K-1 Fiance(e) Visa Process & ProceduresAfter NOA2
Since you'll be going through London, I'll just reiterate the suggestion of going ahead and filing to get your police report-- it takes about 40 days like clockwork, and it's valid for a year. If you get approved any time soon and get through the NVC as fast as some of the recent filers did (to NVC and to the embassy within 2 weeks), you'll do well to already have the police certificate on the way so packet 3 will be nearly complete the minute it's sent to you.

I forgot it took so long to get so it's going to cause us a slight delay (which sucks as we're shooting for a March marriage), so I figure this is one of the more important things to get on. Everything else we personally got done in a week or two.

K-1 Fiance(e) Visa Process & ProceduresDoes the USCIS (secretly) discriminate based on age?
22 and 20 here, we got through roughly the same time everyone else who filed around us did, so score another one for no secret discrimination. :P

K-1 Fiance(e) Visa Process & ProceduresImmigration attorney needed ?

However, their are some people who used an attorney without checking their background and have had trouble with them, so they will write derogatory things about their experience with an attorney.

There are also people who did their research and found attorneys that had a spotless record, but the attorneys gave them completely awful advice about how to do things in a less than legal way. The attorney I checked out was is in good standing with the Bar and AILA, and is also an honorary consul of her home country. She advised me to tell my fiance to plan a trip here, tell the immigration agents that he was 'just visiting' when he really had full intent on staying anyway, and other outright lies. I paid $50 for that misinformation from a so called immigration specialist, and thank my stars that I had VJ to bring me back down to earth, because I could've made one costly mistake with that woman. The only good advice she DID give me was that our case was very uncomplicated and we probably didn't need her help the whole way. As of yet, we've never needed it, and I certainly wouldn't go back to her after some of the other advice she gave.

While there are plenty of good ones out there, I'm sure, and I'm sure there's a few users out there who didn't bother checking their attorneys standings, it's also not fair to jump to saying that people just 'didn't check their background'. Sometimes there's no way of telling whether a attorney is any good until you're having a face to face with them and seeing exactly what they do know.

K-1 Fiance(e) Visa Process & ProceduresFiling buddies
My name's Angela (or Angie), I'm the USC, and I am 22. My fiance, Adam, is 20, and is from the UK (Great Britain to be exact). We'll be going through Nebraska because I'm from Ohio (And I'm guessing we'll get moved to California like everyone else). We've got the paperwork pretty much done and dusted (just need to date it, really), and have most of our evidence together, it just needs to be sorted out and copied and made to look neater, right now it's just in a bunch of binder folders to keep it in one place.

I plan on getting it in the mail within about 2 weeks.

I too am looking to get a job soon, but we have a cosponsor so that's not as much of an issue. Hope you can find something suitable for you, Angilla!

IR-1 / CR-1 Spouse Visa Process & Proceduresi think ill be stuck at NVC for 2 months or so..
QUOTE (xylide @ Nov 16 2008, 06:32 PM) <{POST_SNAPBACK}>
he hasn't file yet..and i think he will file file it joint coz he is getting me ITIN..
really?filing joint cost more than filing seperate?
i will talk to him about it so he can file his 2007 now without waiting 2 months for that ITIN..

but what is the difference of filing joint and seperate?
what is better?

if you file joint, your income will have to be included in his tax returns. Meaning, likely, that you will have to pay MORE in taxes, depending upon how much income you have. If you have zero income, then there should be no problem.
But withouth that ITIN you CANNOT file joint.

If you do not mind waiting and you have zero income in PI, then you will get a larger return on the taxes by filing joint. Because he will be able to claim you as an exemption. But, since he is already late filing that years return, he likely has accrued pentalties and interest on those late taxes. These will be deducted from what he will get back and if it consumes the entire amount and then some..he will have to pay that back.

Best advice I can offer you...have your hubby see a CPA. Do not have him try this on his own. It could be MUCH worse in the end.

I am not a CPA, but I did get advice on my 2007 returns from my CPA. And followed teh advice of married filing seperately.

You can also look up the tax code rules on the internet for the IRS.

I filed my 2007 married but seperate. You may have to pay even MORE taxes if you file joint. Maybe look into that closer and be sure that is what you want to do.

How did he file the 2007 taxes? Did he not do this at all?

I am glad that I could help you with that. It saves some time. The rest of NVC has to be done via mail and paying the fees on-line.

