Thanks Guys...

In the guides of K1 here in this website you will see where says fiance passport type photo there's a link to specifications.


The Passport Photo in my passport is what got me confused, it does not match the example in the Document. However the second set of passport photos I took in Colombia is the same as the Photo in My Passport, but does not match the specs in the document referenced above.. So that's the reason it was confusing to me... No Problem now, I'll follow the Document for Dept of State and send the 2" x 2" Photos...

However, the second half of my confusion is as follows...

IMPORTANT!
Make TWO copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in. All Forms that you submit must be originals with original signatures. Supporting Evidence that you submit may be photocopies. Retain ALL original supporting Evidence since the USCIS has the right to check them by issuing an RFE (Request For Evidence). If you receive an RFE, follow the direction exactly, and make two copies of what you sent back. During any future interviews the USCIS may also want to examine the original supporting evidence.


In the guides it says to make two copies.. No Problem, Done... I've got more than 2 copies, so real good shape there,...... But do I need to send a copy to the USCIS or is one orginal ok? And if I need to send additional copies, do I need to send additonal passport photos as well to go along with each copy.. This is why I'm concerened.. I have only 2 Passport Photos of my fiancee which matches the documentation above.. so if I need more, can I have the photo's copied at a photo center?

Sorry if I seem slow, but really want to get this submittal right...

I might actually get this sent off this year :)

Still preparing my initial submital of the I129F and associated documents. I've been going through all my documentation. I have a question about a few things.

A few months ago, My Fiancee and I got 2 passport photos, then last week, while in Colombia, I had 10 more done of each of us just in case I needed more..

However, I noticed the photos are diferent.. the Initial 2 photos are about 2" x 2" and show head and full Shoulders.. The second set (Most recent photos) are about 1" x 1.5 " inches and show the head but not the full Shoulders...

So Which one is correct? I notice my actual US Passport Photo is the same size as the the second set of photos taken.. But when looking on the DOS Website it describes 2" x 2" Photo with head and complete shoulders...

Which is acceptable for submission with the G-325?

The other things are my list of confusion is:

  • I believe I read that I need to send in 1 Original and 1 extra copy of everything. Is that correct?
  • Do I send in a Passport Photo with each copy of the G-325 or is one photo enough?

Just an added thought here.. I know very little about China, but I tried to get married here in Colombia, and one of the things I had trouble with was providing documentation to meet the requirement to get married in Colombia.. One of the things that Colombian Officials wouldn't accept was my birth certificate.. Seemed insane, but the Birth Certificate I had was valid in the USA, but they wouldn't accept it in Colombia. So just be sure you get a good handle on the requirements for getting married there in her country... I know the laws there may be diferent there

Your reply is consistant with what I had read previously.. However when looking at a timeline of a particular VJ'r I noticed he got his status only prior to the Physical NOA1 or before the check was cashed.. That's why I asked..

Just curious about getting the USCIS Case Number.. I recently submitted the I-129-F on Apr 19th, 2010. I noticed in some timelines that people are able to check the status of their case before getting the Physical NOA1 in the Mail or before the check is cashed. How can I get my case number? I did receive the confirmation from the Courier that the package was delivered on the 20 April, but the check hasn't been cashed yet according to my bank..

Any Ideas?

Being my fiancee is Colombian, I beleive the best thing for me to do is be at the embassy. This entire thing is way to valuable and there has been a lot of time and money invested to take any chances.

I understand that this may be diferent for certain countries, but would not risk a bad outcome regardless.. I've set time aside for the appointment at the Embassy and to be with her on the trip to the US for her POE and wouldn't dream of having it any other way..

Hoping all goes well with the Petition so that day will arrive.. :thumbs:

In many cases, I agree with you, however...

I am not an expert.. Not many of us on here are.. I am, like most on this forum, learning as I go.. However, I would never state something in certain terms as I am not qualified. That is why I stated "I am almost certain that it goes like this" which you quoted... It did not say "I am Certain"..

I specifically stated "I think you should ask your lawyer to recheck his info".. I believe that it made the point that the info given by her attorney was questionable, but that at least she should do more investigation on her own. the other thing was, that my post (as others) are clear that the point is that she should check into the matter further..

