if u were denied number it may still read as originally sent but within the system it has been changed to reflect otherwise and if he was to get return it will be less than originally stated both federal and state returns

not saying he file late, and im sure he did get both but you go back and ck or ask irs and you will prob see they amended the return within the system to not show jointly and he prob would have gotten letters explaining this at the time



Exactly, if filed before April 15th and filed joint...the IRS would have ammended to married seperat, spent the tax return check, and he woudl have gotten the ammended 1040A....that should be sufficient for NVC processing of AOS. Should be no problem, if this is the case.

Maybe I am misreading, but I thought "NVC and they told that my hubby really needs to file his tax for 2007".this meant he has yet to file his 2007 tax returns. Am I mistaken?

I cannot speak abou the processing of the ITIN, but I do know for a fact that he cannot file joint without the ITIN.

Moonhunt may have been through the process before and have a better handle of the processing of an ITIN.

I think that is a good choice, but have him go ahead and process for the ITIN..so, that for THIS tax year, he can then file joint and get those extra deductions that are oh so nice.

I am not a CPa, but if your goal is to speed through NVC so you can get the the U.S., my advice is to have him file his returns, married filing seperate and send it off ASAP. Have him get his tax returns direct deposit to his bank account, and wait for teh 1040A to be sent back my the IRS..then he can send that to NVC to join with his AOS and you should be on your way then.

when the AOS was sent he must not have had 2007 tax returns, so(if I were to guess)..they won't process your AOS, thus not your case. They require, at the least, the last years tax returns. From what I hear you saying, he does not have that.

I know for certain that when her files his 1040 form that he will be asked ofr either your SSN or ITIN....that tells me that it is not possible to do that.

Again, I think he should seek the advise of a CPA; just to be certain. You don't want anymore delays than needed.

Why did he not file hi taxes before April 15th? And now..is NVC stopping your processing b/c of that?

yes, once you have either a SSN or an ITIN then ...yes, her can file joint.

But for you current issue. You must decide what is more important...

1)filing seperately..which he can do now and send the 1040A off immediately...

or..

2)filing joint..which he will need to wait for the ITIN and then have your signature on teh 1040A and you providing proof of your income in the Philippines so that income can be taxed as well.


you must decide what is most important. Yes, if you file joint you may be entitled to a larger income(depending upon that amount of YOUR income ot be added) or the speed by which to process the IRS and get to finish at NVC.

Those, basically are your options.

If the spouse does NOT have an ITIN then you CANNOt file jointly. It will not be allowed. As on the 1040A you must submitted either a SSN or an ITIN...if you have neither of these, then the IRS will revert one back to married seperate filing.

I would disagree with this. At least from the standpoint of having everything the Service needs and presenting it in a tidy fashion. I do think that's important insofar as getting a petition approval without an RFE.


I would have to agree here also... maybe wont make a huge difference, but a small one atleast. No-one likes a job that is any more difficult or unorganized than it has to be.

Texas is a sorting center I believe, the other service centers still exist, but the papework doesnt get sent directly to them any more.

As for those asking how we got it so quickly, who knows??? We did not apply to have the case expidited, we just filed it with everyone else. Lucky I guess??? Also i made sure the package was complete and well organised, and used the forms/samples from here on VJ.... who knows if that helped things along also?

Well I checked the USCIS site yet again today and of course - no action. I finally had enough and called my Congressman and spoke to one of his aides. In a nutshell I told her what the situation is and she said the congressman has a full time employee that strictly deals with federal Governmental issues (ie: USCIS, IRS, etc). She said she would send me a privacy form authorizing the release of private information (which I received 10 minutes later).

I cited on my form the inequity of this system and that folks were recieving their NOA2's within 3 weeks of their application while I've been sitting in initial review since January 8th.

We shall see what happens...

"As the stomach turns, so are the days of our lives dealing with USCIS"...

