Hi. I just sent our I-129F off today and thought I'd kick it off for the November crowd. My fiance left the US and I'm already going crazy waiting for him to be back here, but it sounds like I've got to get used to the idea of being a bit lonely for several months yet.

I'm a new member to VJ; this is a great site with tons of information. I have a case of my own and I'm a bit worried about the status of my case. I filed a 129f petition for my Macedonian Fiance on 28 Oct 2009. I received the NOA1 email notification on 2 Nov 2009. I have not heard anything since then and according to the USCIS website, my case has not been "touched" since then. I keep seeing spreadsheets on this board with different cases soarted by the date the NOA1 was received. Does anybody on this board has a NOA1 received date of 2 Nov 2009, and a spreadsheet showing the cases showing NOA1 received on 2 Nov 2009. It's been over 100 days since my NOA1 was received and i hope my NOA2 comes soon. Any info is greatly appreciated.

Anyone else out there a November 2009 California K1 filer?

We just sent our K1 on Friday (11/6) via USPS priority. Looks like the processing times for both Vermont and California are trending downward... VJ's best guess right now is USCIS adjudication sometime around the end of January.

I'm hoping to have visa in hand sometime around the middle/end of March. It's probably a terrible idea to try to plan a wedding/honeymoon when the dates are still up in the air, but it's really tempting, especially since prices are likely to climb as the time gets closer and places fill up...

Not all Clerk's use the old-fashioned embossing device.

USCIS understands this.



NVC just sent my case to the Consulate (Skopje Macedonia) and i was reading this post, i decided to to check my divorce decree. (Texas does not give divorce certificates).

My final decree has a stamp and a signature from the judge and court house. My only concern is my signature, my ex-wife's signature and my attorney's signature are not the original signatures. I was overseas when my divorce took place and my attorney emailed me and my ex-wife all the documents, we signed them and emailed back to her (attorney)so when she finally put the final decree together all she had was copies of the documents with signatures. The judge's signature and the courthouse stamp/seal are original. Please advice me if you think this is going to be OK or not. By the way, I'm still overseas and it's going to be very difficult to obtain another copy of the decree with all original signatues.

Ou all this is tnx to you, i just followed your advice. You were right, people here are open and they all want to help in any way they can so i am very thankful to everyone :) Once my fiancé and i start gathering the documents that we need for the K1 process we will have many more questions, but we will cross that bridge when we get there ;) Step by step! The first question we had and which honestly really scared us seems to be answered in our favor. Its a nice start.

Some are more alike then others, but the bottom line is the same, you have to try and hope that everything goes well. I just really dont want to be denied at the entry, that would be a killer ...

You came to the right place, the people here are full of good info....I guess i was right, you can still visit your Fiance with your tourist visa until you receive the K1 visa...I'm sure the Consular Officer (CO) of the Imigration Office (IO)will cancel your tourisst visa once you start using your k1 visa...good luck.....by the way my wife's case took another step forward today...yessssssssssssss..... :dance: :dance: :dance: :dance:

ChinaPolice Certificates for DS-230/OF-169?

Hey everyone,

Just got my first NOA (!!) back and am working on filling out the DS-230/OF-169 forms. I'm filing out of Guangzhou, China for my Chinese wife.

In the packet, they list police certificates as one of the required forms. I was wondering if anyone here had any experience acquiring said certificates from Chinese or other foreign authorities? My wife's parents went to their local police station and they said that they needed a direct request from the US Embassy, which seems strange. Has anyone else done this?

My wife, in Guangzhou, just got her police certificate. There was no request needed from the US Embassy. She is in the Yue Xiu district, don't think it should be different in yours.

Update on this case. After I called on September 10, I received a letter int the mail, stating that the petition has now been upgraded to reflect my naturalization status. Yay!!.

I hope things go now quicker.

Just called them, they told me to give me a response within 15 days. I have a hunch. Since I filed as a permanent resident initially, then became a USC in 3/12 afterwards and we reported the status change.

Time line for USC is 5 months, for PR is 9+ months. I believe they did not move my case into the USC queue and left in the PR queue which is much slower.