In most forums, people state things with qualifiers such as "Almost Certain" to indicate more investigation is needed and the original poster should inquire more. Also it leaves room for others who are more familiar to add thier thoughts as well..

In my post, I made sure to mention that the thread starter should have her attorney re-check her info. So, please try not to be so critical to posters.. it keeps people from offering any help with that kind of critique. In addition, this forum as well as other forums are full of post with similiar suggestions..

Again, I respect your opinion, but keep in mind, this is a forum of "E"-Friends helping "E"-Friends...

Once he receives his visa, he has 180 days to enter the US, then the 90 day clock starts once he enters the US..

This comment is just plain inappropriate. I absolutely dis-agree with your opinion on who should post here.. I strongly feel, This kind of Advise should be offered since maybe the poster didn't properly understand what was needed for the initial submission. It could be something that would help the original poster or someone else down the line.. I feel you ALSO answered the question well, and its certainly makes a good point about front-loading the initial submission.

I am not trying to take sides on who answered the question the best.. That isn't the point... The point I was trying to make was, There is no need to be insulting to each other...

I absolutely thank god for the help I've received from all the VJ'rs.. Sometimes, I may not know what I need to do or even exactly what I need to ask, but posts like Alan's can be just as helpful even though he may not have directly answered my posted question..

Here's a question for you; "what is the real objective of VJ?"

Yourself, Alan and countless others have no obligation to continue to offer their advise, but I am thankful they do.. I tried really hard not to respond to this post, but as you can see, I wasn't able to resist.

Do you really find it crucial to insult other posters? Alan gave a valid answer, however your post also helped. I just don't see the need for the insults and arrogance.. There's got to be a better way to make your point.

Let me share something with you..

If you travel often to other countries, you'll find very few cultures are as hard on others as Americans are with each other. It's a culture shock when foreigners experience the way we treat each other.. Regardless of the diferences in the way we respond to posts, will all have the best of intentions.

NOBODY Deserves to be treated in that manner.. It simply doesn't matter about your experience, income, where you live, the car you drive, who you know, where you work, or anything else, nobody should be treated dis-repectfully !!!

The USC must be in the states to file any visa except the DCF (which not all consulates allow, you would have to check into the one in Colombia) but in that case they must be living together in the same country.

I read someplace that possibly there are some exceptions to filing while outside the US and being a student appears to be one of them... Maybe someone can shed some light on this.. I am going to try to find where I read this..

To Qualify: U.S. consulates will typically only do this for US citizens who are Legal Residents of the country (typically for at least six months) in which the US Consulate sits (overseas). You will be required to show proof. This can be any country with a US Consulate (that the US Citizen is a resident) and need not be the country in which the Non-US Citizen Spouse lives.


Maybe someone can shed some light on this as Far as DCF, in Canada, with Non USC Spouse in Colombia...

Hello all

Still looking for feedback...

This couple are personal friends of mine from my travels to Colombia..

We have questions and I am not sure how to answer them...

With the USC living in Canada, and foriegn fiancee in a diferent country, being that the USC earnings are below the poverty line, what is the best route for these guys?

If the USC Citizen travels to Her Country to get married, then petitions for the Spousal Visa, how will that work being he is living outside the US in a diferent country?

She is considering apply for a tourist visa to come and meet him in the US and my thoughts are that could complicate the Spousal or Fiancee Visa for them being that it's likely she'll be denied.

She was already denied a tourist Visa into Canada last year.

Would it be dificult if he stays in Canada? Should he consider making his residense in the US while pursueing either the Spousal Visa with a co sponser or Fiancee Visa with a Co Sponser?

I hope some of you VJ'rs can help this young couple. They're hoping for some encouraging thoughts and some good advise..

The reason for no tax returns is that he has not lived in the US for the past 3 years.. His jobs have been temporary Part Time earnings in Canada.. He is likely below the minimum income requirement.. Can he use a co-sponser for a fiancee visa, or if they file for Spousal, are they required to meet the Minimum Income requirements at this stage or later in the process?