I've been reading your "rants" and wish you the best. I hope you get some action on your case very soon...I know it is very frustrating. As for Elsie and I, the petition has flown through the USCIS system...even including a silly RFE which was my fault. I think I know the reason why my petition has gone so rapidly. I told you that I'd done this for my Colombian "wife" didn't I? That petition/approvals and interview were scheduled for 3/12/08...it was a done deal and that took about 9 months from our wedding date of 5/17/07. Maybe they matched my information up with my previous information and that speeded up the process for me? I'm not sure but it sounds reasonable???????
Actually, I wasn't "ready" for all this until June because of my work commitments. But, now that it is happening I am getting excited. Elsie is picking up her Packet #3 on next Tuesday, the 13th of April. She is going to try to get her medical done and get the Police Certificate (if needed) while she is in San Jose next week too. Also, I've sent her the forms, DS-156, DS-156k, etc. almost completely filled out for her...all she has to do is complete some minor information like parents dates of birth and prior jobs/addresses information. From what I can determine, she's nearly ready with her suitcases. LOLOL
In any event, I sure hope you get your NOA-2 soon!! You'll have to post a GRAND ANNOUNCEMENT on VJ when it happens. I am sure there will be many happy people rooting for YOU!! You will get lots of :thumbs: :thumbs: :thumbs: :thumbs:

PS I guess you saw that I had several people "jump my case" :unsure: when I posted my opinion about a "marriage broker" situation. They do that here on VJ! From what I'd read, using a marriage broker DOES create a "red flag" with the USCIS and causes them concerns about the bonafides of the relationship. It should be interesting to read how that person's case materializes. Hopefully all will be ok for them...no problems or issues.

Just received an email from NVC research .... they have contacted USCIS and my petition is " enroute " to NVC. Now the question is ... how long " enroute " ??? :huh:


My "enroute" was very short...about 3 days. It is only going from the CSC to the NVC in New Hampshire. Give them a few days and call for your new case number. I called at 7pm in the evening and waited about 3-5 minutes to speak with someone. They were very nice and told me that my case had already been forwarded to the Embassy in Costa Rica as of the 23rd of March. I am very pleased with the speed and efficiency of the USCIS/NVC. I know others will disagree but my experience has been very good. :thumbs:

My petition was filed on January 4th....NOA-1 and NOA-2 followed very rapidly. Our file was sent from the NVC to the Embassy in San Jose, Costa Rica on March 23rd and arrived on March 27th. We already have a new case number and my fiance is waiting to receive "Packet #3"...she will call next Monday to find out more. :thumbs:

Middle East and North AfricaAny info on taking S.O on a cruise

So, our 4th yr wedding anniversary is in July and my 10yr work anniversary is also in July. So, Im thinking of either Adam & I going on a cruise with Carnival to Cozumel or Pensacola FL. Still thinking and thinking. Has anyone been on a cruise with their S.O? Do they need birthcertificates and/or passports with them?

I see alot of great prices on that website and I have several co workers that go on cruises which made me start thinking about it. Any ideas?

Im dying to see some white beaches and blue/green waters and have a Vacation!!!

I've been on a dozen or so cruises and the only thing I needed was my U.S. Passport...and I had my driver's license too. This should be very easy to check out on the Carnival or other cruise lines websites.

Hello,

I just received my biometrics appointment letter in the mail yesterday. I am considering a walk-in and I am not sure if they make a big deal out of it (may be turn you around and ask that you come at the designated day and time). I can't be out of work in the middle of the week since that is when I am supposed to be processing payroll for my company, so I was hoping to do it on say a Friday, plus I am excited to move the process along and did not want to reschedule for a later date and request a Friday appointment. That would just take more time, but I don't want to risk being turned away since the Pittsburgh Application Support Center, where my biometrics app is, is at least 2hr away. If all else fails, I am going to try and make it on the day. I guess I am hoping to make the process as painless and convenient for myself as I can since we all know that immigration is anything but that.

So if you have experience with walk-ins (especially at the Pitt Application Support Center) please share :}

We had the biometrics appointment as a "walk-in" although it was completely an accident. My wife's biometrics appointment letter was returned as "undeliverable" for some unknown reason. So, we scheduled an INFOPASS appointment at USCIS in Cincinnati to determine the cause of that problem. While there, the very nice woman told us that it was the biometrics appointment letter and we had missed the appointment already. So...she called downstairs to another level of the building to the biometrics area and explained our situation. They said, "send them down and we'll do it right now"! So, we went to that area and had NO WAIT whatsoever. The biometrics took about 15 minutes from start to finish.
AS A NOTE: This was done on a Thursday when they are less busy. The early days of the week are very busy and I doubt if you could do it. Friday is also busy because people want to get it done before the weekend. We were just lucky, I guess. To allay your fears about the immigration process, we have had nothing but GREAT experiences and dealings with really nice people!!!! We started the "Adjustment of Status" part of the process in January, 2011 and yesterday (6/6/11) we received notification that "production of Elsie's Permanent Residency card had been ordered". She got her Worker's Permit & SSN about 6 weeks ago and has already obtained a job which she loves.

