Actually that not very correct. The airline would not be responsible to cover the cost. If she was holding a valid K1 visa, the airline has done it job correctly to make sure can get access to the USA. They cant be hold liable for a decision, the COB made regardless of her paperwork.

I know JFK well. Connecting times can be brutal. You need more than 2 hours. Four would be a minimum to be safe. As others pointed out, she needs to clear immigration, get her papers, then baggage, then customs, and there is no way you can be there. You will first see her coming out of the secure area with a ton of baggage. I do not know what airline she is flying on but I would bet she will arrive in the main international terminal, but may have to go to another terminal to pick up the connecting flight to NC. That is not difficult, but for a person not familiar with JFK, it can be very daunting. You must be there for her. Period.

Now a suggestion. I suspect you both will want to be "back home" as soon as possible, but have you considered taking your time doing this? She will be arriving in NY, one of the greatest cities in the world ( I am a New Yorker :) ) so why not take a day or two to see this city? The ride back to NC passes our Capital, and can be a great time to talk in the car while driving through some beautiful countryside. When will she have the chance to do this again?


I second this recommendation. If you can arrange the time, I would make a trip out of it for at least a couple days. For my wife and stepdaughter I drove a rented minivan from Washington State to LAX to pick them up. We spent that first night in So Cal and took a couple days to make the drive home, They saw some scenery and got acquainted. Raleigh is a lot shorter drive than that. Yes, I've made that drive too. :-) And many more.

Oh thanks for the processing times link. It helped out great. I will just do a one way to JFK and then when I make her plane ticket, I will make mines.
It will only cost an extra 100 dollars for me to go see her and bring her back with me, but after paying all these immigration fees. 100 dollars just seems like pocket change.

Also, meeting her at the POE will be better since America works a little different than the Philippines. It will throw her off seeing organization. LOL

If I am not mistaking usually when you switch from International to Domestic then you have to carry your own bags. Air lines haven't been the best of support when it comes to making traveling easy.

No, you can't hold her bags while she's being interrogated. She will clear passport control and immigration before she picks up her bags, then pick up her bags and clear Customs before she sees you. You can help her make the transfer of luggage and the connecting flight.

That 2 hours seems kind of tight for JFK.

Factor in possible long lines at immigration, flight delays due to weather approaching New York-then trying to clear customs-then she needs to haul her bag to the new gate to check-in for the connecting flight-then stand in line to get re-screened by the wonderful folks of TSA.


Factor in late departure from Manila or connecting city. Are you sure she won't land first in Honolulu or Guam?

My personal recommendation is that if her POE is JFK and her destination is RDU, that you meet her at JFK and drive or take the connecting flight together. If that's not practical, have her arrive as early in the day as practical, with at least a 4 hour layover to something other than the last flight to RDU that night.


No buying a round trip from RDU to Manila and back with the idea she'll just take the return leg. Do your research well and unless she's an experienced traveler with excellent English skills, don't leave her to make that connection on her own.

Hi all, I need your help. I am in the process of applying for a K1 visa to marry my fiancee who lives in South Dakota. We have gotten through the process slowly but surely. I have my interview tomorrow, and and the weeks building it up to it I have been very litigious about double, tripple and quadruple checking everything. Only to find that I've missed a valuable piece of information regarding my Birth Certificate. The certificate I am in possession of is the UK short version (in fact I have two valid copies of this), but I seem to have missed the comment about the long version, and didn't until yesterday even know what a long version was. My dilemma is thus, it is now Sunday, my interview is tomorrow and 9am! I have all my other information, what should I do? I intend to go to the consulate to honour my appointment and explain my mistake. What is likely to happen? Any ideas?


Yes, go to the interview. Chances are you'll receive a "soft" denial with a request to obtain and supply the long form birth certificate. Obtain it, submit it and wait for them to issue the visa. This will cause a delay but probably no more than a month or so. Maybe only a few days.

Sounds like you need to indicate in the "Other Names Used" field something like "Goes by...." or John David (Dave) SMITH. If it can't be explained that way, explain it in a separate letter.

