Hi all

We are sending our 3rd petition, the 2 others was lost, but during that time my fiance's mother has passed away unexpected, my fiance is the u.s. citizen.
We were planning to live with her for the first few months of my arrival, then he would find an apartment, but as things now changed, we dont know yet where to live.

So we are just doing this I-129F petition, and it says where we plan ME to live in the U.S, but since we are talking months and months before I will move there, he isnt looking for an apartment yet, he lives with his dad and they are already many in the household, he is 19 and starting on his university on September next year.

So basicly my question is what should we put in as my adress in the U.S. when we dont know that yet?
Has anyone been in the same situation, we dont want to get RFE'd for it, since we already lost too much time due to our 2 lost petitions, so it would be a great help if anyone could help us sort this out.

Hello all.
We finally recieved our NOA1 and i am so happy!
But then we tried to look for our case online on uscis.gov, our casenumber starts with EAC then followed by 10 digits, but everytime we try it says Validation Error(s) or something, like the number do not exist and we checked it 100 times now and it is the right number we are typing.

Then i'm thinking maybe it takes a few days or something before we can track our case online?
Did this happen to anyone else before? smile.gif

Hi all.
We received a RFE and they requested a few things but also my fiances naturalization certificate.
Or atleast a copy of it. (We did include it, but they wanted alot of stuff that we already included, odd)

He tells me now that on the back of the naturalization certificate it says that you can get punished for copying it or something, not quite sure, so can he not just copy it himself with a scanner and provide it or does he needs to get a certified copy in someway?

I'm so confused and I just want to send these items to them asap, but this is slowing us down, as we dont know weither he can copy it himself or if he needs to do something else..

Anyone?

And you may not need to worry about it. On the other hand, you may find yourselves severely disappointed in the initial outcome of your visa process. Matt & Bing - Yes, unfortantly. We lost 2 of them in the mail or they just never got it according to my fiance, I still don't know where on earth they are. But the 3rd they received it.

Gary and Alla - I believe my timelime is already filled. He told me that he received the I-797C notice of action, i never saw it though, he sended it to me 1 month ago but i haven't received it, its probably lost in the mail aswell. dunno whats going on.
Yes, they asked for proof of ongoing relationship from NOA1 till then (I believe it was march, they even wrote to include e-mails/letters etc.) I was surprised aswell. Denmark isn't just a high fraud country I believe.

The online system still has our case on hold ever since March 5, so its not from there smile.gif

My fiance he has today received the new RFE - It just asks to submit evidence that we met in june/july 2008. We'll send them back the same pictures as last time, but add a few more that we didn't last time, we'll copy his boarding passes and his passport stamps again. That's all we got, its soon 1 year ago and we didnt knew at that time that we would file for the K-1 so it's limited, but I hope its enough. He'll send it express Tuesday (think its holiday Monday) so I hope it will all work out.

Thank you all for your help, this hasn't been an easy journey for me so far.. ill just wait and see what happendes when we submit the evidence back.

Well since the USCIS said that they would send a letter to us within the next days, saying what kind of evidence we need to provide i'll guess we will just wait till we receive that letter and give them what they want.

The man that my fiance talked with told us that we would have an answer latest 15th June, if we would be approved or not (again) so..
My fiance is coming here to visit me at June 18th and it was the intention for me to come with him home to USA at august 11th, cuz we assumed that it would fit fine with all these processing times, looks like we might aswell just forget that sad.gif

I know that it's silly but.. does anyone have any suggestions when i could have my visa? Lets assume that by june 15th im approved, and everything goes well, does anyone have any ideas when i could have it, its just ideas.. dont be shy.. im from denmark, so i dont really know if they go fast or slow, but what is your guess.. smile.gif

There has been soo many problems for me and my fiancee and now i am starting to lose hope in this.

I don't know what is going on and im so confused - according to my fiance (USC) we received the NOA2 on 13th April.
We have waited for over 1 month and we still haven't heard a thing, he called them 2 weeks ago and the USCIS told us that they were in a busy period and they didn't send it to the NVC yet, but would do it soon - ok fair enough.

