No, actually I've seen this with different companies and I believe it's due to some kind of law. Maybe you can type up the letter saying that they can call the 800# and have it signed by your HR department. I mean, there isn't much you can do if that's their policy.

But see, I just went to the DOS site and looked at the form and list of documents and can't find that info. Maybe it's different for DCF since they're filing everything with the embassy, but for CR1/IR1 visas, you send that in when you file the I-130.

Where does it say that for the DS-230? You don't have to send this to the NVC.

It depends on the embassy but for the most part the difference is not much, even if you don't follow the shortcuts described in the NVC forum. Also, as far as interviews go, it depends on the embassy as well. In Colombia they follow the same rule as the NVC, the appointments are scheduled based on when they received the case, usually for the following month.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen to send in I-864???
Did you pay it online? If you did, then you should be able to print it from their web site. If not, then it will take about 1-2 weeks for you to receive it from the NVC once they process the AOS bill.

Paying the IV Fee Bill will eventually generate the DS-230 coversheet, it has nothing to do with the AOS stuff. Two different paths endind in the same place. happy.gif

You can follow the shortcuts if you choose to do so or simply learn about the process at the NVC for CR1/IR1 visas. Loto's guides are also very useful.

IR-1 / CR-1 Spouse Visa Process & ProceduresSome general questions so I can try and be prepared
Well if you want to file for CR1, you first have to be married and no, you should be able to visit her until you get a visa interview at the embassy. Some POE officers may deny entry if they think you plan on staying in the US permanently before the visa is approved, but if you have enough evidence to prove you're only visiting, you should be ok.

If you file for a K1 visa you will then have to file for AOS when you get here, this may take at least 3-6 months to be approved, not counting the months of waiting while you wait for the K1 visa interview.

It can take anywhere from 1-7 weeks for the NVC to receive your petition, I've seen people who have said it took 12 weeks. Just gotta keep calling the NVC until they've said they've received it.

Even though K3 holders are able to fly back into the US if they leave before AOS if filed or approved, they are not authorized to legally work or get any legal documents such a driver's permit or driver's license.

IR-1 / CR-1 Spouse Visa Process & ProceduresAny one applied for K3 Visa & after interview they said wait for ADMINISTRATIVE PROCESS?
We had a VJ member in the Colombian club whose fiancée was put in AP after the interview. They waited a month, she called the DOS and they said to call the embassy to schedule a second interview. They did and at the interview they asked him why he was there and that they were not sure why he was still in AP and that it looked like it was a mistake from the beginning. At the end he just went off on them and got his visa a few days later.

The whole AP is a huge mistery to most of us.

Congratulations and best of luck with your interview good.gif

Just a question, how come this month NVC is already giving out interview dates for December, aren't they usually supposed to give out interview dates from second week of each month? Just curious, its a good thing that they are, just wondering if they have changed their policies a bit or not.

That's because they start scheduling appointments with the embassies during the first two weeks of each month. Not just the second week.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 ....what are the fees when sending DS-3032 & I-864?
The AOS bill is $70 which will generate the coversheet for the I-864 once payment is processed.

The DS-3032 doesn't have a cost but once processed, it will generate the IV fee bill which is $400. After this payment is processed, it will generate the coversheet for the DS-230.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen people think you're DIVORCING...
We never got the whole "you're divorcing" schpill but most people didn't think my husband would get his visa or that we were lying about it since it's so hard to get tourist visas to the US. Even if we said that it was a sure thing because it was not a tourist visa but an Immigrant visa, they still didn't get it. And whenever they would see him they would say things like "well, it's been 2 months and he's still here, they're lying." Needless to say, they were pretty shocked when he e-mailed everybody to say good bye the day before we left Colombia. laughing.gif

For my brother:

Can his wife send in the DS3032 to assign him the choice of agent to have the lawyer removed; he was only paid to do the I130 so the first mailing from NVC went to him, he obviously isnt going to do anything b/c he has not been paid. my brother wants to do it himself as the agent.

Yes she can. The NVC will not move forward until they receive the Choice of Agent, which can be anybody she chooses to assign.

Yes, it happens more often than you can imagine. You can call them again to find out what options you may have and try to fight but they will probably say the same thing, file the I-90 and send the $370 to get a "replacement" card.

When you file an I-130 alone, you are eligible to interview for a CR1 visa.

When you file both, the I-130 AND the I-129F, you are eligible to interview for a K3 visa.

K3s are supposed to be faster but for many embassies they are not. They also require you to file for AOS when you arrive, while with CR1s you receive your green card in the mail a few weeks after your arrival.

If you're a US citizen, you can go to the nearest US embassy and register the baby's birth. There they will give you a birth certificate and passport. And I believe a SS# as well, but I'm not sure on that.

IR-1 / CR-1 Spouse Visa Process & Proceduresin the U.S.A. with a CR--1. Now what?
Your green card will arrive within 7 weeks or so and since you already have a SS#, you can go to their office to change your status on that number. Give the USCIS about 2 weeks to enter your info before going to the SSA office to update your SS#.

If you plan to travel outside of the US before getting your green card all you have to do is show your stamped passport at POE so they can let you in without any problems.

Well, another answer is MAYBE. We never received ours even though we had said YES in the DS-230, so we had to go in person to the SSA office to get my husband's SS#. If it's been more than 7-8 weeks and you still have not received anything in the mail, go to your nearest SSA office and file for one. Some times Immigration doesn't let them know that you had requested a SS# on your DS-230.

The beneficiary's birth certificate is not needed to file the I-130, only the petitioner needs to do it to prove US citizenship. Once your case is at the NVC, you will need to send it to them along with the DS-230 and all other required documents.

My husband's took 7 weeks but I kept calling the USCIS once a week to make sure I was on top of things. I didn't want them to come saying that they had already mailed it and that the only way to get it now was to send more money and file for a duplicate to be sent again.

Call them to find out, it might be that they're taking longer to enter new info in their system.

If they are not in English or the local language of the country the US embassy is located, then they need to be translated.

You need to get police certificates from the countries you lived for more than 6 months, and they don't have to be consecutive months. The time of validity of each certificate is designated by each country, so it varies, usually from 6 months to a year.
