11 years age difference is not a big deal at all, also one single visit is depends on the country, country such as Dominican Republic or Haiti with a single trip will most likely earn you a denial. I know two people that has been denied due to insufficient trip (a single trip).

Depends of the reason why the previous revocation happened, in his case a well qualified lawyer is needed, his wife lied about her employment status and possibly did something she wasn't supposed to do while in the US with a visitor visa. so there's a huge chance their K1 might be affected.

Get a lawyer a very good one, and that wont be cheap, also was your wife charged with material misrepresentation, visa fraud, what was the final sentence before the visa was revoked, and also you said its not true that she worked on her tourist visa, when indeed she admitted she did work on it or you are trying to say that they forced her to admit she violated her tourist visa terms.

Also the reason you need a good lawyer is to prepare a solid waiver of extreme hardship in case there's a ban involve usually 10 years or indefinitely. Other than that your wife had already lost the first fight which was her visa.

I don't think I would worry about it. If you have a driver's license, in addition to your social security card, with the spelling you have used your whole life, you should be fine. If you think about when you change your name after marriage, you change your social security card and your driver's license to make it official. If those things match, then I believe that is your legal identity. If you have a passport with that spelling as well, then I definitely think there will be no problem.

One thing you might consider doing is including your name as it is listed on your BC on the forms when they ask for "other/previous names used".

When I filed the I129f petition for my then fiance, we made the decision not to bring his 8 year old son to the States as we felt he was better off in Peru with his mother. He was named on the petition (and all subsequent paperwork), but we simply did not pursue getting a visa for him at that time. We are now married and have had our AOS interview (but have apparently slipped through the cracks as we have received absolutely no word for over 3 weeks- oy vey) and are considering bringing the son here sometime in the future. I'm just wondering exactly what we would need to file, and how long we might expect that to take. I do realize we need to wait for the AOS approval first. I'm really just trying to feel it out to see how feasible it would be. We would really love to have him here with us.

I have a dilemma. I have to get police clearance certificates for all countries lived in for more than 6 months in the last few years. I lived on board two charity ships between September 2006 and January 2008 and visited more than 13 countries. How do I get police certificates to cover this?
The ships' address was c/o a German address but the German authorities would not have a record of me living there because I wasn't, I was on a ship, so I don't think they'd be able to issue a certificate... Any ideas???

We got our NOA2 5 weeks ago. Everyone else from London who got their NOA2 similar time to us has already had their paperwork from the Embassy. My fiance in USA called NVC and CSC yesterday but no-one can tell us where our petition is. Arrrrrrrggh! NVC has not seen it yet. CSC says it was approved and was being sent on Sept 15th (NOA2 - we already know this), so where is it?? They told us to wait 90 days. This is ridiculous - 90 days to send our already approved paperwork to NVC when everyone else's already went weeks ago? Why is ours held up? Any advice? Please? I'm going crazy here...

We called NVC a couple of times... The trouble was not with NVC though because they hadn't received it. We tried to speak with people at the USCIS directors office a few times and also emailed Luke's congressman. Then it just turned up... Back in the system. Typical. 6 weeks sucks though.... We found out it had turned up the next time Luke rang NVC and it had finally arrived. Try calling the directors office or your congressman. Good luck!

As the person who posted before said, although the london medical fee is £180 (roughly $260) plus you also have the cost of any vaccinations you need to have.

Once you are married and have to upgrade to lawful permanent resident status there are more fees, i think around $1400 including filing for employment authorization.

I think that the question is would you rather be apart while you're waiting to get married and then be together forever, or be together but then be apart when you're married and awaiting spousal visa? If you go for the K1 option (which is what we did), be prepared for it to take anywhere from 6 months to a year. Ours took 8 months. If K1, I recommend that you don't plan a wedding date until you at least have a visa interview date if not the actual visa in hand. Another consideration is that you cannot travel to the USA whilst you have a K1 visa being processed so if you're going out in April, maybe file for the K1 as soon as you get out there then hopefully you'd only have 5 months apart... Include a letter with your application stating exactly what you have just told us. I would suggest also getting a letter from your current employer to back this up. The time to get such a certificate when available is closer to the interview, at least close enough to be within the standards of the applicable Consulate. For instance, China prefers no more than six months. Three months or less is better.


Yeah, good catch. I think we will have to get it re-issued once we will get out of CSC and into the NVC.

She initiated the process of getting the certificate when we first started talking about the K1, thinking we would need it for the first submittal. At first I was baffled when she insisted that we needed this "certificate of being single." I had never heard of such a thing before. It took her a while to explain it to me. (her English and my Spanish not quite at fluency level yet). To my horror I thought she was talking about a divorce decree or some such. (Especially when she insisted that I needed one too!) Ha, ha. What good times being "lost in translation" can be.

Yes, we've met in person twice. This is just his first visit here, our two previous times together were in Canada when I visited him.

It does not sound like folks are focusing on an important issue here. You seem to indicate that the only evidence you have of meeting in the last two years are emails, which as evidence for the purpose of proving you have met in the last year do you no good.

If you do not have good primary evidence of being in the same place at the same time in the last two years (passport stamps, boarding passes, train tickets, etc...), then you may want to consider waiting to submit your petition until you can gather the evidence from your next meeting. And since you will know what you need for primary as well as secondary evidence (by reading the guides), you should be able to collect very good evidence.

We put both her last names in all the documents when it asked for her last name. We included a cover letter with out I29-F, and explained on it that her name was in the Spanish/Latin America style of two last names. We also spelled her (and mine) last names with all capitals on all forms and the cover letter to help alleviate the confusion.

