Before reading my question I hope you all understand that I have read the "procedures" many of times, so please don't reply to me by telling me to go look at the procedure. I want to direct this question to experienced people here that knows exactly what's happening. :)

I've received my NOA2 last week. I know I'm supposed to fill out the I-342 or for sponsors. My question is my Fiance (the beneficiary) supposed to get notice too? Is he supposed to get notice from the Service Center? Or his embassy? [he is according to the NOA2] right?

My problem is that we didn't realize his location (Edmonton Alberta) was suppose to put Vancouver Amer. Embassy on the I-129; so we put Calgary! So, at this point, how do we know if it's Vancouver or Montreal? Is he supposed to get something from the Embassy before we take action?

The foreign fiance will be contacted by the Consulate after the case clears NVC. NVC knows where to send the case file. There is only one US Embassy in Canada, and it's in Ottawa. Montreal and Vancouver are Consulates. An Edmonton resident's case file for a K visa should be sent to Vancouver no matter which consulate you listed on the petition. If not, you can request it be transferred.

The Manila trend for Co-sponsors on K-1 Visas seems to be that they're okay if you're a college student or recent college graduate with high earning potential.

What you might want to think about is marrying her in the Philippines and going the CR-1 (Spousal Visa) route. With the Immigrant Visas the NVC handles your Affidavit of Support so you'll have less trouble with needing Co-sponsors.

It seems that the Embassy staff can't deny you unless they find something that isn't previously known to the USCIS so by getting your affidavit of support accepted at the NVC you're in the clear.


Hopefully, getting a job sometime in the next few months will end up being a better solution than a marriage trip and all the hoops one jumps through to marry in the PI.

However, NVC does NOT approve affidavits of support. That's still up to the Consular Officer. Lots of folks get confused about this because NVC will reject improperly filed I-864's. They will send affidavits that appear not to show qualifying income with a note to the sponsor indicating the decision will be made by the Consular officer. Petitioners will get the same note when they clearly qualify based on liquid assets.

Your tax returns for when you do start up your I-129F for a K-1 Visa must be 125% of poverty threshold for two persons. I am estimating at least $15,000 in earned income for 2009. Otherwise you may be delayed for "further evidence to support the beneficiary" because you don't have income. (I learned from experience)


This is incorrect and the OP would be wise to disregard it completely.

I'm new here so please be easy on me. I was laid off after 10 years on the job working IT operations. I met my now fiance through a friend on facebook..we just started talking more and more and after 6 months things developed and she asked if I was interested in coming the to the Philippines. (this was about the 1 year mark) I was scared at first and said I'll think about it. I started thinking more and more and said hey ..you only live once just go. So I took a flight from San Francisco to Tokyo (Norita), to Manila. I was nervous as hell but she was there waiting for me. (I sent her money to meet me she is from Davao City). Anyway I don't want to drag this out too much. Stayed in Manila for a week because i was a little freaked about going to Mindanao. Eventually we booked the flight via Philippine Air lines and flew to Davao. I met all her friends and family. I was shocked. They treated me so nice and i didn't expect it. We visited Samal many times, Telicud island (isla rita) maybe 10 times did resort hoping around Telicud. Flew to Cebu, and eventually made our way to Boracay. I staid many times at her parents place..had fun beers with pops and mom..uncles and aunts..i arrived there nov 6 and left may 4th..i can easily say ..the time of my life..while i was there i fell in love and proposed with a nice ring..i asked papa for permission in private before i was even gonna attempt this. Eventually the day came ..my fiance and I flew back to Manila from Davao and it was a sad 2 days..I didn't want to leave and she wanted me to stay. I'm back in San Francisco/San Jose now. I miss her and we want to work on our visa. When I got back i reinstated my unemployment. Still have plenty from my severance package. I have an interview next week which is encouraging. And starting school again.(online) I scheduled all this abroad shortly before I came back. (gotta prepare). My question is..my family has fallen in love with her as much as i have and are more than willing to co sponsor despite my current situation. Is this possible or not? Your advice and thoughts are most appreciated. I'm new to the fiance visa process.

You do not need a job or income to file a petition but you will need to provide a qualified affidavit of support based on income or assets (requires $3. in assets to replace $1 in income shortall) several months from now when the interview takes place. Manila sometimes accepts cosponsors and sometimes not. Best to get a job but you've got several months to do so.

