Correct. Check your copy of the petition and see how you answered #11 on your side of the I-129F page 1. If you said "No" instead of yes, not only do you need to tell your fiance the truth but they need to be prepared to give your explanation of why you lied on an official immigration form.

A ban isn't a problem to consider, at all. There is no ban so nothing to consider.

The thing to focus on is making evidence of the authenticity of the relationship rock solid. Photos, visits, boarding passes, letters, emails, chats, etc. Being at the interview with the beneficiary can be good. Getting an attorney is up to you; I personally don't think there's a compelling reason to get one.

Although they will probably want to know what the deal was with the abandoned K1 entry before, because it was with the same beneficary/petitioner, it kind of looks more (from where I'm standing) like the trials of a real relationship rather than a years-long attempt at fraud. This is just my opinion, of course. Be honest and thorough and prepared; there appears to be no real reason to deny the visa based on the information you've given. Someone will correct me if this is wrong.


Right and the strongest evidence of a bona fide relationship is time spent together. As I recall the opening post doesn't mention any time spent together since 2007. At least one more in person visit must have occurred in the last two years, to even file the second petition. The more time together the better.

Here's the situation of a friend. She came to the US on a K1 Visa last June 2006. They did not get married with her fiance but stayed in the US at some relative's house until February 2007. Some issues include age gap, the guy being in his 50's and my friend was only 19 yrs old and she was not ready at all to get married then. But obviously, she overstayed because legally, you only have 90 days to be in the US unless you got married.

Now it's 2010. The communication is back between the two of them. To make it short, the love and care is still there, the guy is visiting her again in the Philippines and wants to file another K1 petition for her. I know this road does not look smooth at all considering the issues mentioned. But on the other hand, there MIGHT still be hope. That's why I'm posting this message to seek advice and suggestions on the best approach to do. For sure with the issues they've had, it'll be more than a red flag for the embassy and for the US immigration team.

The previous overstay would incur a three year ban if between 180 and 365 days and a 10 year ban (on entering the USA) if more than 365 days. Just doing the math on paper, at most, she would be subject to a ban from February 2007 to February 2010, so the ban would be moot now or "time served" if you will. At best, the overstay was less than 180 days and there is no ban to moot. I can't tell without the exact dates of arrival and departure. They should expect additional scrutiny of their relationship at the next visa interview but otherwise things should progress normally.

Although it took some work to actually get in and speak to someone, our request was accepted. We received a paper saying that the visa application will be approved once we submit a new medical examination. We also need to pay a new visa application fee.

For reference, we submitted a letter requesting the visa be extended or re-issued and explaining the circumstances why the original visa wasn't used. Just to be safe, we also brought copies of the airline tickets for our return trip as well as my parent's tickets. We also brought a few pictures of our wedding party. Our plan for the interview was to be as nice as possible, accept all responsibility for the mistake and hope the the circumstances around the error would be sufficient. I don't know how much of a risk of denial there really was, but Julie said it definitely didn't feel like the result was guaranteed. I hope that helps anyone else in this situation.


So, how are you supposed to go about submitting the new application? (logistics)

Yes, I saw the explanation in the regional forum. I HOPE they'll reissue but expect they may want another TB test. The Catch 22 is that it is both reasonable to expect a 6 month validity AND to expect the visa holder to look at and adhere to the visa expiration date. I have a hope not a prediction as to the results but am eager to know the outcome.

My fiancee's K1 visa expired, (details here) and we'll be heading to the Guangzhou consulate today to request a visa extension. I couldn't find many postings about extending the entry validity on a K1, so I thought I'd post to ask if anyone had any tips or suggestions to maximize our chances of being successful. I feel our case is very strong, (we didn't notice the original k1 was only valid for 6 weeks and delayed our entry a bit to schedule a wedding party with guests from around china and from the US) but it is very hard to guess how the consulate will respond without knowing the results others have had with similar requests.


I've never seen them extend the validity of a visa. Your situation appears to be one where a reissue of the visa would be in order, so that it is issued with the correct expiration date. If they made an error, they will fix it. If they had a valid reason for the expiration date given, they'll most likely tell you what it was and refuse to grant an extension.

