Doing a little web research today I discovered that having my fiancee come here on a visitor visa while the K1 is processing, might not be the unrealistic thing that it once appears. Right now we are just about 100 days into our NOA2 process and in the April batch that is slowly working its way through the CSC system (no touches since april 24th :( ) It appears that the embassy in Manila has only a 10 day wait for processing DS156s. My thoughts were to have her file for a tourist visa to come here, spend a few weeks in the US and return there while we wait out the K1 process. She has a child there who would not be traveling with her so there's a pretty good anchor / reason for her to return.

This looks too good to be true, that we could be together again, even for a short while (i've already used up my vacation this year going to see her ;( )

So the question is .. what have I missed? Can this slow the K1 process up even for a millisecond or put it in jeopardy ?

We are trying right now. My love's interview is thursday .. we know the chances are slim and the cost for failure financially punitive (no refunds of any fees) sadly our "ties" are limited as she has nothing that isn't in her family name except her daughter which is enrolled in school. We read all the information everywhere, talked to attorneys and everyone agrees that we basically have a minimal chance, but there is always a chance. Looking outward, we have at least 4-6 months left to go (if you believe the VJ timelines) and I'm completely out of vacation except for 3 days which I have saved to be there during her interview or to go get her ... We've put a large package of circumstantial documentation together and I wrote a letter stating our intentions. We've been completely open about her plans to immigrate on a K1 and bring her daughter later.

In the end it came down to this .. we will never know if we don't try, and if we some how make it. somehow get to see each other again while this slow process unwinds, it was worth it .. if we don't .. then we at least tried, and if you don't try, you've already failed.


It all boils down to the interview, the mood of the officer, if he or she will believe our sincerity. Wish us luck, we will report back to VJ on Friday what happened.

Look there's really no point in all the speculation ... you have a lot of options to clear this. If he can't just hold the thing up to a web cam, he can scan the NOA1 in as a pdf and have him email it to you, you (two) are obviously competent enough in your computer skills to handle this. Same with the check. If you don't have a scanner a digital photo works, if you don't have a digital camera Kinkos (found in all the major cities in the US) will scan them both for a couple of bucks and hand him a cdrom with the images.

So deal with that. get past it one way or another but don't dwell on it as it will become more than it is quickly.

Next get the mystery out of your relationship and the trust back in it.. share everything, email, chats, etc. if your really going to be a couple, then end all the secrets now and work together. Above all, look/hear that other person and make sure thats the one you want to be with.

Well after much waiting, we finally got our RFE today .. Guess what .. its for stuff which was in the package already sent.

The lawyers responded by filling out the pretty blue forms, writing a letter to that effect, enclosing a copy of the documents under request (again) and off to the overnight postal envelope it went.

All well and good (except for the sound of my head beating the wall in frustrating)

So a couple of questions come to mind (and are tossed out to the opinions of all to chew on)

Since this was "initial materials" when they receive them (again) will they restart our clock as if we didn't send them the materials (yes we sent them, I used a digital camera and photographed each piece going into the package and you can clearly see the documents in question in the pile and going in the box)

and/or

Since USCIS made a mistake in the RFE is this grounds for an expedite under the "USCIS error" rules?

I am trying to get through the CSC, too...it seems between the time of March 1-4 (the previous update) and March 20 (the latest update), they STOPPED! The working dates are the SAME! I hope this doesn't imply they will be shipping the papers they have to yet another office! Oh Well. Has anybody seen this sort of thing?

:dance: Got the NOA 2 today! Its "Notice Date" is May 1, and according to the notice, the papers are now off to the National Visa Center!!! This all concerns papers starting at the Texas center (originally mailed February 21), then being forwarded to California.
I looked at the timeline here (Thanks everybody!) and it looks as if the papers will be forwarded to Bangkok in about 3 weeks!

You know, I still can hardly believe it. It's still a nebulous dream but the reality will be here so soon!
In fact, Jat was sure I was kidding when I called her! Nope, I would never joke about this! Wow!!! :dance:
So now we have an "A" number, and a real, working receipt number!!!

