IR-1 / CR-1 Spouse Visa Process & ProceduresAny more feb. filers approved?

Hey guys,

thank you for the congrats on our wedding :)

Soooo, today I called the NVC to check with them about my case.. and lo and behold, they said they had received my case and actually sent out the Agent of Choice stuff already! Whaaaaaaaaaaaaaaaaat? So to make sure I called USCIS but in their system we are not listed as approved yet.. So I am not sure who to believe.. the NVC that says they got our case, or USCIS that say we aren't approved yet.. Not sure whether to laugh or cry about it..

Uhmm... that's interesting. Did the NVC give you a case number? If they did, they you're approved and they'll start processing your paperwork. I would e-mail the agent of choice back to them by using the shortcuts once they give you a case number and see what happens.

Sangrita, the agent of choice is for CR1/IR1 visa petitioners who need to choice who they want the NVC to mail all correspondence to. It could be the petitioner or the beneficiary.

My fiance and I were approved on May 16th, 2007!!! Wow...were we happy! Filed it on Feb 21st, 2007. 86 days! Csc[/center Now we are hoping she can be here in 1 to 2 months. The most beautiful woman in the world and her 3 kids....I have 3 kids too....is coming to the USA to be with me forever! This is an amazing feeling.

My Fiance, is always telling me..."My love, we must enjoy these days apart, because someday we will look back on them with memories of the anticipation of being together forever" She is right, it is kinda like waiting for Christmas when you are 6 years old. I never thought I could have those feelings again....It is wonderful!

Good Luck to all!!

Did you e-mail them regarding your choice of agent before it was generated? I see that you e-mailed them on 06/04 and it was generated 06/25, that's probably the reason why you haven't heard anything from them.

Unfortunately, your DS-230 won't get generated until August if they approve your choice of agent soon. I sent my IV fee bill on 06/22, they received it on 06/23 and they still haven't generated my DS-230. The NVC said it would be some time this week but I'm thinking it won't be until next Monday.

I think that as long as you have all the necessary info and they receive it, you should be fine. There is a nother VJ member who's husband is with her in Germany and even though he's the Choice of Agent, they will be sending the paperwork from Germany.

You can also send me a PM with your e-mail and I can send you a sample affidavit that my mom and sister used so I can send with the I-130. By the way, that is all I sent since my husband has never left Colombia and I live here in the States. The USICS approved us without getting an RFE.

IR-1 / CR-1 Spouse Visa Process & ProceduresSteps at NVC (a small question)
It's very difficult to estimate how long a case will stay at the NVC because many things can happen along the way. What I've seen here on VJ is that you can spend about 2-3 months there if you use James' shortcuts, if not, it will take longer.

When the NVC says they've "generated" X form or bill, or they say that they've mailed you some kind of document, the actual mailing takes place a week to two weeks later. So don't count on getting it as soon as they say it was generated.

Here is how the NVC works:

You send the Choice of Agent (DS-3032). This generates --> IV Bill. This generates --> DS-230
You send the AOS bill. This generates --> I-864.
When the NVC is done reviewing both the I-864 and the DS-230, they complete the case.

Niphredill, the reason it took a month to get the DS-230 is because even though they said they had generated it, they didn't mail it until weeks later. The I-864 has nothing to do with the DS-230. This is when James' shortcuts come in handy because it might take a very long time to receive anything they say they've generated.

Hope that helps guys.

Diana

Are you filing for a K3 visa or a CR-1? You need to provide more info so we can help you. Also, if you ARE indeed pursuing a CR1/IR1 visa, make sure to check out the National Visa Center forum, you'll find a lot of answers there.

IR-1 / CR-1 Spouse Visa Process & ProceduresHas anyone sent DS-230 without the passport biographic form?
If the NVC is requesting you to send the DS-230 along with a photocopy of her passport biographical page, then that's what you need to send. I don't think the NVC will move ahead with your case without it. Call the NVC to find out what they tell you regarding this issue though to make sure.

IR-1 / CR-1 Spouse Visa Process & ProceduresTo all Wifes/Husbands of Cubans on VJ
So I I have a Cuban fiance, which does not entirely help your unique situation... but I can tell give any information you might want. I am guessing that the superpacket 3 is similar if not exactly the same, as well as the carta blanca process. My fiance has his interview this Thursday the 10th. I am not sure what point you are at in the process but I scheduled his date via the 1-866 number here in the states. The superpacket 3 has a checklist, as well as the forms he will need to provide for the interview. The forms are: DS-156, DS-156-k, DS-157, and DS-230 part i and ii. You of course will also need to send him the I-134 affidavit of support and all docs to show you meet requirements (or a separate I-134 from a co-sponsor), your originals of the documentation you used in the petition you submited here to the USCIS. I feel like I am forgetting some things. Not sure how much help this was. After the interview I will surely post to let you know how it goes and the questions. Take care and any other questions just let us know. Good luck!!!

