hi everybody i want to ask how the Petitioner receives I-864 Package from NVC ?
we just paid AOS and it shows paid , do we need to wait email from NVC sending package with form or what ? sorry i'm confused


When the AOS fee shows as paid you can go ahead and print out the AOS barcode sheet and send it with form I-864 and the necessary documentation. Same goes for the IV Fee bill and the DS-230 form. Don't wait for them to mail you anything because it can take weeks for things to start rolling, unless you need to make time. You can find all of this info in the EZGuideSpouse guide.

Hi all

I know this question has been asked before but we dont know what to put for our situation. I am the foreign citizen and me and my USC fiance plan to marry very soon and file for I-130 ASAP so have got the forms together already. Now for the last 3 years we have visited each other regularly and he stays with me for 5 months over winter. When it comes to question 21 - were we have lived together, would it be ok to put "we have visited but not lived together in one country" because I guess that is what we are going through all this to achieve! Would that be ok!

Also we have evidence of mail sent for each of us to the other persons address as proof that we have been in a relationship. Do you think it is ok to submit this or could it possibly confuse the people reviewing our case and make them think we have lived together?

You don't have to say you lived together because in theory you were just visiting each other and did not make any arrangements to live together permanently.

As for evidence, the main document that will serve as proof is your marriage certificate. I sent that, as well as two affidavits from people who knew us even before we were married. Now you don't have to send the affidavits, you can also send a few pictures as evidence, but like I said earlier, the main piece of evidence is your marriage certificate, all other main evidence can be brought to the embassy during the interview.

Good morning all!

I'm a USC and my fiance is a UK citizen. We are getting married in Vegas on April 14 (18 days to go!!!) then will begin the CR1 visa process (as he has to return to the UK to continue working :( ) I plan on taking his name, obviously, but am unsure when would be the best time to do so since we want to apply for our CR1 immediately after we get married. Should I change my name right after the wedding so I can put my new last name on all the visa paperwork (even though my passport will still be in my maiden name temporarily). Not sure what the best course of action would be. Any advice is much appreciated. Thanks!


You can change your name whenever you want since it won't affect the visa process. It would be a different thing if you were the UK citizen wanting to change your name to his, then you'd have to fill out every application with your new name so that you can receive your green card with your married name. But since you're the US citizen, you can do it whenever you choose, now or at a later time.

My husband and I got married in 01/2007, I filed for his CR1 visa on 2/2007 with my maiden name and didn't change it until November because I was just to lazy to do it.

well Embassy in Bogota doesn't allow DCF as stated in their web page and i have a valid tourist visa, so getting a denial for a student visa because of immigration doesn't seem logic, since i already can just go as a tourist.


That's a bummer because it used to be available until about a year ago. But anyway, even if you have a tourist visa you can't use it to study in the US, you will have to get a student visa to do so and as with most non-immigrant visas COs tend to deny them once they find out that they're married to a US citizen.

You only have two options, 1. go to the US embassy to see if you can get approved for a student visa. It doesn't hurt to make the trip to find out. Or 2. file for a CR1 visa which will take between 9-12 months but that won't help you meet the October/November deadline.

thank you all for the answers, my deadline for university as an international student is October 1st, and as a resident November 1, do you guys think if i go with the CR-01 is it probable ill make it? i mean do i have a chance?


Do you still need to get any kind of visa, including a student visa, to come to the US? If so, the chances of you getting a non-immigrant visa while married to a US citizen are pretty much slim to none because they will assume you'll use it to immigrate. You can still try though but need to be prepared for a possible denial.

If your spouse has lived in Colombia during the past 6 months you can do DCF which will take about 2-3 months for you to get a CR1 visa. If not, then you will have to file through the USCIS and wait between 9-12 months.

Also, if you file for a CR1 visa, you will be denied for any other kind of non-immigrant visa.

Reason I asked is cause I got back from Colombia and put together the package in one day, didn't really include many pics (just like 14 total, some before and after wedding, a couple from the wedding, our first FaceBook picture with tons of "likes" and comments, and 2 honeymoon pics. Most of the before and after pics are with my and her family. That along with 2 affidavits, one from my mom and another from my MIL.

