IR-1 / CR-1 Spouse Visa Process & ProceduresINTERVIEW ON 8th OCT
Good luck on your interview...you do sound well prepared.

What is the fee you paid? I was not aware of any fees that had to be paid before the interview....our interview packet didn't say anything about it...I know for non-immigrant visas you must pay at the bank and bring the receipt to the interview but I thought for CR1 you don't have to pay that fee.....

Does anyone know if my husband needs to pay any fees prior to his interview? His interview is Oct 15. I know there is some kind of fee for the aramex service to process the visa but I looked all through his papers and online at the dept of state and don't see anything about it.

IR-1 / CR-1 Spouse Visa Process & ProceduresVaccine history incomplete
Did you ask the doctor about this? It sounds like from the description that its not really important (waiver). I wouldn't worry about it too much. The doctor would let you know if you cannot be cleared for medical reasons...and he would have given you all of the shots you needed.

However, with that being said, my husband went last week...and they gave him 3 shots on his first visit and asked him to come back for 2 more shots the following week. So...if they only gave you one and then said you were incomplete...maybe you have the important ones....

I would call the doctor's office and ask them to be sure.

IR-1 / CR-1 Spouse Visa Process & ProceduresDirector of USCIS
Just relax....we all know its hard to wait...but we all have to wait. It drove me crazy when I was waiting after filing in November and not even getting an NOA1 until the end of January!!!! We just now got approved from Vermont for our CR1 and now our case is at the NVC and guess what.....its more waiting. I still haven't gotten a NOA2 for our K3...which if you want something to complain about...its the whole K3 process. Its nothing but a waste of time and energy and clogs up the system. They do the I-130 faster than the K3.

Get used to waiting.....its all part of it this experience of trying to immigrate someone into this country....and it won't go any faster if you panic or start freaking out. Use the time to study up on what you must do next so you are very much prepared so that when you are approved you can supply all of the info and forms you need and do it correctly the first time so that you can help your case move through the NVC faster.

Study, study and more study!! It will help you later! And also helps occupy your time. Hang in there!

Does anyone know where to fax or email the Director of USCIS???? Something has to be done at VSC of the non processing of K3 and the CR-1 petitions. This is totally our of hand and un-acceptable. Why has the I-130 been put on back burner, and they wont process us or even tell us why?

Read the threads, Januray filers, and etc.
Its written right there, K3 and CR-1 petitions are not VSC proirity. READ IT!!!!!!!!!!!!!

When a officer form VSC tell another forum member that K3 and CR-1 are not VSC proirity, to me, that is not a rumor. Besides, its been said more then once. Also look, look at the number of K1 approvals VS. K3 CR-1 filers.

I don't know about the police certificate for Korea...as my husband is from Jordan...however, you may want to look at the Korean embassy's website for the police certificate requirements...as the one from Jordan does has specifics about what police certificates Jordanian's need to obtain.

As for your barcode, it will not show up until the payment has been verified and the funds actually taken from your account and into the dept of state's account. It takes a day or two for that. Once the payment has been actually verified, you will have the option to log back in like you did when you made the payment and then you will see a link for the barcode page to send in with the required documentation.

I hope this helps. Pls let me know if you have any further questions.

Best Wishes!

IR-1 / CR-1 Spouse Visa Process & Proceduresnervous, about marrying too soon

This isn't new, and I tried looking around but didn't really find a a particular topic to match mine.

So, I was recently engaged, and plan to go the spousal visa route for me and my fiance. I currently live with my fiance in his home country of Japan(been working here for 9months now, lived together for 6 months, and plan to leave by the end of November). After reading about how there seems to be an unspoken expedited service for petitioning the CR-1 visa when an expat lives overseas in America's case, We decided to get married by the middle or end of the month and have my I-130 out by then too. In your opinion, is that to soon to file for the petition?
I also don't plan to change my last name, I'll save all that paperwork change and stuff when I get back to the states..will that also raise some eyebrows?
I mean, yes we love each other...and we've been in a Long Distance Relationship for 5 years, but I wonder if they would think its a sham marriage...
We also don't plan to have a real official ceremony till 1 year later hopefully

I'm just nervous because we're hoping everything goes right and that he'd be able to join me in the states by late December or January.
Should I wait a lil bit after we're married before we file for the CR-1 visa?

Not sure the name thing is going to be a big deal, my ex brother in law, married somone from Osaka, she kept her japanese name, she has her greencard and no issues getting it or the visa. In there case they filed within a week of marrige. As long as you meet and can prove the requirements, there should be no issue. Japan is not considered a high risk country, so do not create stress worrying.

