I am soooo sorry you have to go through this with your lawyer. I wouldn't blame your husband on this one because I'm sure he's letting the lawyer take care of it thinking she was competent enough to do the job. You probably feel like your hands are tied because you're so far away and there isn't much you can do at this point, especially if your husband is not cooperating with you.

But this is what I think. Yes, you're absolutely right about feeling frustrated and things should've been done differently. But the thing is, your case is already at the NVC and will get completed in a few months or even faster if you're quicker than your lawyer. Once it's completed you can kiss her good bye!!!

You can start calling them four weeks after arrival. Just call the main 800 # at the USCIS. They will ask for your A# and then transfer you to a "specialized agent". That agent will ask you again for the A# and tell you what the status is. It can take up to 8 weeks after POE for them to process all the paperwork and send you the greencard and Welcome Letter to your house.

If it takes them a bit longer for them to put your info in their system because the paperwork you sent did not arrive with the cover sheet, you might as well wait the extra week or two it might take them to generate it. That makes more sense to me.

Also, I think I saw a template for an RFE coversheet in the National Visa Forum but I couldn't find it. Maybe you'll have better luck.

I was on the same boat and this is what I did. Since contractors can lose their jobs at any time, get the letter from your current contracting company ASAP (no need to get one from your previous contracting company), as long as you have it in your hands you'll be fine. Then send IRS transcripts OR copies of tax returns with copies of W2s for the past 3 years along with the I-864. That's all you need. If you lose your job any day now, the NVC nor the embassy will have to know about it.

Well, it depends if you just got approved and they haven't started anything at the NVC then yes, it'll take that long if the shortcuts and online processing are not followed.

But based on your post it sounds like you're almost done with them meaning they already processed the DS-3032, AOS fee bill, IV fee bill, I-864 and they should be getting the DS-230. Is this correct? If so, then it will take them about two weeks to complete your case and then schedule your appointment during the first two weeks of September. I wonder if you can call them or the embassy after they complete your case and see if they can simply forward your case to the embassy so you can be interviewed on the 5th for the CR1 visa, instead of the K3. It's worth a shot.

They request 1 year of tax returns but many people send info on the last 3 years to make sure everything is ok. You should also send a letter of employment along with copies of recent pay stubs to show your current salary. If you do not make enough this year, you will need a co-sponsor.

When I was a permanent resident I never carried it with me nor did I carry my SS card, I just memorized both numbers just in case I needed them.

My sister on the other hand did carry them with her, got her purse stolen and had to go through all the hassle of getting a new green card and SS card. It was a hassle, lesson learned.

If I were to do this whole DS-230 all over again, I wouldn't have checked the SS# box on there. That was the worst because I didn't know if we had to wait or go to the SSA office to get his number. Turns out the USCIS hadn't notified the SSA about him coming to the US so we had to file again and wait another 4 weeks.

Unfortunately, yes. As Alan said it's taking about 6-8 weeks on average when it used to take 4. The USCIS told me it's because they've had a large amount of paperwork to process. no0pb.gif

I'm sorry to hear your husband still doesn't have his green card. You should call the USCIS 800# to find out. Tell them that he came in on XX date with a CR1 visa and haven't heard anything, the operator will then transfer you to a "specialized" agent, you tell them the same story again, they will ask you for his A# and then tell you what is going on with his green card. I did it 3 times since he got here until we finally got my husband's green card in the mail 6 weeks later. Your husband can call himself as well but if you do, make sure he's present at the time you call because otherwise they won't give you any info.

It doesn't matter where you got married, they just want to make sure you're not petitioning another person not related to you. Your marriage certificate will prove you're already married to someone else and the birth certificate will prove your relationship to your parents. It's the best way to prove that. You have to have something from India because it was needed for your immigrant status when you first came to the US.

The first city and state only apply if you came to the US with any other visa and are filing for AOS as well as the I-130. If that applies to you, then write the address where you are currently staying in the US and leave the other lines blank.

If you are still in your country and not in the US yet, then write the city where the US embassy is located (Manilla) in the second set of lines, where it says (City) (Country) and leave the other lines blank. That way you're telling the USCIS and the NVC where you will be going for your interview.

Well, things have changed dramatically with the online payment process, so it is faster then following James' shortcuts. In the mean time you can start gathering all documents needed for the I-864 and the DS-230 so you can have them ready when you pay both the AOS and IV fee bills.

Also, you should read the Time Savers thread in the National Visa Forum because that will explain the whole NVC process and what each form is for and the order you will receive it.
