I am really sorry to hear that the relationship didn't work out and you were so far ahead too.

I agree, you don't have to give the NVC a reason if you don't want to.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC flowchart..

rika,
somehow, my I-130 also got transfered to NVC now. I think I might have a chance to also follow up on CR-1 route as well. that is why I posted the original question. so again, do I send in both or one of the other to choose 1 of the 2 tracks from the NVC flowchart from the guides? thanks a lot for your help.

Since your interview date is next month you don't have time to pursue the CR1 visa now. The CR1 visa takes about 2-3 months at the NVC for them to process all the necessary documentation before the interview.

It depends on the embassy, the Dominican Republic has a waiting line of about 2 years AFTER the NVC sends the case to the embassy.

I would look at other people's timelines who are going through your embassy AND service center to get an idea of how long it might take.

It's optional but it is good etiquette.

IR-1 / CR-1 Spouse Visa Process & ProceduresWill the USCIS delay recieving the I-129F petition for the new fees
Correct me if I'm wrong, but I thought that for K3 visas, the new fee for the I-129F is $0. Then they would have to pay the higher fee at the time they file for AOS.

If this is the case, then once the USCIS returns your I-129F for not having a check you just re-send the form without payment.

You have to call the US State Department at 202.663.1225 to see if they have an interview date for you. Otherwise, you and your spouse will receive packet 4 in the mail with the date.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 sent where?
It takes the NVC about 2 to 3 weeks for them to complete your case. Then they will send it to the the embassy and that could take another 2 weeks. Keep calling the automated system after you send the DS-230, once it says your case has been completed you can talk to a live customer service rep and ask them when they will be sending your paperwork to the embassy.
Mononoke28FemaleColombia2007-07-25 10:06:00
IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 sent where?
Just as an FYI, the automated system won't tell you that they have generated the DS-230, you actually have to talk to a real person and ask them if they have mailed it to you. If they say yes, then wait about 2 weeks for it to arrive.

We call the automated system to find out if the message says that they have generated such and such form, mainly so we can use James' shortcuts and be ahead of the game.

They won't send you the actual form, they'll send you a coversheet with the http address of where to find it to download it. Also, they will send these instructions to whoever the choice of agent is.

I used the new I-130 back in February and included my marriage certificate and 2 affidavits, one from my sister and one from my mother. We were approved on 05/03 with no RFEs.

IR-1 / CR-1 Spouse Visa Process & Procedureswhen will my husband recieve the AOS Form??
You can find James' shortcuts in the National Visa Center forum under the "Timesavers" thread which is the very first one. Make sure to go to pages 10 & 11 to read the updated version of the shortcuts. Even if you choose not to use them, they explain in detail how the process works at the NVC, so you'll be more informed.

IR-1 / CR-1 Spouse Visa Process & Procedureswhen will my husband recieve the AOS Form??
Ok, who is the choice of agent, you or your husband?

Anyway, if either one of you hasn't received the AOS Bill, you should call the NVC to find out if they even generated it, which they probably already did. If they have, then you can go to James' shorcuts in the National Visa Center forum, generate the bill yourself or your husband and mail it in. I think you're wasting precious time by just waiting around for the NVC to mail their stuff.

If you are referring to the I-864, he can call the NVC to see if it has been generated already. If it has, he can follow James' shortcuts to send the info or wait for them to mail it.

IR-1 / CR-1 Spouse Visa Process & Proceduresconfused topic..

They don't have time to clear it through NVC before the interview but they still have the choice of going ahead with it, returning to the home country and interviewing for an immigrant visa instead of adjusting status.

Right, but his wife would be given a K3 visa in August, right?

Even if you wanted to pursue the CR1 now, you don't have time to do it since your interview is 8/23/07.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion for barcode users
Yep the barcodes and everything else look exactly the same as it does in the shortcuts. And yes, I'm 99.9% sure the date is the Monday of the week they say they're going to mail you the instructions for the DS-230.
Mononoke28FemaleColombia2007-07-25 20:31:00
IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion for barcode users
It took a lot of patience with the NVC but I finally figured it out. They no longer give you a specific date of when it was "generated", nor do they put that in the automated system. So using the date of the Monday of the week they mail the instructions out is the way to go.
Mononoke28FemaleColombia2007-07-25 14:37:00
IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion for barcode users
That's a tricky one I found out so I had to wait for the actual DS-230 to get in my mailbox. But now I know better so if you want to use James' shortcuts, you need to call the NVC and ask them when they will mail the DS-230 instructions sheet. If they say for example THIS week, then you can put Monday's date on the shortcut coversheet, so it will be 7/23/07. The date is always the Monday of the week they plan on mailing the DS-230 to the choice of agent.

Diana
P.D. Please make sure you are using the NEW DS-230 coversheet. It's the one with the blue Statue of Liberty stamp.

Since we're on this subject. I know that this could be different based on the state you live in, but is the stamp they get at the airport enough to get a driver's license or do the have to have the greencard in hand?

Since your wife came to the US on a CR1 visa, she won't have to file for employment authorization. She should be getting her greencard in the mail any time soon, if she already hasn't. That's all she needs to be authorized to work in the US.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS3032 and AOS fee bill
After your husband calls the NVC to get the case #, you can e-mail them to let them know who you want the choice of agent to be. By the time you get the DS-3032 and mail it back to them, you've wasted too much time. Unless time is not an issue with you at this moment.

The instructions on how to e-mail the NVC are on the first thread of the National Visa Center forum, pages 10 & 11.

There are no extra fees that need to be paid at the embassy when going for the IR1 visa since you've already paid everything ahead of time through the NVC. So if she ends up interviewing for it, she's all done as far as everything goes.

No need for OF-169, just the DS-230 for CR1/IR1 visas.

Here is how the NVC works:

DS-3032 generates IV Bill which generates the DS-230
AOS Bill generates I-864

The I-864 has nothing to do with the I-864. Have your wife call the NVC to find out if they have mailed the I-864 already and if so, when.

I apologize but your message is a bit confusing.

Since you haven't been married for 2 years, you will be getting a CR1 visa, not an IR1.

If your petition (I-130) was approved by the USCIS, your husband should've gotten an approval notice, the NOA2, before it goes to the National Visa Center. Has this happened yet?

I also don't understand the message about biometrics. There isn't a biometrics step in the CR1 visa process.

I'm sorry, that's all I can help you with for now based on the lack of information you have give us.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 Approved !
I found this in the Colombia Club from a member who came to the US with his wife very recently. The process at the POE is pretty painless in most cases, you have nothing to worry about.

"Hi everybody,

My wife and I entered the USA in Miami, last Friday.

It was a bit of a shock for me as ALL of the US Homeland Security
officers in the POE there spoke English as a second language.

There were US Gov't billboards there promising good service.

Reality was quite different. The service is incredibly slow and the
officers seemed more interested making jokes and ridiculing the
people who mistakenly entered the room, looking for the baggage
dept. (The baggage signs there are very confusing.)

We arrived through customs ok and we went to the POE together.

There room was only 1/4 full of people in the chairs and there were
5 officers on duty, so we figured it would be a breeze. This was
at 1:00pm.

Well, pretty soon there was only one officer processing the cases.

It took all of three hours to process my wife. The place on a busy day
must be a total nightmare.

So plan to spend some time if you need to catch a connecting flight.

Cheers!

George

JK, yes, some people did not get their VISAs, a familily, and some
fiancees, the fiancees were denied because the man was not present,
that is what my wife told me."