Start doing your DS230 and gathering the info for that and you will be ready to go when time comes for that.

Do a search on this site. My wife did it, I do not know the details...but i do know that she DID do it and that others have done it as well..

Post a new message asking for the info if you can't find it through one of teh shortcuts.

Or ...send a private message to my wife.....RyandGracey....and she would happily give you the details.

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS and IV Fee Bills Rejected
did you explain to the about the "rejection"? I am sure you did. What was their response to that?

I know its a pain in the rear, but you need to call and talk to another operator. Sometimes you can and can get different answers.

Explain the situation to them again. And check with your bank and see it the payment has been or will be processed. Cancel the "rejected" payment and initiate another.

I will be curious in knowing what the results are.

I called NVC last Nov. 26 and they said that they did not receive my AOS, wherein our atty. send all our docs (AOS and DS-230 for me and my daughter) at the same date Nov. 21 and was received at NVC on Nov.25. NVC's AVR said that its still awaiting for the AOS of my husband in order to review my packet forms, and in my daughter's case they already reviewed her AOS which got an RFE. Our atty. told me today that he confirmed from the NVC that my daughter AOS got an RFE and my AOS was there and it was reviewed together with my daughters AOS. Are they reviewing AOS at the same time (2 case) for me and my daughter? My daughter is 10 y.o. and we filled up I-864W wherein she is exempted for affidavit of support bec. of Child Citizen ACT. Im just wondering why until now NVC's AVR still saying they are awaiting for my AOS from the petitioner......your opinion is greatly appreciated............

You cannot trust AVR..in fact, NEVER trust the AVR. our case was completed, sent to USEM and AVR STILL said that it had not recieved our case yet. Always divert around AVR and talk directly to a customer service rep.

Sorry, to hear about the REF's...stay strong, chin up....you are nearly through this part.

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint checking account problem.
HSBC is your easiest solution for a joint account. They offer an on-line account that can be shared jointly and one can tranfers funds from ANT account into that HSBC account. Since HSBC is a large service provider in the Philippines, she can easil withrdraw money directly from an HSBC ATM.

I have done this and it has served as our joint acccount and is a very good way to get money to my wife without ANY fees...such as with Western Union and others.

I could not agree more. Forget the attorney. Rely upon the government bodies that your will process through and ALSO the valuable information that you can get from the people on this website.

If you look at my timeline, you will see that in less than 3 months...doing this without an attorney...my wife and I are nearly complete. Most post on here about attorneys are negative. that is another person in the way and the fees are outrageous.

Time spent for schooling, medical purpose, military, and a few others are all considered residential. Publicaton 519 is clear about that. If one has a child in a school in a foriegn country then this time is still considered residential in the US.

That is to maintain tax residency for someone who was already a resident but not for establishing residency for someone who has never seen the inside of the USA in the first place...

Please provide cite where you draw your conclusion.

the decision tree for resident alien status is pretty simple... (in Pub 519)

Were you a lawful permanent resident of the United States (had a “green card”) at any time during 2008? NO
Were you physically present in the United States on at least 31 days during 2008? NO
Then You are a nonresident alien for U.S. tax purposes.

Your wife is granted resident alien tax status by special election, as a spouse of a USC. Dependents do not get this special election nor do they get to ride the parental "coattail." No such thing as derivitive status, I am afraid.

My wife is not eligible to recieve a SSN until she arrives in the US...I called the SSA to verify this. So, since she is not eligible to recieve a SSN at this time, she can get an ITIN

I am Gracey's husband:

I just got off the phone with the ITS and yes, we CAN file married/joint AND claim our daughter as a dependent.

A non-resident alien(defining resident as actual presence inside the Us or not) can file for a joint return if married to a USC, even though they have ever step foot inside the US. All world-wdie income will be taxed.

What is needed:

1) the current year's 1040
2)W7 - application for ITIN
3)notarized copy of passport
4)a statement signed by both spouses proclaiming desire to be treated as a US resident(for tax purposes)

Read Publication 519. Can be found with an internet search.

Why woudl anyone want to do this???

Use us for example:

1)Filing Single(even though I am not)..my return is about $1700

2)Filing Head of Household...my return is about $3800

3)Filing Married Joint with one dependent....about $6200

HUGE difference!!

So, for those who never considered this, please read and pass along. My CPA was not aware of these last year and we lost out on a couple thousand dollars(thoug I think i can file an amendment to that, but not for certain).

