Please I need someone who's more knowledgeable to advise me on this as am just freaking tired. i130 was filed since March 2013 and my priority date states 14th March. On 31st of October case was transferred to local office and was told to wait for at least 60 days. What I don't understand is that other people within the same category as I am have gotten their NOA2 and I don't! Its annoying to sit back and not know whats going on. Is this normal? Is there any March 2013 filer here who's going through the same wait time as I am? I'd need your input so I know am not alone. I guess waiting for an approval is the longest of all the stages, just to get an i130 approved is taking forever! protest6wz.gif

 

 

You're not alone -Coded. A lot of people here are in the same situation like yours. While others got approved even though you submitted earlier than them. My husband and I  filed last July, transfered in Texas on Nov.25 and got approved last December 2. Right now we're still waiting for NOA2 or the notice of approval so we could proceed to the NVC process.

 

Actually there are cases that the NVC process takes longer compared to the USCIS process or I130 approval. 

 

Still all of us are patiently waiting. Let's continue hoping and praying for the best. It will be all worth it as soon as these waiting times ends for sure dancin5hr.gif

I hope I'll receive good news soon after my transfer to CSC. Ugh. Hehe. Transferred last November 25.

 

You'll surely receive yours soon! Seriously, a lot of transfered cases especially in TSC got approved recently. I'm almost sure yours is next. Just keep the faith. :D :) :) :)

Many cong... its your good luck i guess...my case was transfer to nabraska servise center on 15th-Nov-13 but till todate we could get any news from them.on daily basis im checking USCIS website to get any news but still unluck.

 

 

 

 

Thats alright -jasraheel! A lot of transfered cases from November was already approved this week. Right now, I've met 2. Me and someone else I forgot the name. Surely, yours will soon be approved too! Doon't loose hope. :)

By the way if the notice of transfer will take more than 2-3 weeks, it won't hurt if you give USCIS a call about it. But it usually comes after 1 week. :)

No we didn't request for an expedite. It was all because I'm a Filipina, the beneficiary. Filipinos who were affected with Typhoon Haiyan last month got the benefit of being expideted automatically as USCIS relief contribution. They said it's to help the petitioners/benefciaries unite with thier families after the devastating Typhoon. Truly, God works in mysterious ways!


ooh yea! they just said that in the e-mail ! 

 

Yup! So now all you have to do is sit back and relax. The notice of transfer will come soon. :)

That's good news -meegheni! There's a high chance that your petition will be approved before on month of December ends or next year January. A lot of I130 petitions are transfered to different service centers for fast processing. :)

 

I was transfered in Texas Service Center November 22, and got approved yesterday December 4. Praise God!

 

Yours will surely be approved soon! Just keep the faith!

 

You don't have to do anything. A notice will be mailed to the petitioner/US Citizen saying that your  case is transfered. After that you only have to wait and keep checking USCIS website for the approval of your case.

Yes, that's what they do.  They email you saying they got it, then it takes about a month for them to actually process the request.

I've contacted the ombudsman twice and will send in another complaint next week.  They usually take a month or so to reply.

Just a quick question. When you emailed the Ombudsman did they replied that they received your email and they're entering it to the system? They actually replied to my email and that's what they said. It says it might take up to 3 weeks before they enter our case to their system and take action to it.

I've read post from other sites that says they actually reply the day after you sent them an email. But if they don't we can wait for about 10 days because they might be reviewing your case and already sorting it out.

 

I'm looking forward for a postive feedback from them.

Hello krispykreme!

 

He was able to talk to an officer that time but Im not sure if that was a supervisor? Because the operator who first answered his call told him to wait because he will forward the call to an officer. Then that officer told him our case has already been reviewed and forwarded to NVC (which wasn't true like I said above). The officer in fact admitted that it was a USCIS mistake and that we should hear something within 14 business days (my husband called 2nd week of December). But until today we haven't received any news yet and everytime we call they will tell us to wait. 

 

It's so sad that we have to wait due to other people's mistake :'(

Hello everyone!

 

I just want to ask if any of you here tried sending an email to the Ombudsman for a case assistance due to a USCIS mistake? Can you share your experiences please? 

 

I sent an email today and I am hoping that they will respond to my email as soon as possible.

 

Our case problem is this (the same with what I emailed to the Ombudsman):

 

1. We received a Notice of Action Form I-797 from USCIS stating that our case has already been approved. (Please see attached file for the copy).
 
2. The approval notice additionally states that the beneficiary (Me) is RESIDING in the U.S and must apply an Adjustment of status and need to obtain Form I-824 and pay for the fee so we could move on to the NVC stage. --- THIS IS NOT RIGHT. THE BENEFICIARY (Me) IS NOT YET IN THE U.S RIGHT NOW. WE FILED AND WAS APPROVED WITH A SPOUSAL VISA PETITION SO I COULD LEGALLY ENTER THE U.S SO THAT MEANS I AM NOT IN THE U.S YET. OUR CASE SHOULD HAVE BEEN  FORWARDED AUTOMATICALLY TO NVC FOR FURTHER VISA PROCESSING.
 
3. My husband called USCIS and NVC to ask for an update. At first he was told to wait. The next time he called he was told our case has already been reviewed and already forwarded to NVC. But when he called NVC, they said our case is not there yet. 
 
4. Our lawyer received a letter stating that our case was sent back TSC to be reviewed. Our lawyer said we will surely hear a response within 120 days. -- MY HUSBAND AND I WOULD LIKE TO INSIST THAT IT IS UNFAIR FOR US TO WAIT FOR (POTENTIALLY) SUCH A LONG TIME JUST BECAUSE USCIS MADE A MISTAKE IN SENDING THE WRONG NOTICE OF ACTION.
 
5. Our case should have been in NVC by now for further processing. We SHOULD NOT file for Adjustment of Status/Form I-824 for them to forward our case in NVC because I AM NOT (the beneficiary) IS NOT YET RESIDING AND HAVE NEVER BEEN IN THE U.S YET.

8 weeks is the longest. Yes you can call USCIS and NVC anytime you want to ask where your case is :) That's what I do these days too, calling them everyday. hehe :)

Approval is a case to case basis. Approval is not base on which country the beneficiary is from as far as I know. A lot has been approved last year month of December 2013 and this month January too. You might be able to get an approval this month. Just keep the faith and the patience. :) Approval lately is within 4-6 months from the NOA1.

Sorry for throwing a question about CFO. I realized you're still waiting for your Case Number.

As per VJ timeline, spousal visa approval's standard time is 8-14 mos. We're just on time, considering that a lot other members applied before us are still waiting for their NOA2's.

 

I am a Filipina but our case had been processed here in Thailand, since I work here.

 

You'll get there soon also.

Oh and about the CFO, you'll need to have it Fiance or Spouse. 

 

I had mine last year December because its a requirement for me to apply for the passport using my married name.
