I just went to the US Embassy in Bangkok site and their Packet 3 Instructions clearly say:

The original documents must be presented at interview.

TERMINATION OF PREVIOUS MARRIAGES: If either Petitioner or Beneficiary was
previously married, please provide proof of termination of that marriage (e.g. death certificate
of spouse, final divorce decree or annulment).



So, according to the US Embassy, you will need his original divorce decree document.

We had chat logs from MSN Messenger and what I did was copy a conversation and edited on an excel sheet, that way it showed the names, the dates, the times. I did this with 2 conversations per month for 2½ years, one sheet per chat converstion, so only two pages per month. I have to say that the CO read every single page, so I'm glad I did it.

You definitely need to wait until you have the final divorce decree document or the USCIS will reject your petition. Also, you only need to send copies of everything to them, not necessarily the original documents. This goes for everything, birth certificates, divorce decrees, translations, etc. Only copies are needed.

For now, just follow the guide on how to file for a K1 visa. Once the petition is approved it will get sent to the NVC for a case # and the forwarded to the US embassy. The embassy will then ask the beneficiary for the additional paperwork, including the I-134 and financial evidence.

If she wants to start using your last name as her married name she will have to start filling out every document with her new name from now on. She will need to use her marriage certificate as legal proof of this change.

As far as getting an approval for your visa, it really doesn't matter if you're employed or unemployed, if you have money saved up or not. All they care about is that your sponsor(s) makes enough or has enough funds to support you while you're in the US.

Try to have as much evidence as possible just in case you get an RFE from the USCIS before they approve the I-129F. It will also help for when your fiancé goes for his interview. Evidence can be things like copies of e-mails, chats, pictures, itineraries, etc.

And don't worry, many people meet only once for a short period of time and still get approved.

Both the CR1 and K1 visas take almost just as long, especially going through Bogotá. I recommend the CR1 if you can get married first to save money and time since you'd have to file for AOS with a K1 after arrival.

The only two service centers processing these type of visas are Vermont and California. You have to send the petition to the one you have to based on your current address.

Yes, that's pretty much all the additional info he needs from you to take to the embassy with him. Fill out form I-134 and send him copies of last year's tax returns with corresponding W2s, if you have them for the past three years, even better. Letter of employment where it shows how much you earn a year and copies of your most recent pay stubs. That should be plenty.

Keep in mind that a lot of it depends on which service center you had to send it to. The CSC is known to be much faster than the VSC for most petitions but that changes every now and then. Also, if you have a straight forward case and sent all the info they need, it makes their job easier, thus getting a faster approval.

I would like to thank anyone who can help me on this as I have gotten different information from the consulate in Krakow, the embassy in Warsaw, Poland and the immigration lawyer I consulted so I am pretty confused.

I am a US citizen (currently a student in Poland) who has applied and been approved for a K1 visa with my fiance. We just mailed in our DS-230 Part 1 form along with the I-134 & the I-1864a form and are awaiting our interviews to be scheduled.

Assuming that everything goes well and we are able to go to the States to be married, will my fiance (at this point my wife) be able to stay in the US while we apply for her Adjustment of Status?

She won't need to return to Poland for any reason will she? We are hoping to apply for the change of status on the first day of the K1 (we are waiting to get the visa to jump on the plane) and are hoping that we can file the I-765 so that she can start working as soon as possible.

Are we missing a step or does that sound about right? We have been told several different things and are really getting tired of the 'officials' all contradicting each other.

I'm really confused by your post. You filed for her K1 visa and are waiting for the interviews? How many people will be having an interview? Also, you say she's your wife? Or are you referring to her as your wife after she arrives here with her K1 visa? One last thing, did you say you were filing for AOS the first day of her arrival? If so, I highly doubt that she can arrive early in the day so you can get married, get your marriage license and file for AOS.

Yeah, don't bother with lawyers unless you have a very difficult case because all they do is ask you to fill out the forms, give them the supporting documents and mail it to the USCIS, all of which can be easily done by you.

And yeah, the initial process may be overwhelming but just wait until you have to file ofr AOS. :innocent:

Absolutely, your approved petition is never forwarded to the embassy from the USCIS. It has to go to the NVC to get a case # or the embassy wouldn't even accept it. Like other members said, keep calling until you get to a rep that knows what she's doing.

Welcome aboard and I echo what others have said in that it is nice to have a bit of an insider's viewpoint to the whole adjucation process. I can tell you that I knew little about the whole process before even reading your well spring of information. Thanks for your patience answering all the posts, as well as helpful tips.

When you mentioned contacting your congressman(woman) because the petition is not being processed in a timely manner... exactly what is meant by a timely manner? Based on the USCIS timelines or just after a few months? Just curious. Thanks.

Good luck with your process and at least you will hopefully get it right the first time with no RFEs... then again one never knows.

I am not sure about that but I bet its better to be safe rather then sorry...I have found a really good calling service that you can recharge when you run out of minutes and it shows EVERY call you make and to where and you can print it out every month to show that you talk....its pretty cheap for me to call Dominicain Republic so I would imagine its cheap to call Euorpe! Then, I have to talk to the consulate in Nairobi and get them to agree to send the case to Nigeria. This seems like such a monumental feat of coordination that I feel like crying at the thought of it. So, I'll begin making calls to Lagos tomorrow morning.

Anyone have advice for me, or similar experiences to share? I could use some comiseration at this point headbonk.gif

Me and your Nigerian Fiance are in the same boat, I am a haitian citizen and ive been living in the Dominican Republic for the past 10 years, NVC shipped our case to the Consulate in Haiti instead of the Dominican Republic, now its a pain in the neck, I dont have any address in Haiti right now they told us they was going to send me packet 3 to my address in D.R. and to my Fiancee in the US, untill now we are still waiting for packet 3, our case has been in their hands since June 26, my fiancee called they said they received a transfer authorization from the Consulate in Santo Domingo and was going to mailed packet 3, NOTHING still, but still they dont even answer to our emails. We are in the air right now we dont even know where exactly we are going to have an interview.

I've had a K1 visa 9 years ago, but our marriage ended. Everything was legal, no funny business. The divorce has been final for over a year now. straight forward, just your average divorce with all the mixing of "he said, she said".

Now I have another K1. Filed in Late Jan, 2011.

Do you think I'll have the same problem? that is, YOU ARE DENIED!!!! NOT approved !!! etc...

I agree with extremerecluse, NVC did a background check and saw her fiance sponsored a previous girlfriend which possibly turned sour, then failed to go back to her country, case was denied for that matter.

11 years age difference is not a big deal at all, also one single visit is depends on the country, country such as Dominican Republic or Haiti with a single trip will most likely earn you a denial. I know two people that has been denied due to insufficient trip (a single trip).
