You should hopefully hear something as they say in 60 days.

As for the websitre is very unreliable. And really there's nothing to really look at. Everyone is in initial review once the receipt# is assigned and you stay in that status until RFE or approved. Nothing more.

Not until you are at NVC and you get to track your case does it getting alot better. Too bad USCIS doesn't have same thing. Sorry.

Oh Okay you updated you are at NVC. Phew. You said you were in initial review (don't believe what you see on that USCIS website). Well you are alnmost done. Maybe a February interview for you.

I'm sorry but I got to ask something about this comment of yours. Does that really happen? That the USCIS website doesn't update case status in a timely manner? I felt so irritated after reading this (not your fault of course). I'm starting to worry on my case. I mean, what's the use of thier website if they don't update the case status appropriately? I'm sorry for the rant. Its just that I find them unbelievable. Although our lawyer is handling our case, I am still interested to know whats going on with it by checking our status online. My husband works everyday and he doesnt always have the time to call USCIS or our lawyer regarding with our petition.

But I did experience checking their website one time and it says we're already on a post decision status. Lol. I clicked it again and then it went back to initial review. It really pisses me off. Are they playing or something?

Again I'm sorry for the rant, it was all for the USCIS hehe. It's still our 5th month of waiting anyway, I hope everything works our fine now since our case was transfered to TSC last Nov22.

HI!

I'm Jennifer from Sri Lanka. My husband filed the I-130 petition on September 23, 2013. We both received an e-mail saying the lockbox received the documents on September 25, 2013. However, we never received the NOA1 -- Notice of Acceptance.

It is a little confusing as to why this was not sent, either by e-mail or post. After inquiring about the state of our case, we were e-mailed back saying the case was being processed at the National Benefits Center. However, still no NOA1.

The USCIS Check-Your-Status tool shows our case is at the initial inquiry level. I've already emailed the lockbox asking why the NOA1 was not sent. I am still wondering if that little e-mail we got was actually the NOA1!!!

Any thoughts? I would appreciate some feedback.

NOA1 Hard Copy will be sent to you 2-3 weeks after. That's what to happened to ours. Just be patient, it will come.

Bonifide Marriage Question

I think the Marraige Certificate is already a firm and strong proof of a bonafide marraige.

(Any other relevant documentation to establish that there is an ongoing marital union. ) You can include or send photos of your wedding and any proof your relationship. Although when we applied we didn't really include any pictue of us except the passport size photo.

No need to own anything in the foriegn country where you are right now just to apply for an I130. My husband and I didn't do any of that when we got married here in the Philippines and applied for I130.

Anyway, others might want to post a comment on this too. What I wrote is only base on what I know and read here

Should we hire someone to help us with the CR-1 Visa???

Hey guys. I have looked around on this site a bit and haven't seen many people talking about hiring "consultants" or attorneys to help them file for family based Visas. Is there a thread or section where people detail those experiences?

Regardless, I would like your opinion:

My fiance lives in Brazil and I am in the US. We plan to get married in January 2014 and then immediately file for the CR-1 visa so she can move here to the US and work. I feel like we have a very solid case with no potential problems. She works for a US company, has already received a masters degree from the US and we also have documented proof of us dating for two years.

Does anyone think we should hire a "consultant"? We have a lot of things to do planning a wedding and we also need to deal with filing for my visa in Brazil. We thought it may be nice to have someone help guide us. We have explored the options and the attorneys want $2,000-4,000 which we are not willing to pay. We found www.k1k3visas.com and they are willing to do a lot of the work and guide us through the entire thing for $525.

Thoughs on this anyone???

I think $2,000-$4000 is too much. My husband hired a lawyer with about $420 for everything.

However, I do agree with those who said that majority of what should be done for I130 Petition will still be done by you and your spouse. But if you have enough finances or if you think the fee is not really that big, I see no problem with hiring a lawyer.

Reason why my husband and I hired one is to have someone to atleast have our documents checked and if everything is done accordingly. Another thing is we both are busy with work and can no longer concentrate that much with the petition. Having a lawyer for us, to make it brief, is just to help us feel we are backed up and supported in case anything happens and for us to avoid any mistake we might do and might slow down the process instead.

It's still up to you really. By the way, if you decide to hire a lawyer, do a background check, previous client feedback, etch.,etch., This is what you will obviously do ofcourse, I just thought I needed to remind.

Thank you i will keep on top of them...they did say yes they will look into it and they said they have international address on file so dont know why mistake was made...I contacted them Jan 6 and they said to wait they will review my case.

I am in same predicament now I called USCIS they put in service request and I also emailed Texas Service Center.January 6 and 13.Just waiting on outcome now.I got approved Dec 30th with same wrong wording about I 824 and that my spouse is in United States which is totally wrong..they are so called looking into getting my case to NVC pray this doesnt turn into a nightmare

That's too bad I don't even understand why these mistakes are done. The forms we submitted are all correct and in fact when my husband told them about it they also admitted it was their mistake. Then they asked us to wait because they will review our case. I didn't want to wait for potentially such a long time just because of a USCIS mistake so I did my best for them to hopefully notice our case and work on it. Eventually, somehow it worked. What you did by sending them an email is correct, and try calling them too to ask about your case.Talk to a supervisor.

I hope yours will be fixed soon. Just keep the Faith

Don't wait on the NVC, be proactive and call them to obtain your case number. Then read the first two posts of the thread linked below for information on dealing with the NVC.

What happened in your case did USCIS send your petition to NVC yet.

Hello there! Yes USCIS already forwarded our case to NVC last January 16, 2014.

I think its because I emailed the ombudsman and the Texas Service Center for help that USCIS were able to fix it right away. I am very thankful. Now we're just waiting for NVC further instructions.

Your husband needs to call the USCIS and make sure your case is headed to the NVC because you are not adjusting status. It should not be going to the NRC. He needs to call ASAP!

You do not have to file the I-824, the USCIS just sends your approved petition to the NVC. Here is the link to the instructions for peace of mind:http://www.uscis.gov.../i-824instr.pdf

Hi everyone! My husband received the hard copy of NOA2 this afternoon (USA time), scanned and emailed it to me. It says we have to fill up form I-824, submit it to USCIS to request them to forward our case to NVC for further processing. I researched for it, found the form, and I found my husband also had to pay for $405.

My questions are, after we fill up this form, pay, and submit it to USCIS, how many days will it take for us to wait until USCIS forward our case to NVC? and how many days will it take for NVC to notify us and tell us to do the next steps? I would appreciate any answer related to these questions. I just would like to have an estimated time in my head.

And I'm also wondering why others didn't have to file for I-824 and was already forwarded to NVC? I am confused here. Hehe

NVC Error

I mean if they have said to wait for 4 weeks and then call, how is it going to get our case number faster by calling everyday. i am waiting since january 10th and they told me call this friday when i finish 4 weeks.

calling them daily puts unnecessary burden on them. i hope people realize this and call them when its really time to call them. please dont get me wrong , i am noy trying to be mean.

Like I said, emails take time. I personally know someone, K1, who received her case number by calling, but NVC emailed her case number after 2 weeks. You be the judge.

NVC Error

Why are you calling NVC everyday ?

To atleast let them know we're waiting for it, and hopefully push them to move fast. A lot of couples here did that and they were able to get their case number by just calling. NVC don't reply to emails right away too. So the best thing to do is to call them everyday.
