Hey all,

 

I am getting things ready for the i-134 and I am having some problems with getting a transcript from my bank. (I live in Texas now and there is no US Bank here)

 

I have ordered the tax transcript already and have a letter from my employer stating my yearly gross salary. Will that be enough or do I need to have the transcript from my bank? Is it ok to send her copies or does she need the originals?

 

Also, once we have a definite answer to this it should be stickied! So many people are asking about it.

I am just getting down to dotting my i's and crossing the t's of my initial K1 application and i am wondering about the alien registration number. my fiancé is British but has been working on a C1D visa as a crew member so she also has an i95 but we cant find an A number on either? Are these only issued for certain visas or should she have one? If not do I just leave that section blank?

I have recently got my passport and the yellow immigration packet, I was told to pay the immigration fees online of USD 165 before my entry into the US and for that I should have my DOS case number and A number.

Now my query is that I do have the DOS case number but I havent been assigned with any A number, only A number I got is the onw which is on my NOA 2 but when I attempt tp submit my information on the USCIS ELIS site - it says that the number is invalid.

 

Please help where should I get my A number from? urgent feedback required please.

 

Another question is that - I haaver been issued a K1 visa and thinking to have all the vaccination in prior from my home country which will be required for changing my status there - any suggestion wchich vaccinations will be required at the time of getting the greencard and will it OK if I get my vaccinations done from my home country and take a vaccination report to the US.

The trouble is, our interview is four days after yours.  We don't have time to change the BC.  We have to explain that her father was unknown to her, that she didn't know about or authorize the change, and hope for the best.

 

Fortunately, we haven't gotten the visa yet - so a reissue won't be necessary.  However, I am worried about a delay in processing - or worse, an outright refusal.

While getting the necessary paperwork together to prepare for our October 29, 2013 interview in Tegucigalpa, Honduras, my fiancee discovered something interesting.

 

Her "father" - whom she did not know, and who was not originally listed on her birth certificate, seems to have "recognized" her as his daughter in 2010, while she was living in Europe.

 

She now has an additional last name - and a new listing under the paternal side of her certificate - two things that are NOT on our USCIS application (because we didn't know!)

 

All of her other documentation - including passport, national ID and the Birth Certificate she left the country with in 2008 (which does not include an entry in the paternal fields), are all under the name we used to file our application.

 

We've gone to a lawyer and gotten a document that was approved by the Corte Suprema which essentially states that "this person with these four names is the same as this person with these three."

 

However, is this enough?  She is filing a petition to remove the additional last name, but that will take six months to process, and her interview is in three weeks.

Any suggestions?

You may find the Packet IV from your embassy of choice outdated.  The Tegucigalpa packet also said DS-260, but immigration services are moving towards the DS-160, which is a combination of five different forms.

 

My advice - contact your embassy to make absolutely sure.  My bet - the DS-160 will be their ask.

That will get you the clear and direct answer that the visa cannot be extended. If you wanted the child to come later, you should have obtained the child's visa on a follow to join basis. The visa then could be issued up to a year after the parent's visa was issued. You could ask the IV unit about reissuing the visa, but I doubt they will. They won't extend but if they also won't reissue (also unlikely) then your option is to have the child come to the USA to live BEFORE the visa expires, OR the US citizen can file an I-130 for the step child and obtain a CR2 visa in about 8 to 10 months from filing.

I submitted my welcome letter which included my date of hire, my salary and my position. Remember, an employment letter is not required, but your employer should be able to provide one on company letterhead. What they really look at is the tax transcripts.


This is misleading. Tax transcripts or tax returns are for documenting past income. Employer letters and/or pay stubs are for documenting current income. One does not substitute for the other. The only time tax data documents current income is when the sponsor is self employed.

Personally, I prefer using a current pay stub, instead of an employer letter, for documenting current income.

The K1 is issued as approval to "enter the USA for 90 days" for the purpose of marrying the petitioner in the USA during the 90 days and also provides the basis for adjusting status to permanent resident provided the terms of the visa are complied with. Visas are used to "enter" countries.

