She obtained a job here in the US already? Can't she go to her future employer and see if they can still give her a job and wait until she arrives with her IR-1 visa?

If you're able to pay your IV bill and print the DS-230 coversheet from the DOS web site today, you may have a chance to have your interview scheduled for next month. The NVC is currently scheduling interviews until probably the 13th which is next week. So you may be able to make it even though it's not guaranteed.

But if you don't have any children put NONE on question 19.

You have to put the addresses of all places you've lived since you turned 16, even if it's been the same one you've always lived in.

In question 23 put all schools you've attended (my husband only wrote down high school and college), write your course of study even if you didn't graduate and in DEGREE OR DIPLOMA write NONE since you didn't get your degree.

No, the embassy doesn't care if you owe the IRS any money or not since they're separate government agencies.

After the NVC has received the DS-230 they will complete your case within a week or two if the I-864 was also reviewed already. If this happens before the 15th of the month they will try to make an appointment during the first two weeks of the month with the embassy for the following month (in most cases depending on the embassy). If they complete your case after the 15th, they will wait until the first two weeks of the following month to make your appointment.

After they have an interview date they will send both, the petitioner and the beneficiary, packet 4 which as all info regarding extra documents you may have to bring in, medical and lab info.

You wife needs to fill out form AR-11, you can find it at the USCIS site and file online, just make sure you print a copy of it for your records.

Also, ALL sponsors need to file form I-865 which you can also find in the USCIS site. Make sure you follow their mailing instructions word for word as they tell you how to do it so you can later on prove that you indeed filed it with them.

After they receive both forms, you will get an NOA for each of them. You will have to do this every time either one of you changes their address until the LPR becomes a US citizen.

It's all up to you depending on what you want. If you decide to go the CR1 visa route, you won't have to file for AOS after you enter the US with your visa, you'll get the green card in the mail and that's that. If you decide to go with the K3, you will have to file for AOS, pay $1,010 and wait about 6 months or more for it to get approved.

If you can get a letter of employment then all it needs to say is that you work at the company and make X amount of dollars a year. Now, some people are not able to get this letter for legal reasons so don't fret if you can't get it. That's when copies of your tax returns and W2s and recent pay stubs come in handy.

Now days for most embassies a CR1 visa takes just as long as a K3 visa, so it would be a waste of money to even file the I-129F and then file AOS. You can now pay your bills from the NVC online and be done with it in about a month, month and a half. So I highly recommend the CR1.

Well, that makes more sense now because if the embassy was aware of the children, even if they have their interviews at a later time. So as a whole you had to include everybody you will be responsible for and that's why you will need a co-sponsor. They're pretty strict about that, so they say "ok you made this much last year (based on your taxes), you will make this much this year (based on letter of employment and copies of pay stubs) and you will be responsible for these many people". If according to the I-864P, which should be updated to reflect 2009 figures, you do not make enough they will automatically ask you for a co-sponsor.

But like you said, she wasn't denied, her approval was just delayed until she goes back to show the co-sponsor info. No big deal.

I'm so sorry to hear about this elkfarmer but if you make more than 125% over the poverty line then you should be fine. Maybe you can print this out and show it to them: I-864P. It shows the Poverty Guidelines in order to have a visa granted. You should also visit the 2009 Federal Poverty Guidelines and make sure your salary is 125% over.

They shouldn't deny the visa if you make more than enough.

Lately it's been taken more than usual but mine took exactly one week. You can call the NVC automated system everyday to see if they got it.

I've also seen this happen in the US embassy in Bogotá, Colombia. It's not routinely done but every CO has the right to ask for one since it's so easy down there to pay any notary office to change birth record information just to get a child out of the country. It's expensive and a hassle but totally understandable in my opinion.

That's correct. You now wait for your NOA2. Once the petition is approved by the USCIS, it will be sent to the NVC where you will need to pay a couple more fees and submit the civil and affidavit of support documents and forms. You don't have to send in more evidence but you should be ready to send it just in case the USCIS sends you an RFE requesting it. The instructions for the I-130 tell you exactly what can be used as evidence.

Hi Lee,

You're asking this in the wrong site since Visa Journey is only for people who want to come live to the US and not in any other country.

But here is my 2 cents:

1. I'm pretty sure that you will not be able to stay longer than 180 days in Ecuador (maybe less) if you only use your passport. You will need some sort of visa but you will have to contact an Ecuadorian consulate here in the US to find out.

2. For your marriage, you will need to find out directly from them to find out what documents you will need. Each country is different and they all request different things. Also ask if they need these documents to be apostilled and translated.

3. I'm not sure about this since I'm not from Ecuador and not familiar with their residency laws, but it would be a good thing if your fiancé starts asking around to see what you will need and what the chances are of obtaining residency.

4. This is a tricky one. She has a 50/50 chance of getting a tourist visa, especially if she's married to a US citizen. You may be denied, you may be approved, who knows but it's definitely not certain. Also a spousal visa either a CR1 or K3 does not apply to you since they're only for people who use it to come live in the US, not for visits.

The I-864 actually only requires a copy of the tax return for the most recent year but most send in the tax returns of the last 3 years just in case. So if you only have last year's return, that's fine.

You can come to the US to visit, get married and stay here while your petitions are being processed but planning it before it happens is considered fraud. using a tourist visa or any other visa to enter the US with the whole purpose to adjust status here in the US is considered fraud. Now, some people have pulled it off and have lied to the USCIS to get approval but you will need to be ready to answer any questions they may have, especially since you had already filed for a K1.

The SSA has to wait until the USCIS enters the beneficiary's info in their system before they can issue a number, this can take anywhere from 2-7 weeks. If your wife has not received her green card in the mail yet, then you need to call the USCIS to find out if they entered her info in the system. If they did already and she still does not have her SSN, then you will need to go to your nearest SSA office and pay them a visit.

I also used the DS-230 coversheet when our case was at the NVC being processed and this was way before online payment was available. The coversheet does work but if you choose to use it, make sure you know FOR SURE that the NVC has generated it before you mail it because it may cause you major delays down the road.

When you register with the USCIS Case Status Service Online you'll be able to see any action on your pending petition. You will need your receipt number to register and the system will show a date on it. Every time this date changes it means that someone touched your petition.