IR-1 / CR-1 Spouse Visa Process & ProceduresPLEASE HELP!
I am also very confused

Legitimation/Legal Relationship - The child/applicant must meet the legal requirements pertaining to legitimation.  A child born to a female U.S. citizen (and a non-U.S. citizen father) is automatically legitimated.  Proof of legitimation is, however, required for a child born to a male U.S. citizen.  Persons born to an in-wedlock U.S. citizen father and non-U.S. citizen mother are legitimated by virtue of the marriage.  Persons born to an out-of-wedlock U.S. citizen father and non-U.S. citizen mother, and not legitimated by the natural parents' subsequent marriage can be legitimated under the Immigration and Nationality Act by one of two methods.  See the Legitimation Requirements for further details.

Since your married already they child qualifies by default. Again I would advise you to call. Was your wife married before? They could be questioning that

Not sure who told her about the DNA testing, this came from the embassy website.

Evidence of the couple's relationship prior to the conception of the applicant.  The burden of proving a claim to U.S. citizenship, including blood relationship, is on the person making such claim.  Photos prior to the time of conception, letters, and other correspondence may help establish the couple's relationship prior to the conception of the applicant.  When no substantive form of credible evidence is available in conjunction with a CRBA or Passport application, a parent may find genetic testing to be a useful tool for confirming a stated biological relationship.  Note: Do not initiate a DNA test unless it was recommended by the Embassy for your pending CRBA or Passport application.  A DNA Test that was done independently and not according to Department of State procedures will not be accepted to support a CRBA or Passport application.  For more information, read the DNA Testing Procedures.  Click here for English version.  Click here for Filipino version.

I was told the exact same thing by the consular when I called a few weeks in regards to the posibility of child being born prior her visa getting approved.

I know its way to early for me to be worried in this long process, but I sent out our I-129F on May 21st and still have not received an email/txt notification about an NOA1. The package was confirmed received at the Dallas Lockbox on May 23rd via USPS. I've noticed others who sent our I-129F on May 23rd and have already received an email and/or txt.

I created an account on the USCIS website, but its asking for a receipt number, which obviously I don't yet have.

The holiday will delay things for sure, many people were off friday and tuesday. My check was cashed the same day I got the text and email. Best of luck you will be fine

Um, no offense, but why one earth would you say something as ignorant as 'all people from the Philippines get approved easily and fast'.

Clearly you have NO idea what you are talking about. They get approved no faster than most other countries. And there are plenty of stories on here of people being denied from the Philippines.

You appear to be from Brazil, so what makes you think you know anything about the Philippines.

And you're telling him he won't have any problems even though he has basically NO evidence of having spent time together.

Sigh. Why even bother posting if you have no clue what you're posting about.

K-1 Fiance(e) Visa Process & ProceduresJust got back from my Congressman's office

I am currently at day 179, which I know is slightly under the 6 months I read you should wait, but I couldn't take it any more and the office is just down the street. I felt like I needed someone on my side... Unfortunately, that person is certainly not going to be in Congress. I didn't so much want someone to bump my application to the top or the like, but I wanted to hear that my wait was normal and my time was close at hand. OR, that I had done something grossly incorrect that I needed to fix. It was a government office, so I wasn't terribly shocked at the lack of kindness but it plainly set the tone for my experience.

I, with great hope, gave the immigration person my reference number and she went to work. After a short while she returned and told me that my application was with an officer and that was all she could provide... which is fine. I asked her, from her experience, what she thought was a reasonable timeline. She informed me that I had probably 2 more months before my NOA2. To which I balked because, from all my research, VSC is processing at around 6 months. She then asked if I was lecturing her on how to do her job and I politely responded in the negative but it didn't get much better from there. She asked why I was in such a hurry. "I was hoping to have my fiancee and her family over for Thanksgiving and I don't feel like displeasure with a 6-8 month wait is vastly impatient", I responded.... She laughed and said that I would be lucky if she made it over by new year and that I was indeed simply being impatient. She then began to quiz me on what I included in my I-129f packet. I passed everything except for the personal references she mentioned. She said that I should have included 3 personalized letters from my peers and because I didn't I would positively receive a RFE. Does anyone know if this is true? My packet was extremely detailed with ample proof but no letters from friends or coworkers...

Ok, I think that's it for my rant. Really just a long post asking about references but I would appreciate and thoughts on this. Thanks as always, Team.

Best,

Josh

Based on Igors list, the last few days there have been several dates close to yours being approved. I am sure you are only a few days away rather than a few months. As far as the references go, it is not a requirement, and personally the first time I have even heard a few things.