Ours had all 3 of those things as sub-headers, if memory serves, so I am curious if it was really just a boilerplate letter or if yours had less requests than ours did and they really do want that much more from us.



To clarify myself now that I have the paper in front of me, ours said:

Evidence of good faith marriage:

Then has 3 subheaders of:
  • Birth Certificate (of any children)
  • Financial Records (evidence of joint ownership of assets and joint responsibility for liabilities etc)
  • Residence (evidence of communal residence)

And then, of course, examples under all of those.

The RFE I received last month gave me 85 days to respond from the "notice date" that was on the RFE.

So, depending when in January it was issued, you might have a few days still to reply, but only if they sent it near the end of January...

Fingers crossed they sort this out for you!

We were waiting in hopes some other pieces of evidence would come in the mail, but decided to go ahead and take a chance with what we had, because we wanted to mail it before we leave for England this weekend.

Still waiting on a response to our RFE :whistle: Adman ... any response to yours (assuming you've sent it :) )? Anyone else who received a RFE gotten anything back, or did it show up in your case status on the USCIS site? Ours still says initial review.


Haven't sent ours yet! Might be a few weeks. Trying to be as meticulous as possible in what we're sending because we really have no idea what they want, and trying to think of something else that we might be able to include. Ever since you mentioned they only asked you for those 2 categories of things (and we got asked for 3), we're really stumped as to what the problem is, or what they didn't think was enough proof, so we're trying to cover every base. I figure if anything, that's what we sent the most of in the first place, so I just can't understand why they're asking for more.

I've started with a letter explaining what all is being sent-- going item by item on their list, and responding line by line with "we already sent this, but they are included again in case they were lost" or "we already sent 3 years, here's 1 more" and so forth. I hope they don't think I'm being a smartass about it, but I mean, they asked us for nearly everything we already sent, so...

As of now, the only new stuff we've got is:
-The new apartment rental agreement
-Renters Insurance evidence of insurance that is addressed to us both (paperless, though, so it's just a printout of a fax)
-Print-out of our account info for internet/cable that shows me as an account "partner" and shows Adman logged in. We always just used the same login before... *shrug*
-print-out of account info for cell phone showing account managers (this includes me (bill in my name), Adman, and also my mother (family plan), so I'm hoping it doesn't confuse them)
-2012 tax transcript - Not sure if I need to include w2s-- they had it listed on the RFE but I thought transcripts meant you didn't have to send w2s?
-Utility Bills in his name + cell phone bill in my name-- both show same address, but neither have both of us on the mailing address
-Itinerary of a flight we have booked together in May to visit his family back in the UK. Gonna highlight the price of the tickets coming out of our joint bank account in hopes that means something to them...

The old/updated stuff we're resending/updating is:
-ALL our bank statements from back to 2007 when we got married (only sent quarterly before)-- We plan on putting sticky note flags on anything that was a bill paid on the shared account-- again, no idea if this is overkill, but...
-print-out of new car insurance with just Adman and I as "Drivers" at the new address (previously sent one in my mother's name as we were on her policy at her house, now in my name since we moved, I am listed as the primary insured, Adman listed as "Driver - spouse")
-2009-2011 tax transcripts-- sent 2008-2011 last time. For some reason when we called for transcripts it wouldn't let us access 2008 this time, so I'm hoping that isn't an issue. We didn't file in 2007 because neither of us worked, if memory serves...
-Re-print of health/dental/rx/vision insurance card showing both of us + a recent invoice showing him and I as patient/responsible party + a letter from his workplace confirming shared insurance + life insurance with each other as beneficiary (they had all this before minus the invoice...).
-And I'm considering sending copies of the USPS confirmations of change of address for us both, just in case they're still not sold on the "we still live together" thing.

It just feels like it's all "meh" proof. If they want more confirmation from when we first got married, I don't know what to tell them-- we sent all we had, so I guess they'll have to call us for an interview if that's the case (I presume they go to interview stage, and not just rejecting us?!). If they want more recent stuff, well, hopefully this is enough, because it's all we've got as far as I can tell. I wish they'd just come out and say what they want in the RFE. Argh.

I think that the move/change of address form(s) might have just put a flag on the file (it is all hypothetical and from some other things I read before somewhere that I can't remember right now). We filed in August '12, bought a new house in October'12, filed the change of address forms shortly there after some time in November. I think that they just want additional proofs that we still live in the same house, at the same address. It's all good, honestly. Can easily prove and send what they request.