Looking for some addtional thoughts...

In recent past years, his income has been in Canada and has no US tax returns filed for the past 3 years. He (USC) is 30 Years old, the Benficiary is 23 yo.

Trying to get a small headstart on the paperwork needed after the I-129 is approved..

Reading the Guides I found I still have a few questions..

The first is regarding the Affidavit of Support..

what is the diference between the I-134 and the I-864? What determines which form to use? Is there a requirement for a bond? If so, what kind of bond is required? (Item 5 on the I-134)

According to the instructions, the DS 156K will be furnished by the Embassy if needed. I remember reading that completing this form ahead of time is acceptable,, Any thoughts?

It appears the reason was just as I thought.. I failed to answer the question on the I129F in Part C, Item #2 regarding previous convictions...

Maybe just overly anxious, but worried why I have not received the RFE Notice in the Mail yet...

On Jun 18, 2010, I received an email as follows..


Current Status: REQUEST FOR INITIAL EVIDENCE SENT, CASE PLACED ON HOLD

On June 18, 2010, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.


Checking my case status online, I noticed a "touch" on Jun 21, 2010...

I am concerned since I haven't recieved the notice in the mail yet... I called USCIS and they told me that it takes about 15 days..

What is the normal time to receive this notice?

I am anxious to see the reason/s for the RFE and get this resolved as anyone would be.. Any ideas????

The new requirement is that the CO requires the beneficiary to bring a DAS Certificate of the Petitioner to the interview. In the past it has always been a DAS certificate on the Beneficiary. 6 months ago initiated the new requirement that a DAS Certificate is required on both the Petitioner and Beneficiary. Apparently the only way for the US Petitioner to get a DAS Certificate is for the USC to go to Bogota and get it. I.e. His fiance cannot get it for him. I have read where the petitioner can jump through a bunch of hoops... I.e. Send a notarized power of attorney to the beneficiary and then the beneficiary can go to Bogota and get it... which is not always feasible. I.e. It's not easy to get a notarized original power of attorney to a beneficiary and then for the beneficiary get to Bogota a few days before the interview to get it.

Apparently, it is a new requirement, however, they are not asking "everyone" for it. It'd be great if you could find out some info on this requirement and how exactly they expect the beneficary to have the USC Petitioner's DAS Certificate. In case you didn't know... it's listed as a requirement in Packet 3. I assume it was not needed when you petitioned for your fiance as they just added it to packet 3 in April.


Ok.. I had heard of a few cases where the CO requested a DAS Certificate from the petitioner, but it was very rare.. I do remember that I was kind of worried this might had come up at our initial interview, but thankfully it didn't..

Did this happen to you or someone else recently?

I read someplace here on VJ sometime back, that this typically occurs if the CO is suspicious of the Petitioner or the Beneficiary or the relationship itself.. But frankly, my memory is vague as to where I read it exactly..

Kenny,

You seem to have a very good relationship with CO. Perhaps you could kindly ask him about the new requirement of the Petitioner needing to get the DAS certificate. I realize your situation may be different as it's the sponsorship of a child and you have already sponsored your wife, but it would be great to know what he says about this new requirement.... or perhaps you could ask him when you go for the step-daughters interview as in a closing. Ie. Tell him that many are curious about this new requirement of the petitioner needing the DAS certificate when petitioning for a fiance. How does a petitioner get this certificate if he/she cannot go to Bogota? Are there ways the fiance beneficiary can get it for the petitioner in his/her hometown in Colombia?

Ask if you would like, and it'd probably be best to ask after the interview, kind of like a "By the way..." It would help the Colombian VJer's out a lot to have that info.



I will give it a shot, but, honestly, I am a little out-of-touch... what exactly is the new process? I am not aware of the changes... Can you elaborate a bit on the process and the questions you have..

