IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 Approved !
I found this in the Colombia Club from a member who came to the US with his wife very recently. The process at the POE is pretty painless in most cases, you have nothing to worry about.

"Hi everybody,

My wife and I entered the USA in Miami, last Friday.

It was a bit of a shock for me as ALL of the US Homeland Security
officers in the POE there spoke English as a second language.

There were US Gov't billboards there promising good service.

Reality was quite different. The service is incredibly slow and the
officers seemed more interested making jokes and ridiculing the
people who mistakenly entered the room, looking for the baggage
dept. (The baggage signs there are very confusing.)

We arrived through customs ok and we went to the POE together.

There room was only 1/4 full of people in the chairs and there were
5 officers on duty, so we figured it would be a breeze. This was
at 1:00pm.

Well, pretty soon there was only one officer processing the cases.

It took all of three hours to process my wife. The place on a busy day
must be a total nightmare.

So plan to spend some time if you need to catch a connecting flight.

Cheers!

George

JK, yes, some people did not get their VISAs, a familily, and some
fiancees, the fiancees were denied because the man was not present,
that is what my wife told me."

Congratulations!!!!

1. The I-551 stamp is something you can use to prove your status in the States until you get your green card mailed to you. The actual card you get in the mail is the 2 year card.

2. Your POE will be JFK. Once you are done with immigration, you can go to the gate of your outgoing flight to Chicago.

It won't affect you at all since you will still be employed. You can still submit the letter from your previous job and the letter from the new job and that's it. As long as you're making the dough, that's all the NVC cares about.

By the way, I hope you meant to say the new company will pay you 15%-20% MORE...

Jigi,

The DS-230 is the visa application for the immigrant which means the questions are regarding yourself and your personal situation.

Remember, you sign Part I only, Part II you sign at the time of interview.

IR-1 / CR-1 Spouse Visa Process & Procedureshow much are fee bills
The cost for a CR1/IR1 visa now is a total of $805. K3 is $1366. With the CR1/IR1 visa the beneficiary doesn't have to do anything more once he/she arrives in the US until 90 days before the 2 year expiration date of the green card. A person coming in with a K3 needs to file to adjust status and get EAD.

Also, depending on the embassy, the time difference between a CR1/IR1 and K3 is about a month or two.

Are you pursuing a CR1 visa? Your timeline says it's a K3 visa. If it is, there isn't a IV bill nor an AOS fee bill for K3s.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen do we get the AOS fee bill?
There are two reasons why he hasn't received it. 1. The NVC is really backed up with all the petitions they've received since May. And 2. Just because they say a form has been generated it doesn't mean they have been mailed it. As of a month ago anything they said they were sending took about 2 weeks to get to the recipient. Now it's about 4 weeks or more.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about DS-230
The I-864 has nothing to do with the DS-230, so you can send the DS-230 before sending the I-864. They won't complete the case until they have received and reviewed both forms. Once they receive them, it takes about 2 weeks for them to complete the case.

Since you haven't worked before you can use a co-sponsor who earns enough to support you and your family.

Also, are you a US citizen? If you are your children will automatically be US citizens as well. All you have to do is take care of the paperwork, you don't have to petition them.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 virtuality and reality
Please check James' shortcuts here: http://www.visajourn...h...=117&st=135 , they explain the whole DS-230 process.

You can also go here http://travel.state..../info_3176.html to see what extra documents you might need to send along with the DS-230 form.

The information the NVC is missing is probably the DS-230. Your husband needs to call the NVC to find out if it has been mailed out. If it has, then it takes about 2 weeks to be delivered. You can tell your husband to call very early in the morning or late at night to see if he can get through and talk to a customer service rep. It may take a few tries.

I'm also stuck at the DS-230 part of the NVC process. The automated system keeps saying they are missing info, which is the actual DS-230 packet we should send them, yet they haven't said if they mailed out the instructions for it or not.

Your husband can call the NVC to find out what date they mailed out the instructions, that should give you a rough idea of when to get it.

For us, it took about 2 weeks for them to complete the case after they received the DS-230. Once you call the NVC, the automated message will say that the case was completed on XX date.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the right thing to do?

Even if we got married here in US?

Just because you got married doesn't mean he will get his green card. The purpose of a K1 visa is to get him here with the intention of getting married AND filing for AOS. He will not get his green card until the AOS is approved. Since he left the US before the AOS was approved, I'm about 99% sure you will have to start from scratch.

I don't think he can come back on a tourist visa since he already came in as a K1 visa holder. He should've applied for AP before leaving the US so he could come back to finish the process.

What I think you will have to do is start all over again and file for a CR1 or K3 visa.

Don't even bother mentioning your financial situation for 2004 & 2005, all you need is copies of your tax return and W2s or tax transcripts for 2006, letter of employment and recent pay stubs as pushbrk mentioned. Don't sweat it.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS 3032 and AOS fee bill sent/received together?
Just because the NVC says a form was generated on a certain day, it doesn't mean that it was mailed out that same day. So even if you already received the DS-3032, it might take longer to get the AOS bill depending on when they actually mailed it.

Also, they are both 2 separate things so you will not get them together at the same time and in the same envelope.

IR-1 / CR-1 Spouse Visa Process & Procedurestime estimate...
It depends on the embassy. If you go to the Department of State link and pull up your embassy, it will tell you what documents you need to send to the NVC. Jordan and Colombia for example require additional documents such as the birth, marriage, police certificates and copy of passport bio data page to be sent with the DS-230. Which means the NVC will schedule the interviews. The Frankfurt embassy for example requires you to send the DS-230 and copy of passport bio data page only, which means the NVC will just forward the case and the embassy will make the appointment.

The NVC schedules CR1/IR1 visa appointments with the embassies the second week of each month for the following month. You can call them the third week of each month to find out when your interview is. Once they schedule it, both the beneficiary and the petitioner will get packet 4 in the mail which is the interview letter.

There are 2 barcode coversheets used by the NVC for the CR1/IR1 process. One is for the I-864 and the other one is for the DS-230. You can find both of them in the the National Visa Center forum under Timesavers thread, pages 10 & 11 are the updated instructions.

I personally thing a lawyer will make the process even longer because they won't have the same interest as you to get every piece of document back to the NVC ASAP.

The USC living in the States is always the best choice when it comes to the NVC process for a CR1/IR1 visa.
