I don't think the lawyer will help much there, I think its a matter of they won't blow you off as it gets witnessed by someone who if they complain gets paid more attention to than just any old random person.

The real reason I hired a lawyer (outside of checking our paper work and being present at the POE to represent my angel in case something happens) is to have one more person to complain too that at least has to have the pretense of doing something.

They are not infallible though, just a second set of (hopefully better educated) eyes. After all the filings and papers we did, it was reading here on VJ that lead me to find out that we need a police clearance from japan (where she once worked) at the interview. My lawyer who is ranked very high in the state (and by far not the cheapest) didn't know this was a requirement, but once I read it here, they were able to do the research and confirm it.

You should consider them an extra resource, but they are no substitute for your own mind, nor your own research.

Called CSC today, with my lawyer, spoke to the lady with the indian sounding accent others have reported talking to, she said "Your case is already with the officer and you should have a decision today" She was very pleasant to us, I suspect having an attorney on the line makes for better conversation.


Here's hoping she's accurate, this wait is killing us.

Sorry buddy..most of us here, if not all, know before we all have filed for this type of petition that we have made plans and have expected dates to have your SO here. Like we all have a good idea that it takes atleast 6-8 months from filing to the arrival of SO here in the US. Unfortunately there are some that have to go through the hard way by waiting longer. Not everyone gets through this journey smoothly like most others have. I filed back in March and after 5 months got an RFE instead of a NOA2, which I can understand. But after the case has resumed it is still taking a lot of time even though for the fact that officers work on RFE first thing when they get to work. I have also searched some members here that had a RFE and took just days or a couple of weeks to get their NOA2. So you see, me and my fiancee are just having it the hard way, unfortunately. I'm already waiting 6 months for my NOA2 to come and I am aware as well that another 3-4 months before she gets here. NVC, medical, interview.. etc.. because of the wait that we are going through we have to keep pushing things back. I am very happy for those that had gone through this process the way it's suppose to be, withouth the extra long wait. A little encouragement wouldn't hurt and would be greatly appreciated. I was really expecting her to be hear around October because her birthday is in that month, or atleast before the end of the year. Well, I guess I go back and just keep waiting and praying. Thanks for those who have given me their understanding and encouragements.



I wonder if there is a specific issue around south asian or the philippines, seems like either there is a lot of us with filipino wives and/or fiancées that are lagging behind the curve.

Like yourselves, we made plans based on the trends, only to have them squashed by this process. Now we wait. Lonely for each other on both sides of the planet. Separated by a process that we neither control, nor have insight into.

However we had no say in its implementation, it was enacted without a vote, without a referendum and very little public oversight for what, in my opinion, should be a *very* publicly visible process.

I'm sure the people in USCIS are doing the jobs the best they can, but their management needs a house cleaning.

DHL Global is very reliable and Phil customs does not open or examine the contents. Other carriers are subject to phil customs opening at least that is the info I got from a friend that runs a postal store and ships worldwide for his customers.

I used DHL to send my wife documentation for her interview and it was couriered right to her door step and I was able to track it the entire time.


hi guys n gals, would anyone be able to provide me with experience with mailing stuff (ie: documents) over to do Phils, cause I use US postal service, usually when I send documents I have no trouble but about 45% of the time he doesnt get it, and I need to send copies of stuff over there for interview ,anyone use another service? Also , for the interview does he need original items; ie cards he sent me, and vice versa? Do I need to send original paystubs? Thanks!

Ron, don't sweat that. My wife's approved packet had a corner ripped off. The important thing is that the sealed bag it is in stays closed. POE officer will open it to stamp a couple of pages. Our POE officer ripped the thing open fast to get to the pages he wanted to stamp, it was really a 2 minute process and your on your way.

I know this process makes a normal person paranoid but you are ok as long as it is still in the plastic bag sealed.

so they say dont ever try to open the visa packet... i did not!!! however there's a torn on my packet which i've read a torn packet will EXPERIENCE A SIGNIFICANT DELAY... so by looking at the picture, should it be adviceable for me to go to embassy and have it resealed again??? im really in the stage of paranoia right now (as always)... hope you can help me ease my mind on what to do... thanks!!! The POE was a simple 2 minute stand at the window get a few stamps and hand them the sealed envelope. We are both jet lagged but very happy to be home together. It was the first time I have flown home from the Phils without feeling so depressed ;-)

My wife went to the CFO in Manila today and said it was very unorganized and had very long waits compared to the one in Cebu City where she attended her seminar. She just went today to get the stamp in her passport so she could travel back with me on the 27th. After a 3 hour wait she received her stamp no questions asked.