It is definitely not "approval to marry" and no such approval is needed from USCIS or the US Dept. of State. (The US Government agencies associated with obtaining a K1 visa)

Approval (license) to marry is obtained a local government authority in the USA AFTER and only AFTER the K1 visa holder enters the USA. Approval to marry in any other country is obtained through a government agency in that country. Visas are used to "enter" countries. Visas are not required for marriage in the USA, as long as you are already here. It happens all the time.

A couple can marry without a visa. Most couples do marry without a visa. They can marry abroad, or they can even marry inside the US. True, for some couples, getting INTO the US without a visa could present a problem, and in some cases might or might not involve breaking a law or two that might or might not cause serious immigration difficulties, but it wouldn't cause difficulties in getting married.


Great explanation. On a more basic note, "visas" are for entering countries. Citizens of some countries don't need visas to enter the USA. If you are in the USA legally or not, permission to marry requires a marriage license issued by a State, usually through a County officer. If you can properly identify yourself and are otherwise free to marry, you can obtain the license and marry.

The K1 visa is a specific kind of visa used to not only enter the USA but after entry and marriage, the foreigner is provided a legal path to

Hi Dr. Pepper: I hope you are managing well under the stress of all these replies, some of them not so nice, huh?

My fiance and I will be getting married out of the country. We are both Catholic and when he arrives with his K-1 Visa this summer, we will get married in jeans and t-shirts in front of a judge just to satisfy the legal requirements. We may not even tell anyone about this. My family is from the Caribbean, and my parents are planning a huge wedding in their country for my fiance and me next Spring. We're confident that by that time, he will have restrictions removed and he will be able to travel in and out of the country.

Being young has little to do with inexperience here. All you have to do is do the research and you'll be just fine. Good luck!


Having a wedding ceremony when already married is not "marrying". Married is married. Sounds like you're having a ceremony and party outside the USA AFTER you marry IN the USA.

Hi all. We have our NOA1 and now waiting for our NOA2, but were wondering what would happen if we were to have a ceremony in my fiancee's home country before getting officially married in the US. According to South Korean law, having just a ceremony is not recognized as an official marriage in South Korea, and therefore the US wouldn't recognize it as an official marriage either, right? We wouldn't be signing any papers or anything.

What do you mean, "sent home"? If you mean deported, there's not much chance of her coming back. If she went home voluntarily without USCIS involvement, maybe. The petition must include a copy of the annulment documents, so if they indicate a judge granted the annulment due to marriage fraud associated with immigration, the chances of petition approval or a visa are very slim, if any.

Just one more question - my fiancee has read from Chinese visa community forums that if the co-sponsor has filed taxes jointly, as parents always do, then either both parents need to sign the same I-134 or include a cover letter that has both parents' signatures explaining that the 2nd parent is on board. Only my dad's signature is on the I-134. She is worried about it, saying all the K-1 applicants have a cover letter like the one just described if their parents are co-sponsors, and if not they get a blue slip. I'm finding contradicting sources of info and it's very frustrating. Any advice? :wacko:

No. Just use the transcripts. Usually, I would recommend using the actual returns and W2's a joint filing cosponsor situation for the exact reason you mention. In your case though, your father actually has ZERO current income and current income is how one qualifies. The "trick" here is that he's going to be stating he is currently self employed. Remember, I said self employed people can only state current income as that from their most recent tax return. Your father has not yet filed a tax return as self employed, so technically has no income. My suggestion is to tell the truth about his self employment and use tax return transcripts as the supporting documentation. Then, let the consular officer make their judgment call. When showing a parent with a history of good income, they are not all that likely to look any deeper.

You're going to have a similar problem again after marriage, when an I-864 needs to be provided with the adjustment of status.

Dear all,

I've hit a fuzzy area with my father's I-134 (he is co-sponsoring my fiancee with me), and could really use some insight.
My father just left a high paying job to go into his own management consulting practice. I have three questions driving me crazy:

1) My dad files jointly with my mother. I know tax return transcripts are usually enough, but does he need to supply his complete tax returns to prove the majority of the joint income came from him and not my mom? If so, what does he need to provide in addition to the transcripts? Are the one page w-2s enough, or does he need to supply complete tax returns for the past three years ( a lot of paperwork).