Just hoping I don't get an RFE cause we use mainly FaceTime, textfree, Tango and iMessage which don't really have logs i can print. And it would really suck to add more time to the already expected delays coming up.

In all honesty, you really don't need to send a lot of evidence because your main piece of evidence is your marriage certificate and most people have not lived together as a married couple before they file. I only sent a copy of my marriage certificate with the translation and two affidavits from family members and that was all we needed to get approved at the USCIS level. We brought all over evidence with us to the embassy for the CO to review.

Anyone who is fluent in both languages can translate any document and write a certification at the bottom of the page. So if your neighbor or your gardener or the guy at the nearby Starbucks is fluent in both languages and is willing to translate and certify, you're good to go. You can find examples of what the certification should say online, just Google it.

Also, you don't need to notarize anything AND, only send photocopies of any document you send the USCIS.

I have been doing my best to understand everything that goes along with this application, but it really is somewhat difficult at first - especially with all the acronyms and such. I would love to give a run-down of my plans here and get your feedback to make sure I am on the right track.

I am the US citizen and my husband is a Colombian citizen. I have been living and working in Colombia since 2008. We got married July 2012. We hope to move to the US in August - September 2013. This time is pretty set because I am a teacher and would need to start a job then and my husband is most likely going to start a PHD which would also start then. According to my calculations, it would be best to start the spousal visa application now. From my understanding - if it went through fast, we would still have 6 months until he had to enter and use the visa.

1. If he receieved the visa earlier than we wanted to move, could he enter the US to activate it and then leave again until we were ready.
2. He is on his 2nd US tourist visa (5 years each) and has traveled in and out of the US frequently. Is there a problem with him using the tourist visa while we are completing this application? for a December Christmas visit?

Since I am living in Colombia, I do not have a US job at the time which would allow me to be a US sponsor. One option is to have my dad sponsor him. Another option is for us to get the cash together.

3. Could we keep this cash in accounts in Colombia?
4. When does the sponsorship form have to be sent in? (I assume not with the first I-130 application).

5. Should I put my Colombian address as the address on the I130 and my US address (parents house) on the sponsorship form where they are asking about domicile.

1. Yes, he can use his CR1 visa to enter the US, leave the country whenever he wants and come back by using his I-551 stamp or even his green card since he should be getting it in the mail within a few weeks of going through immigration. The one thing he should not do is stay in a foreign country for a long period of time, usually 12 months but some people get hassled even if they stay away for more than six months.

2. Yes, he can use his tourist visa to enter the US while his I-130 is being processed. But keep in mind that it is up to the immigration officer to decide if he can enter the US during one of those trips. Most people don't have any issues but it's best to be prepared.

3. As per the DOS's web site, cash can be used as assets based on the following:
  • The assets must be convertible to cash within 12 months
  • The applicant must show that the assets can be removed from the country where they are located. Many countries have limits on cash or liquid assets that can removed from the country
  • The net value of assets is at least five times the difference between the sponsor's income and 125 percent of the poverty guideline for the household size.

If you meet all of those requirements, then you should be fine. If not, then you will need a co-sponsor.

4. You need to send in your I-864 (as well as your co-sponsor's if you decide to have one) after you pay the AOS fee bill at the NVC stage, which is after your I-130 petition is approved by the USCIS.

5. Enter your Colombian address as your current address and your parents' address as the address where you plan on living once you enter the US.

my wife sent the ds form threw email to nvc,its been 1week and half,i called today and they said they have not recieved the email yet.i also sent the affidavite of support a week ago.Should i resend the ds form to them because as of know no new fees are generated.I know it can take up to 2 weeks but i feel should have recieved somthing.thank you


You need to clarify which DS form you're referring to. If it's the DS-3032 to let them know her choice of agent, she can re-send it to them. If it's the DS-230, that is only generated after the IV Fee Bill is paid either online and if they've received the check.

The only things you need to bring with you to the embassy for your interview are the medical exam results and evidence of your relationship. That's it.

We stayed at a private apartment which is about a 10 minute walk from the embassy. The web site is called We Love Bogota. Several members have stayed there and it is highly recommended.