Not quite. Countries in the waiver program are there because of statistics showing a low rate of rejection and a low rate of overstay. Can't recall the exact numbers (and this has just being modified -in how the calculation goes-; but is around 10% and 3 % respectively I believe)
Countries like Poland for example, that are in the EU, are not in the waiver program; thus a visit to the embassy and visa are required; at same time, obtaining a visa is not really a big deal -in most cases- other than the time and money.
High fraud in the context of VJ means using a K-1 and/or CR falsely to gain residency status...In other words, entering into a marriage with other intentions.


Pretty much the same countries have a high instance of fraudulent applications for any visa, so the context is not so limited as you might think.

Yes. You say fiance but are posting in a spouse visa forum. Instructions for using assets can be found in the I-864 instructions. I suggest the US Citizen sponsor carefully study those. Even if this is a fiancee visa case using the I-134 instead of the I-864, the guidelines are the same for using assets.

Right - some countries want to know how much you're taking out - so they can get their share I imagine wacko.gif - but the US it is $10,000 and up. good.gif


"Money" comes in multiple forms including electronic transfer. Many countries have limits on how much of their currency is allowed to be taken out of the country but have no limits on how much US Dollar (or other) equivalent can be transferred or currency carried. Then you deal with US regulations on bringing in currency.

If you have more than the value of 10,000USD to move, it is probably going to be better to do so electronically.

Sounds like you have some Consulate specific research to do but NO, the I-864 will not be used until it's time to adjust status. The I-134 is used to obtain the visa, so one from you and one from the qualified sponsor.

If he filed an extension then provide a copy of the extension he filed. It will state his income. It MIGHT work. It would be best to provide the actual tax return but if he is employed, meaning he has a "job" instead of being in business for himself, "self employed" then his current income can be documented with a pay stub. For the self employed, current income must come from the 2011 tax return.

Hi all!!

My Fiance and I are in the middle of the K1 process! I have a query regarding obtaining an Australian police certificate from Italy.

I live in Italy but spent almost a year in Australia so I need to provide a police certificate also from there. The US Government requires a check based on name and fingerprints from Australia. The Australian police advised I can send them copy of my fingerprints taken from a local (Italian) police office. I went to the Italian police today and they told me they don't take fingerprints and that's something they cannot do.

Has anyone been in the same situation? Do you have any suggestion?

Thanks for starting this topic. I've learned a lot. Mongolians use cyrillic, but there are so many was to transliterate cyrillic, not to mention the cyrillic is only a close match at to how it's actually pronounced, and when you transliterate from cyrillic, often the roman letters are no where close to the pronunciation.

My problem is that in mongolia, children take their father's name for their first name, but they add a suffix (iin) to the name that isn't found in English which would most closely be translated "of". So we put Dashjamts Khandsuren on the petition in stead of Dashjamtsiin Khandsuren, the way which it apears in the origional language, but since the "iin" isn't actually a part of her name but a suffex added to her name to say that she is "of" her father, we didn't put it on the application. I hope this is ok. I could see it messing up things either way.


Anderson, Johnson, Henderson etc. all originally meant Ander's son, John's son Hender's son etc. So you have Ander JOHNSON etc. In all those cases "son" is a suffix but it is part of their official name, if that's the naming convention. Whether it's still done that way in the Scandinavian countries, I wouldn't know but a name is a name. You don't just change it because you decide to fill out a form differently. It's a legal process. The way the name was transliterated in the passport is "correct". If you don't like it, do a name change and get a new passport in the preferred name.

She can go through the process to change the spelling in the passport or use the spelling in the passport. Be aware that between alphabets, there can be more than one way to "transliterate", not "translate". For some alphabet transliterations, there's only one correct result. For others, there can be multiple. The "official" papers should all match.