2) Since he just recently left his job to go into his private practice, his current annual income is just a projection. There is no real way to prove it, even with recent bank statements. Should I be worried? Is there something he should be including to show recent self-employment or probability of future income?

My fiancee's interview is coming up in 4 weeks, so I'm starting to worry about how long this is taking to put together and mail. An insight is truly appreciated. :help:


The problem with being self employed is that when stating "current income" the only figure they will consider is the one on line 22 of the most recent tax return filed after becoming self employed. So, for example, if your father quit his high paying job during the year this year, and is now self employed, his current income is actually $0. Is your mother's current income sufficient to qualify?

If not, what I think I would do is provide three years of transcripts and hope it works.

Ok, question... My fiancee went to the interview and she was missing her police clearance from when she worked over sea's in Lebanon. They told her to turn in the police clearance and they would then process the papers and tell her if she will get her visa or not. She explained why she did not have the police clearance papers... Which she Requested and paid for, they told her it would be 3-6 more months when contacted after the interview... She asked if there was someone she could talk to to have the papers Expedited so that our medical would not expire they told her no and rudely told her to be patient and just pay for the expired papers again.

Any suggestions of what to do? I am contacting a senator for help, but probably won't help at this point..


Meaningful answers beyond the general information already given would depend on the country and any other potential problems in your case. Either way, you submit the missing documents and wait for them to be processed. You don't need a Senator for this. The police report is a required document. Nobody is going to twist their arms and make them issue the visa without it.

Placing the passport photos in a plastic sandwich bag attached to a full sheet of paper is perfectly OK. They see them this way every day. However, it's best to put the photos of the couple together on full sheets of paper. Just print several to a page from the computer or make color photocopies on full sheets of plain paper. Two photos fit nicely on one full sheet when copying.

I never even thought of them looking at it like he was buying his way in, omg, this really is a tough hill to climb! I was just thinking it would look better, a little cushion if you will, and even less likely to be a burden on our government. As far as meeting the necessary income I am good. Just remember, "totality of circumstances". If you have enough income, concentrate on relationship evidence and interview preparation.

Technically, you can include any supporting documentation including that of the foreign fiance's assets. Cash and savings account mean the same thing in this context. When using foreigner's assets for self support, they must be documented as being in the same name for at least several months. It's best if they are already in the USA.

Doing this, however, is a two-edged sword. Unless you have significant evidence the relationship is genuine, it tends to look like the foreigner is buying their way to the USA by using the US fiancee. They are going to consider the totality of circumstances, which we here do not know, so your chances of success are impossible to predict with any confidence.

Words mean things. Your petition was "rejected" not "denied". You didn't apply for anything. You filed a petition. When a petition is denied, they keep the filing fee because it is a fee for filing, not a purchase price for a product.

Because they were right to deny the petition. You would be appealing whether the reason they gave you was correct. Since it was, you'll lose the appeal AND the time. You could only win the appeal if you can show compelling evidence that you actually DID send all the required supporting documentation.

This ain't my first rodeo. Same goes for the others telling you to skip the appeal and file again. We see this frequently. Time to bite the bullet.

Just to be clear, you aren't appealing whether you qualify to have a petition approved. You're only appealing whether you filed what you were supposed to file. You didn't, so you lose.

You can but it's a supremely bad idea. They properly denied the petition. File a new one properly instead of wasting months on a denied appeal.

Perhaps I'm wrong, but in a case like this, where the OP has been waiting since June of last year, wouldn't an appeal be faster than a new petition?


No and the appeal would be denied anyway.

My petition was denied on 1/10/2013. The mailed reason stated that the petition that was filed did not contain any initial evidence or supporting documentation. You have failed to comply with the regulatory requirements for documents to support your petition, as outlined in the instructions on the From Petition for Alie Finance Form 129-F.

In visa petition proceedings, the petitioner bears the burden of establishing eligibility for the benefits sought.