I am headed to the Phils Monday Am to spend Christmas with her in Cebu and we are flying back to the US Dec 27th.

:protest: PW, it is not that those of us in AR did not have our documents ready it is that the consul wanted to verify one of our documents with the nso. Every time I see someone post like this I just cringe. A document check can and will happen randomly to cases. In talking to the embassy every day Lorrain admitted to me that the embassy lost some paperwork they ordered before our interview which leaves me scratching my head. They tell us to gather up cenomars, bc, mc, nbi but then they go ahead and order duplicates to check and throw people into AR and a lot of times they don't order up duplicates until after the embassy. They batch those requests which can take 4 to 6 weeks. A bit of advice, if your fiance/wife gets AR have her ask if she can carry a copy from NSO to the embassy, this may take time off of a document review related AR.

cybernutguy, I hate to say this but I am offended by your comment. If you read my post carefuly, never did I say that those in AR were not ready with their documents. And I quote my actual post:

Take note of the reasons for AR ~ birth certificate, Cenomar, divorce decree ~ so let us make sure our documents are in order.

I am sure that all of us spent many months and hours preparing and poring over our documents. But regardless, we all know that even if everything is in order, the embassy can still put anybody in AR. However, the chance of being put in AR "may" be minimized if documents are in order (e.g. they are current, they are NSO-issued, annulment decrees are certified true copies with embossed seal and not just photocopies, etc. etc.). We've heard of ladies appearing for their interview without photos attached to their visa applications and without the I-134. So what is wrong about reminding people to make sure that their documents are in order that it makes you cringe?

:protest: PW, it is not that those of us in AR did not have our documents ready it is that the consul wanted to verify one of our documents with the nso. Every time I see someone post like this I just cringe. A document check can and will happen randomly to cases. In talking to the embassy every day Lorrain admitted to me that the embassy lost some paperwork they ordered before our interview which leaves me scratching my head. They tell us to gather up cenomars, bc, mc, nbi but then they go ahead and order duplicates to check and throw people into AR and a lot of times they don't order up duplicates until after the embassy. They batch those requests which can take 4 to 6 weeks. A bit of advice, if your fiance/wife gets AR have her ask if she can carry a copy from NSO to the embassy, this may take time off of a document review related AR.

I am reading all these depressed posts, and feeling for everyone, and what really chaps my butt is that the Immigrant Visa Unit could very easily publish a helpful tips list: I am betting that 8 out of 10 AR causes are virtually identical. The pre-screeners and consular officers see upwards of what, 200 per day (guessing here, whatever...) and they probably just glance at the attachments and mentally think "Hmm.. this one's ripe for an AR"... why not just publish the damn list?

The other thing that really steams me up is that every poor anguished soul sitting in the waiting area represents upwards of $100 revenue to the IV unit. In the case of CR1/IR1 it is $380 per backside! For What??? In my case, even though successful (I hope, not yet got the visa in hand), they had lost the medical results and the original DS230I, and kept asking us for them as if it was our responsibility to find them. I wonder what exactly the $380 is supposed to pay for? That is in addition to the $190 for the CIS to rummage around in your I130 information. And in our case, they too lost important paperwork never to be recovered. Damn, I'm getting all steamed up and we were successful!! You poor folks on AR must be just desperate! I am so sorry...


Just a speed bump for those of us on the AR $hitlist. We've done everything we can, I call and speak with Suzy or Lorrain every day at the embassy. She tells me our case is with the consul officer who interviewed my wife and as soon as she reviews the additional cso birth certificated added by my wife Nov 29th it will be released to debros.

I would follow others advice and leave it alone. If I had known my wife 6 years ago when she corrected her fathers middle name on the bc I would have had her leave it alone oh well.