That is great advice and I am really happy to hear you finally got through somehow. That number you used might have been the number that worked for me with no problems. And I would also recommend anyone in the same process to call or fax like a week after it is sent from NVC. My fiance has met lots of people who had to wait around 2 months to actually pick up the superpacket. They supposedly sent a telegram to my fiance to pick it up, but he obviously never got that... not even to this day. (F) Good luck to all and thanks for posting!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresPOE for Cubans Cuba-Cancun-Miami Is it an option ?
I know that one of the Cuban posters did that exact thing... flew threw Mexico. My thought is that if it is just a layover flight of less than 24 hours there would be no need of a visa from Mexico. I will try and remeber who it was that did exactly what you are asking... maybe I will pm you with that. Oh... and off the subject. Is there absolutely no rum or cigar allowed into the US, or do you know if maybe there is a small limit that could be brougth in? I know I asked before but wanted to double check. Thanks!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresForeign Spouse Document Requirement
The only documents that you would need would be a divorce certificate or prior spouse's death certificate if the beneficiary was previously married. If not, then all you need is a signed G-325A (all 4 pages) and a passport photo. That's all.

They should've been done scheduling appointments last Friday, but I guess it's their call on when to start and stop making appointments. They usually go over if the first day of the month lands on a Wednesday or Thursday, but they usually stop the last day of the second week. You will need to keep calling to find out.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 FEE BILL
If the NVC has said that the AOS fee bill has been generated you have two options:

1. Follow James' shortcuts and send them the bill with the payment. It will take about a week for them to receive and process your payment and another week or so for them to send you the I-864 package.

OR

2. Get your IIN from the NVC, pay the AOS fee bill online, wait a couple of days and then print out the I-864 coversheet needed to send the I-864 package.

Option 2 is better because it will save you weeks of waiting.

You can find all this in Wiki's Loto's Guides

Diana

It has been IMPOSIBLE for me to obtain the IIN number... NOBODY is willing to give it out... since yesterday I have called like 30 times... and NO luck... headbonk.gif

Has anybody been able to obtain the IIN number from the operators?

Thanks for your replies!!!

Merry Christmas!!!

Kelvin,

Keep calling, most VJ members have said the same thing and they keep calling until they find an agent willing to give it out. For some reason the night time customer service reps seem to be nicer than the ones in the other shift. So if you call at 11:30 p.m. EST you might be able to find someone who will be nice enough to give it to you. Just say you want to have it for your records and that's all.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresName on the NOA1
QUOTE (Waldo @ Dec 29 2008, 10:40 PM) <{POST_SNAPBACK}>
My wife and I decided to keep her name the way it was and so we filed it with all 4 names. Milagros Melody Alarcon Casafranca. On the NOA1 it says Benificiary: Alarcon Casafranca, Milagros. Is this how it's going to show or should I have them change it to have Melody in the Beneficiary?

The mother's last name will be non-existent here in the US, so you didn't need to write down the Casafranca. Based on what the NOA1 says, the USCIS is thinking her entire last name is Alarcon Casafranca, which is not valid since Alarcon is her only valid last name. You can call and ask them what you need to do to have it changed.

Just remember that from now on any document that needs to be filled out here in the US needs to be in this format:

First Name: Milagros
Middle Name: Melody
Last Name: Alarcon

The Casafranca will no longer be used.

IR-1 / CR-1 Spouse Visa Process & Proceduresds 230 and civil documents
QUOTE (Ruth1_16-17 @ Dec 29 2008, 08:07 PM) <{POST_SNAPBACK}>
Hi again! I have been reading Loto's and James' shortcuts and they all say that the civil documents should be sent in with the ds 230. However, the letter we got from the NVC only says to complete the ds 230 (I haven't seen the letter yet since my husband has it and will scan it). We're wondering if they should be sent in with the ds 230 or do we need to get specific instructions from NVC? We just don't want to send documents without authorization from the NVC. But from the threads I read, everybody has sent in the civil documents with the ds 230.

Grazie~Thanks~Salamat!

Yes, you need to send the civil documents along with the DS-230 and the DS-230 coversheet. The NVC is in charge of reviewing not only the DS-230 but the civil documents as well before making the appointment with the embassy. So you need to send them.

IR-1 / CR-1 Spouse Visa Process & ProceduresTravling on a K-3 with an approved CR1?
QUOTE (BeeNee @ Dec 29 2008, 06:52 PM) <{POST_SNAPBACK}>
Hi guys, I'd like your advice on a visa dilemma I'm in right now. My wife interviewed for a K-3 visa at the embassy in Islamabad last week. She was approved but the bad news is she's going to have to wait 1-2 months for administrative processing before they send her passport.

In the meantime, our CR1 petition which was running concurrently with the K-3 was completed today and NVC is now arranging an interview date for the immigrant visa. Problem is, January is all booked up so the earliest she would be able to receive an interview would be mid-February. That's not too long of a wait but again we may likely have to endure administrative processing and who knows if it might taken even longer than the timeframe quoted for K-3. All of that is going to tack on months to this already grueling wait.

At this rate, we're tired of the waiting and just want to get her into the country ASAP. If say she receives her passport w/ K-3 visa in January, then she is willing to travel in on that rather than pursuing the CR1. When I suggested this to the NVC phone rep, he was unsure if you could adjust your status after your immigrant visa case had been approved. Does this mean she would be forced to wait for her CR1 visa before she can travel to the US? And do you think its worth it to take our chances and wait for the CR1?

Thanks!

This is what I would do. Since she already interviewed for the K3 visa and is only waiting for the AP to be completed, I would go back to the embassy and ask if they can give her the approval for the CR1 visa instead, that way she can enter with it instead of the K3. Since all fees were already paid at the NVC, I think it would be a mistake to use the K3 visa to enter the US instead of simply asking the embassy to change the approval for a CR1.

Diana