My full name (the way it is written on my birth certificate) has a suffix of "JR"
There is no place on the I-129 (or the G-325A) specifically for a suffix.

Should I put the suffix in the Family name box after my family name?


Yes, put the JR in the family name box, as in SMITH JR John Michael

There may not be a single correct way to do this but I assure you this will work. If you also want to put in other names used "John Michael SMITH JR" that will make it crystal clear.

I hope this finds everyone fine and healthy. I have a quick question that somebody may answer for me. I am going to start the process for my fiancee in the month of August, hopefully. However, my dear fiancee has been married before. He is from the country of Morocco. His previous wife was from the UK, and they married in Morocco. Even though they never left the country, his ex-wife eventally went back to UK after obtain a police recorded in Morocco for violence.

He just recieved his divorced. And another person that is peitioning for her fiancee stated that we may have problems. Here's the reason why:

1.) he married her about two years ago and she is more than five years older than him.

2.) she was non-muslim.

3.) the divorced is just now being finalized, and filing for him in August is too soon.

she said based on this reason the US counselate may consider this as red flags for him only trying to obtian a US visa to escape Morocco.

The question is should I file or should I wait?


Only you can make this decision but all these concerns are valid red flags. If you wait, it would be for the purpose of continuing to build a genuine relationship with further visits, etc. You'll be going through a high fraud Consulate with a reputation for dealing with such red flags pretty harshly.

Just check birth in the US and provide the birth certificate. The second part of your question doesn't apply to you. It applies to those who gained their citizenship in a way that required a certificate of citizenship, on which there is a number, date and place issued.

I have also found out that my other half has not filed a tax return in the USA for the last 3 years as he has not worked since he left the military. He is now working, and would surpass the 125% income level. But will it be a problem that he has had nil income for the previous 3 years?

You will want to use the embassy where you will be living at the time you will have your interview. Also, I don't see why you couldn't apply for the K1 while you are on VWP. As for the papers I have read stories where a woman was denied entry because they found papers (work resume and birth certificate) that would suggest she was going to overstay her visa, so I would suggest maybe someone send them to you once you are here. Hope this helps.


Visas are applied for abroad. The US Citizen can file the I-129F petition while the foreign fiancee is in the USA, sure. She will apply for a visa at the US Consulate in Sydney, not any Embassy in this case. All papers needed for filing the petition can be generated in the USA except divorce decrees and absolutely nothing "original" is needed from the foreigner at petition filing that cannot be produced in the USA. I would scan and email any divorce decrees and leave the papers at home. Things like birth certificate and divorce decree originals will be needed at the interview, not in the USA while filing the petition.

The OP needs to be very careful upon entry. Answers to "purpose of visit?" like "to see my fiance" are great ways to be denied entry.

I remember from long ago you had to interview in the country you married in. Is that true of the CR visa also? So this is another thing to look at if you want to go back there for the interview or not.


It is and was true for the K3 visa but not the CR1. K3 is obsolete anyway.

I'm not saying you posted your question in the wrong place. Visa Journey is a support site for people bringing family members to the USA. Getting married in Barbados doesn't get the foreign spouse permission to live in the USA. It just puts you on a spouse immigration path instead of a fiancee immigration path.

You're asking a lot of very basic questions, indicating you haven't read the guides. Unless you are intending to bring a loved one to the USA, it doesn't make much sense to hang out here and ask questions irrelevant to you personally. If you have a foreign fiancee, start by reading the K1 guide. If you prefer to marry before starting the immigration process, study the CR1 guide.

I do not recommend lying. Who you are visiting and why has VERY LITTLE to do with whether you are granted entry...maybe NOTHING to do with it. Having evidence you will return is most important. Best things would be a letter from your job verifying that you are scheduled to return to work on (date), home mortgage or lease, educational commitments, etc. Saying you are here to visit your fiance(e) AND having no evidence of intent to return is a surefire way to get refused entry, blaming it on the fact you have a fiance(e) here is making an error.

TELL THE TRUTH when asked.


Tell the truth, of course, but holiday, vacation, visiting friends or going to Disneyland, (if true) are all truthful answers but more generic. Indicating you are visiting a spouse or fiancee is a sure fire way to face some more specific questions and subject yourself to extra scrutiny. Generic truthful answers AND evidence of ties to the home or residence country is my advice in these situations.