For an absolute answer have your States side spouse call the IRS directly and ask specific question,,,,they are helpful and will give a definetive answer.

I sent the funds for the first part of my k-1 visa to my fiancee in america via Bank Transfer. Western Union quoted me $48 Australian dollars, the bank charged me $20 australian and her bank charged her US$15 so still cheaper than western union.

At this point however, I am talking to the bank to see if I can get a second visa card to send to her, so she can just access the funds straight from my account, will still incur some fees, but will be lots cheaper than the fees mentioned above.

My understanding is that anytime anything is done to your petition, it is 'touched'. They could be working on it, or moving it from one room to another. No real way to tell.

All petitions are "bar-coded" and scanned by workers at USCIS. Whenever moved as stated above, a touch is denoted. Essentially, it means nothing.

I disagree with this whole-heatedly. Everyone deserves to be loved and respected. Everyone deserves to be 100% sure their partner is faithful. Cheaters are of weak moral character and not worth anyone's time. They need to fix themselves before inflicting themselves on others.

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed a Divorce now.
Hello....and sorry for what you are going through.
I've been there, done that and got the T-shirt too!! (Colombian woman) I agree with the person who said that it is best that you found out now.
1) The first thing you need to do is STOP the petition process by notifying the NVC here and the Embassy in Thailand. This is very simple and straightforward...send an e-mail/fax notifying them that you wish to withdraw your petition.
2) Secondly, you will need to find a competent divorce attorney who is familiar with international divorces...specifically Thailand. This will probably be a difficult proposition and could be very costly. I had zero luck finding an attorney here in the states who had any knowledge of Colombia laws. So, I just did it in Colombia and it cost me about $500 plus some filing fees. (Fortunately, my wife was cooperative because she was pregnant with the other man's child.) Interestingly, NOW she is sorry and has apologized profusely for what she did...but, it is too late.
I am a proponent of the K-1 Visa route because of these types of situations...they happen with frequency. There are many insincere women and men who use USC's for their ticket to a better life. I think it is best to "check them out" for 3 months and see how they handle living with you. (And, it gives them a better opportunity to know you too.) Look at the number of VJ'ers who met online and are engaged or married shortly thereafter. This is not reality. I admit it myself...I met my wife on January 1st 2007 and was married on May 18th because I was "crazy in love!!!!!!!!" We had about 26 days together...not much time to get to know each other on more than a superficial level. Anyway...I paid the price for my "rushing into marriage."
All I can tell you is "Good Luck!"
Sincerely,
Franc

Everything else was alright on the original visa application except for my wife's biographic residence. I have the revised application ready to send next week.
thanks,

You can't send a return for 2010 yet....we are still in 2010 and taxes for this year are not due until April 15, 2011. Many people have filed their tax returns for 2009 already. I guess you are one of those who waits until the last possible moment? Considering that you are in this process, I'm surprised that you didn't file earlier. Personally, I would send the 2009 return and be prepared to be asked about it at the Embassy. (Otherwise they are looking at your 2008 return.) Why did you wait so long? I was told that each RFE adds about 24 days to the processing time. :crying:
Best Wishes,

PS It's not a "visa application"... it is a Petition.

My I-130 got approved in only 21 days, for my wife and my step-daughter. We were going to pursue the 129f route and K3 route, but it seems things have changed now.

Seems the the CR-1 is not only optimal but nearly mandated at this point. And we are ok with that. But now we are in waters we did not expect. After recieving the NOA2 letter...how long before getting info for me(in the states0 and my wife(in the Philippines) from NVC?

Any idea how long we could ROUGHLY expect the approval of a CR-1? Does this type of VISA better suit our situation? We want out daughter to finish the school year there, so getting them here ASAP is not imperative. From my reading it seems 6-8 months for approval, does that sound right?

Also, does my step-daughter, who is 5 years old, ride on my wife's CR-1 or do she have one filed for her independently? Her biological father IS NOT on the birth certificate, nor has he been involved in ther life or offered a dime in financial support....will this cause any issues?

any info would be appreciated.

NVC has recieved and processes the AOS fee for our case...

my next step is.....???......complete the 864 and send a the Document Cover sheet...is this correct? Am I to wait for a snail mail response from them or just go ahead and send the forms? If this is so..are these the ONLY documents that I need to send? If any others..what are they?
