OK we seem to have a conflict in advice here. Darnel's answer seems to be the closest to what uscis.org told me on the telephone. They said that I need to send my fiance to Guangzhou along with her son, about a 3 hour bus ride, along with his civil documents so that the consulate can talk to him and then see if there is a visa available for him. Then they tell me that I need to call the Guangzhou consulate to verify what they told me. The only phone number I have from website in a recorded information line only. My only option is to email which I have already done but they have not answered me. My fiance's son works full time and his boss told him that he would fire him if he went to Guangzhou. So before I take any advice and get him fired I need to be sure what is factual and what is not. So please understand why I would ask you to backup what you are saying.

Can you help a guy out here? Do either of you have experience with this?


Sure, we both do. I think Darnell answered before he saw your reply about the son's date of birth. Your problem is timing and age out. First, you need an interview date. You can email the Consulate about the age out situation and see what kind of date they can give you. Then, if there's enough time, they'll tell you whether they would issue the visa. However, getting the visa is only a small part of your battle for the son.

If he goes to Guangzhou, there's no guarantee of ANY visa for him OR his mother but assuming he gets one, unless there's time to get to the USA, marry, file to adjust status and get the status adjustment expedited to complete, ALL before June 7, he's back to China with no job. If you can get an early April interview, success with both visas and virtually immediate US arrival, marriage and AOS filing, you'll need to know how fast USCIS will complete an expedited (due to age out) AOS process for you. You can call back and ask the misinformation line about that too.

Then it is most likely a lost cause. I don't expect GUZ would grant the K2 visa unless there was time to get here, marry, file and complete AOS.




Fill out all P3 documents on the child, get the civil documents, get a medical exam, bring all to the K-1 interview date along with the mother's set.

I received the i-129F approval, it went to the NVC and she received the P-3, filled it out and sent it in. The children have been listed from day on but only one qualifies to come and he will be 21 soon. Now she wants to bring him and he wants to come. On the DS-230 we an N/A on questions 31a and 31b which says no one is coming with her. So I called immigration and they said it is still possible for a K-2 just fill it out, take the son to the consulate and see if a visa is available for him. Then she called the consulate and they told her I needed to do it. Then I got to thinking that the son will need the fathers approval. Well he gave it.

The idea of her son coming to America with her is OK with me. He is a good young man and we get along pretty good. If he doesn't come with her he will have to wait 8 years to get approval on his own so who am I to stand in their way?

So the question is, What needs to happen to make this work and not set ourselves back a year?



First, no parental approval was needed for a child over 18 in China. Second, he can get a medical and apply for the K2 with his mother but unless he both arrives in the USA AND completes his status adjustment before his 21st birthday, he will need to leave. Is there time to get the visa, come to the USA, file for AOS, plus three months? You can ask for an expedite in an age-out situation but the marriage must occur in the USA first.

Hello all,

First post and all that, apologies for jumping straight in :).

Anyway, me and my fiancée are currently in the process of preparing the I-129F package and looking ahead a little at the other things we need and so we're looking over the I-134 Affidavit of Support.

Now my question about this form is the following:

There is a sentence on there, near the top, that's like "I am xx years of age and have resided in the United State since xx/xx/xxxx"

Now my fiancée, who will be the one sponsoring me, was born in Puerto Rico and came to the "mainland US" when she was 8 years old. And so we're both wondering what date to put there, the day she was born or the day she actually moved to Florida.

I'm hoping someone is able to answer this question, thanks in advance for everyone's time :).


If she's only lived in Puerto Rico and the mainland, then she's always lived in the USA.

No information will be available until they complete their review. They will not even tell you why the case was sent back for review until they complete their review. If they send it back to DOS, they may not even tell you why then. This is unusual but there's nothing at all you can do but wait. for at least 60 days. After that, the petitioner may want to contact their State's Senior US Senator's office and ask them to do an inquiry. No guarantee as to whether that would be productive either.

Usually, with some thought, either the petitioner or beneficiary can come up with a clue about what might be the problem though.

