You should always send your petitions to the corresponding service center even if they are transferred some where else. NSC and TSC no longer process I-130 & I-129F petitions, so even though they have to be sent there first, they will be be forwarded to CSC.

As for the time frame, it could add maybe an extra week for the whole process. Currently we are seeing an average of about 90 days or so from the time the petition was mailed out to NOA2. Again, these are just average time frames, some take longer and some take less.

So I guess it works for the majority of the people who check the box on the DS-230. I hope it works for us because taking time off from work to go to the embassy and then getting a SS card will not fly for me. Not to mention running the whole getting a driver's license errand. Phew!

Since she came in with a CR-1 visa all she has to do is wait for her green card to come in the mail. 90 days before the 2 year mark she will need to file to remove conditions and that way she will get her 10 year green card.

I think most of his observations are pretty funny actually. :P

And the thing is, we all come here to learn and to help each other out. If we have doubts, we ask and then we get the answers. When other people ask the questions we had asked at the beginning, we then in turn help them out with the stuff we've picked up here and there along this journey.

Bottom line is we're all here to learn and that's exactly what I've done in the past 6 months. On top of that we encourage each other and cheer other people's victories in this painful process.

Quick question. If we decide that I, the petitioner, will be the choice of agent, will I be the one getting packets 3 & 4 in the mail here in the States? Instead of him in Colombia? In that case, I will have to mail everything for him to have when he has the interview. Is that correct?


Packet 3 will be mailed to you (Choice of agent/the petitioner). You'll need to send the DS230 part one from packet 3 to your SO to sign and have the SO send over the appropriate documents you need to send with Packet 3. You can do this ahead of time - download the DS230 and send it to your SO have them sign it and send it back to you.

Packet 4 - which is the interview packet will be sent to your SO regardless of who the Choice of agent is.

Not necessarily. My interview packet was sent to my hubby (choice of agent) in the US. Some consulates obviously vary in who they send the packet to. Best bet is to always check with others from the same consulate.

This has nothing to do with a CR-1/IR-1 visa, but my mom is a US Citizen (born in Colombia). Last February her POE was Houston, TX and it was a nightmare. Just because airport staff knew she was coming in from Colombia, they opened up all of her luggage, they took everything out and put it on the table, they asked her a ton of stupid questions, took her high blood pressure medicine away from her, treated her really badly, and kept asking her over and over again if she had any "special" stuff in her luggage. After a while a manager came over to this guy and told him he was going overboard, the guy said ok and left my mom's stuff all over the table and even the floor. She then had to re-pack everything and almost missed her connecting flight to Denver because of this jerk! :ranting:

You won't have to pay that amount at the embassy at the time of the interview if you are the choice of agent and pay it ahead of time. If you choose the beneficiary, your husband, to be the choice of agent, then that's when he would have to pay the fee at the consulate. So you won't have to pay it twice, only once depending on who is the choice of agent.

In my own personal opinion, I think it's best to wait since you've already waited almost 3 months. The average wait for CSC is about 90-120 days for an approval and you are so close. Our timelines are pretty much alike and I'm hoping for an NOA2 any time soon. And even though I have had a few touches, I saw several people who were approved last week who didn't have a single touch since they filed back in January.

I think you should be patient for the time being since the CR-1 visa is so much more convenient than a K-3. But if you feel that waiting a little bit longer is not an option, then you could file the I-129F and wait for that to be approved.

Just as an FYI, your petition was approved, not the type of visa. The visa approval happens at the time of the interview. And yes, they will hold back the I-130 and go ahead with the K-3 visa process.

It is possible that leaving the I-130 alone for a CR-1 visa might work for you. CR-1s are known to take longer than K-3s in most cases. I think the best thing is to check the timelines for both visas and your embassy to get an idea or how long each one might take.

I was on the same boat as you. Planned to file for a K-3 visa but never received the NOA1 for the I-130. There are some members in here who filed the I-129F without a copy of the NOA1 but they also had the receipt # written on the cover letter. I'm not sure if that will be ok with USCIS though. You can do a search on the subject to find out how they pulled it off.

As for which visa to pursue, it's really a personal decision. I kind of made out the # that was written on my check (it should start with WAC# by the way) and when I called USCIS 30 days later, they gave me a different #, but I still haven't received my NOA1. Because of this, my husband and I decided to just go with the flow and hope that USCIS will approve our I-130 since we had to wait for so long for the NOA1 anyway. In the long run I think it's a better visa option since we won't have to deal with AOS or EAD when he gets here. But if you and your husband want to be together ASAP, you should look into finding a way to file the I-129F. I also suggest you look for members who are also from Canada and see how long it took their petitions to be processed, it also depends on the embassy you're going throgh.

Unfortunately, it's an unknown situation for all of us. The bad thing about it is getting the translations for the papers we are assuming the NVC will be requesting. One thing is to have everything ready and another thing is getting the translations along with it. To play it safe, my husband will not only be sending me the documents listed on the DOS web site but translations as well.

We got this new info from jediknight (JK) since his DS-230 packet was requesting police certificates as well. I also read on a different post that the NVC has changed the rules as of 04/01/07, where the documents don't need to be taken to the embassy but submitted directly to the NVC. It also changed for other countries like the Ukraine.

And as far as phone calls, Bogotá is no longer taking any phone calls. It all must be faxed in. Again, as per JK posts.

I guess time will tell. :huh:

Choose Certificado Judicial (this takes you to the page about the certificado judicial)
Choose EXTRANJERIA then Certificación Movimiento Migratorio

I have one question for the people who have done this before. I read on the DAS website that the certificado judicial has to be done at the DAS building in Paloquemao Calle 17a Carrera 27 and that the certificado migratorio can be done at Calle 100 # 11b-27, is this right? 2 different locations in Bogotá for the DAS documents?

Also, do the applicants have to bring anything from the embassy or NVC in order to get these documents? Or can they just go in and get them?

George, did your wife tell you how much she had to pay for those?

I'm pretty sure we're going to have to send all those documents to the NVC since it seems they changed the process. But like many of you, I always have a lingering question. Are you guys also sending the certificado migratorio to the NVC along with its translation? Or just the certificado judicial? :huh:

Sure, no problem. All I did was go to the DOS link for NVC documents needed for BGT. I think you had talked about this link already but I'm not sure, so here it is: http://travel.state..../info_3176.html

When you choose BGT and then click on "list of documents" it shows which have to be submitted to the NVC. It starts out with:

Birth certificate
Court and prison records (IF the beneficiary has been convicted of a crime)
Deportation documentation (IF the beneficiary has been deported from any country)
Marriage certificate
Marriage termination documentation (If either beneficiary or applicant has been divorced, had a marriage annulled or is a widow)
Military records (IF the beneficiary has been in the military)
Photocopy of valid passport
Police certificates (these are the DAS documents)

Then right below the list you will see a note that says "Applicants must obtain English language translations of any documents that are written in another language." The reason for this is because all that paperwork will be going to the NVC and their employees are not fluent in all languages, so translations need to be submitted for the documents as well.

I believe the new NVC rules apply as of 04/01. And yes, the documents you need to send to the NVC are the DS-230 (part I signed, part II not signed), photocopy of beneficiary's passport, certificado judicial and certificado migratorio (both from the DAS) & marriage certificate. All should be certified copies and TRANSLATED.