Duh, yeah, Ankara IS the Capital City so yes, that's where the Embassy would be. All dealings will be with the Consular staff, not the Embassy staff, specifically the immigrant visa unit of the Consular staff.

The Istanbul Embassy takes non-immigrant visas, and immigrant visas can only be done in Ankara. This should be an obvious question since the K-1 is a non-immigrant visa, but all reviews on this site that I found are for Ankara and not Istanbul and that caused me some concern since I need to list the embassy on the i-129f petition and Istanbul is more convenient. The Ankara website is not clear and actually confuses the issue some. Any help would be appreciated.


All I-129F petitions are filed with USCIS in the states. You cannot begin the petition process in Turkey for a fiancee. At the end of the process, they will interview for the visa in Ankara.

One of the K-1 documents has an incorrectly formatted signature date on it: 05/10/25, instead of 05/25/10 (May 25th 2010). The other documents filed contain dates from May 25th and May 28th, respectively.

No problem. They'll understand the date in that format because they know it wasn't dated 85 years ago or 15 years from now.

What makes the visa application fee "fair" is that it represents the cost of processing the visa application (including the interview). What would be "unfair" is to continue to have this cost supplemented by tax dollars from people not requiring the service. That we don't like something, does not make it unfair. That one thing costs more or less than another thing results in unequal costs, not unfair costs.

The idea that from filing to green card, the fiance process has higher total government fees, so it's "unfair" is ridiculous. The process isn't the same, so the fees are different. I would call the difference in petition filing fees "unfair" in that the service is the same but the fee is different. I expect the I-130 filing fee to go up soon too but these things tend to happen independently.


On a further note, the $350 visa application fee should be $400 like the immigrant visa application fee because the service is the same. It's an expensive process with "travel" not "fees" as the biggest budget item in all but border town couples' cases.

think of it this way as it relates to cost to obtain green card...

I-130 petition $355 + IV fee $400 + I-864 fee $70 = $825

I-129F petition $455 + visa fee $350 + AOS fee $1010 = $1815

about a $1K difference

The $350 isn't an interview fee. It is for the visa.

So if you get denied...you wont pay it. Eh? There's a bright side to everything....;)

I am glad the K1 still exists. I couldn't put a price on starting our married life TOGETHER. Oh wait..yup...the cost of AOS. Worth every single cent.


It is a visa application fee and is paid to process the application. The outcome from processing may or may not include actually issuing a visa.

You'll save a lot of time, just reading the guides here. Decide if you want to jump through the hoops to marry in the PI take the Fiancee visa route and then learn and follow the applicable spouse or fiancee path including careful study of the guides here and the actual form instructions. In either event, unless you plan to move to the PI for a year or more, you'll be filing a petition in the USA and waiting 5 to 8 months for a visa interview.

Bear in mind USCIS doesn't issue visas.

Send a copy of your passport stamp entering Peru before the petition was filed. Send new letters of intent, one from each of you. Photos together are not primary evidence of meeting. Passport entry stamps and boarding passes ARE. If you didn't send a passport style photo from each of you, then do that too. Do it, in time, or start over after the petition is denied.

First allow me to say this is a great site and thanks to everyone for their input in advance. I have read many internet articles and advertisements and stumbled across this site. (thank God) I have searched but have failed to find this question at least this bluntly stated. I am the USC and my Fiancee is from Ecuador. I have some possible red flags and want to know if the concensus is I need a lawyer or do it myself. I am capable of filling out the forms but am worried also about an omission. Here are the potential the flags.
Two felony convictions in 1985. Only one is supposed to be showing in the records but who knows for sure. Did not serve prison time, probation only. Both are long behind me with no further problems.
Next, Reported income level is Not above the 125% guidlines, and i am self employed.

So, Plain and simple, Hire an attorney or not?

And i'm also curious, Are the "Cupid" websites considered a marraige broker?


