Make sure to read pages 1, 10 & 11. They explain the process step by step with shortcuts included and the type of bills the choice of agent will be getting from them. It's a great map of the whole thing even if you choose not to take the shortcuts.

If you file an I-824, it will take another 3-6 months to have it processed and approved. So you really need to see if abandoning the K3 visa is worth waiting another 3 months, plus the 3 months the NVC takes to process the CR1/IR1.

The I-130 will probably be forwarded to the NVC and they'll start the CR1/IR1 visa process which you can choose to follow. Or they may hold the I-130 until the I-129F is approved before sending them both to the NVC for the K3 visa. It's just a matter of waiting to see what they do with your petitions.

In my opinion, it's best if they only process your I-130 for the CR1/IR1 visa because that way you will only have to deal with the embassy and forget about AOS when your spouse gets here. It only takes an extra month or so of processing vs. the K3 visa.

You can follow the shortcuts to see if they can process your forms faster or just read it for your own reference. You will most likely spend about 3 months there before they complete your case.

Your lawyer sounds like a nice piece of work. Documents that are not in English nor in the local foreign language where the embassy is located have to be translated. Also, they can be translated by anybody who is fluent in both languages, this means that even a family member or friend can do the translations and sign the document saying that they are fluent in both languages.

Call the embassy yourself and find out for sure but paying your lawyer another $400 on top of what you've already paid is a total rip off.

The NVC steps are as follows:

1. DS-3032 (Choice of Agent) / AOS fee bill
2. IV Bill
3. DS-230
4. I-864

The choice of agent, in your case I believe it will be your lawyer, will get those documents in that order or variations of it, but that's the main idea.

Your marriage is still valid in the US. No need to re-marry.

I'm not sure I understand your co-sponsor question.

You can go to the SSA office to find out if they are processing your card, if not, you can file for one. You can also do it over the phone but they pay more attention to you if you go in person.

Also, green cards are taking about 7 weeks to arrive since the USCIS is so backed up entering information in their system. At least that's what I was told.

We took over 100 pictures to the interview and the CO took his sweet old time to see each and every one of them. There can never be enough, so take them all with you if you can.

You're correct. All you need to watch out for is to make sure he gets his Social Security #, even if you checked the box on the DS-230. Some people never get it and have to go to the SSA office to find out what is going on. Besides that, you're free of fees and paperwork until you remove conditions two years later.

Unfortunately, she will just have to go to the US embassy in Bogotá and apply for a tourist visa like everyone else. It's up to the CO to decide if she has a good enough case to be awarded with a visa.

No, no, no, you don't need a copy of his birth certificate nor a copy of his police report to send along with the I-130. You will need them once your petition has been approved and sent to the NVC though, but not now.

Since he has to send you his signed G-325As, it would be a good idea for him to send you a couple of his affidavits. Make sure they're translated, they don't have to be certified nor apostilled.

This is all you need for a CR1 visa;

I-130
G-325A (4 pages each, signed)
Copy of your passport or birth certificate or Naturalization Certificate
2 passport style photos each
Copy of marriage certificate
Affidavits with translations if you have them

That's all.

I filed for a CR1 visa for my husband back in February and it was the best decision we've made. We got married a year ago in January and didn't have any of the evidence they were asking for when I filed so I only sent the I-130, 4 pages each of the G-325A, copy of my marriage certificate, and 2 affidavits from my mom and sister. That's all we had, that's all they got and never had a problem with it. I left the pictures, boarding passes, copies of e-mails, chats, letters, cards, etc. for the interview.

The USCIS will take about 6-7 months to approve your I-130 given that everything is in order. Then it takes about 3 months for the National Visa Center to process your case. After that, it depends on how soon your embassy can acommodate an interview for your husband. The US Embassy in Colombia gave him an interview right away and our process took only 7½ months.

But if you were clever enough (most of us weren't at the beginning of the process) and generated the DS-3032 yourself following James' shortcuts, had your spouse sign it and mail it to you before it was generated by the NVC, you'll be way ahead of the game and won't need to e-mail them at all.

I echo the thoughts of the OP. Has anybody run into problems when generating their own forms? Has anyone ever been advised as to the "legality" of it? KWIM?


I used James' shortcuts while going through the process without a problem and so have others who were at the NVC with me. As long as you follow directions well and understand how to generate the forms you should be ok.

Yup. We even went in person and got a reference number and now every time we call for status my husband either gets this "Sorry we cannot help you unless you have a social security #" (duh! that's why he's calling). Or 2. they put me on hold forever and a day and then come back and say they don't have a status on it. Today I called again and was transferred to someone's voice mail, I left a very stern message and demanded some king of explanation on this. mad.gif

If they said they're going to mail it to you this week, that means they generated it on Monday. You can send the I-864 coversheet if you have it ready and it should be ok. That's how they played me with the DS-230 and a few people told me to go ahead and send it, I panicked and ended up waiting for it instead. When it arrived, it had the date of the Monday of the week they said they were going to mail it.

No pictures were included since the marriage certificate and affidavits are all I needed for the I-130. I took the pictures to the interview though.

Then I put a big paper clip on it and sent it off.

That doesn't make sense because the NVC has to review all documents that are sent to them and if they're not in English, how are they going to know that they are correct. They have to have translations.
