2010 is almost 1½-2 years away and that's a pretty long time to stretch the whole process. You can probably delay it by 6-7 months but that would only make it until summer of 2009. Another option would be to cancel the I-129F and re-file later on either for a K1 or if you want to get married a CR1 to save more money.

Also, even though the economy is not as most people would want it to be, it's not as horrible is many people think it is. It has affected a lot of people that's for sure, but it's not like you won't be able to find employment when you get here. You may end up doing something else until you're able to find the job you like, but it's not like you're going to be unemployed forever. Same goes for your fiancée, he can still go to school and work part-time like my husband is doing.

And to address the tourist visa petitions. It's all a gamble. The CO may flat out deny it because of whatever reason or may grant it because again, it's not a sure thing. So, if you do decide to go for it, be ready for a denial. If you get approved then great, if not, you were ready for that.

And yes, you will need a notarized I-134 AFTER the petition has been approved and sent to the embassy. Your fiancée will show this form to the CO the day of the interview.

Once she/he gets here, you will need to send the I-864 for her/his AOS.

Well, he has to have something, boarding passes? pictures? e-mails? hotel receipts? Anything? If not, then his Turkish passport has to have some kind of marking showing that he entered Turkey within the past 2 years. Most American passports are not longer stamped as they are scanned and that's all they do, but his Turkish passport should have an entry and exit stamp.

If you want to continure the immigration process here in the US, your only option is to go for a K1 visa (fiancée).

If you want to get married in Canada, then you will need to file for a K3 or CR1 visa.

K3s take a little bit less time than the CR1s but once the beneficiary gets to the US, he/she will have to file for AOS which has an additional cost of $1,010. Plus, he/she cannot legally work until their Employment Authorization Document is approved. All of this can take at lease 3-6 months.

CR1s take a bit longer but once the beneficiary gets here, all he/she has to do is wait for their green card to arrive in the mail within 2-7 weeks.

But bottom line is you cannot bring her to the US to live with you as soon as you get married. She may visit you while her petition is being processed, but she cannot establish residency.

The USCIS timelines are not very reliable. The best thing to do is to find people who filed for the same type of visa through the same service center as you did to get an idea of how long your approval may take.

And no, the USCIS does not care about finances at this point. If your fiancée doesn't make enough a year or is currently unemployed, he/she will have to get a co-sponsor who will agree to use his/her financial info for your visa approval.

What the USCIS is talking about is the K3 visa which will require you to file both petitions at once. Ciudad Juarez is a time consuming agency for some visas and it would be best to see if you can find out from other members who have gone through there or are still waiting and hear what they have to say.

If you still haven't received your NOA1 for the I-129F you sent back in October, you need to give them a call or see if you check was cashed to see if they're even processing it. It's been a while and you should've received your NOA1 by now.

Also, to reiterate what was said by other posters, you should not get married before you arrive in the US using the K1 visa. If you do, you will have to cancel the I-129F and re-file for a K3 or CR1 visa. So basically, start all over again.

Before deciding on what visa to pursue, I recommend highly that you do more research on the CR1 visa. The reason for that is that in most cases, they can take just as long to be processed (the CR1 may take a 1-2 months longer) but I've seen that Canada processes CR1s at a different rate.

CR1 visas are much better and less expensive than K1s and K3s because you won't have to file for AOS and she can get her green card in the mail a few weeks after she enters the US.

One of the conditions for permanent residents is for them to live in the US for at least 6 months out of the year. So if you think you're total amount time spent in Hawaii would be more than this, then you could qualify for a CR1 visa. Now, even if you do that, you would have to an explanation ready for the POE officer when they ask you why you spend so much time outside the US. Some of them get really ticked off that permanent residents don't actually reside in the US for most part of the year, so just be ready for that.

You can also find out from a realtor or mortgage broker to see if you have to be a US resident to purchase a home in Hawaii, you might not have to be.

You and/or your fiancé can find all info in the USCIS web site. He and/or your sponsor need to fill out form I-134 and send it to you before your interview at the embassy. You will find the instructions here and in many other threads found here on VJ.

The EAD stamp a K1 visa holder gets at POE is only valid until the expiration date of the I-94, not the K1 since their actual visa is no longer valid once they enter the US. Even if your fiancé gets his EAD stamp valid for a full 90 days, it would be hard for him to find an employer who would be willing to hire him to work for less than 90 days. Once that EAD stamp expires, he cannot continue to legally work unless he has either his EAD card or green card and that won't happen 90 days after his POE.

I printed out two chat sessions per month for the previous 6 months before our interview, but I didn't print them all. I copied them and pasted them onto an excel sheet, then I edited out any information I didn't want them to see or stupid stuff that was not necessary like LOL's, smiley faces, stupid jokes, things like that. I compacted one topic of conversation and made sure it all fit onto one page only, so each chat was one page long and also that it showed our screen names and time stamps on it.

I also only printed out one e-mail topic per day. Ex.: my original e-mail addressed to my husband and his response, or his e-mail to me and my response. Two per month and that was enough. Otherwise, you end up with too many pieces of unnecessary paper.

The idea is to prove that you keep in touch on a regular basis, but at the same time make it as quick and easy to the CO to read everything if he/she decides to do so. Same for the USCIS.
