The topic of this thread specifically refers to the I-134, not other requirements that the particular consulate may or may not have on thier particular instrucion page.


I would imagine, however, that they're considering that they've seen lots of other people use pay stubs in combination WITH the I-134. As I quoted from London's page, those documents are for the I-134. "the sponsor should attached two or more of the following items to the affidavit". That says to me that it is a requirement for at least London's I-134, so you can't make a blanket statement that no one wants pay stubs.

I was merely giving an example of why some people may choose to use pay stubs, which you seemed to think was wrong or unnecessary-- It's actually correct with at least one major Embassy, probably more. I was not replying to the original post so much, but rather, to the question you asked.

I dont even believe the UK requires an affidavit of support, thus, they have established thier own rules.


Someone's visa in London was just temporarily denied pending an I-134, ergo, the I-134 is required at London. The person in question didn't have time to get one together and thought theycould get by without it. They didn't.

Even the embassy site says "Persons in the U.S. who wish to furnish sponsorship of a fiancee or Kii visa applicant in the form of an affidavit of support should use form I-134 which is available from the U.S. Citizenship and Immigration Services." They also mention an option for a sworn affidavit, but I've never seen anyone go that route and the information on that particular piece of info on their website could be out of date. So, yes, although they have their own rules (as it seems every consulate does), my point still stands-- There ARE places that say "other evidence adequate to establish financial ability" or similar wording, so its not like some people are just completely making up the need for pay stubs and other 'useless' evidence.

London, for example, does ask for at least two of the following, to "substantiate the information regarding income and resources" (which sounds similar to what you asked, at least to me). It's important to remember that what is requested varies from embassy to embassy.

* notarized copies of his or her latest federal income tax return;

* a statement from his or her employer showing salary and the length and permanency of employment;

* a statement from an officer of a bank regarding his or her account, the date the account was opened and the present balance;

* any other evidence adequate to establish financial ability to carry out his or her undertaking toward the applicant for what might be an indefinite period of time.

I'd say pay stubs fall into that last category, even if they aren't specifically asked for. Some embassies and consulates may not take even a glance at them, others may specifically request it, some may just take it into context with the employer letter-- I'm not sure if the OP's consulate's website may say that pay stubs are required or not.
I'm personally going to cover all bases and send all of the above, because I feel my bank statement is weak (Thanks for nothing, National City), because the income has changed from last years taxes (about the same amount but part of the income we have is non taxable, and thats covering what we lost), and because the employment situation is a bit hard to understand without having at least 10 sheets of paper that document the exact situation. No guarantee they'll accept any of it or even ask for any of it, but it's better to have it available on the chance they do ask.

As for how many pay stubs I'm sending, technically, it's going to be around 12-15, but as mentioned, my case is a little more detailed than others, and all paychecks are bundled together in groups of 3 and 4 which correlates with the Workmans Comp paychecks that go alongside it.

Seems easier to just fill in the dates by hand, to me... But that'd work too if you're worried about it being all typed :)

I realize this isn't about the I-134 which is what you asked about, but I figure it's worth mentioning in case you've missed it elsewhere (like I had).

Go ahead and order up your UK police report if you haven't already-- or at least do it around when your NOA2 comes. It takes 40 days to arrive-- it is currently what is delaying us- we waited until around the time we were out of NVC and it's delaying us sending back packet 3 by a few weeks.

I wish I could help with the other stuff but I'm not familiar with what military sponsors have to provide so hopefully someone else can help you there.

also, shouldn't i just be able to bring a i134 not filled out to the bank and sign the thing in fron of the guy without having my personal information on the document? i really don't think it's anyone's business what i needed notarised, just that i need something done should be sufficient. is that a correct assumption?


If it's any consolation, my notary didn't even look at anything except the bit she signed. Whether this happens at every notary or not I can't say, but mine didn't even look at it, so she knows none of my personal info besides my name.

I am bringing my wife to the states via a K3 VISA through a 129F Fiancee VISA....my question: until we file for adjustment of status can she work? And can she get a driver's license here in the states? I am a US born American.


Also, I have sent off the initial 130 Petition. I saw that USCIS has withdrawn the fees from my bank account....does this mean I can relax and the Petition is being processed with no issues? And if so, how long before I should expect the reciept?