Most adjudicators will be familiar with the Spanish naming convention, so just fill out everything with his complete legal name as it is on the passport.

I think that happens when the holding queue for calls are full. You have to call at a time of the day that is less busy for example I called late afternoon yesterday and I was able to get an operator after a 20 minute hold. You may want to call either early in the morning or in the afternoon. It is usually busier at nights.

For the proof of the visitation, does any receipts (hotel, atm, restaurant) need to be translated to english from russian in my case? I also has some boarding passes/tickets from travel from Mowcow to her town and the titles are in english but the responses are in Russian. Am I over analyzing this?

They can. They probably won't. I know lots of Russian (Moscow) couples that have met only once and been successful. Your chances are as good as you make them. Provide plenty of evidence of relationship and they are 100%.

Who is the USC? The employment situation of the foreign fiancee will not matter in the process. The US citizen needs to show he has a means to support his fiancee at the time of the interview. Moscow accepts co-sponsors.



I was just thinking the same thing if there is a chance that the US citizen could not have a job then it might be a good idea to start preparing for a cosponser. Here is a thread that has links to the poverty guidelines for the affidavit of support I134. There are other threads on the cosponser process.

My fiance and I have almost finished going through the K1 visa process which has taken us almost a year. I am from the UK, he is from NJ, US. He works for a large pet retailer, Petco, and recently had a new general manager take over who has treated the whole team, but particuarly him, very badly. Right from the start she has deliberately changed his quantity of hours and schedule at the last minute for no reason, (which she knows doesn't suit him), she once refused to answer her phone to him in an emergency (he was the manger on duty in the store), she reprimands him in front of customers for not carrying out certain tasks that he has never been trained to do, she belittles other staff, she refuses to acknowledge him for work that he's done well, she also refuses to pass on compliments of good work from customers to higher up in the company and generally just makes life extremely difficult for him. He also recently saw her acting suspiciously around the safe one evening recently and when he queried why it wasn't balanced, she looked nervous and he saw her throw in money from her own pocket to make up the balance...

Anyway, he is so miserable there and hates his job so much he is about ready to walk out. He has been looking for another job for weeks already. He also fought very hard to get a letter for K1 to say that they pay him so much salary and so many hours and they have totally gone back on that. Now they just give him minimal hours and obviously not the same salary.

So in preparation for our new life together, it was always planned between us that he would come over to the UK and fly back with me in May when I emmigrate, to help me move and assist me transport my labrador dog over to the US. I am so grateful that he is coming over to help me as I really couldn't do it without him.

At this time, despite working for the company for a year, he is entitled to only 4 paid days off. These are for him to take before his 1 year of service runs out (which is by June 12th). We are then planning to get married during the last week of June, which he has also requested a week of paid time off for - as he will be entitled to 18 paid time off days by then. By the way, he has not taken any time off since he started working for the company last June.

Today he has been told by the manager that she is not prepared to authorise the first set of 4 days off at the end of May, and that he cannot have time off to come to england and must stay in work. She said she will authorise our time off to get married but not the time needed to emmigrate together. She has not given a reason and won't when she is asked repeatedly.

What can my fiance do? His payslip clearly says that he is entitled to this paid time off, but regardless of that, he should be entitled to take it unpaid if necessary in these circumstances. Does anyone have any suggestions? Can he complain to HR? Is this unfair treatment?

I would agree with those who recommend talking to her manager about the time off. I would also bring up about incident about the safe and money. But be aware that there could be some retaliation on the part of his manager. Some states are no cause states while others arent so she could fire him for no cause depends on state and company policy.

We used a lawyer- and although I didnt have to worry about anything- she handled everything and just told me what documents to provide and fill in, she wasnt the best and ultimately one of her mistakes cost us 3 additional months apart. I had to nearly harass her for updates and info- once you pay your retainer- they dont seem to rushed to do much.

We had a similar situation, South African husband was living in another country- mine was living in the UK- got married in Denver while he was visiting, applied for everything when he was back in England. Our process started in June 08 and its still not complete, though I think he will finally arrive in the US in 2 weeks!

A couple words of advice:
1) Its going to take forever regardless of the visa you choose I think.. sorry! There are always unexpected delays. If I did it over again, I would choose the route of being apart the least- meaning I would rather we be together in the US him not being allowed to work for some months, than him being abroad working, waiting, waiting waiting for his visa and to see you.

2) Best word of advice is to get everything together early- know what documents you are going to need for the 'next step' and have them organized early. For ex: background checks for packet 3. He must provide at some pt, background checks of every country he has lived in since age 16, we knew this and figured a couple of weeks max right? It took us 10 business days to request one from the UK, and 7 weeks to get one from SA! 7 weeks! We had no idea it would take this long, which delayed the whole application.


Good luck! Choose a lawyer carefully if you go that route, know the process and required docs very well beforehand and be prepared for a stressful roller coaster. Its not easy, but the price we pay for falling for foreigners.

What's with all the yelling? Bring down your font a bit.

You and your fiance need to sign ALL 4 pages of the G325A, each. You can fill out her information on her 4 pages but SHE has to sign all 4 herself.

It depends on how you feel about filling out paperwork, doing a lot of reading and triple checking everything you do. If you're ok with that, then you should do it yourself, if not, then hiring a "good" and trusting lawyer should be ok too.

That's correct. The WAC is your receipt # which is completely different from your case #. Once your I-129F is approved by CSC, it'll go to NVC. Once they receive it, they will assign your petition a case # which usually starts with 3 letters specifying the consulate city. In my case it would be BOG# for the embassy in Bogota, Colombia.

Since you're going through CSC, you still have about 2-3 months to go before you can get your case # from NVC.