I think you can do well with the information posted on this site. The people here have been through all sorts of situations, and you can get a very good idea of the process. IF [VERY BIG IF] you have problems; RFEs, rejection for any reason; you can post here and get good informaiton. If you like, at that point maybe [again, VERY BIG MAYBE] you might decide to use an attorney. The process is very straightforward if complex. There are no secrets of how-to. Just follow the rules to excruciating detail, and you will be fine. Best of luck on your wonderful adventure!

How long does it generally take from the time of sending the forms DS-230 etc until the consulate schedules the interview? According to the timeline, it takes about 1.5 months for processing, but what about more specifically from the time the forms are sent by my fiancee to the consulate until they schedule an interview? I appreciate your advice on this matter. This is concerning the Thailand embassy.

What does the consulate REALLY need to schedule the interview? The form says to send only the DS-230, but later in the same document, she is told all forms must be with the consulate before the interview can be scheduled! Huh? Which is the truth? Thanks for the advice!

Do they contact the exwife who got you here at all? I always wondered about that. I mean God forbid my husband did something like this I would hope the USCIS would contact me to ask what really happened. If not they really need some revamping.

He came here from Egypt because he married a USC. He fell in love with a gril from Egypt while married (cough cough), divorced the USC as soon as he was able to petition legally for the Egyptian and now got approved. I would hope that this would have sent a huge red flag to the USCIS and that they would have contacted the ex to hear her side of the story but I guess that's just wishful thinking on my part. Sorry I'm b!tchy today and not politcally correct. This stuff just rubs me the wrong way.

Ok about me as some of you have asked! I am a true born texas girl but with a interesting twist. My father was from Lebanon and my mom is 100% pure Choctaw Indian. I do not speak Arabic but I know a bit. I was not born Muslim as my father was Orthodox. I was raised Catholic

I started this journey when I met my husband online in a chat program back on November of 2006. He is from Damanhour/Alex Egypt. Big red flags went off in my head and all I heard from my friends was that he must need you for a green card and people that look for mates online are a bunch of losers. I am not one to listen to others lol so I went to Egypt April 2007 for 1 month and met Kariem and his wonderful family. They welcomed me with open arms and the minute I saw them I knew I was at that very moment a member of the family. We had a engagement party with friends and family. Then my X popped back into the picture and being the self destructive girl I was at the time went back to him for a short time. Lots of tears and pain, Kariem and I found our way back together again. I went back to Egypt in September of 2007 for one month. I am horrible with keeping up with dates as some of you gals do but I filed for K1 in July 2007 and he came here May 2008 and we are in AOS.
We have a great life together and I love him with everything I have inside of me. He is my special angel and I have never met anyone so kind and good in my whole life. Sometimes I pinch myself to make sure its real that this is my life now.

For sure life is not all butter fly kisses but its dang near! Before he came here I broke it down that life here is not easy as you have been told. We all work extremely hard for what we want and get out of life blam blam blam. I think I painted it a bit dark, I actually scared him and he told me just last week, homara (his pet name for me) we live like we are rock stars. I was like huh? He said yes I thought I would be living in a so bad place and not have anything we have it all! You and Me! That just melted my heart. He has been extremely lucky. He got to work right from the start in his field. I have a friend from Palestine that gave him an apprenticeship at his company. Not only has this helped with him not getting bored but he has met so many different types people but he get to go to the mosque every Friday since his boss is Muslim!

I have been around for almost 2 years but as a lurker. Please do not start throwing shoes at me for not participating. I have read and learned many things from you ladies of information. Really I am at complete awe of how you have opened your private life and put it here on such a public forum. I have watched as you have cried for each other, gave money when other Mena girls was in a time of need, I even saw you girls hold each other when you lost one of your beloved sister members. I have seen fighting and bickering just like one big family! With all of this said I am so happy that I have lurked and learned from a wonderful bunch of gals and one dude!

My reason for not posting and joining sooner was due to a member that was very hurtful to me and my husband. We knew her on a personal level as she is married to one of my husbands best friends. If she had known any of our progress she would have tried to destroy what we worked so hard to build. She is not very active these days so I feel like expressing myself now!

Hamdy, this is what I do not get. I have been through this process and it does'nt happen that way. So I would suggest that you wait until you get the actually letter from the embassy.