I'm(USC) filling out the G-325A for the beneficiary. The form requests He has lived at one residence since Feb of this year (4 months) and his previous residence from 1995-Feb '10. Both Residents were outside of the U.S., but he hasn't been at his present address for over a year.

From what you write the address from 1995 to 2010 would be the last address outside the US for more than a year.

My Aussie fiance and I are getting ready to apply for the K-1 and are worried about an overstay of 1 day from 2006. He tried entering Canada, but because the woman he was doing a ride-share with was denied, he was too. He left the next day (one day past his expiry date) for the Bahamas.

In 2007 he applied for and was granted a one-year tourist visa. He received another year-long visa in 2009. He was just denied another year-long visa this March.

Keeping all this in mind, what are the chances that he'll be denied entry as my fiance? Should we get married in Oz and have him immigrate as my spouse?

About 0% as a result of a 1 day overstay. For any other reason, near zero as well. Obtaining a visa is a separate question for which odds have no relevance.

I said we (or Karin rather) didn't bring anything special. We had already gathered evidence of meeting but added her boarding passes etc from that trip to the package. If you look at the guide everyone is talking about - there isn't a lot that is needed from the foreign beneficiary at the petition stage. Certainly not things they'd need to bring with them (unless perhaps, things mentioned in #13 & 14 apply to you).

I'd bring the birth certificate - just in case, so your USC fiancé has it - I've seen rare cases where it has been asked for (although its not needed from most folks).


As I mentioned before, the guides AND the I-129F instructions are critical to your success. What you call a birth certificate is not important. You'll need it later, not with the petition filing. It will be a government record of your birth, date, place and parents' names at minimum.

AFTER you read the I-129F instructions, you'll know if you need to bring anything besides the knowledge in your head. You may well need to bring something (like a divorce decree, if applicable) but it will be case specific, not generic. Read the I-129F instructions, both of you.

That's all listed in the I-129F instructions. It will be critical to your eventual success to carefully study the guides and form instructions. It works infinitely better that asking to be spoon fed through the process.

I have a question about the wage and income transcript from the IRS, all it shows is the income from my w-2 and not my income from my 1040 Schedule F, did I request the wrong transcript? I cant seem to find out if there is another transcript I can get from the IRS which will show all of my income. I think I remember reading on here that a person is better off sending a tax transcript then your a copy of your tax return, is that true? or does it just look better having a letter from the IRS?
A little more info on me, I work part time and get a w-2 and I'm self employed, I took to many deductions last year so I will need a co-sponsor. Also I have know other way to prove my self employment income other then on my taxes, I own livestock and get a big part of my income at one time of the year.

How long is too long for the explanation of meeting #18, I wrote mine and went from how we were introduced, to me moving to Nigeria for my PhD research, to our friendship becoming more, to meeting his parents, to the proposal. Is that too much-it is 3 pages too long??? Please help! Any input would be appreciated greatly!


I would answer question 18 within the space allowed on the form. However, since this is Nigeria, your evolution of relationship letter is a good thing to include. You might have a less interested party give you some editing suggestions though. Three pages is a bit much. Keep it to a page if you can. That way, they'll actually read it.

We received a RFE and our Lawyer has contacted us saying it is to do with the Adam Walsh ACT...
She said it is part of a new form USCIS is making people resond to.

Has anyone else had to respond to this and what is it????

In short, a petition receiving an RFE in connection with the Adam Walsh act indicates the petitioner has a criminal history that includes at least one conviction for a sex crime against a person under age 18.

Um, yep, us as well, however his I-94 in his passport specifically says "MULTIPLE ENTRY" and he was told that it means exactly what it says, and after he asked 6 times, the officer started to get frustrated with him. I'm wondering if ANY one else has had this experience and received one?


Never heard of it but I'm sure if he uses the same POE, it shouldn't be any problem.

For a US Citizen, just answer the specific questions on the I-129f with a NO and get on with your life. If you are the foreigner, I hope you like where you live now because you won't be entering the USA anytime soon, if ever.

So a couple months(or maybe even years) ago you had quite a time laying in to my posts! Now I'm back and you're silent.

While you don't always uphold the friendliest of tactics, I do trust that you have a wealth of knowledge!