So my fiance has just now called them again.. Only to get told that we defently weren't approved, the man couldn't see it in the system, he called some officers or so and they said that we werent approved - they needed to see more evidence of our relationship.
(we received a RFE in the start of March and provided everything it asked for just few days later by fedex so we know they got it) ( it was proof of his US citizenship, proof of ongoing relationship)..

We have provided plenty of pictures, ticket stubs, passport stamps, emails, skype calls, and so on.. (they wanted to see ongoing relationship in the rfe)

Now i'm like.. #######?! First they send a RFE, we respond back, they receive it and we get approved some time later (received NOA2 in mailbox), and we wait just to find out that we aren't approved anyways?!

We got a RFE because they wanted stuff that we already sended in.
They asked us to send in my fiances proof of citizenship, a copy of my passport, proof that we met within 2 years and they wanted proof of ongoing relationship

I'm the beneficiary. We already included everything above in our petition when we first sended it in, but not the proof of ongoing relationship after filling, because we thought that was first needed at the interview stage.

So we just sended it all again, but we included proof of ongoing relationship aswell. smile.gif

So don't take any chances!

You can send in the paperwork any time, any place...just be sure to go home before you overstay your visa and everything will be perfect...overstay a little bit no big deal, but over stay 180 days and it starts to get messy. And as Ryan said if you INTEND to enter on a tourist visa, get married, and then STAY here to adjust status, you would be taking HUGE risks that are simply unnecessary.

I'm not in any way willing to jeopardize my visa approval with illegal stays or fraud. I just think the potential 1 year wait for a visa is awfully long to be apart! So I am hoping we can still see each other while the visa is processing. It is much easier for me to travel because I am a student and I have breaks for summer, fall, Christmas, Easter and whatnot. My fiancé works, so he can't up and leave for Denmark so easily.

Also, I have a ticket (there AND back) bought and paid for for Christmas already. If we decide to marry in the US in October, I would hate to give up our Christmas together.

If you are thinking about having your fiance come here on a tourist visa with the intention of filing to adjust status off the tourist visa, then I have one word for you, DONT; that scenario is visa fraud.

I just want to get married in the US, and then ship the envelope before I go home and wait for the visa to process. I suppose we could wait and ship the envelope after I have physically left the country (I have no intent of staying illegally), but I am wondering if it makes a difference as long as I do go home? I would basically like to cut back the time as much as possible.

Yes--you can certainly mail in the paperwork beofre you return--that would be great since the sooner you send it in, the sooner you will be approved !!!

As far as returning for Christmas, you may need a ton of documentation showing strong ties to home, so bring lots of stuff to "prove" you will go home. The odds of being turned back are very small, but not zero, so be prepared for the worst.

If you plan to get marreid in the US, there are usually only two ways to do it--get a K-1 visa and then adjust status in the US after you are married or get married (it doesn't matter where) and complete the CR-1 process OUTSIDE the US. To come to the US on a tourist or business or student visa with the INTENT of STAYING after getting married is usually viewed as visa fraud, and can result in being banned from the US for life, so let's hear more about your plans so you don't do something with irrevocable consequences.

We are considering getting married in the US in October and then filing the I-130. This would be a short stay, as I have only one week of break from my studies in October. After the wedding I return home to Denmark while the visa is processed, I am clear on that. Wouldn't it be OK to physically mail the form while I am still in the US though? As long as I go home from my tourist stay as planned? And would it be OK for me to make another 3-week tourist trip for Christmas (with no intent of staying) while the CR-1 visa is being processed?

Basically my fiancé and I have known each other since 2004, and have been a couple since 2008. We are now making the first steps towards my immigration, but I won't be done with my studies till June, so we have time, so to speak. We never before considered the option of CR-1, however, so this is all new. I am just trying to plan the year ahead :-)

Will you be married in Denmark or the US?

We are only now starting to form this new plan, so we have not decided on that yet. But I think the US is the most likely option.