In this case, the falsely filed petition should be withdrawn before a finding of misrepresentation can occur. Then, they start over again with a new petition. If they proceed with the process now, the best possible outcome is a visa denial followed by a new petition and successful second try. The worst and more likely outcome is a denial with a finding of material misrepresentation resulting in a lifetime ban from entering the USA. Lying on immigration forms is an extremely serious matter.

This is why I recommend Priority mail over Express mail. You pay extra and lose a day, making the delivery the same day anyway. Priority mail with delivery confirmation is the way to go but that's hindsight. No worries. The package will be delivered or has been already.

My question is regarding question 11 on the I-129F where it asks if "Have you ever filed for this or any other alien fiancée before?. If yes give name, place, A# and result (attach additional documents if necessary) Can anyone please give me advice?experience on how best to deal with this? Should i attach copies of all the NOA?

Answer, First Middle Last, I-129F, 2002. Now Naturalized. Then if you know the A number put it in. If not, say "A number unknown". No need to attach anything else. I-129F is only filed in the USA, so no need to enter a place.

In our case I controlled each and every part including researching what was needed for the interview which involved not only study here but emailing and calling the consulate several times. I went to Ukraine and accompanied my fiancee (now wife) to each and every place we needed to go and secured each and every piece of documentation needed for the interview before we filed the petition This delayed filing the petion by a couple months. So what?

If you study the law, you will find that a 221g IS a denial and he is, for example, required at this point to answer affirmatively if asked "have you ever been denied a visa to the United States" The difference is that the denial, at this point, is based on grounds which they have given you the opportunity to rectify.

My point is that I have always felt that ONE person needs to be responsible for everything in this process. From petition to citizenship. It is not a good project for a group effort, something is going to get "dropped" and if it does, for any reason, you have problems. Particularly when one of the parties does not know what they are doing it is impossible to have positive results. Now, we have done a K-1, two K-2s, AOS for all and RoC and not had even one question asked...ever. Other than to sign where required and show up for medical exams and fingerprints, my wife and children ahve never touched a form or collected a document of any type.



It's a good idea, in theory but must be modified for many. My wife and daughter didn't fill out any official forms themselves but did need to take care of obtaining police reports etc. in China. I couldn't really help with that but I made certain I KNEW that THEY KNEW exactly what to do.

I spent 11 continuous months in the US from the second half of 2009 until may of 2010. I arrived there on J-1 and before it expired I filed for visitor's visa which was approved and granted me time until may of 2010.
Should I somehow try to obtain police certificate from the States as well as from my native country, Croatia?
I'm a K-1 beneficiary.

You do not need a police certificate from the USA. USCIS will order the criminal records check for the US, during the petition approval process.

You might be misunderstanding the meaning of the text on the consulate website. They might mean that only a citizen or permanent resident of Canada can interview for a K1 anywhere in Canada, and residents of the listed provinces and territories interview in Vancouver, while residents of other parts of Canada interview in Montreal. US consulates in most countries require you to be a legal resident of the country where you are applying for a visa, and not merely a visitor. This is meant to discourage people who live in countries that have a high level of visa fraud from going to another country as a visitor because of the perception that it will be easier for them to get a visa to the US. Neither Canada nor Australia are considered "high fraud" countries, but consulates apply this rule uniformly.

You should check with the consulate and see if they will allow you to interview for a K1 in Canada, based on your current visa status in Canada.

Also, Inky was talking specifically about the medical exam. Those aren't performed by the consulate. They are performed by approved panel physicians. Any panel physician approved by the consulate can perform the medical, which means an approved panel physician in Vancouver could do the medical even if the interview were in Montreal.




Jim is correct. Here's what the website has posted. The context of Montreal is geographic not status related.

The U.S. Consulate General in Vancouver processes fiancé(e) (K1) and spouse (K3) cases for citizens of Canada, or aliens who are Canadian permanent residents. Applicants must also be residing in British Columbia, Alberta, Saskatchewan, Manitoba, the Yukon or the Northwest Territories. All other applicants in Canada are processed at the U.S. Consulate General in Montreal.