One example is Chinese. A Chinese family in the USA prior to there being any official mainland Chinese transliteration method to the Roman alphabet would have transliterated the same character to Wong, as is now properly translated to Wang or Tong for Tang. You get the picture. Or, my wife's name requires three Chinese characters to write but is only two names, so the correct transliteration would be Wang, Tangjin, not Wang, Tang Jin but you'll see Chines people doing it either way. Even her paychecks and W2 use the Tang Jin Wang, transliteration because her Chinese employers are not properly educated in the use of "Pinyin". (Not her real name) Point is, her immigration documents, passport and green card all have the same transliteration. The Chinese do NOT have middle names, whether their given name takes one or two characters to write in Chinese. All family names are single characters. Chinese characters represent (generally) syllables, not letters.

Cyrillic has its own peculiarities.

Most of the time takes 1 week, unless you are so lucky and the embassy is not crowded they'll issue in 2-3 days. I hope your flight is not a charter one, so you can change the date. I've been here for 10 days, 3 before the interview date for Medical ... Horrible!
By the way they'll put the visa in the passport, it's not a separate sheet!

How soon she'll get her visa and the logistics that go with it are Consulate specific. Before purchasing travel would be a better time to ask this question. She cannot hold onto her passport though. The visa goes IN the passport, so she will NOT have a passport until she has the visa. The exception would be if the Consulate expects a delay in visa issue. If they do, they'll arrange to get the passport back for visa issuance when the time comes.

I have compiled most of my paperwork. I think I have about 200-250 pages of information and here is how it is organized and broken down:

1) Affidavits testifying that we have established a bonafide relationship (5-7 people will issue us these affidavits)
2) Evidence of our visits (boarding pass, tickets, itinerary, passport stamps). We have photos but we sent those in when we sent in the application as well as during the interview, I can also submit those again.
3) Emails regarding our wedding preparations (this includes announcing our engagement, contacting banquet halls and photographers (with their responses), and emails about my bridal shower that my friends and family are planning for me (I highlighted dates and important information in the emails).
4) Emails of our personal exchanges. (highlighted dates and some content for them to read easier).
5) Photos we have taken over the last 2 years through Skype and other messenger services.
6) Facebook exchanges we have had (a few pages providing evidence of our love and intent to get married,also highlighted dates and important content)
7) Skype exchanges that provide evidence of our relationship (I chose a few pages of text where we talk about our relationship and getting married and planning out our future. These were highlighted as well, just like the others I mentioned)
8) Yahoo messenger messages (just like skype, I chose a few chats where we talk about our love and wanting to get married and settling down and highlighted the dates and content).
9) Phone logs from the last 12 months.
10) Text message logs from the last 12 months.
11) List of people who are aware and have been aware of our relationship and our engagement. (I have not gathered this list yet but I can come up with at least 50 people who can provide their contact information).

What do you all think? Any thoughts?


First, get this down to no more than 50 pages of your best relationship evidence. I would start by eliminating 9, 10 and 11 entirely. Prioritize the best of everything else. Keep cutting until you get to no more than 50 pages. This is so they MIGHT actually READ what you send. I would pick two or three people for affidavits but no more. Pick the ones who have the most intimate knowledge of your relationship and can actually express what they have observed about it.

Thanks for the post. My fiance and I do have pretty personal emails and posts from our messengers and Skype that I can pick and highlight and submit. In addition, I plan on organizing all the information (like I have done before when I submitted the original fiance visa application) chronologically and dividing the paperwork based on category (photos, personal emails, affidavits, etc.). As far as I am concerned, this SHOULD be enough, but as many of you have pointed out to me earlier, the U.S. embassy in Islamabad make it nearly impossible to approve Pakistani men for visas during the interview process (usually they require more evidence).



Organization is great but don't overdo the quantity. Make it easy for them to actually see what they said they want to see, in examples spread over time. What you did before sending hundreds of pages, virtually assured that they would not see what they NEEDED to see.

When I asked my bank they said to fill out a W8BEN to add my foreign spouse. They have to send copies of passport pic and a bill or something with their address on it. Not all banks will do this and also I don't know if it can be done for engaged people. But it doesn't hurt to ask.


Major banks will commonly do this. Try B of A or Chase. However, this will NOT help the OP's fiance obtain the visa NOW. They are looking for more "personal" evidence that shows a close personal relationship. A joint bank account doesn't do that and certainly won't work AFTER the visa interview.