When I first called the Embassy in Copenhagen about getting a visa a couple of years ago because I wanted to take leave from my studies and spend a year with my furure husband, I learned that there is no such thing as a let's-see-if-the-relationship-goes-well-visa and was recommended the K-1 route. In the end I got a tourist visa and have been thinking along the lines of K-1 ever since. But now I realise that CR-1 is not so lenghthy as it used to be, and, after all, much less costly. So we are now trying to get a grasp of this whole new plan. We did not really think we were going to marry till next summer :-)

Are you asking because there is something I should be aware of?

As far as I can tell from all the CR-1 information I've been chewing thruogh lately, I (the beneficiary) don't actually have to turn in my passport before the final interview. Is that correct?

So I am wondering, is it possible for me to enter the US during any of the previous steps of the Visa processing? My American fiancé and I are contemplating getting married and filing 1-130 in October, but I already have a ticket to visit him in Wisconsin for Christmas - something I would hate to miss.

Also, can someone here tell me about their experience with the medical exam in Denmark? What does it entail? How much does it cost?

Hey all

I am getting everything ready for going to the US, getting married and starting the visa process! :D

For the DS-230 I need a translation of my birth certificate which is in Danish. Question is, can I make this translation myself, or can I have a friend of mine do it? Or does it have to be done by some sort of official? The wording is unclear to me:

"Translations. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English."

Shop Lifting? Do you think if they will show this mark in your PCC? If they dont, and give you clean chit, then you are fine! Dont bother for anything else. Just try to get a Police Clearance Certificate, and everything should be fine.


One of the reasons I'm asking is that when I applied for my tourist visa in 2004 that shoplifting incident was showing on my criminal record, and so I had to get court docs and all that. It wasn't anything big, just a 35$ fine and a warning not to do it again... still, it was listed on my papers for 2 years. Also, the official wording for required papers just isn't very clear.

From Reciprocity by Country:

A penal record (Straffeattest) is available to all persons 15 years of age or over. Individuals in Denmark can obtain a copy of their police record within minutes by requesting one in person at virtually any police station in Denmark. (Parental consent is required if the person is under 18 years old.) Individuals outside Denmark can obtain a copy free of charge by sending a written request along with their CPR number and a copy of their passport or birth certificate to:

Conviction records are sealed within five years of completion of the sentence and are generally not release for any purpose. Convictions resulting in a fine or no imprisonment are sealed two or three years after sentencing. Convictions are listed by citation of the pertinent section of the penal code only. Details of a conviction may be obtained from the court transcript (Uddrag af Dombogen) which lists the charge, the court findings and the judgment. The court transcript is issued by the appropriate court for a fee dependent upon the length of the transcript and only upon application from the individual concerned. In rare instances a penal record may be issued covering the applicant's entire lifetime upon direct application by the individual to the Ministry of Justice (Justitsministeriet).


The penal record (Straffeattest) I have and it's clean. It doesn't say whether or not I need the conviction record. :huh:

I have a question about the police report requested for DS-230. On travel.state.gov I have found that the required paper for Denmark is my criminal record, which is clean. However, it also says that "If you were convicted of a crime, you must obtain a certified copy of each court record and prison record, regardless of the fact that you may have subsequently been granted amnesty, a pardon or other act of clemency."

Does that mean that even though my criminal record is clean as of now, I still have to get a copy of those ancient court papers? I was caught shop lifting in 2002... :blush:

To be more specific, we have not send in any of the paperwork yet, so there is still time to make then change if that is recommended. However, the marriage licence is in my maiden name, because in Nevada where we got married, name changes are not made simultaneously. So, if I do use my not-yet-official-married name on the i-130 form it will not be recorded or proven anywhere and probably won't be for at least another month before I can get the paperwork to Denmark.

What should I do?

After reading a few posts around the forum, I get the impression that I should use my married name for the i-130, as changing name midway can cause delays. Can put in my married name even if I haven't officially changed my name yet? Or should I wait it out till the whole process is over with? If so, what happens when I have to renew my passport (after the interview, before I enter the US) ???
