It appears the reason was just as I thought.. I failed to answer the question on the I129F in Part C, Item #2 regarding previous convictions...

Thank God! that's all it is...

The I-129F is a bit confusing. My guess is that they just need the information for those items. The good news is that you'll be getting your NOA2 in the near future after you've submitted the data they need; I don't think there's anything to worry about.

Hello All

After seeing a touch today, then receiving a Text Message saying my case was updated, I could hardly wait to get to an internet connection to login to my USCIS Account. I'm in Colombia this week and was hoping to end my trip with good news.. I was so excited expecting an approval and hoping to celebrate the good news with my fiancee this weekend.. NO SUCH LUCK! I logged in and found I have an RFE..

I am leaving sunday, so doesn't appear to be a celebration in the plans..

After seeing this RFE, I was completely distracted the rest of the day wonder what in the world it could be...

I have a complete copy of my submittal with me, but I wasn't home all day. So I tried to keep a good spirit as to not spoil the day with my fiancee, but, man that wasn't easy. I kept thinking what could it be.. I sent in everything I could possibly think of that was needed.. Photos, G325's, I129F, Evidence of meeting in past 2 years was plentiful, including boarding passes, passport stamps for both myself and my fiancee who came to see me when I was working in the south carribean. Birth Certificate, Report of Birth Abroad, just could not imagine what it could be...

I arrived back at our apartment late this evening and reveiwed the paperwork and noticed on the I-129-F in Part C, Question 1 related to military service, I had put "Not Applicable-No Military Service".. The part that I beleive may be the reason for the RFE is on Items 2 & 3 related past criminal offences. I left these blank thinking they were related to Item 1.. Thinking back now, that was plain stupid of me..

I hope that is all it is.. I realize I need to wait for the Actual RFE to arrive in the Mail, but just can't help but to be distracted..

Any thoughts from anyone?

If we find that the issue is in fact that I failed to answer those 2 items, Will I need to re-submit the entire package or just send the corrected I-129-F?

Any idea, on how this will delay my approval?

My internet access here is somewhat limited, but please share your thoughts and I will try to read and reply as soon as I can...

that sounds great! do you have a landline or a cell phone? sprint unfortunately charges for incoming LD. which really bites. it is cheaper though since its not as expensive as outgoing LD but still pricey. i am hardly ever home because of classes and work, i hardly use a landline.
i am going to look into magic jack! he doesnt have internet but his cousin does.
other than that, MetroPCS does not charge for incoming LD and its only $50 a month! im thinking ill see how crappy the connection is and if so, its calling cards and skype for me!

I believe strongly in international relationships.. I don't beleive they offer gaurantees in cases where one or the other partner has extreme views. I don't beleive people there are many diferences between men or women seeking relationships abroad and those seeking relationships in their hometown, there are just many good people and just as many bad people in either scenerio... Whats unfortunate is that when relationships go wrong, is they blame the system rather than look at themself..

GOing into a Long Distance Relationship comes with certain understanding between two people.. LDR has it's share of challenges due to the time apart. People in a LDR need to understand that going in and work together to help each other to deal with those challenges.. Asside from those things, the dynamics are the same.. If your extreme in any particular ideas, eventually any and every relationship will suffer and likely end and manytimes, end badly...

Al, I would seriously search inside and understand if your anger is really about problems with Elena, or is it because you're hurt and feel you want to blame someone.. Have you really sat and given yourself time to reflect on other possible causes of this ending.. You can't beleive simply because her last relationship failed, that she's a scammer.. Maybe she realized something about that past relationship that frightened her..

The fact is, there is just as much possibility that the cause of this relationship failing is due to more than you're sharing.. It does nobody any good, (I mean it does YOU no good) if you're not honest with yourself.. If your personality changed during the time you spent waiting for the NOA2, and it became such that Elena lost interest, then those things will also your future relationship if you're not honest with yourself..

A long time ago, I was taught the value of responsibility. You simply do not make a life changing decision that another person depends on to change his or her life and then nine months later say "Ha ha, I was only kidding." Only the most morally bankrupt person would do something that reprehensible. But then, since the creeps at RWD operate at the same lowlife gutter level, I suppose they see what Elena did to me as just fine.