Aside from you, no one here is getting hostile. As you have quoted (and yet again misread) we did not JUST send chat logs. We send a plethora of proof (pictures, phone logs, etc.). What my fiance was ASKING was whether video can be sent to the embassy as further proof of our encounter. Instead of continuing to suggest things we have already done, perhaps you can be more productive by answering his original question. Or rather, don't if you can't answer the question adequately.


You responding with hostility will not help in the least. The first thing I would advise is to get your head around the fact there is no such thing as "proof" in this context. The best you can do is to provide "evidence". What you provided did not create a favorable enough impression to grant the visa. My read of the original post is that the communication evidence was not "personal" enough to show a convincingly personal relationship. Since you can't manufacture evidence that doesn't exist, I suggest you focus on what DOES exist that demonstrates a close personal relationship. If you are unable to do so, you may well be faced with starting over after such evidence DOES exist. If so, my advice is to concentrate first on spending more time together in person.

Fiance visas out of Pakistan are tough sells.

So here's the deal,I had my interview at 22nd of March this year.
I submitted lots of proof (500-1000 pages chatlog,phonelog,pictures).
So what happened at interview was that it actually went fine but the guy at the end gave me this green sheet and told me that he acquires me to provide more proof. I responded to him that I already provided what I could in this particular case of long distance relationship , so he replied back that he read all my chatlogs and he doesn't find them deep enough. He also mentioned that most of the marriages from Pakistan are arrange marriages so if you are having a love mmarriage you have to show it more.


I am seriously disappointed , that how people judge your love, also can I send them videos as a proof?

I will be grateful for all suggestions.


The strongest evidence of a bona fide relationship is actually the time you spend together in person. How much time did you spend together? Did you provide evidence of that? You can't provide what you don't have but if the CO isn't impressed with what you DID provide, start thinking about other possibilities.

People who get NOID letters, have a brief time to respond. USCIS will then either reaffirm their approval of the petition and send it back for a second interview or they will revoke the approval. A reaffirmation is absolutely NOT a reason to count on obtaining a visa. It's 50/50 at best.

Cgayle, there are many different types of visa that goes thru the calif USCIs, there is the K1, K3 or the CR1. We had already established that the CR1 (130) does not have an expiration date, the K1 and the K3 does, since these two donot mean any thing to you, disregard any comments or reference to them.

My statement was in reference to all and any type of petition that goes thru the Calif USIS center. A 130 petition doess not have an expiration date, but if it is revolked it is as good as never existing.


You are simply confusing people. No "visas" go through USCIS. Petitions do. It is the "approval" of an I-130 that doesn't "expire". If you will learn and use the correct terminology, people will be far less confused.

You seem to be confusing petition approval and visa denial. Once an I-130 petition is approved, the foreigner applies for a visa. If the visa is denied, the petition is sent back to USCIS with a recommendation the approval of the petition be revoked. Approvals of I-130 petitions do NOT expire. They can be revoked. Your opportunity for rebuttal would happen AFTER a visa is denied, not before.

Approval of an I-129F petition for fiancee expires four months from the approval date, so if the petition gets sent back to USCIS in California, they generally just let it expire and tell you to file again if you wish.

I received this email today from USCIS and was wondering what it meant. My fiancee had a protracted court case in China and we gave up on the K1, just didn't reschedule the Guangzhou interview after we asked and were granted a delay.

My fiance is planning to get her 9 year old daughter right after she arrives in the US and marries me. If I submit the application this week and assuming her visa will be granted around Dec-2012, she would have 1 year to file for her daughter a K2 visa.

That said, will my fiance be allowed to travel back home to bring her daughter while in a state of conditional green card, assuming she has secured a parole to travel?

Sure, she can re-enter the USA with her conditional green card. Once she has that, "parole" is meaningless. Advance parole is for travel in ADVANCE of receiving the green card.

