I agree with Mononoke28. I was going to go the K3 route but later realized the speed and fees weren't worth the AOS process so I then decided to wait out the CR-1.


Nyseness, I'm keeping my eye on your case every day because if my calculations are right... you should be getting your NOA2 in about 3 weeks or so. I'm keeping my fingers crossed because if you do, that means I should be getting mine in early May. :dance:

One correction. K3 visa holders do not need Advanced Parole. The K3 is a multiple entry visa good for two years.

I would research the timelines for the Philipines specifically and then consider how IMBRA could come into play on your I-129F for the K3. Your earlier filing can complicate the whole process or not. Then make your own value judgment on what's best for you in your specific circumstances and based on your own priorities.


Oh wonderful I did not know that, then that would be another plus if you're considering a K-3.

It depends on what you prefer. The K-3 visa for most countries is being processed almost in the same amount of time as the CR-1/IR-1, but like you said, not in all cases. At this point it could be a gamble. The only pro of filing this type of visa could probably be that it's faster, but then again, not a guarrantee.

You also have to remember that once your spouse comes into the US with the K-3, she will have to adjust her status, apply for employment authorization and possibly advance parole if she wants to go back home for any reason before her green card arrives. All of that right now is about $600-$800, plus the $170 for the I-129F that you send out in the beginning. All of those fees will most likely double this summer when USCIS raises the prices.

As for the CR-1/IR-1, it's pretty simple. Spouse gets approved at the embassy, they come to the US and a month later, bam! they get their green card in the mail and are authorized to work in the US right away. No need to apply for anything else. BUT it could take longer than the K-3... BUT then again, it might not. :D

Talk it over with your spouses and see what feels best for you. In my case, CSC never sent out the NOA1 for my I-130 so it made more sense to leave it alone and wait for the CR-1/IR-1.

Yes, they stopped processing both, the I-130 and the I-129F. If that is your service center you still have to send your application to them, they will then forward it to the California Service Center who are the ones processing these type of petitions at this time.

It's a document you get from your country where it shows how many times you've left and enter the country. It's actually called Migratory Movement Certificate.

In Colombia you get it at the same place where you get your police report which is the DAS. Your country must have a similar entity that takes care of these type of documents.

Based on the VSC timelines, it looks like they're processing K-1s within 2 weeks but all others in about 5 months. I would wait until July if I were you. If it's approved earlier, then great. If not, then at least you were prepared.

On average CSC is about 3-5 months from NOA1 to NOA2.

I haven't seen that happen. It all depends on service center and embassy. If things go smoothly and you're going through CSC, you're looking at an average of 3-4 months there, then another month or so at NVC, then another month for them to complete it and another month for it to get to the embassy and have an interview scheduled. So you're looking at a 6-7 month wait and that is all in a perfect world type of thing.

If you're going through VSC, things are going a lot slower for CR-1/IR-1s. I've seen people who filed back in August and haven't been touched since September/October of last year.

Several people from Colombia have recommended for the petitioner to be present at the time of the interview. Like it was stated above, it depends on the embassy. If you can afford it and have no issues taking the time off from work, then why not? If you can't then let it be.

The difference between denied and closed is the applicant can close the petition at any time but cant denied it and USCIS or Embassy can denied at any time but cant close it.

I am trying to file my taxes for 2008. I am having a hard time because I was married in May 2008. We have been living apart until our visa was just approved January 13th. The problem is that my husband does not have a SSN yet. You cannot file a married return without listing your spouses social security number. Do I file single since he didn't live or work here in 2008? Does anybody know. I have been on the phone with the IRS for the past hour and they can't seem to figure it out. HELP!!!!

Since your case was completed on 07/30/08, it means the NVC will try to make you an interview appointment with the embassy the first two weeks of August. So after this Friday, 08/15/08, you should know whether or not they made your appoinment for September. If they didn't, they will try again during the first two weeks of September to get you an October interview.

They should move up as long as they keep approving older petitions. The bad thing is they're time tables are not very reliabe and their dates are just a ballpark number. If you want a more accurate time table you can do a timeline search and see how long it took other members going through the VSC to get approved.

It depends on the embassy. If they're good at what they do, they should process your paperwork faster and give you an interview as soon as they complete your case. I mean, they received your uncompleted case from the NVC for a reason, right?

As for the IV Bill, don't worry about it. The DS-230 wouldn't have been generated if you had not paid it. The reason why you received the DS-230 is because you had already paid the IV Bill, and the reason why you received the I-864 is because you had already paid the AOS fee bill.