I've done my homework and read through manuals. (Maybe that's why my posts aren't as fun for you anymore! haha) I've just got to fill in some forms(that were already filled out, but then G had a change of date and we've got to make sure we're submitting factual information!), and print off a few things, but I've basically got it all loosely together. Well, really loose. I was wondering if you had a suggestion on how to assemble the pictures. I have them on an SD card, but I went and had them printed off. There's about 18 that span over my 3 trips to Venezuela. Should I glue them two to a sheet on write on the sheet? Should I print them off on photo paper and type up a caption?

Also, what about mailing off the package. Once I've got the I-129F itself assembled, how should I package it (I'm planning USPS w/ tracking, etc, but I'm referring to the actual packaging of the I-129F "package".)

I would make color copies of the photos on plain paper, as many per sheet as will fit. Use a paper clip or binder clip to keep the papers in order. They won't get shuffled inside the Priority Mail envelope provided in the correct size by USPS free.

List the items in a cover letter and build the stack in the order mentioned in the list.

i entered the states on a B1 visitor visa and on the Form I-94 it says that i should leave before the date "X/Y/2010".
while i was here i married a US citizen and i filed I-130, I-485 and I-765, and i received the receipt notices for the forms i submitted.
my question is:
is it OK to overstay beyond the date written on my I-94, since I filed form I-485, until a decision is made? or should i file for an extension?

As I've mentioned earlier, my fiance is planning on doing his embassy interview in his native country (where he was born and has his residency for the past 11 months; Arabic country) with his European passport (where he spent the vast majority of his life). On the form G-325A it asks for your name to be written in your native language if the alphabet is not in Roman letters. Should I write his name in Arabic on the form or leave it as N/A given that he is applying with his European passport?

Clearly his native language/alphabet is Arabic, so do as asked. You can certainly "write" the characters but you can also have him type them and paste them in. Th I-129F will ask for both name AND address in Arabic, so you'll need to do it there too.

K-1 Fiance(e) Visa Process & ProceduresProblem with I-129F Filling Package

Hi Guys,

I finally sent the packet to USCIS on monday and just realized that I have made a major mistake. I think I may not have attached my fiance's photo with the G-325A. Every thing else is in order.

So, I called USCIS to see if that could be a problem and the gnomes that are sitting there have NO answer for this. I called twice more and each time I got another gnome or gnomette and just told me to contact a immigration attorny. WHAT? I about reached thru the phone and .....

Sorry if I sound so pissed off, specially when I am the one who made the mistake.

Anyway, may be you guys can help me with this.

1.) First of all, how much trouble I am in? --Scratch that, I am already in trouble with the ONE
2.) Will the USCIS still start my application and put me in line and just ask for a photo?
3.) IF not then do I have to start the whole process again but loose the fee I already sent?

An RFE is the worst case. Most likely, they'll just proceed normally but the only thing you can do is wait. Have the photo ready if requested.

I have two Dwi convictions in Texas, one in Oct 2009 and one in Nov 2009, the first was in my car, the second was in a boat, both were class b misdemeanor and no jail time, i recivied 1 yr probation for the 1st and only a $700 fine on the second, my probation is over now and i am staying out of trouble,I have never been in trouble before in my life, it was just a rough couple of months then, I filed for a K1 for my fiance (Philippines) on Feb 10th 2010 after traviling there 3 times to see her, we have all the proof we need for the relationship, i am just worried about the Dwi's. does anyone know if this will affect our visa, she already knows about them and understands i have changed my ways, i totaly quit drinking, I just want to get her here and i dont want this to be a factor. any comments would be helpful. thanks


You will simply answer no to the criminal questions on the I-129F (Even in new math, 2 is not 3 or more.) and get on with life. Unless you have been convicted of a sexual offense against a child, the US Citizen's criminal record will not impact petition approval.

My fiance stated in his declaration of meeting in I-129f that he stayed in our home between 09/02/2009 to 11/18/2009 but the time we had been together is 09/04/2009 to 11/17/2009.. He included the day he departed from US 09/02 and the day he departed from Manila 11/18..
will it lead to misrepresentaion of facts?
please help..


No and if there's any question about it, just indicate he took the dates from his travel itinerary or boarding passes. They'll understand as they know many flights from USA land in Asia two days later.