We really need help. I am on K1. My interview will be next month we just noticed that on my birth certificate from NSO, my father's first name is mispelled instead of lorenZo it is lorenSo. We're still going to LCR to have this corrected but i understand this will take time and we have 2 months to go.Anyone have the same case or any input on this?

It is much better that you DON"T correct it. Just leave it the way it is. A correction on your BC is more likely to get you AR than a misspelled name of your father. At least your birth certificate remains unchanged and original, and hopefully not late registered. At least it is authentic.

There has already been one case of AR because the BC was changed to reflect the correct spelling of the father's first name.

Panicked, if you have spent time with her it would be a good idea to visit your doctor and get a chest xray and screening. TB is highly contagious and communicable. You can be a carrier and pass it along to your family if you are infected. Also have her family get treatment.

I worked as a medic through college and they were always screening us for this.

[size=4]My fiancé failed her medical exam, what happens now? (K-1)

[size=1]St. Lukes discovered that she had active TB! She is undergoing treatment and will not be eligible for her interview in 6 months. No one knew of her aliment until she went to the medical exam, about a week early. St Lukes told her that they canceled the interview, for now. She is curable, doing the traement etc. We think she may have gotten infected when Luzon was struck by typhoons earlier this year.

I called the embassy and they said that I need to fax them some basic information (case number, etc) and that I must sign it, to show that I am not abandoning the petition. Needless to say, I am sticking it out with her for the long haul. She did not attend the interview because she was told not too. When I called the embassy, they said that it is proper but that she is 'showing' as a no-show. (hence why I ned to send the fax)


1. When she gets the 'OK' from St. Lukes, how do we get a her a new interview?

2. Will she have to get a new NSO birth certificate, in addition to a new NBI clearance? I am sure that I will
have to send her a new ITR, but is there anything else that she will need to get?

3. Does any one have any suggestions about what we should be doing, besides sitting on our hands,
crying?

UPDATE:

My wife returned to the embassy on 29th at 1PM and submitted another copy of her bc at window 17. The filipino pulled her case on the computer and then asked her why she was back. She showed her letter and then produced the nso copy of her bc she had picked up earlier that day from nso in Quezon city. The man then told her your case is approved the document review has been removed by the consul. Go home and wait for delivery of your visa.

My wife was very happy but I am cautious and won't beleive it until she has visa in hand. She is in Makati City with aunt and the man told her 2 days for debros delivery. I will beleive it when she calls me and has visa in hand.

Meanwhile I will be calling embassy on a daily basis when they reopen Monday to check status. I will be relentless until I "see" a result.

Lilia will order one additional copy (other than the one she currently has) from NSO on NSO paper in unopened NSO envelope. Hopefully, the one mailed from NSO will find its way to our file prior to the interview. We will have one additional copy from NSO in unopened envelope from NSO PLUS the one she already has in her file. I will also attend the interview. These are all the measures I can think of to head off what appears to be almost automatic AR.

I wonder why the consul ask your girl to have another copy of her BC from NSO. What was wrong with the BC that she brought during her interview? when did she order a copy of her BC from NSO before interview date? I just wonder if the consul would want the latest date of the requested copy of the BC in security paper from NSO. I also wonder if that's the case with the CENOMAR coz I ordered 2 copies of BC and 1 CENOMAR last August and Im thinking of ordering new copies by January before my interview so I will have the latest copies. Just taking some measures as Robhankins said.
By the way, my BC is also registered late. I was born Dec 1972 but my BC's date of registration which was received by the local civil registrar was Aug 1973. On the other hand, it doesnt have any comment that it was late registered. Honestly, Im getting worried also about my BC. But someone said that it wasnt much a big deal coz my BC was only few months registered late and not years. i just have to bring back up documents like school records and employment ID or any documents that would help proved my identity.

The "Name check" was completed on Monday the 27th! The consul approved the visa on the 28th, and today we checked Delbros and saw the following messages:

The wife carried a new nso bc up to window 17 at the embassy today. They told her the visa will be released to debros as soon as the consulate finishes reviewing the document. My wife said it is exactly like the first one she took to interview just a bit cleaner without wrinkles coming directly from NSO Quezon City.