I was also confused about this part but after reading it a few times over the grammar errors made sense to me, kind of like those 3D pictures that were so popular in the 90s :lol: . It pretty much says that you can schedule your appointment without your interview letter as well as go to the Consular Section waiting room on the date of the interview without the letter. They just mixed up the medical and the interview processes all in one sentence which makes it difficult to understand. <_<

What most people do is print out the online appointment schedule where it shows the BGT case number and the date of the interview. Page 2 of the Instruction Package also says to download the Appointment Package in case the appointment letter is not available:

Hey Diana, Thanks, but now with the new medical requirements, of needing to have the TB Results prior to the Interview date, how can you wait until the day of your appointment?

You may schedule your medical appointment and enter the Consular Section waiting room only on the scheduled date of your interview without your interview letter.

This is the part I don't understand.. From what I remember about the day of our interview, this is not possible if you must be at the interview at 7 AM, how is it possible to do your medical on the same day? Especially with the new TB Testing...

I had a question for you Kenny
My husband will be coming with his IR-2 visa in October. He has some family in Canada that he would love to visit. Would he need a visa to go sometime down the road? I read online that his green card was enough to go to Canada but I have read other articles that completely contradict that. Do you know?

Great to hear about your husband... I asked a Canadian Immigration officer once about having my wife travel with me sometime.. I was told she could with her Green Card.. That's the extent of what I know..

I will say, that they're tough on everyone, they often pull you back into secondary and run your background..

A little more research into the matter may be worthwhile.. I will try to see what more I can find and let you know..

I'm looking for flights, because Janeth's coming in December and I have a feeling the sooner we book, the better. I'd like to get something a month in advance at least. But I've noticed something and I wanted to ask about it.

Most of the flights pass through Miami, Atlanta, or Houston before getting to Memphis, TN. That's fine. But I've noticed that there's a flight that's 200 dollars cheaper than all the rest that goes from Bogota to Toronto, Canada, and then to Memphis. Seems a bit convoluted but what do I know?

Anyway, my question is, with the nature of this flight, would there be any problem with her going through Canada on her way to the US? I know the rules are slightly different as long as she doesn't leave the airport, but I just want to make completely sure. Anyone have any experience here?

I am not certain, but it seems like that's a lot of connections, and you're bound to encounter some problems especially with her VIsa Type..

I travel to Canada a lot, in fact, I'm in Canada now.. And their immigation is much tougher than US, beleive it or not, especially if they're on a K1.. I am not absolutely positive, but I beleive Colombians cant fly thru Canada without a Transit Visa, and they can be very hard to get for Colombians... Also, Very few US immigration officers understand our own K1 processes, so you cant expect Canadian immigration to understand it, and I wouldn't count on it.. I simply wouldn't risk it.. It could be a very bad day for your Fiancee, and if you're strapped for cash, you could end up loosing the the fare if she ends up returning to Colombia due to the confusion..

My suggestion is go for the higher fare, and save yourself a lot of headaches.. Continental goes through Houston, and American Goes through Miami.. If you can afford it, I would fly down there and return with her to the US..It may be worth it for her to have you with her on her big day..

She will also need her DAS certificate (certificado del DAS) as well as her medical exam results. As for evidence, I seriously doubt they'll want to see any since her mother's K1 visa has already been approved.

You're the greatest. Just what I was thinking..

I simply dont want to mess this one up.. We've been soo fortunate so far with this entire process. Getting Valentina to the US is sooo important to us... To take anything for granted and get denied or have to return to the embassy for anything would seemingly be soo ironic at this stage...

It's great to see Colombia Club III Going.. I was wondering if it was going to get started..

I need help again..

As some of you know me, My wife arrived last year, we married and AOS'd and she now has her GC, but we are starting the Process for her daughter who was listed as "Will Follow" on the DS-156...

As you may remember, Valentina is 8 years old.. Her father has given us his permission..

So the question is, since my wife is now here and we're married, do we still need to submit any additional proof of the relationship?

I completed the DS156 Visa Application and am sending the Original DS 156K which we submitted for my wife.. Also the DS230, and so forth as well as the I-134, taxes, pay stub, job letters, Birth Certificate, Registrar Civil.. What else is needed?

What proof, of the relationship will the want for an 8 year old...

PLEASE HELP MEEEEEEEEEEEEEE!!!!
