I received a letter from CSC yesterday only to let me know that they have received the request I made on 03/16/07 for my NOA1. So that's what my touch was about on 04/19??? Over a month later? Oh! and I STILL don't have the NOA1.

These people make me sick!!!!

What???!! You're kidding me! That totally sucks. :(

I also had the wrong receipt # when I got it from the back of my check but then USCIS gave me the correct # when I called them. I still feel iffy about it and would feel a lot better if I had my NOA1 in my hands.

I really do hope you get your NOA2. I was so happy for you.

One quick question, was your I-130 touched at all from December until you were approved last week?

I feel for you guys because I've checked timelines for CSC filers and their stuff has gotten approved in about 60 days or so. But then again, K-1 filers for VSC are getting approved in about 4 weeks.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp My husband appointment has not been scheduled yet
I just went to the Department of State web site and it shows that for Guayaquil you have to send them a whole bunch of documents along with the DS-230. If that is what you did, that means they schedule the interviews, not the embassy, so the argentinian lady is not correct. The NVC started making these changes this year and the embassies don't seem to give out the correct answer.

Have you called the Department of State to find out what they have to say?

Have you called the NVC, the Department of State and the embassy? I would call all of them to find out what's happening to your case.

IR-1 / CR-1 Spouse Visa Process & Proceduresinterview document question
I took copies of EVERYTHING I sent to the USCIS and the NVC to the interview just in case but the NVC had sent all of that stuff to the embassy and they already had it. It doesn't hurt to be overprepared.

IR-1 / CR-1 Spouse Visa Process & ProceduresI may go with a CR1 rather than K3
James' shortcuts found in the National Visa Center forum, first thread pages 10 & 11.

It depends on the embassy. You have to count the time it will take at the USCIS, then about 3-4 months at the NVC and then whatever time it might take at the embassy. For us going through Bogotá, Colombia, it took almost 8 months, a K3 would've probably taken about 6-7 but now we don't have to deal with AOS or EAD.

IR-1 / CR-1 Spouse Visa Process & Proceduressocial security card
Well, I didn't do it to save time but because it would've been almost impossible to get time off from work at a later date to go to the SS office to get it taken care of since I know immigration will most likely not take care of his SS paperwork.

IR-1 / CR-1 Spouse Visa Process & Proceduressocial security card
Immigration needs to forward the SS card petition to the SSA. I decided not to wait for that to happen and went with my husband the day after we arrived in the States. The SS office said they will process it as soon as immigration is done processing his paperwork, but at least we got that out of the way.

It depends on the country. I filed on 02/05/07 and our visa was granted on 09/27/07, so about 7½ months.

IR-1 / CR-1 Spouse Visa Process & ProceduresPOE and I551 stamp?? Did I get one?
Yes, that stamp means your visa has been endorsed and it will be good for 1 year, but hopefully you will get your green card in the mail within a few weeks. As stinger said above, that stamp is valid for work authorization but you can't get a job until you get a SS#. The good thing is, you can get that # with the stamp you got at the airport.

The documents you send the NVC need to be either originals OR certified copies.

I suggest the new people going through the NVC to check James' shortcuts in the National Visa Center forum. He suggests to write your case # an the paperwork you send the NVC. That's what I did and everything was rather quick and flawless.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864
I file my taxes online but before I hit the e-file button I print the forms, attach them to my W-2s and then file them away.

Jasmin, most people here in the States will file federal and state taxes which are two separate forms. Nevada residents for example do not file state taxes, only federal. The forms each person uses to fill out the tax info from the W-2 (which is sent out by the employer) is what the transcript is, some people use form 1040, others use 1040EZ, etc. That's what the IRS will be sending your husband when he sends in his request.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-824 Form Question
If you want to receive the CR-1 visa, then that is the only choice you have now. If you don't want to wait that long for it to be processed, then you can just go witht he K-3.

I think the best thing to do before you file is try to find the posts made by people who've filed the I-824 and see how long it's been for them. OskaryAndrea is a member who had to file it since her K-3 visa was denied back in February, she might be able to answer any questions you might have and she's really nice and very helpful. ^_^

Yes, it looks like choice D would be your answer.

I've seen a few posts from VJ members here who filed the I-824 and they've said it takes about 6 months or so for it to be processed. Just a thought.

IR-1 / CR-1 Spouse Visa Process & ProceduresI cannot bloody well believe this

Talk about flipping angry, first of all our case is NOT APPROVED because THEY gave us the wrong bloody case number and this woman I have just spoken too was way rude I mean over the bloody top rude. Our case number will not register on there web site, I told the lady this, she just said she had other callers waiting and that my husband should call as she would not give me any other information, which is fine but she could not speak proper English to me it was all broken English, I said that I could not understand her, at that point she shouted at me, I just sat on the other end of the telephone kinda speechless (which is unusual for me) I tried to explain that it was there office which gave us the wrong case number in the first place (big mistake) oh woe betide anyone who accuses them of incompetence, she then gives us this other case number which will not go into there system. I phoned my husband up and told him what had happened and he is fuming. Jon is going to phone them and demand an answer to all this mess which they have caused and if he does not get anything satisfactory he is going to phone his Senator tomorrow.

Did you get your NOA1 in the mail? I still haven't gotten mine even though I called them almost a month ago to let them know I hadn't received it. When they gave me the receipt # over the phone, it was different from the # I thought I had on the cancelled check. So now I'm a little bit nervous about my receipt # because I don't have my NOA1 to see if that is the correct #.

Oh I know, I can't believe it either. The only reason why I would love to have it in my hand is to make sure that the receipt # they gave me over the phone is the correct one. I've seen a couple of people who were all excited about being approved only to find out they had the wrong #s all along. -_-

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Question

I'm not so sure I agree. If you stated you will be pursuing the K-3, they might retain your I-130. (This has happened to other members.) If this happens you would have to file the I-824 form ($200).

I also chose to go the CR-1 route since I never received the NOA1 for the I-130. I also wrote in my letter that I would be pursuing a K-3, but it seems CSC didn't give a rat's ### about it since I never received the I-797 I needed to file with the I-129F.

I really doubt that they would retain the I-130 until the I-129F is filed and that we'd have to go the I-824 route since the I-129F was never approved either (how can they approve a petition when we never sent it).

Same for Colombians. My cousin went this morning with a good list of personal assets and nice letters from his employer and was flat out denied.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed HELP QUICK!!!
Even if the I-134 is not required for immigrant visas you should fill one out, do as the CO says because you need him to grant your wife the visa. This is not a time to complaint and win the battle, once she gets her visa, you're game.

Also, the spouse IS allowed to go to the interview with the beneficiary. It is not a requirement but if you can go, you should. And as far as extra evidence, try to bring in as many pictures of you together to the next interview, bank statements or any other contracts in both your names if you have them, affidavits from family and friends who can testify you have a bonafide marriage. I think that should be plenty of evidence and most importantly go with her to the interview if you can.
