According to your timeline, you applied over a year ago, and got your RFE in January 2013.  You are just getting denied now, 11 months after you received your RFE?

 

Is your fiance subject to the Adam Walsh Act?

Excuse me? no he is not. I met my fiancé June 2010 we filed the petition June 2012 our RFE was December 2013 by the time I got all my required evidence at this end and posted it to my fiancé it was January when he sent it.

I sent plane tickets, photos, conversations we have had since 2009, a copy of my divorce, a copy of my passport date stamped when I visited 2010. My fiancé had to get letters together from people supporting they had met and spent time with me, along with his copy of divorce. We did everything they asked for on the list. And yes we had met in person within the 2 years prior to the petition which worked out well when we filed as the law in NZ was I had to be separated 2 years before my divorce that was all finalized when my fiancé petitioned too. I realize we are not the first couple to get a denial and that it is probably a minor error on our part or USCIS, I just hope that it can be fixed or are we going to have to go through the whole process again from the start with a new petition

Seems like  maybe you didn't send in enough Primary Evidence? Photos, letters from family members and copies of conversations usually fall into the Secondary Evidence category. By themselves, they're not enough to prove that you have met within the 2 years prior to filling the petition...

I just hope its something small if that makes sense I would love to hear from anyone else who has been in this situation, I guess if we don't have options we will start the process over

May I ask what your RFE was for?

They wanted proof of our relationship I also had to send a copy of my passport stamped when I visited, my divorce and he had to send his as well. Photos we took when I visited letters from family supporting they had met me, copies of conversations. I hope it is just something small and we can fix it and be together, I have just come back from spending time with  him and we were so confident it was going to be approved

The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of December 2, 2013, please call customer service at 1-800-375-5283 for further assistance.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

Sorry to hear of your denial its a very frustrating thing to read, my fiancé and I received one in December ours was due to two letters from his family members that had to be redone and sent back unfortunately the letters did not arrive within the time frame they had requested and they denied us on lack of material evidence of our relationship. With Harpas advice and another VJ members we are refilling we have learnt a lot from this experience and this time round feel a lot more confident with our submission, good luck

I remember a member on here whose petition got denied because USCIS didn't receive a reply to an RFE that the USC initially never received - was that you?

Crossing fingers second time is the charm - good luck!

Our denial was around the same time as that, and thank you I have a good feeling this time round. We did not leave any stone unturned bonus was I made a trip there in October so we have fresher evidence

Well, when my fiance sent the petition he only sent the form I-129 and the check, nothing else.
Everybody said that we were going to be denied, but he got an intent to deny letter asking for all the evidence lacking, he sent and we were approved in 4 months.
We were lucky

Our last petition was stuck at Vermont filed June 2012 RFE Dec 2012 responded we were not one of the lucky ones to have ours transferred, in that RFE my fiancés family members had to write letters to say they had met me 2 members had not dated their letters it took Vermont till late July 2013 to contact him to say those 2 letters had to be re written and dated with a deadline to send them back. The letters made it but were a few days out of the date, that's what our denial was for not because we did not send in the proof they requested. So weren't you one of the lucky ones! Thanks for the input I've put that last petition behind me by the way

Yes we will have to go through the 5 months again but with the help of this site we have far more knowledge now of the process than we did when we first filed. Our denial was due to lack of material evidence for our relationship, two letters that family members of his had to re write and date that did not make it back to the service center on the required date.

Alot of us here are patiently waiting to receive the long awaited NOA2, and there is an unpleasant feeling knowing the members of this forum are stating they received theirs within 2 weeks, or in some other short term period within 2 months.  From what I heard, some people are just feeding their ego and lying about their NOA 2 date.  So I ask that if you're gonna write about receiving your NOA2 earlier than most members of this forum, to prove it by simply uploading a copy of your acceptance certificate (white out your important info).  This way, we can separate the egoists from the legitimate approvals.  Thank you :)

I got that from their website. recently. and the information you get on the phone very much depends on who you talk to. One told us, our case has been assigned to an officer for decision on may 16th and it would take 30-45 days. Next one says they have changed their policy and wont give any more information on RFE or where your case is at right now. It's a funny bunch of people working there dealing with our future :-) 

My fiancé called a few weeks ago expecting to be told they are processing Dec. No mention of Dec processing all the lady told him was you will get a letter in the mail

It's taken 7 days from posting the info to receiving the no2. It was a simple RFE they just needed the divorce decree from my guys first marriage. Good luck in a speedy reply wendy71, it's a real roller coaster getting a RFE , happy they have finally looked at your stuff then the worry of how much longer will this take, another wait.

Thank you ours was simple RFE as well thank goodness it will be a year October 13th since I was over in Tennessee on holiday with him fingers crossed i'm back there for our first Christmas together. Good luck with the rest of your journey wont be long and we will both be with our loved ones (L)

It never ceases to amaze me how many RFE's are issued for proof that was already sent to them.  I sure am glad we don't have to trust our money with these people.