Now that I think about it, I hope that Elena hooks up with one of those creeps and that they make each other's lives the worst living hell they can possibly imagine. They both richly deserve it.


I dis-agree, anyone in a relationship has the right to back out at anytime.. If you don't understand that, you should not be involved with anyone much less doing a Visa Petition...

That's one of the risks of life... She must have seen something about you that she simply couldn't live with... Your opinion about being locked in once the K1 app is started is the reason I am suspicious and likely one of the things that scared her...

Why do you feel your dream is dead? You should know, you can meet someone again and submit another petition if you need to.. You may need to also submit a waiver, but unless USCIS finds you're involved in a Visa Scam, (doubtful) those waivers usually get approved..

Maybe someone who has experience with this can offer some thoughts...

My only advise is to take time to heal.. and when you're ready, then get back into the dating game.. There are many sincere wonderful people all over the world, not only Russia or Ukraine, but other wonderful places as well..

Your dream doesn't need to end! Keep your hope alive!!!

For me, waiting for the visa was stressful, but once My "now wife" arrived and I watched her adjust to the US culture, and saw her crying and crying from home sickness, that's where real stress lies..

It sounds like you need a good paying job now. Forget begging for co-sponsors. The trucking industry is in desperate need of man power. Don't know what you are doing now. But, it sounds to me like extra income is in order. I suggest you try trucking. You can train with one of the bigger companies, work for them for one year and move on to a better paying company. You will start at around $40,000 depending on miles driven. You will have a job for life. after about four years, you will be averaging 60-70K per year. Only a suggestion. You can start as early as next week if you do some serious investigating. I would try SWIFT Transport. They are the biggest operation in the US now and are always looking for drivers. If you have a decent driving record, no criminal record and a good work history, you will be a good candidate. Good luck. Alaways try to think outside that tiny box.

Truck Drivers work countless hours and 60-70K sounds good to many, but when you consider the sacrifice you make and hours you must work to make 60-70K, it's peanuts.. Being a truck drive is like being a musician, it's something you have to love to do...

My wife just did her interview and they questioned the travel receipts I had... so they asked for her to go to the DAS and get a print out showing all of my travels to and from Colombia. I then did some research and found that is a normal request. Wished I would have known that prior.


What did she need to get that information? Copy of your passport? anything else?

How long did it take to get it from DAS? minutes? hours? days? longer?

Any thoughts on our issue, my wife is now a legal perm resident and we are working on the Visa for her daughter who was listed as "will follow" on the DS156K.. She is only eight years old, but my wife already has her green card and we are only completing the K2 portion of the visa for her daughter..

The interview for her 8 yr old daughter is in 2 weeks... My wife will be in Colombia for the interview, the child is not required to go, but will be there anyway because she must go for the medical exams..

She will have our US Marriage Certificate with her and I imagine can go to the DAS Certificate if needed.. But, just wondering if it's needed in our case..

I married a lady that is 25 years younger than me. She had no problems obtaining a CR1 visa. The difference in age is not uncommon for the Philippines. The only difference is you being the man is 25 years younger than your wife. It should not make a difference. You just need to convince the interviewer that it is a legitmate marriage supported by how frequently you chat with her which is supported by chat logs, etc.


One thing to keep in mind, is this is common in PI, but may not typical in Lebanon.. Make sure you're prepared...

I asked a my tax professional and he said per IRS Pub 519 we can't legally file anything but single because she doesn't meet the physical presence test and that he was going to draft a letter to Immigration for me to bring to the interview stating these facts. I just want to get this right. My wife had no income either in 2010 so it would only be to my benefit as well.

there seems to be a disconnect.. I was considering marrying my now wife while she was in COlombia, and if she's your wife, the Tax Rep at the IRS ran me throught the test, and she qualified as my spouse on my return.. I ended up not getting married in Colombia, but I do specifically remember that I could have claimed her on my return.. An ITIN number is needed which can be complex to apply for, because you have to prove forreigh status.. but a notorized copy of her forreign passport should do the trick...