What is the definable difference between dismissing the I129F or not? Is the only difference the time it takes for them to get to the U.S. Because, of course, I want them here ASAP.

If I file teh I130 for my step-daughter. does that include all the others with it...the G325A, the proof of relationship and all that stuff too?

Plus, just how much proof do I need to send to USCIS. I have over 1000 instant messages, 1000 emails spanning the time of 2 years. Plus nearly 300 photographs from my 3 trips to the Philippines. I just do not want to UNDER send what may be needed. Any suggestions?

You can file the daughter's I-130 now or with her Adjustment of Status. My recommendation is to do it now, so she has an option for an immigrant visa and both mother and daughter can complete AOS together rather than waiting for the daughter's I-130 to be approved. Then, seriously consider just sticking with the immigrant visa and skipping the I-129F for spouse altogether.

From what I know so far, 21 days approval after filing is quite fast and I had received advice to go for the CR1/CR2-IR1/IR2 route. We have not filed our I-129F yet though we wil be in a couple days due to some unforseen circumstances (aka failure of the postal system). Where are we supposed to file it if our I-130 is now en route to the NVC?

Also it is my understanding that the USEM will waive the K3 application if there is already an approved Immigrant I-130 petition. How/why so? What should we do now? unsure.gif

One of the requirements for filing I-129F for spouse (K3) is a pending I-130.
Since your I-130 is approved, filing I-129F for a K3 visa is longer an option for you.

You didn't mention whether you file one I-130 or two. Did you file a I-130 for daughter as well? If you have not, you may want to do it now.

Yesterday 8/25/2008 I recieved a second NOA for the intial I130 sent. Got this even before I have sent out teh 129F. I am not sure as to where to send the 129F(for my wife and step-daughter). I130 was received in Chicago and sent to NH. So, do I send the 129F to teh address on the NOA? That would be california.

I am a bit confused as I am to send teh 129F to where the I130 is being processed; I don't think that is NH, but I would like to confirm that.
Any help would be appreciated.

Also, seems I got the NOA for teh I130 REALLY early. Does this matter much?

We don't know where to go from here. Wait for the NVC correspondence? Proceed with K3 VISA or go with CR1/CR2...IR1/IR2?

Seems a quick approval, we are thankful, but not sure how or why approved so quickly.

I also believe that the vaccinations aren't required until AOS, but I figure might as well get everything done together.

Hi Wayne/Rachel,

Since I live in Sydney, I have booked to have my check/prints done at my local police station. Call to make an appointment - my station only does this on sundays. Not sure where the Watchhouse is but Lynjer is from Brissie! I'm almost certain this can be done at your local cop shop anyway.

All you need is the P800 form and the fee of $175. You will then receive the cert in the mail in a couple of weeks. You can have it sent directly to you (as indicated by Barbara J) rather than have them send it directly to the US EM (where it will most probably get lost). It also lasts for a year!

I'm going to have mine done on sunday so I'll post back to let you know how it goes :)

My fiancee and I have matching stainless steel pendants with a photo of the two of us laser etched into the surface of them (same pic as our profile pic :)

Perhaps if you wan't to use a piece of jewelery to show togetherness, something like that could work for you and be a much safer bet than a ring that could be confused as being a wedding ring? Have to agree with the other posters,the risk of a CO deciding the rings are wedding rings and denying you just isn't worth the risk.

The sample version suggests putting "N/A ( K1 visa process for permanent residence )" as the answer for this line... is this question really not applicable? what did everyone else do? I followed the guides and sample forms until now, but am unsure on this one.