Chalk it up to a gut feeling/instinct. I frequently get them, either feelings or in the form of dreams and they become reality. Nothing scary thank goodness, but like I said, I just KNEW that we were going to get one. It was our turn :) HAHA! Yep, confident that we have all the info plus more that they are looking for. John and I are just sitting going through all the pics we could print that they would not even look at. I'm gonna throw in a few for good measure just for fun ;)


You know, I was considering this the other day as well. It's really the only reason I can see that they RFE-ed us, too-- we moved in October/November. And it's a dumb reason, since we both filed change of address with them, so it's not like we're suddenly at different addresses! And even if we were, what if we were divorcing (perish the thought!) and DID move to different addresses, wouldn't he still be eligible to file ROC? It's just a really curious thought to me.

We're still getting our stuff together, working on a lease and whatnot with my brother-landlord, and that kind of thing.

But, like you said, at least it means they're looking at our forms. I just wish in the RFE they would say "hey, we need more recent proof since you moved" or "hey, ______ is the problem" instead of "please send us all the things you already sent and then maybe some other things that don't exist like birth certificates for your imaginary kids", haha.

Total bummer :(

I was thinking the other day, just hypothetically, what additional information would we send if we got an RFE. Well, since August, we've had some holidays where we could send additional family pictures, copy of 2012 tax return (can't get tax transcript yet because we JUST filed it), copies of more bank statements. We purchased a house in October, so we could send copy of the deed in both names, and new car insurance cards, as they renewed in January. What are you guys going to send?


We really aren't sure what to send at this point, we've been wracking our brains to think of something that might help. Everything we've thought of is really weak compared to what we already sent.
- We have to contact our rental insurance to see if they can send anything with both of our names on it.
- We started renting an apartment in Nov 2012 (we were living with my mom for the rest of the time, which we know is untraditional, but it was our best option financially as I was out of work for awhile and Ad couldn't work until we filed his AOS), but the problem with that is that we never signed a lease for the new place-- the property owner is my brother and he didn't feel like a lease was right since we are family, so we're renting on a month to month basis with no lease. We're going to ask him to write a letter explaining as much, or possibly work up a lease agreement for us since we moved in back in November, if that's possible, but I don't think it's going to hold much weight because my mother did the same thing (a letter saying we've lived with her all this time due to financial difficulties and that we were moving out in a few months-- which we did) and clearly that wasn't enough.
- New car insurance cards (though they're about to expire)
- Flight Itinerary for a flight we have scheduled in May to the UK to visit his family
- I had to get a new drivers license since we moved, but Ad hasn't, so now our licenses say different addresses! We sent a copy when they were the same. All I can think is sending a new copy of mine and showing that the new address matches his address on the electric/gas/internet bills-- which are all in his name because all the companies said they could not put 2 names on the bill! Argh.
- Sam's Club memberships (presuming they have the same membership number, I haven't checked yet)
- 2012 taxes (like you mentioned, don't know if a transcript will be available yet!)-- we already sent 2008-2011!
- copies of more bank statements (because 6 years wasn't enough I guess!)
- if we can find it, USPS address change confirmation papers showing we moved to the same address

Basically a bunch of fluff, as far as I'm concerned, at least compared to everything we sent before, which you can see here!

Sigh. Adman & I got a rather unexpected RFE today. Opened the mailbox, saw USCIS's return address, got excited for 2 seconds and started running towards the house, then thought "No, wait, we would've gotten email notification if he was approved... oh, #######. There's no way...". But, alas. Yes way. RFE.
It's pretty useless in what they're asking for, looks like a boilerplate letter for "evidence of good faith marriage". Asks for a bunch of things we already sent, and we sent basically everything we had, and several people here on VJ said they'd been approved with less. Urgh.

So. Incredibly. Frustrating.

The second is, because I filed an I-130 for each my wife and son do I need to fill out all the forms for both of them? And include each other as an immediate relative traveling to the USA on each others forms? This is so convoluted, errr!

We are currently awaiting our invoice number from the NVC to begin this process of obtaining their (wife and son) visa, but just ensuring we have all our i's dotted and t's crossed.

I am going through a very similar issue right now...check out my posts as there are several replies that may answer your question. Seems that since the biological is NOT on the birth certificate..then on teh DS230 you can simply put "n/a"..which is what my wife and are are going to do as well.