It does not shock me about your experiance with the office, people forget that they are in office to SERVE THE CITIZENS OF THE US and we pay for them to be there. I recently reminded TSA of that in the Philly airport, and at the end, I got an appolgy for the persons actions. Best of luck!!!

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa question

This may seem like a really stupid question: How do I play with "numbers" the only thing that I can access is checking out my "case status" but that hasnt changed in six months... :)

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa question

we have about the same NOA2 date.. have u played with numbers on the USCIS website? you can see who is in your "group" of numbers.. looks like mine is on the floor and being processed... 16 people in my "group" and 8 approved or rfe'd... and the other 8 are waiting like myself. i wouldn't be worried, sadly we are at the 6 months mark but theres no real order or logic to their processing in my opinion.. some workers are slower, some are faster, some petitions get held up by name checks etc.. i think you should hear something very soon.

how do you get this information on the USCIS website?

K-1 Fiance(e) Visa Process & ProceduresSeveral Questions about Form G-325

I've researched around for these questions but just wanted more of an updated/detailed answers.

These questions/post are in relation to the form G-325 that we will file with the I-129F/K-1 fiance visa.

- Would it really still be acceptable to use the G-325 form?
- Do I or should I really used the G-325A form instead?

My fiance showed me the G-325 form that he had written-filled out in pen and was about to mail to me but I noticed that there were printed "0000"'s placed under the Year spaces.

For those who have printed the G-325 or G-325A forms and had encountered "0000"'s placed under the Year spaces, What did you do in that situation?

My fiance just wrote the number years over all of the 0000's. He knows I worry about almost every little detail on these forms but I'm concerned whether or not it will be readable to whoever reads it when we submit it. I feel like it would be better to print out versions of the form that had no 0000's at all. So as to look more neat and readable.

If this is the case, then I think that if he does refill it out then I'll request him to print out the G-325A form instead of the G-325 form that he originally printed. Because everyone else seems to have used the G-325A but then I had also read that some people use the G-325 form (but I forgot how long ago they had used it).

Also, I think I read somewhere that wite-out (correction fluid) is not recommended to be used on the forms we will submit? I asked this because under "This form is submitted in connection with an application for:", he had checked off the "Other (specify):" category which he then had written "I-130" which we now know is wrong, right? Especially since if we are filing for a I-129F (K-1 Fiance Visa) then he should write "I-129F" or "K-1 Visa", right? I had told him just to use wite-out fluid over the "I-130" writing but after reading online somewhere not to use it, I'm having doubts for him to use wite-out.

If we need to include a supplement paper that goes along with the G-325 form, how formal does it need to be? I saw a template that someone posted but was thinking couldn't he just handwrite and format the additional information similarly to the G-325(A) form? He doesn't need to sign the bottom of the supplement page too, right?

My fiance doesn't have quick and easy access to a printer, has limited time to make it to the post office during his country's business hours so I know this will add to his ongoing frustration with all my request for him to fix certain things on these documents so that it will look really neat and acceptable before he mails it all out to me.

Thanks for the future feedback.

Not sure the difference in forms, but If you are going to all of the trouble to reprint them, it would be much faster to input the data on the computer and mail it to work and print it, that is what I did, no clue why someone would want to do it by hand.....

K-1 Fiance(e) Visa Process & ProceduresExpedite based on financial hardship

I understand what you are saying here, Vanessa. I worked overseas for almost 4 years before coming here in the US last month. I saved as much as I can and my husband did his part too. We were denied when we filed our K1 (overseas consulate) in February 2011. Pre-VJ for me. Long story but it was devastating and we did not give up. We both went home to Manila to get married. Fortunately, I had a job overseas as a nurse so I had my own money at least. Despite the financial challenges (K1 denial, wedding, overseas trips to see each other, CR1) he visited me where I was based, BUT we planned for that, saving a certain amount of money each time we got our paychecks just for the trip to happen. The CR1 took longer than expected because we had to request transfer of the interview to Manila. My husband did not want it but I insisted because I was scared to be denied again. I went home to Manila for my interview and my husband was there too. This immigration journey is NOT cheap and honestly, if it were not for my job, I don't know where my husband and I will be financially right now. Maybe too much debts and I never wanted to be a burden to him (financially). Right now we are tightening our budget and I am in the process of getting a job already because I want to help us both get back on our finances. So I understand and sympathize with those couples who are maintaining 2 households during the entire visa process. We are in a difficult situation but we need a lot of patience to get through this.

