You need to call the USCIS to find out if they will process your I-129F. There are many members here on VJ whose I-129F have been discarded and the USCIS will only process their I-130 forms for CR1 visas instead of K3. Verify this with them before your lawyer gets more money out of you to "process" something that has already been processed by the USCIS themselves.

Yes, it depends on the airport. In Miami they only had a section for LPRs and citizens and another section for all others. If I were you and you weren't sure, I would either ask one of the people working there or play dumb and go along with the US citizens line and wait for them to either process you, or ask you to go to a different line. happy.gif

It sounds like a mistake on their part. Even if the USCIS is thinking you applied for a K3 visa, your wife will not be receiving it since the NVC will process the I-130 as a CR1, not a K3. So you're fine.

Have you received the DS-230 yet, is that what you mean by packet? If yes, then they might be talking about an RFE on the DS-230. If not, then they are waiting for the DS-230. Either way, you HAVE to talk to a customer service rep since the automated system is not updated sometimes. The best time to get through is by calling very early in the morning or late at night, around 11:30pm EST.

You have to wait for the IV bill to arrive since there isn't a shortcut to generate it. Please read James' shortcuts found in the NVC forum so you can see how the process works and how to generate the DS-230 and I-864 if you choose to do so.

I did not know that the NVC would let both people be the Choice of Agent, I thought it was only one person. In any case, the NVC sent you the IV Bill, which the actual visa fee right after they received the DS-3032 (choice of agent form). Once you pay them the $400 IV Bill, they will generate the DS-230.

Have you paid the AOS fee bill yet? If not, then once you pay it they will generate the I-864 which is the AOS. This will give you husband a chance to file his taxes for 2007. The AOS portion of the NVC process has nothing to do with the IV Bill and DS-230.

What you now need to figure out is see who the NVC has assigned as the Choice of Agent because that is the point of contact where they'll start sending all correspondence.

If you check the DOS link and pull down your embassy, Rio de Janeiro, you'll see that it says:

Translations

All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations.

So you do not need to submit any translations unless they're not in English nor Portuguese.

Once the NVC completes your case they will make your appointment in Manila the first two weeks for the month. So if you call the NVC by the 15th of April, they should be able to tell you when is your appointment at the embassy. You do not make the appointment yourself, they make it for you.

So you sent the I-864 already, right? If this is correct, the RFE they're talking about refers to the DS-230 they are missing. They're missing it because you haven't received it yet. It takes about 2 weeks to get to you even though they will say it takes up to 6 weeks. If you feel comfortable enough to use James' shortcuts and generate the DS-230 yourself, you can go ahead and do it now and get the process completed faster.

I'm not sure if it depends on the country you come from but in Colombia a lab takes care of the blood work and x-rays and then sends them to the doctor. You can also either get the shots you may need or get them at the medical and then they will weigh and measure you, make sure you're female or male and you're done. It's quick and painless.

Keep in mind this is in Colombia for the US embassy in Bogotá, it may be different somewhere else.

It depends on your embassy. If the difference between the K3 and CR1 visas is 1-2 months, then your best option is for the CR1 since you won't have to file additional paperwork once the beneficiary gets here. If the difference of processing times at your embassy is greater than 1-2 months, say 6-12 months, then the K3 would make sense.

There are no more visa related fees after the case has been completed at the NVC since the choice of agent already sent them in. He should also be getting an interview packet (packet 4) but it might get lost in the mail dependin on how reliable the mail system is in their country.

The Follow to Join benefit has to be processed at the time his original I-130 was processed. Then they have 1 year after his visa was granted to make an interview appointment at the embassy for the child that will join him at a later date.

If he filed on his own as an LPR after he arrived in the States, it will take years for the child's petition to be approved. But if his wife files as a step-parent as YuAndDan suggested, it shouldn't take that long.