The approval for the I-130 can take anywhere from 3-6 months depending on the service center you sent it to. It doesn't matter if your wife has a good job or not, it all depends on the amount of petitions they received and how quickly they can process each one.

I have a question regarding DS-230. In the WikiPage here it is stated that if my case is Appointment Post Processing, the additional documents (Police Certificate in particular) have to be translated. Now somebody told me they sent it to the NVC in german (native language of my country). I am confused now. Does this mean, the NVC only "gathers" the documents and forwards them to the embassy who will review them, or did I not understand something here? Do I need to have these documents translated after all?
That would mean Standard Proessing would have been much easier since I would have to bring the documents to the interview (only the german ones) instead of spending more money to get them translated.


The instructions in the Department of State site say that any document not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations. So if you have them in the official language of the country you're having your interview, you don't need the translations.

Call the NVC to clarify though, because they may be requesting the translations even if the instructions on the DOS site state otherwise.

No, the fee you paid with your petition covers all the work they have to do on it. So after they cash it, they start working on your petition and if all it's good, they'll approve it. If they're missing something they'll send you an RFE (Request for further evidence) and then work on it again after they receive what they asked you for and so forth.

It's best to mail it with delivery confirmation just so you can have some kind of peace of mind, but it's not a requirement. You will know for sure that they have received when they cash your check and/or send you the NOA1.

No, you don't have to inform the USCIS about your new job. But you do have to let them know about your new address by filing an AR-11 either electronically or by mail.

You file one or the other but not for both. The time frame depends on how fast or slow your service center is processing petitions, how fast you can go through the NVC process and it also depends on the US embassy it is going to.

Regardless of what you decide to do, once you get your permanent residency, you are not supposed to live any other place other than the US. Thus the name permanent residency. If you move to Spain with your husband to live there, you will lose it.

I think if you want to move to Spain, the best thing would be not to file for AOS and move there with him. As soon as you decide to move back to the US, if that's in your plans, then you will have to start the immigration process from scratch and file either for a IR1 or K3 visa.

No, she doesn't have to stay in Egypt to show that the marriage is genuine. She would have to stay in Egypt for 6 months if you were applying for DCF. But for a CR1 visa, she can get married and leave the next day as long as you have enough proof to show that you have had and still have a legit relationship.

Yes, he can call the embassy to see if they need to do anything in regards to his IR1 visa, since he should be eligible for it, instead of the CR1. If not, then he can straighten it at POE.

Also, since he's coming in with either a CR1 or IR1 visa, he won't be given an EAD stamp. Only K1 visa holders are eligible to get this stamp. But since he'll be getting his green card by mail a few weeks after he enters the US, he should be able to work as soon as he receives it.

Your approved petition should be received by the NVC shortly if it's not already there. You should read the Time Savers thread in the National Visa Forum to see what the process is like for CR1/IR1 visas, especially pages 1, 10 & 11.

In a nutshell, you won't need to file the AOS (I-864) until after you've paid the AOS fee bill. This probably won't happen for another few weeks or so. You will need to submit copies of pay stubs & letter of employer. Since you're just starting to work you will need a co-sponsor.

All of this happens before the case is forwarded to the embassy for the interview.

The interview should be at the embassy of the country you're going through. The passport is stamped by the Immigration officer at the POE.

The CO should be able to let you know if the visa has been granted the day of the interview, if not, you can straight out ask. But they usually say "congratulations, your visa has been granted" or something like that.

Most people choose the petitioner as the choice of agent because many live in foreign countries where mail delivery is not very reliable. Also, it's a lot easier for someone living in the US to make the payments than having to deal with buying a cashier's check or money order overseas.

We sent a copy of my husbands bio page of his passport and the actual police certificate. Since the police certificate is a little booklet in Colombia, we put it inside a little plastic bag with his name on it. But we didn't sen copies of it, we sent the actual police certificate since that is what they are requesting.

It depends. If they sent him an RFE it means that they are working on his petition. If he sends them the further evidence they're requesting right away, they will most likely pick up where they left off and approve it a few weeks later.