OP, how far along is your fiancée in her pregnancy? Are there other factors involved that make her a candidate of C-section? If she is worried about NPA in her province, she can always stay in Manila and find a doctor with reasonable price. (Please find someone who will not take advantage of the fact that she is engaged to an American). Sad, but this is true. The cost of a baby's delivery varies in private hospitals. It is usually a 'package deal' in the Philippines, meaning to say the woman's Obstetrician will let her know early on what the expected expenses are if the baby is born (normal or CS). My sister-in-law gave birth (normal delivery) in a private hospital in Quezon City last year and my brother spent $1K for that (including baby's pre-screening etc) . My sister-in-law originally thought she would be giving birth via C-section too because of my niece's position but she was awesome because she did a lot of walking, prevented herself from eating excessively to avoid being too large and frequently visited the doctor and in the end, she went to give birth normally. You can always call private hospitals in Manila and inquire the costs of both normal & C-section delivery. I wish you luck!

She is at 7 months now, we are looking into moving her to makati in a few weeks and looking at hospitals. Thank you for American price factor, I have learned that lesson already.

Thank you for information it will come in handy. Welcome to America!!!!!

K-1 Fiance(e) Visa Process & ProceduresExpedite based on financial hardship

I thought we lived in a time when people knew how to prevent pregnancy. If you cannot afford the cost of having a baby or the baby itself then don't have one. It is not anyone else's responsibility.

This is how it works:

Sex=baby. If you cannot stop the baby with protection (and you cannot handle having one) then don't have sex. Simple.

Another person making a comment that is off topic, how about this... We had sex, the condom that was bought at 7-11 in Manila broke. Next you will say that she should have been on birth control and I should have never trusted a condom in Manila. I am a human being we all make mistakes in life I can tell you this, The child is NOT a mistake, what is mistake is insensitive people like you making comments about someone you have no clue about so dont judge. I will provide a better home than most, the reason my home is full of love not judgment....

I wish all of you the best of luck on your journey, it s completely bull that people come here for genuine help and a few idiots always have to talk smack.

They will review it and get back to you before even putting your application into the file system they have over there. I sent in an expedite for the cost of birth and the pain I would have to go through being separated from my first born and it was denied. Maybe I wasn't exact enough. Now, I feel like they are jerking me around. I received an RFE on the exact day before my 7 month point, the day that I would have been eligible to request an expedite based on the amount of time things are taking. They mailed me the RFE, which they say could take 15 days. They really want to make me wait now that I thought I should be given priority over all the other I-129F filers. I must have rustled somebodies feathers and now they really want to get back at me. Everyone else who submitted at the same time as me received their RFEs AND acceptance letters (even after an RFE) before they even bothered sending mine. My case is not that complicating. I recommend that, if you try the expedite, that you try the expedite. After the expedite was denied, I continued to follow up with my senator... Probably each time pulling my file and pushing it further and further back in the stack of files.

In my opinion, they need a better filing system that keeps things more fair. On the other hand, if they really do want to mess with me now that I've persisted too much, then I guess they have that right and I can't do anything about it. Keep these things in mind as you pursue your application. I should have taken the advice of others "It's best to wait".

Very interesting. I would have done that, however I did not know she was pregnant at the timing of filing, otherwise I would have married her then and filed the marrie route, it interesting about your RFE, what was it for? My case is also cut and dry. I will make sure not to call the senators office again at this point. Best of luck with your journey

Dirk I would do some research on available Philippine hospitals and doctors (and midwives) to make sure your fiance has the best care available. I'd also start saving to make sure you have more liquid assets on hand for such a case. Despite the rate of c-sections in the USA, they're actually not needed most of the time. My personal opinion of elective c-sections is less than agreeable. I had to have one. I wish with all my heart that I didn't have to. It was far from elective and it was to ensure my child's life. Of which I almost gave up my own to give.

While I understand completely your want to be with your fiance and with your child at his or her birth, like Vanessa&Tony stated, there is a reason they do not expedite for pregnancy. If you make 5 times the poverty line, it is doubtful they would expedite for financial hardship either. Unless something is quite wrong with your fiance's pregnancy, expediting doesn't seem likely, BUT you can try if you choose. No one says you can't, just that they feel the likelyhood of such a request will not help you. However if the K1 is not completed by her 36th week, it would be best to stay in the Philippines for her to give birth. At that point she may want to stay anyhow because she's had particular doctor her entire pregnancy and most likely would be more comfortable with that person than some stranger.