In view of the above, the petition is denied.

Can someone help me out? There is nothing in the letter informing me that I did not send in a certain form. Of course I am going to file an appeal but I am not sure what documents the USCIS needs if they have not told me in the letter. I called the office and they told me that they can't comment on what I need to send in which makes no sense at all.

Please help.


Read the I-129F instructions and follow them. Whatever you see listed there, that you didn't send, will be what was missing. Start by clicking on the word "guides" at the top of any page here. Study carefully and then ask any remaining questions. You simply file again, properly this time.

As you move forward, I suggest you become an excellent student of the guide here. You won't find any suggestion to use a binder. USCIS will build it's own file. To do so, they must discard any folders or binders.

If it were me (due to my inability to learn the skill of patience), I'd probably send my copy of the I-129 with the check I forgot. I know they'd be mailing me back my other application, and then I'd not lose so much time--they'd cross in the mail. Of course, I have no patience, but I do have faith the rejected packet would be returned to me in one complete piece :). And, I made my original packet in triplicate anyway--one for me, one for my fiance, and one for the USCIS...with original signatures of course.


Are you seeking an employment visa? That's what the I-129 is for. Hopefully you filed an I-129F, if you're bringing a fiancee to the USA. If you want to help people here, it's best to have the patience to type the correct form name.

They don't pitch this kind of filing. They "reject" it and return the complete file to you. They might pitch your binder though.

I went page by page by page. Used tabs, color sheets to separate each section of the K-1, quadruple checked every bit, made two entire color copies of everything, provided extensive evidence of having met in person, 3 trips, etc., etc., etc. Two hole punched it, put it in a labeled binder, blah blah blah. Mailed it in a few days ago. Discovered today that I LEFT OUT THE $#@#@%@! CHECK for $340, as I discovered it still in my #$!@$#$@ check book. Son-of-a-beotch.

So do I wait until I receive notification?
I don't have a case number yet, so cannot send a check with a case number reference.


Usually only takes 10 to 14 days to get you package back rejected. If you can reproduce everything, send another package correctly assembled. If not, wait. When you send again, keep the binder and use a big paperclip and a priority mail envelope. The first thing they're going to do is toss that binder. They may do that before they send your package back.

FACT: I sent Western Union receipts along with my I-129F and I got approved.



Helped, didn't hurt and can hurt are three separate things. Whether Western Union receipts, help hurt or make no difference depends on a lot of things. Generally though, they CAN hurt and seldom HELP. That you got through the process successfully says nothing about whether sending Western Union receipts helped. It's one item in a sea of total circumstances.

To file an appeal would be to do exactly that. The appeal will fail, then several months later, they'll still need to refile but won't get that time back.

Yes, I know there is technically nothing to appeal, but they give me that option. I was denied, based on lack of evidence/proof, so I can appeal that denial by providing proof. If it goes quicker appealing, then I will, if not then I will just start over with a new file.


It would be a waste of time. They were correct to deny. The option is an empty one. File again properly.

There is nothing to appeal. They were correct to deny the petition. Of course they'll know about the first petition when you file again. No problem. Just do it right the next time and the petition will be adjudicated again, independently from the first submission.

I think it was more common for a petition that was lacking mandatory evidence to be rejected and returned to the petitioner back when petitions were submitted directly to the service centers. I think the document uptake employees at the service centers are better trained in what constitutes an acceptable petition package. I think the employees at the Texas lockbox facility are trained only to look for the most obvious stuff, like a check with the wrong amount for the type of petition being filed, or a missing signature on the petition form, etc. Once they've accepted the petition and cashed the check the petition is sent on to the service center. At that point, the service center doesn't have much choice except to adjudicate the petition because the check has already been cashed.


Pretty much, yes. It would be nice if the service center would deny them immediately instead of sitting on them several months first but this IS how they do it.

I pretty much only filled out the I-129F form and mailed that in with the fee, nothing else.


So what are my options? Should I get a lawyer?



Yes, a denial is what you can expect when you file only the I-129F.

Either use the guides here to learn and do the process correctly or hire professional help.