IMO, the issues you describe don't scream ATTORNEY to me. However, the decision to hire professional help is a personal one that I think depends on a lot more than whether you have a complicated case. The factors I would consider important are....

1. Do you have the time and inclination to spend at least a hundred hours over the next few months to learn the process?
2. Do you have confidence you can and will read carefully, interpret literally and answer accurately?
3. Does this confidence come from having previously dealt with government forms and agencies?
4. Are you reading and writing skills advanced enough to do as described in 2 above?

There are other conditions and just to cut certain comments off at the pass, I'm not saying people who can't answer yes to all of the above will fail. I'm saying each of these items is something to consider in making your decision.

I sent in my I-129F petition last week for my fiancée and her children so she can receive a K-1 and they receive a K-2. The oldest daughter will turn 18 this month. Now I just read the following on the State Department website(just need to refer to the last sentence in caps):

Children Have Derivative Status
The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is longer than one year from the date of visa issuance, a separate immigrant visa petition is required.
Remember that in immigration law a child must be unmarried. THE STEPPARENT/STEPCHILD RELATIONSHIP MUST BE CREATED BEFORE THE CHLD REACHES THE AGE OF 18.

So what does this mean? Can she(the daughter) still have derivative status through the I-129F or do I have to file another form for her to be able to come over with her mother and siblings? I apologize if this information is already posted on this website but I could not find it. I'll appreciate any feedback.

For a K2 visa holder the step-parent relationship need not be established prior to age 18. For K4, CR2 or IR2, it must. For the K2 beneficiary, the US entry, marriage of the parents and adjustment of status must all occur prior to age 21.

Yup - I should have clarified that - in the OP's case, "N/A" would not be appropriate since you did indeed have one.


Actually, there are three acceptable answers. The A number, NONE and UNKNOWN, as applicable. The question IS applicable, so N/A is never going to be the right answer on this one, IMO but I doubt it would cause any trouble or confusion if born in the USA.

A dependent child with a US passport NEVER APPLIES FOR A VISA. If any question comes up about the child it will be at the interview. The fiancee simply indicates the child is a US Citizen. The Consulate will then drop all questions about a visa for the child.

Part of the confusion here comes from interchanging the terms "file a petition" and "apply for a visa". So, even after all these times you've been told your child will not apply for a visa, you still ask, "When does.....apply for a K2 visa?" The answer is "NEVER".

The link is good but the fee you mention is to adjust status, not file a petition. I see they are lowering the I-129F filing fee but raising the fee to file the I-130. Those are the "family based petitions" not the I-485, though it is certainly part of getting a K1 visa holder a green card.

I am sitting here in Argentina filling out the 129F form with my Fiance. I am leaving for the US on Monday and wont see him again until he arrives to the US to get married! We just want to make sure we are doing everything correct while we are together..

I have several questions:

1. At this time, is the only paperwork we need to send is 129F, and the Fiance intent to start our VJ?
2. Do We need to send the G325 at this time or later?
3. If I was married prior and that person was granted a green card, but was NOT brought over on a K1 visa, do I need to state that in section 11.
4. We have just spend the year traveling around the world, should we put our residence as our "home" address the one we had before leaving? Since we traveled we didnt have any jobs.
5. Will having a laps of residence hurt us?

6. How much money do I need to make in the US to be able to qualify?

Thank you pushbrk. That seems like very wise advice. I just want to feel that I can ask a question here in the future and not get accused of being an idiot or having people give their opinions on my relationship. I am still really upset about the person who accused Julian of abusing me.


You can ask questions and get helpful answers regardless of what else you get. When you give it a rest, it will rest. You can also ask the moderators to close or even delete this thread.

Is this really about my blog? I didn't expect anyone to read it. I sometimes click on people's links but I didn't expect everyone to have an opinion on my life. I'm not changing my ID and I'm not going to stop posting in my blog or edit how I sound there. It's how I work through some difficult emotions.

In these situations, when filing an I-130 prior to hearing from USCIS about the I-129F, I suggest including an I-129F withdrawal letter with the I-130 filing. I've seen it work just fine in a California case.