 

The good news is, you can get a fast reply to them and a subsequent approval rather quickly after that.  You are very close.

I agree with you on the whole RFE its ridiculous lets just hope its a minor thing it would not surprise me if they want letters from friends and family of my fiancé saying they have met me something I was told not to include in our submission to USCIS. April 1st here and it's like a joke :( I haven't got transferred and still waiting, I feel like crying every time I open Igor's List and see April approvals on TSC, but then figure out they were transferred. :(

Yeah it sucks a little I have not really been spending a lot of time on here kinda stopped when I saw all the transfers, hang in there our times coming and who knows we could get our approvals before some of these transfers.

I'd say don't worry about it! I'm positive that CSC will approve you guys before recent filers. They have to work in order, according to NOA1 date. I was just joking! Hopefully we'll all get approvals and be with our loved ones :)

I need to believe that first part about a little glimmer of hope really badly. I just got a text message from my other half this morning and it was emotionally heart wrenching. Something has to change soon. Here's to hoping things are join to pick up at TSC soon. At this point I would be overjoyed with October!

I'm sorry that you got a text like that I had a pretty heart wrenching conversation with my fiancé on Skype yesterday, I last saw him November last year was suppose to be there till December but I had to come home due to my father passing away I told my fiancé I just want some good to start coming into my life. Not here...my guess is October...being hopeful. I'd prefer 5 months in September. Oh well, hours got cut at my work this month, so it'll give me more time to save money since my paychecks are unfortunately smaller...for a few weeks anyway.

There have been approvals for TSC the last few days not April though, so there is a little glimmer of hope. And sorry to hear your hours got cut chin up it will get better for all of us soon

Uhhuh. It's annoying & he's bragging. None of us want to hear it. It's not like he misread & did it once, it's constant & well...rude. We are all upset here knowing it's going so slow.

At least there is movement in January. Maybe they'll pick things up, but January has been trickling since June & there's still some December waiting. And then in another thread a guy was insistent that tsc was only taking 110 days. That's a bit over 3 months. If that were the case, half of March would be done by now. Ugh, I'm so impatient with this. I hope peoples contacts with media outlets helps...

Yeah I hope they can help too i'm still blown away at the response my fiancé got from the lady on the phone last week saying you will get a letter in the mail, really is that the best they can come up with now. I was also reading there have been members on here who have checked their case number on the website with no change but have received their NOA2 in the mail no text notification either to say its approved. Hang in there keep positive it wont be long and we will all be with our loved ones

It is crushing me. It's agonizing knowing it could be next year until he's here because tsc won't work on petitions. I'm going back AGAIN on august 15th for 9 days-using the last of my vacation time. Within a few weeks of getting back I'll be calling them. There's no reason for this that I can see except illegals (no offense to them) getting their cases pushed ahead of ours. There's no way CSC can process a case in two weeks where someone at tsc who's case is being looked at takes over a month. It's utter BS. So come September I will be contacting my senators & representative & calling on a daily basis until they look at my case. I'm a persistent little thing.

My fiancé bless him can sometimes let his low tolerance for patience take over he called USCIS today all they told him was he will receive a letter in the mail he said there was no mention made of what month they are processing. When he called back in April which was funny as he had misread what the NOA1 letter said they lady told him going by the info in front of her ours was moving rather quickly and we could be looking at August, I wont hold my breath on that if nothing has moved by late August I may just take a trip over

No approvals in TSC for the past two days!  :cry: At least not on Igor's List that I can see!


This whole process is very stressful my fiancé and I have had to refile the last being under VSC and we got caught up in their back log we were not fortunate to be transferred. Now we are with TSC and what do you know another back log I must say I have lost a little faith in the USCIS process. My last visit with him was 7 months ago we text and Skype everyday but its not the same as you guys are aware, I am considering making another trip its just the thought of leaving him behind again its too heart breaking

:) its very frustrating maybe people need to read the guides properly. I looked on Igors list at the TSC entries that's where I saw the mix up, I agree I hope too the ones getting approved are from TSC. Glad I took the advice of others and read up on the info properly

Ok...there is no such thing as a transfer from tsc to CSC. People think that because they mailed to Texas lockbox that they started at tsc. It wasn't transferred, just sorted out to go to CSC. That's why the timelines for tsc are so messed up...hopefully those being approved lately in dec. & jan really are from tsc.

I totally feel you. There is nothing that can console us seeing how lucky CSC filers are. I see that you contacted your Senators. What did they say? Same ####### about "5 months normal processing time?"

I'm not finding any of it accurate right now there are members who were with TSC transferred to CSC have put transfer but not bothered changing the service center part

I've come to a conclusion on some of this of course I could be wrong, it could be that not everyone who has filed with TSC is updating their timelines as they are getting their NOA2. I also read advice from a VJ member was to try not to follow your predicted adjudication date range too much as its really only a prediction last I looked on the USCIS site when it was updated May 3rd it was as at March 31st. Just trying to keep positive another thing to have you sent an e request they do say you can do them after 60 days I think
