It took over 2 months for me to get my NOA1 but I did have to call because my receipt # was not very clear on my cancelled check.

You should call USCIS to find out if your # matches what they have in their system. Before they give you any info they ask you a whole bunch of questions to see if you are indeed the petitioner and also to make sure they have it all correct. Don't hesitate in calling them, they're very nice.

Let me clarify we have no intent to marry if she gets the tourist visa i was just curious what the options were if we did decide to marry :)

Is that a wink, wink type of statement?

Here is the thing, YES you can marry but it will be considered fraud if your fiancée stays since you did have the intention of doing just that before she came. BUT... a ton of people do that and they just play dumb when it comes to adjusting status. And to be honest with you, I don't blame them.

Dannyj,

I strongly recommend translating any certificate you might have in Spanish and get several copies of it because you might need them down the road. Certified translations are A LOT cheaper in Colombia than they are here.

K-1 Fiance(e) Visa Process & ProceduresTranslation of Documents
I'm pretty sure that any document that you need to take to the embassy for the interview does not need to be translated. Now, if you are sending any document to either the USCIS or the NVC and it's not in English, it does need to be translated. If that is the case, any person who is fluent in both languages can do the translations, and I believe there is a sample of that here on VJ.

K-1 Fiance(e) Visa Process & ProceduresG-325A Employment Data Question
Even if you held your job as only part time, you still have to put it down as part of your employment history. USCIS doesn't differentiate between a "proper" job or a job you had on the side. And also, any gaps between jobs need to be labeled as unemployed.

The legal wedding needs to take place in the States if you want to pursue a K-1 visa. You can still have a non-legal binding "ceremony" in Canada but the actual legal wedding needs to take place here.