Married in August 2011, filed I-130 for both my wife and my daughter the I-130 petition in January 18, 2012. Received NOA1 1/19/12. Since then the status is keeping on "Initial Review"

I see on the forum, that other people receive the NOA2 within 5 months, so it drives all of us crazy that it is 8 months now that nothing happened. Any other wait that long?

My advice is, don't rush it if you don't need to. I have been through a series of crazy relationships before finding my wife. Truth is, that in the beginning all seems more ok, but after a while the real person comes out. Some other have more luck, a friend of mine found his wife also online, met quickly and then got married on K1. They are now married 8 years.

Issue is, you just don't know what person you meet. I learned, that if there is just the slightest sign of doubt, better move on. Thats actually also true the other way around. My wife best friend (also chinese girl) had a few western prospectives. Some of them also turned also out to be crazy. She kept on searching and found her husband where they live together now and expect their first child.

Your heart had been ripped out, but better now then later when its too late.

ChinaScheduling an interview date

Hello all,

My fiancee and I recently received our NOA2. We are glad to have some movement on our case after waiting patiently for 6 months.

My question is concerning the visa interview. My fiancee cannot come to the USA until she has fulfilled a 2 year residency restriction in China, which will expire February 9th. I have been trying to time this all properly but it seems like everything may be going a little faster at the consulate than the Guangzhou website states.

I was wondering if, when sending in packet 3, anyone has had luck in asking for an interview AFTER a certain date. I know that one can't ask for a particular interview date, but if it is scheduled before Feb. 9th the visa will be denied because the 2 year restriction hasn't been completed.

Another option may be to try to get the interview asap and then reschedule.

Does anybody have any thoughts/advice about my dilemma?

Oh, one other quick question since I'm asking....does my fiancee have to fill out the medical forms in Packet 4, or does the doctor do that during the medical examination?

What is the 2 year residency restriction? I have never heard of it. My wife is also in Guangzhou, so I am naturally interested to hear about it.

My wife had her interview on Friday 27th in Guangzhou together with our daughter. Process was very smoothly, its off to pack the bag. The whole process was almost 2 years, but happy to get through the finish line. I put my wife's review out below. The only thing I am upset about is that she drools about the "handsome blond foreigner VO", oh well

I just read, NOIR is the Notice of Intent of Revocation. Used when USCIS has previously approved and immigration visa petition and now is revoking it.

If a DOS (Department consular officer) discovers during the course of a visa interview that the underlying petition should not have been approved, or is no longer approvable, the petition may be referred back to USCIS. In such cases, the returned petition should be accompanied by a memorandum explaining the reasons the approved petition should be revoked.

I was told by someone that with the green card granted to beneficiaries, the right to work in the US is included. But then I saw some information about immigrants needing to apply for a work permit so now I'm confused. My wife will be arriving on a CR1 visa in a month or two (fingers crossed) from Vietnam. Do we need to file additional paperwork for her to get a work visa or not? Thanks

The GC is the work permit. No additional work visa needed. Just need to have a SSN as well, but thats only a formal application at the local SSA.

IRS and USCIS are not related to each other, have different rules of what is a household. I also pay child support, IRS says not dependent, but needed to mention in USCIS forms.

That sounds normal. It just had been a little over 2 months, right? There won't be any status update online until NOA2. The goal normally for CR-1 is 5-6 months.

Look at the bright side, every day that goes by without an RFE is a good day. Usually the RFE come early in the process.

Interesting, I had a tax accountant doing my taxes last year. As my wife never lived in the US and also does not have a SSN or TIN, he told me to file as single.

Hi!

I received a letter on January 23rd stating that petition has been approved, and that it will be forwarded to the US Embassy within several weeks.

How long will it take for the US Embassy in Vietnam to mail my fiancee the interview packet/next steps?

It's been 2.5 months and nothing yet, so we're getting nervous.

Should I contact the Embassy directly?

Hi,

My fiance has filed K1 I-129f petition for me.

She recently received this mail

"Current Status: This case has been received from the State Department with a request we review it.

.... a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our custome..."

She received NOA2 for approved petition like 20 days back and today she got above mail.

Does anyone know what this mail means? What should we do?