I understand what you are saying but I have met all the requirements. I didn't file my 2010 return because it's my legal right as a US citizen. The NVC asked about it and so I supplied what was required instead of the tax return. Any person with common sense could take one look at my W-2 (2010) and letter of employment which were requested as well and see what I earn/earned as proof. Obviously she didn't have any. My wife is a lawyer in Colombia but will be studying to become one once she arrives here and then it won't cost us a thing, besides time. I have subsequently, as of today, filed my 2010 return. Is that enough to bring to the next interview or do I need to get a co-sponsor?


This isnt a smart position to take if you care about your wife's immigration.. I also worked outside the US while doing my visa. And I also had the right to file an extension, but knowing that I was going to need my tax return, I filed it on-time and took it with me to the Interview.. And yes, it was important enough to me, to make I was there.. regardless, your position is arrogant and obviously you can see where it got you..

What are your options now??

My first suggestion is to chill the attitude and arrogance, and if you care about your wife's immigration, get your 2010 tax return ready and be at the next interview...

We aren't lawyers, but keep in mind that even lawyers offer bad and even illegal advise with the intention of lining thier pocket books and not so much to help others.. I disagree with the way this whole issue was handled by katheryn, her response may have been a little too harsh. It is good the moderators point out when bad advice is given.. It may have been better handled a diferent way..

Dont Forget, This is a Free Forum that all can participate.. Unless VJ want's to restrict everyone from offering advice unless we meet some sort of prequalification, we just have to expect that some responses will be bad advise... However, people can and do benefit from VJ in a HUGE way.. I won't be the only once who'll say this, but for me, there is no possible way I would have gotten as far as I've gotten without the help of all of you.. I am extremely grateful for this forum... But I do realize, sometimes, I might get some bad information, so I need to review other resources as well.. I beleive my situation is typical across most others on this forum...

I read the other thread.. Lets say for the sake of discussion only, that you gave out bad information.. Although I don't know you very well, you don't seem like the kind that would intentionally advise someone to do something illegal.. I think VJ is an Excellent resource that has tremendous value for all those involved in the Immigration process.. You may be taking drastic action in response to what happened on the other thread..

If it is the case that USCIS employees read this site, then please can you try to get your mis-information line sorted out.. You guys really need to stop giving out information that is inaccurate !!! Especailly when that infomation takes money out of our pocket or has a detrimental effect on petitions and applications.

This journey is enough of a mine field already without having to get our legs blown of by receving WRONG information!

The only thing (and I believe it's a big thing) is if they are married, and now she leaves and re-enters then applies for AOS, I wonder if they would catch that at the AOS interview?

Wouldn't that be considered "mis-representation"? What would the concequences be for her future immigration and her career (especially if her job requires she travels to the US)?

Seems like a real possibility for disaster not just for the relationship, but her job could be at stake as well.. And there is a possibity of this being discovered when they return and attempt to lie about it at POE.. I would think especially if they're traveling together, but if they're smart enough to not travel together, then certainly there is a record of the wedding and dates of entry into the US...

Just seems really risky not to mention stupid...

Hey MarkieBoy... Congratulations..

It took me 2 weeks to recover from the excitement after getting NOA2.. It was ok, but lost time.. I don't know about PI, but our Consulate allows us to send P3 without waiting.. And we can email it direct to the Embassy. So check out PI Embassy Web page and see what you need for P3 and get moving on it so you don't loose anymore time.. We had our interview and our approval 45 days after sending P3 but could have been sooner if I hadn't take so long to get my act together... If I had sent it sooner, I might had gotten an september interview instead of a October Interview..

Anyhow no goofin around get your stuff ready to go so when the Embassy is ready for you, you can be ready also..

Hey Redneck... Sorry about your daugter.. please keep us posted on her progress..

contact NVC if you haven't already... However, unless you get put in AP, NVC stage should move thru quickly.. otherwise you'll need to work with Montreal to get the process for the expidite..

Also, some like to give unsolicited advice even though they jump down others throat for doing the same thing.. please forgive Jill, you'll learn to love her..

Let us know how things go with your daugther.. we're all concerned and praying for her.. How old is she?