Hello everyone, I really didn't want to ask this question but I have searched this site and I couldn't find the answer so here goes: As some of you may know I am a medical student which means I have not worked full time since 2009. I only work part time in between class, my clinical rotation, and my on call schedule...babies come when they decide to come, which is usually when I'm sleepingPosted Image
so, my income is based upon my part time work, my child support, and my student loans. Since I am on a graduate level my student loans are substantial. I am able to pay my tuition, lab fees, and books with the remainder to support my living expenses. I am aware that child support is considered income but are student loans as well when completing the affidavit? I checked with the Department of Education to understand the guidelines regarding the usage of student loans and I learned student loans are designed to pay for my education and living expenses while in school to ensure I am successful in completing this medical program. Has anyone ever added their student loans in with their income on the affidavit of support? I need to show at least $23,868 for a household of 3.

Here are my calculations:
2011 Salary $12,000
Child Support: $7,200
2011 Total Income $19,200

I am short $4,668 can I add the income from my student loan to my total income for the year? If the answer is yes, then I will not have to ask for a sponsor for the I-134 Affidavit of support. I will be finished with school May 2013 so when we complete his AOS my income will be well over the poverty line Posted Image thanks for helping me. Also, I know that I am only required to show the last 3 years of income tax statements, but because I have been in school the last 3 years my total income has been below poverty line. Student loans are not income. Child support can only be counted if it is court ordered and you have documentation of the order and that you are actually receiving it. You are not required to show three years tax returns for an I-134. You'll need information from three tax returns for the I-864 when adjusting status. Since you haven't filed yet, you'll either need a cosponsor or you can time your filing and progress so that the I-134 is not needed until after you have sufficient income.

I-129F petitions are ALL mailed to a PO Box in Dallas, for intake processing in a facility in Lewisville, TX.

K-1 Fiance(e) Visa Process & ProceduresAdvance Parole Concern

Hi! My fiance and I are on our 5th and a half month of waiting for the NOA2 of our K1 to arrive. Our file is in Vermont and I've noticed that lately it has been slower for that service center.
Anyway, back in January 2012 we already made plans to get married in the Philippines (church wedding with all our friends and family). We booked our church and reception for early March 2013. We counted the months for the K1 visa process and at that time, it all seemed to fit. We'd get married civilly in the US around Sept or Oct 2012 and apply for Advanced Parole so that we can return for our March 2013 wedding. Because things have been moving quite slowly and we don't have our NOA2 yet we were thinking of moving the wedding to maybe June 2013.

Do you think that if we hang on to our March 2013 wedding, we'd be able to make it back to the Philippines on feb 2013 to do last minute preparations? Or would it be wiser to move the wedding to a later date, say June 2013? The USCIS website says it takes a minimum of 3 months for advanced parole to get approved. I'm just worried that the NOA2 might arrive later and that the transit from Vermont to NVC to the US Embassy in the Philippines might take long and AP might take more than 3 months to approve for whatever reason.

The wise choice is to refrain from setting the date until you at least have the visa in hand. The same goes for any decisions that cannot be implemented until other things outside your control are accomplished.

I understand your frustration. But just do as they ask. Be thankful it is just that and you have a way out. This could put your case behind by 60 days. We had a document signed but not filled out and we got an rfe. At the time it drove us nuts but now we have moved past that. Accept it and move it real fast. Dont waste any time. You will come to terms with it. Just be glad the reason for the rfe is an easy one. Hang in there. All the best.

It's illegal to colour copy any government document It's not acceptable they would have preferred black and white

Why take the chance? You can get your entire passport color copied for a few dollars.


There's no chance being taken. A scan and print is exactly what a photocopy is. The difference here was the scanner and printer were in different locations. There's no way to tell the difference between a printed scan and a photocopy because there is no difference to tell. A color photocopy is still a photocopy is still a printed scan.

I pay $40 for three months of unlimited calls but it would show a chinese number on her phone records. Or should I get a international plan on my phone so my american number will show up on her phone records?



Why not use the Skype records showing you calling her phone?

If Skype can't do that, then I suggest Dynasky.com for phone calls to China.
