El proceso administravo es algo que los cónsules no pueden controlar. Por más que un cónsul le quiera dar la visa a alguien, no lo puede hacer porque si el sistema dice que tiene que entrar a proceso administrativo, no lo pueden aprobar hasta que el proceso haya terminado. El proceso es sencillo y lo hacen cada vez que el sistema ve alguna coincidencia, algún nombre que cuadre con los nombres que tienen en su lista del FBI, etc. Ellos tienen que asegurarse que la persona que está siendo entrevistada no tiene ningún tipo de antecedente.

Ahora lo que tienen que hacer es comprar el PIN para recoger la visa y listo.

Y espero que no suene como regaño pero no sea tan negativo hombre que pensar negativo sólo atrae cosas negativas y no soluciona ningún problema. Ahí le dejo esa inquietud.

Since you filed for a CR1/IR1 visa, then the NVC should be sending you both, your husband and you, packet 4. This packet contains all info related not only to the interview but what other documents if any you need to bring with you to the embassy, it will also include medical and lab info that you may need.

So if you haven't received anything it will be a good idea to first of all find out if the case was already sent to the embassy and when will you be receiving packet 4.

That's correct, one is not valid without the other. So if you only sent your W2s, then you need to send a copy of the corresponding tax return. Same goes for the people who only sent their 1040s without the corresponding W2s. Now, if you don't have one of the two or both, then you can contact the IRS and get a copy of your tax transcripts which can be used in lieu of the 1040s and W2s.

It's really up to them to decide what type of visa she should've received. If the embassy gave her an IR-1 visa, the Immigration officers at POE may catch it and fix it to make it a CR1, or the USCIS may catch the error while entering her info in the system and mail her the CR1 green card which is only valid for two years. If she does end up getting her 10 year card just give the USCIS a call to find out if it is indeed valid for 10 and not 2. If they say it's ok, then celebrate. They make mistakes all the time so it's not out of the ordinary. happy.gif

According to the U.S. Department of State web site, they don't have to be if they are in the official language of the country in which application for a visa is being made, which coincides with the DS-230 instructions you received from the NVC.

You need to read LingChe's NVC Shortcuts to see what the process is like at the NVC. The first step is the DS-3032 but you need to make sure that they have generated this form, if they have then you're good to go.

According to the USCIS, these are the documents they accept to prove US citizenship:



What Documents Do You Need to Show That You Are a U.S. Citizen?

1. If you were born in the United States, a copy of your birth certificate, issued by a civil registrar, vital statistics office, or other civil authority.

2. A copy of your naturalization certificate or certificate of citizenship issued by USCIS or the former INS.

3. A copy of Form FS-240, Report of Birth Abroad of a Citizen of the United States, issued by a U.S. Embassy or consulate.

4. A copy of your unexpired U.S. passport; or

5. An original statement from a U.S. consular officer verifying that you are a U.S. citizen with a valid passport.

6. If you do not have any of the above documents and you were born in the United States, see... "What If a Document Is Not Available?"




What If a Document Is Not Available?

In such situation, submit a statement from the appropriate civil authority certifying that the document or documents are not available. You must also submit secondary evidence, including:

A. Church record: A copy of a document bearing the seal of the church, showing the baptism, dedication or comparable rite occurred within two months after birth, and showing the date and place of the child's birth, date of the religious ceremony, and the names of the child's parents.

B. School record: A letter from the authority (preferably the first school attended) showing the date of admission to the school, the child's date of birth or age at that time, place of birth, and names of the parents.

C. Census record: State or Federal census record showing the names, place of birth, date of birth, or the age of the person listed.

D. Affidavits: Written statements sworn to or affirmed by two persons who were living at the time and who have personal knowledge of the event you are trying to prove. For example, the date and place of birth, marriage or death. The person making the affidavit does not have to be a U.S. citizen. Each affidavit should contain the following information regarding the person making the affidavit: his or her full name, address, date and place of birth, and his or her relationship to you, if any, full information concerning the event, and complete details explaining how the person acquired knowledge of the event.

You can access the DOS link of the applicant's civil documents needed to send along form DS-230. It says:



Unobtainable birth certificates

The applicant’s birth record may not be obtainable. Some reasons are listed below:

* The applicant’s birth was never officially recorded.
* The applicant’s birth records have been destroyed.
* The appropriate government authority will not issue one.

Please obtain a certified statement from the appropriate government authority stating the reason the applicant’s birth record is not available. With the certified statement the applicant must submit secondary evidence. For example:

* A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)
* An adoption decree for an adopted child
* An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parents names, and the mother’s maiden name.

Note: An affidavit must be executed before an official authorized to take oaths or affirmations.

Some people include all those things and others don't. Other things listed on form I-130 are lease agreements or bank accounts with both your names on them. I didn't have any of those things and didn't want to send my personal pictures and e-mails with it either. So my mom and my sister wrote 2 affidavits regarding their knowledge and support of the relationship. I figure if they need stuff like pics and e-mails, I'll either get an RFE or they'll ask for them at the embassy. But feel free to send them in as well, I know a lot of people have done it that way with no problem.

I'm not sure why the NSC doesn't process I-130s anymore. Bottom line is that if that is your service center, then that is where you have to send it to. They'll take care of forwarding it to CSC for further processing.

I believe that is one of the requirements, whether it's for the sponsor or co-sponsor. The last 3 paystubs, letter from employer and US bank statements are also back up evidence to show that you or your co-sponsor are 125% over the US poverty line.

My husband and I decided to pursue a CR-1/IR-1 visa instead of a K-3 since our NOA1 for the I-130 is taking so long to get to me. This is going to sound like a silly question but on the cover letter for the I-130 I wrote that I would eventually file an I-129F for the K-3 visa. Will CSC care now if I don't ever file and let the I-130 take its own course or will I have to inform them that I won't be filing the I-129F after all? I'm thinking I don't have to but I'm checking with you guys just in case.

If you don't receive your NOA1 in 30 days call them so they can re-send it to you, or at least so they can give you a receipt # for you to log in their site. I sent mine on 02/05 and never received an NOA1 but was able to locate it on my cancelled check.

Based on James Shorcuts, the next step is the choice of agent. Either your husband needs to fill out the DS-3032 form asking for the choice of agent (either you or him) so that all correspondence is sent to that agent. Most people choose the USC since the USPS is more reliable here than the mail service in foreign countries. If you two decide that he will mail it to NVC, he needs to sign it. BUT, based on these shortcuts, he can also e-mail them (instead of using form DS-3032) and tell them who he chose to be the agent. There is even an example on how to do it.

The other step is the AOS bill. Just try to follow all these steps slowly and you'll see that you won't have any problems.

Since you file for a K-3 visa your I-129F will be the one who takes the lead. It is a different process from a CR-1/I-R visa. Once your case is assigned by NVC, it will go to the embassy of your husband's country and they'll let him know what to do next.