I suspect that you have not filed yet and you are guessing or your visiting VJ to start some issues. If I am wrong please accept my appology. If I am right be careful we have amazing modorators here that will not accept problems. Good luck.

Sounds like you have things under control now, but I'm wondering what you mean by "he was not included on the first application".

I do hope that you listed both of your wife's children (and yourself) at item C.17, where you are instructed to list the benficiary's spouse and all of their children. This does not have anything to do with whether or not those children (or you) will also apply for a visa.

Yes I listed both on the origional application but did not show them to be immigrating. I did list all that I knew to list. Sorry for the late message I have been out today. I will file the I-864 with gross income for last year. I think I have finally figured out what is required for the household. No I do not pay alimony to the ex wife. It is not allowed in this state. I only pay child support for the 2 kids. Do I still show them as a member of the household listing? So I do not show my current wife's children on the form. What confuses me is that one place tells me I can file an i-129F for the 18 year old son of my wife and others say only the I-130 can be filed by me or the wife. I need to understand this because she tells me I should file the I-129F and I did not think I could since the son is not a step child because he turned 18 before we married. The income I uderstood was to be my gross salary for 06 and w2's for any previous year I wish to send. Thanks for the help Yodrak.

I-864 asks for income in two ways - current and past as reported to IRS. For current income take your base pay from your most recent pay statement and express it as an annualized figure. For past use Line 22 on the form 1040 (unless perhaps you've had foreign-earned income excluded).

You do not show your wife's children as household members on the I-864. Do you pay the ex-wife alimony?

If any of your wife's sons will want to join her in the future she will have to petition for them using form I-130. You cannot petition for them, they are not your stepchildren for immigration purposes.

What confuses me is that one place tells me I can file an i-129F for the 18 year old son of my wife and others say only the I-130 can be filed by me or the wife. I need to understand this because she tells me I should file the I-129F and I did not think I could since the son is not a step child because he turned 18 before we married. The income I uderstood was to be my gross salary for 06 and w2's for any previous year I wish to send. Thanks for the help Yodrak.

I know I count her as part of the household but dont know how to handle the children. I am divorced live alone and pay child support only for 2 kinds one almost 18 in 5 months and one 15. I married a woman from Belarus and she has 2 children One 18 and one 25. We married after the youngest turned 18. We married in September of last year. I need to get this back to them as quick as possible. If you could give me some guidence that would be greatly appreciated. My name is Chase and I live in Texas. Hello, Chase. You list gross income. As for the household size, you list both your own children as you pay child support for them right now even though it may end soon for one of them. About your wife's children - where are they now and if they're not in the US, will they be immigrating with your wife? Her children will only be included in the household size if they will be immigrating with her or if they are already in the US and you and your wife could claim them as dependents for tax return purposes. Does that make sense?


Pretty close but the ability to claim them for tax return purposes has nothing to do with whether they are included in the household. If they are immigrating, you count them.

I am processing now an I-130 and I have a question on if and how to bring her son's. I know when the ds-230 is filled it asks if there will be someone to come with her. One son is 25 and the other is 18 and he turned 18 before we married. I was wondering what is involved in now bringing the 18 not 19 year old over here as well. Will his mother have to fill an I-130 for him and can she do this before receiving her immigration visa and or green card. Any help with this matter would be greatly appreciated.

Your wife can file for the 25 year old son after she is a permanent resident (after US entry on an immigrant visa or having adjusted status on a non-immigrant visa) but it will take several years. The 18 year old is in the same boat but there is a way to get him here with her. You would file I-129F using the "for a spouse" instructions. When the wife is awarded a K3 visa the younger son can have a K4 visa. There are some additional complications after arrival you'll want to study up on or review with an attorney but at least he can come. If you don't go the K3 route both sons are in the same boat.


I have already applied for the immigration visa for their mother. It I hope will be approved before to long. Her youngest son will turn 19 next month. I was trying to see if there was any way to allow him to come when she is approved. Or what will be involved later in bringing them over here. I thank you for your quick reply to the first message. I am trying to learn all possible ways to bring them here. I thought maybe for the youngest since he is in college to see if could get a transfer that way. The oldest I know will have to be done differently. Thanks again for your help.