I would contact the Consulate directly, by email, with regard to whether a person with your status in Canada can interview for a K visa in Canada, period. I think you can if your status is the same by the time the interview occurs, but check directly.

There's no way to know or find out the reason unless NVC sends the case back to USCIS. If that number or a similar number is shown as "total income" on both the tax transcripts and on the extension he filed, I expect there will be no problem. For the self employed, it is the tax return "total income" that is used as "verification".

a)since my fiance is self employed, does that mean i only have to bring tax transcript? i wouldnt need w2s, paystubs, and employer letter, right?


b) my bigger problem is that my fiance filed for a tax extension for 2010. i already have transcripts for 2008 and 2009. for 2010 i have a copy of his 1099, an extension form, and a letter explaining why he had to file for an extension. am i missing something? for all three years we are comfortably above the poverty line. i hope we do not run into problems :(

c) should i ask for his paychecks for 2010 to substantiate his income?

Self employed people don't have W2 forms or an employer letter. He did not "have to" file an extension. IMO, that was a poor choice for somebody in an immigration process but the extension might be OK. The key will be the income that shows on the tax returns.

All, can you please elaborate here, see the instruction from embassy is stating only applicant has to complete the form DS-156K. I am also seeing question 40 in the DS-156K form stating, if someone else filled the form, he or she has to include his or her name there. These two documents are contradicting each other. I told my fiancee to do it herself and i will translate each question for her over the phone, so that way technically she has filled DS-156K. I am thinking the embassy instruction sheet has more weight than the document itself. I am concerned that when she hand over DS-156K with my name in question 40, they might reject her visa since it was clearly stated in the instruction sheet that applicant has to file the DS-156K. What you all think about that?



No elaboration needed. You can help all you want or do it entirely for her, then say so. When they say "complete" they mean "sign". They mean the foreigner is applying for a visa, so only the foreigner needs a completed and signed DS-156K.

Someone posted that if you go to the DHL tracking website and enter something like "EXP 27 APR 2011A" you'll get a listing on shipments from the NVC to the various consulates.
When I called the NVC they told me that my application was sent on 5/2 and sure enough I found the item with tracking number.

I have to tell you that there are some shrewd folks on this site.



Nevertheless, this statement is absolutely correct. "There's no way you'll ever know for sure what day or in which package your file was shipped." When NVC tells you your package was shipped, the operator only knows on which day the file was cleared to be shipped. They have no information as to which day the mail room actually shipped the file, because they have no access to that information. You can track packages, you just don't know which package YOUR case file is in.


Once the file has left NVC, you want to know the case status from the Dept. of State Visa information line. They can tell you when the Consulate actually did something with the file. That's what you want to know.

Hey guys.

So my co-sponsor is going to be my fiacees dad, He has just stated recieving his pension, which is way above the poverty guidelines, as he has just retired from 30 years as a school teacher. My question is, what kind of supporting eveidence will he need to provide to support his financial income (pension) he has only been getting his pension for 1 month so only has 1 pay reciept from them to date. I know people with jobs provide tax returns for the past 3 years and pay slips and so on, but obviously this is different. I just want to make sure i get this all done right. I'm sure you all understand the importance of the affidavit of support. Any help and advice, or anybodys experience would be greatl appreciated

well we just got approved NOA2, and we submit 0 ZERo: Yes zero photos, cause we had enought proves of meeting in those last two years: my trip to the USA, our trip meeting in Europe and flights and hotels, and his trip to Algeria, plus phone record!
we didnt submitt: any emails or chat record or letters with that! im not sure im going do that to the embassy, maybe just few emails and letters, cause we never though of saving chat logs,and feel its really strange that peopel save there chat conversation, this maybe will show that all this relationship is planned since the first conversation, i guess to be unperfect somehow in evidence is normal!

I guess ,u dont have to put too much pictures, just organize them carefuly, by trip and periode, that will tie to the trips and travel evidence, and also, choose pics together, activities, but also with people: freinds, family .....

Forgot to add that the pull quotes should of course be supported by the actual letters, e-mails, YMs and what-have-you that the two of you wrote to each other. You can just choose those that absolutely drip with honey ^_^ and/or indicative of your plans for the future.