Before I respond to your question about the POE, I am curious how long the process took you? How do you know that he will get his Immigration Visa in February...or whenever? (This is not a guaranteed process...some people get the visa and others do not.) Where is your timeline? This would help a lot of us in the forum to understand the timeframes and what happened to you during this process.
My answer to your question is as follows: First: You may want/need to buy a round trip ticket for him. (The times that I've returned to the USA from Costa Rica (twice), it was cheaper to buy a round ticket from SJO to MIA/FLL on American Airlines.) Both of these airports are POE. I'm assuming that you are accompanying him back to the USA since you used the word "we"? IF so, ANY POE airport is acceptable so I'd be checking into fares to the cheapest city for your arrival. (Most will be in the southern part of the USA....Miami, Ft. Lauderdale, Orlando, Houston, etc.) Also, I am assuming that you intend to go to his interview in San Jose and then depart fairly quickly afterwards? What if he's not approved or there is a delay? What if you've already purchased the ticket/s????? The low fares are non-refundable tickets. Second: Once you get into the USA, you can buy tickets from whatever city you use as POE to Chicago....and, many airlines have competitively priced ONE WAY flights to ORD.
This is the way I intend to do it "when and if" my fiance' gets her visa. I'm flying to SJO on a RT ticket to/from Miami/Ft. Lauderdale. Then, when WE are in the USA, I will buy the one-way tickets to our final destination of DAY. Or, I may drive to Miami and drive back to Ohio with her as a little way of seeing the USA on a car trip. LASTLY, the interview at the POE will be very short. Remember, he has already gotten his visa and has been approved so they will just check his papers to be sure he has everything in order and say "Welcome to the United States of America!!!!" Your "waiting time" at any given airport cannot be ascertained by members on this forum because "it all depends" on many factors...time of day/night, number of passengers on the flights arriving from other countries in the world, whether an immigration officer called in sick that day, whether it is lunchtime/dinnertime, etc.

PS Airfares are ALWAYS in a state of flux...you can check online for a price today and IF you do not book it at that moment, it may not be available in an hour. Your ticket to/from the USA is almost a non-issue....except that you will have a return flight from SJO on a specific airline on a specific date/time. So, you will have to buy a ticket from that airline IF you want to fly back with him. I would not worry about whether you choose Spirit, TACA, American Airlines, Delta or any airlines...for me, the issue is the cost of the tickets and nothing else. How much stuff does he intend to bring to the USA? Suggestion: Take a nearly empty suitcase down with yourself and pack it with his stuff along with 1 or 2 others and be done with it.

My husband and I are just beginning the process and gathering information for formI-130. He is in Costa Rica and I just returned to the US to begin the process. At this point I am only confused on the address format the US requires on the form. Costa Rica address format is very informal, which is probably why mail is impossible. Addresses being a distance from a land mark, such as; 50 meters N of Rubi's Super, Orange House.

Is this how we should write an address on the file?

He has lived and worked in VERY remote areas, that just plain Do Not have addresses...
How do we list those?

Hi...and Good Luck!!! I have a similar situation with my fiance'... the way I get mail to her is by using a local Post Office (Oficina de Postales) in a larger city. She calls by telephone to see if the package/mail has arrived. IF it has....she goes to retrieve it ASAP.

The postal system in Costa Rica is VERY BAD...and there is nothing that can be done about it until the government decides to standardize addreses throughout the country. Until then, you'll have to use the informal address and HOPE that everything arrives there. I've had mail delievered fairly quickly (<10 days) and I've had mail "LOST" forever. Unfortunately, there is a problem with dishonesty and theft in many Latin American countries. Packages/mail that arrive from the USA are assumed to contain money and valuables. Therefore, they seem to disappear frequently.

Another option is to use an international shipper such as DHL Worldwide...but the costs are OUTRAGEOUS. I checked out the cost to send a 5 pound box of stuff to Costa Rica through them and it was over $110+ ... United States Postal Service was about $35.

My point is....list what you know to the best of your ability. The people at USCIS know that not every country has a postal system like the U.S.A.!!!!!!!!!

I have a question about the evidence needed for the I-134 form. I'm finding it difficult to get a statement from the officer of my bank and would like to know what evidence others have used to with this form.

I do have a letter from my employer, a copy of my bank statements, and my income tax returns from 2009..

Should this be enough evidence for support?

Your evidence is sufficient. It would be helpful if you had a couple prior year's tax returns. Since you have copies of your bank statements you should not need any "statement from an officer of the bank"...your bank statements will tell the tale. You do not need ALL of these things...note the words "as appropriate." Others are using the same types of evidence as you are using. Don't worry.

1) No...you already paid your money with the K-1 petition.

2) Typically the cases are forwarded within 10 days from the NVC. You can call them and get your new casenumber or you can wait until you get a hardcopy notice from the NVC.