I was impressed my wife was able to get another copy from NSO within 24 hours, I'm so proud of her.

I thought what if you were to take that nso copy and have a large poster board of it printed up? Maybe a 3 foot by 3 foot, can you imagine the looks on their face if the girls come carrying that into the interview ;-)

More waiting. ;-)

Rob, that stamp is just like the one on my wife's bc that got us an AR. She produced another paper along it that were signed authorizing the change but they still wanted another copy from NSO. Maybe if you go into that interview with enough NSO copies the consul will have a heart.

I wanted to post regarding our AR because of an amended bc on NSO paper issued by NSO to my wife. I called and spoke with the embassy this morning and they told me my wife just needed to provide another NSO copy of her bc because the consulate officer was not happy with the copy she provided in the interview, no reason given just wasn't satisfied with it.

My wife went to the NSO office in Quezon City today and she will pick up another copy of her bc at 10am tomorrow morning. She was instructed by the consular officer to bring the new bc to the embassy at 1pm tomorrow. The part that gets me is, the embassy will still take 4 to 6 weeks to complete their internal investigation where they may request their own copy of the bc from the nso to complete their review. Embassy said once the review is completed they will release the visa to delbros for delivery. Now we are back to playing timeline games and my wife is going to live with her aunt in Makati city and wait on delivery or a letter from embassy because she beleives the visa will be released in a matter of days. She said the consulate officer (lady) was very nice and smiled and laughed with her then stuck it to us..ha

We did this by the book, paperwork was perfect, it just blew up in our face over her father's name being changed several years ago on the bc. If I had any advice I would say to include a visit during the medical to the NSO office in Quezon City to request several copies of your BC, CENOMAR and/or marriage certificate so that your wife/fiance can pull extra nso copies out if her bc or any other document is challenged. In the end, if they want to put you into AR, it is their perogative.

You can also request by web, pay with cc and have it delivered in 9 to 12 days locally according to their site.

There is a sticker with a few stamps with signatures from CSO indicated on it by the corrections.

My wife seems a bit more upbeat about this than I. She acted so matter a fact about it and said the consulate officer told her that her visa is approved and to go pay the delbros but that the visa would not be released for delivery until she returned to the embassy with the duplicate copy from the NSO. I guess from all the reading I have done I know it can take 4 to 6 weeks to get an NSO document. My wife is from cebu but staying with family in Makati City and is determined to stay there and go after nso for another copy of the bc.

I went ahead and paid $20 from the NSO website to have another copy couriered to her aunt's house, 3 days to process request and 9 days to deliver the document according to the receipt after submitting my request.

How are these "corrections" done on the BC? Handwritten or what? How do they know it's corrected or amended?

Yes NSO security paper and all. Consulate Officer told her due to high fraud to changed birth certificates any amended birth certificates need to be verfied by requesting a copy from the NSO. I've requested online and wife is there in person now.

What kills me is it was a typo on her fathers first name Manual instead of Manuel, and her birth cert on nso had the correction stamps and seals.

Guess an amended birth certificate is an automatic AR

garya i believe your fiance is from CDO right? i got my BC here at the NSO CDO. and of course i believe all BC coming from the NSO itself is all being done and printed with their security paper. an NSO seal on the top left side, a barcode and serial no#'s on the bottom left side, printed name and signature by the Administrator and Civil Registar on the bottom right side. (i wish i could scan it for u but my scanner wont scan if one of the ink is empty)... but if u really want to make it sure, have ur fiancee go to the NSO office (easy to reach if your from CDO), or have her call the local office and ask if all security paper are the same regardless on where u requested ur BC... :thumbs: i wana hear what's the final verdict too! lol

Wife called, the consulate officer gave her a form and told her that since her birthcertificate has been corrected that they need another copy from NSO. Gave her instructions to report to NSO for another copy and come back to embassy. She was asked to pay delbros.

All because her father's first middle name was misspelled on her original birth certificate and was corrected with the nso several years ago.

oh well...I'm numb at this point.


I am climbing the walls nervously waiting a call from my wife. She is at the embassy doing interview today. I hope to have some good news later this evening!

All these months of waiting, paperwork, fees comes down to a 2 or 3 minute interview with a consulate officer...