I'm not sure of the c-section rate in her country, but I'm going to bet that it's a great deal lower than the USA. A c-section is major surgery. It is a major as open heart surgery, or an organ transplant. There are very serious complications from them and while they're meant to save lives, they're capable of taking them away as well. Do some research! Find your fiance a great doctor, a great hospital and then try to support her. While a pregnancy of a loved one is a big deal, especially to you as a fiance (or to a spouse) it is a much much much bigger deal to the mother to be. At home she will likely have female relatives to help her out and also support her. If she is in the USA she will have only you. A lot of women want their mothers there when they give birth, and you may not be able to help her with that. This is a time to think about her needs. She may say she wants to be in the USA because it would make you happy and she loves you and wants you to be happy. It's very hard to not manipulate people this way when we feel strongly about something. It's not purposeful so it takes a great deal of purpose to do the opposite. She needs to know her decisions are okay, that you're supporting her and love her unconditionally for whatever decision she makes about her body and the baby growing inside.

I wish you both the best. I hope she has an uneventful pregnancy that's full of common complaints but no hardship. I hope the process goes fast for you and you can be with your family sooner vs later. Best of luck.

Thank you, in the case of the baby, the DR is worried not only due to the size of the baby, but do to the position of the baby at this point. I am not a medical DR and am going on what I am being told. Yes I am looking at all of the hospitals in the Philippines to make sure she and the child get the best care. C Section is a last resort, but we need to plan accordingly.

in this case the financial hardship was insane... $11K for schooling? It was about saving money, not about being poor now.. which is a big difference.

The OP wants the child born in the US because it's expensive to fly there and because he doesn't have the money now to do that - which is bad with the whole "supporting the immigrant" issue.

He also said he has a $100 co-pay. Others have stated medical in the Philippines is cheaper than in the US. Unless and extremely large amount I doubt they'll approve on those grounds.

Honestly expedite based on pregnancy tends to only work when it's a high-risk pregnancy or something like that. I wish the OP best but I also kinda don't... while I sympathise with the situation, it's not a high risk pregnancy or anything remotely emergent if they start expediting based on pregnancy then people will start getting knocked up to save time. I'd have saved thousands in rent if I moved quicker, like most of us probably would have. There are people supporting two households on their one US income due to immigration stuff.. it's a hard road for a lot of people but you can only make the choices to minimise the difficulties you might face.

Let's not confuse the issue. At no point did we get pregnant to expedite the process, it happened after we filed, other wise we would have got married and filed for a spousal visa. It is very rude for people to read and imply such a thing,

Also let's not confuse the fact that I am 5 times above the poverty level, I just don't have liquid cash on hand, think about 3 trips to the Philippines over 7 months, a first time child on the way and the start up costs,

While I appreciate the genuine responses, we come to this board for help, not to be judged or criticized, if that was the case I would just use facebook...

You should send documentation like how much the co-pay for your health care insurance, a quote from a hospital in Philippines showing how much it would cost to deliver over there, the cost of ticket for the child and etc. If she's having a complicated pregnancy, you should ask for a medical certificate from her doctor over there saying that the health care that she'll receive over here is better than the one in Philippines especially if she lives in a remote area. Also, you'd like to be next to your fiancee so you can support her during her pregnancy.

I requested expedited processing for my mom because I am having a difficult pregnancy and I sent my medical records to NVC which forwarded my request to the US Embassy in Philippines. It was approved within a week. I don't know how long it takes for USCIS to process expedited processing though.

I am 7 months pregnant right now and I totally understand why you would want your fiancee to be next to you.

Congratulations on the baby and good luck on your expedited processing request! :)

Thank you so much and good luck to you, I just got off the phone with her . She has an apt on Monday and will get the dr to prepare the documentation.

I was in your situation. But we decided to wait until after our was born to send our paperwork. I didn't want to add the extra stress on her during the pregnancy and the extra time would allow for her family to spend time with our son. I did travel back for the birth and made another trip six months later to see my son.
She also had a c section and i believe i came out of pocket $2400 for everything.
It is tough being away from them now since we are also at VSC and waiting. But It was important for me to allow my fiancee and son to spend time with her family. There isnt much you can do except be patient and plan well. Congrats and good luck.

Congrats to you both. Once we found out she was pregnant she left Manila and went back to capiz to spend time with her family. Her family wants the child born here due some NPA security concerns in their own mind,

It's a lot cheaper to give birth in Philippines than over here. C-section over there in Philippines is still a lot cheaper than normal delivery over here in US unless you get free medical insurance premiums for your health care at work for your dependents?

Yes it is much cheaper than here in the US, however I have premium health care so it is only $100 co-pay. Plus I added the cost of being with my child at birth if I had to go, as I would have to make another trip to get her and the child after the CBRA and her visa approved vs a trip to go get her now. I am very bitter towards the overall process due to the fact I am discriminated on by the state I live in and align with VSC. If I was a Cali, she would have been here months ago, the cali part of the statement was put in the request as well.