WOW..I just read your post and don't know what to say!! I can't say, "I feel your pain" because my process never got this far. But, I can only imagine how disappointed you must be today. There are options available to you but they will take more time...and probably more money too. I assume you were doing the petitioning without an immigration lawyer? Maybe contacting one of them first would be a good course of action. You'll get more advice from others too.

I sincerely hope you are not offended or angry with me for making a couple of comments/observations. I am doing this only because I have concerns for you and want the best for you...you are a really nice woman.

The first question about "Why never married?" (to me) appears to be a legitimate question to be asked in an interview. And, his answer was good too.

The second seems unprofessional and judgemental... and since you were not there, you will never know if or how this question was asked. (NOTE: That's another good reason for going to the interview with your mate.) These people in the Embassies do this for many people...and, they get a complete file on every SO in the Visa process. Maybe there was something in the file that prompted the denial?

Lastly, I think Nigeria is one of the "high-risk" countries where they are very cautious with approving visas. You're in love and want your man by your side and I understand that....good luck to you and keep us posted on your journey.

K-3 Spouse Visa Process & ProceduresNeed Help - USCIS Approved to NVC - What Next?

Hello all,

I applied for both the I-130 and I129F in conjunction for my wife in Korea. Both were approved at the same time by USCIS and is not en route to the NVC processing center.

I believe the next step is for the NVC to forward our paperwork to the proper U.S. Consulate in Korea near her residence is this correct?

After that, what's the next steps that we should expect? I keep hearing about these "packets 3" and "packets 4" but not sure what people are referring to. Once the U.S. Consulate receives the paperwork from the NVC, will they contact my wife to schedule the interview?

If anyone can detail out the exact steps and process after this stage, it would be greatly appreciated.

Hello Alan and welcome to VJ,
First you need to be very careful with your typing and wording...both here and when filing your paperwork with the USCIS, etc. One small word can change the meaning of everything. Example: You said that "is not enroute to the NVC Processing Center." I read your posting and thought...Their petition was approved but it was NOT sent to the NVC because that is what you wrote. However, reading it a second time I realized that you must have meant to use NOW instead of NOT. You could have avoided any confusion by elimininating that word and simply said: "is enroute to the NVC Processing Center."

Yes, you are correct...the NVC sends your approved petition to the consulate where your wife will eventually have her interview for the VISA.

The consulate in Korea will send your wife a "Packet 3" with specific instructions on what to do and what will be needed to have them set an interview appointment with her. They will NOT contact your wife to set up the interview. The responsibility will be upon your wife to complete their request for information and that she has all the necessary paperwork. In many cases she can notify them by FAXing an OF-169 Form with whatever else is requested...copy of her Passport, Biographic Data, etc. THEN, and only THEN will the Embassy send a letter to your wife with an appointment date and time.
Finally, many countries do not use a "Packet 4" any longer. Check the specific information in this forum as to whether or not Korea uses it. I cannot answer anything about "Packet 4" for you.

PS I was not trying to call you down about your usage of words in your posting but I have seen many people get confused and upset when the correct words are not used. For example: Some people write "I filed a VISA application for my fiance/wife..." The correct terminology is NOT "application"...it is a "PETITION." Everyone on here will try to help you....try to help us too. Do you have a timeline filled out on VJ?

"A Fiancé(e) Is Also an Immigrant

Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry an American citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa."

The K-1/K-2 is a NON-immigrant visa. The K-3/K-4 is an immigrant visa. Note the words..."must meet SOME of the requirements of an immigrant visa." These types are somewhat similar but not the same.

Yes, you are correct..."my opinion is my opinion." And that is what a good percentage of the posters on this forum are giving free of charge. That is the entire point of VisaJourney...sharing information and giving opinions/advice.

As to your second point about what "I think," I do not respond to a posting unless I have researched the answer to a certain extent. I did read and refer to ALL previous posters replies...and those were opinions/advice as well. The response to the poster's question was researched at the U.S. Department of State website...please read below, and I quote:

"Can a K-1 Visa Holder Leave the United States?

The K-1 visa allows a fiancé(e) to enter the United States one time only. If you leave the United States after entering on a K-1 visa, you may not re-enter on the same visa."