I've added as appendices the list of phone calls, text messages, snapshots of e-mail inbox to establish the frequency and the ongoing nature of the communication, again with the proper annotation (i.e.how many, how frequent, how long).

Actually, it has gotten so elaborately personal (I was originally planning to just do a photo album with some captions) that I'm now a bit embarrassed to show it to the interviewer :D I just hope he/she sees it for what it is. A true labor of love.

You've already filed the petition. The CO is not concerned about evidence of meeting. USCIS will adjudicate that based on primary evidence. Photos are secondary evidence of meeting. For USCIS or the Consulate, I recommend printing multiple photos per page, in color, on plain white paper. You may then add any date or other information you think may be helpful. If the photos are not already showing an interior date, that's fine.

Hello All,

I'm looking for some advice. I am a US Citizen and my fiancee is a UK citizen. We plan to marry in the near future and then live and work together in Italy, where he is an airline pilot. We do not have plans in the immediate future to have him immigrate to the US (maybe 10 years down the line, but not now). We would like to get married here in the USA as soon as possible. My question is this: If we plan to marry and then leave the US together shortly thereafter, does my fiancee need to apply for the K-1 visa before coming over? Or can he enter on the visa waiver?

We do plan to travel to the States several times a year to visit my family. If we get married and attempt to return here to visit, will he have issues entering the country for a visit without a visa once we are married?

One last question...when we get married (at the courthouse), what documentation does a UK citizen need to present? Is a passport sufficient?

If you will marry and leave, no fiance visa is needed. Each entry is a separate decision but you can avoid some problems by going through separate lines at the Port of Entry and him giving generic truthful answers for the purpose of the trip, like "visiting family and friends" or "holiday" instead of "My wife and I are visiting her family." etc.

Usually, just a passport would be needed but check directly with the jurisdiction where you intend to marry.

If you have excellent English skills and the time patience and ability to read carefully, interpret literally and answer questions accurately, there's a good chance you'll be successful managing your own process. If you decide to hire professional help, IMO, there is no real advantage to them being local. Most of your interaction will be by phone and email anyway.

At the interview, when the visa officer asks your fiancee why you didn't get married in your fiancee's country and instead you chose the K1 fiancee process, how would she answer it? The DS form refers to applications for immigration to the USA, not Canada. You friend's fiance should enter NO as the answer. His attempt to immigrate to Canada has nothing to do with his K-1, and he should not mention it because it has no relevance.



The DS156 is an application for a non immigrant visa. Your friend is not applying for a visa. The foreigner is. An I-129F is not an "immigrant visa petition", so the answer is no.

If the USCIS was going to deny the petition, they would send the petitioner a Notice of Intent to Deny (NOID).

IF that were to happen, the petitioner would need to respond to it with any and all evidence of your relationship. Failure to respond to a NOID would not be solved by getting married and filing a new petition.


This is not correct. If the petition is denied, USCIS will send a "denial notice". NOID's are for petitions returned to USCIS by Consulates.

I meant the letter he mentioned he could get from the person who contracts him and is his sole source of income and also the receipts he mentions.


London has approved people (even recently) without tax returns. They want proof of income but do not require a tax return. You can even do a do-it-yourself affidavit for London, but it's easier to fill out the I-134 than construct a proper affidavit. And a beneficiary can self-sponsor without any affidavit. It's pretty flexible as long as you can show them the money.


I understood what you meant. Nevertheless, without a "tax return" a there's no way to determine "income" for a self employed person. In the context of the self-employed, a letter from a "customer" is verification of "revenue", not "income". The good news is that he's likely to HAVE a tax return by the time the interview takes place.

Just a couple of comments--

For London you do NOT have to have a tax return or W2. Just prove you make over the $18K with the employer letter and pay receipts. DO NOT get a co-sponsor or another job as suggested. Not needed. The financials go to her interview so not an immediate concern.



Self employed people do not have employer letters or pay stubs. They DO need at least one tax return as the number from line 22 is what is considered their "Current Income".
