Hello,

Today I submitted my I-129F to the The USCIS Dallas Lockbox at the following address:

Is this the Texas Service Center (TSC), or will the USCIS send the packet elsewhere? I prepared the materials myself; however, this wasn't very clear to me.

No, the lock box is not the service Center. Your package will be sent to a service center. FYI, TSC is in Mesquite, a western suburb of Dallas, while the lock box is in Lewisville, a NW suburb. They are about 50 miles apart.

I'm in need of help with a few questions. I found this site looking for more information about filling out the I-129F form and this site has already been extremely helpful.

1. I work for one of the major cruise lines and don't own a cell phone, thus I don't really have a phone number. What should I put for phone number? I don't know if I should put my parents number at home since that's where I am when I'm on vacation or just not list a number.

2. We are working on the ship we are currently on until February then going on vacation. We're working on filling out the paperwork now and planning to send it in within a couple weeks. We're considering doing a couple months more on another ship during April/May to save a little extra money before we get married this summer. Would me being outside of the US/her being outside of Mexico (her home country) when the I-129F is approved be a problem?

3. Since we are on a ship which is currently sailing out of Texas, she has an I-95. We leave the record number on the form blank since that is for I-94s only, correct? The date of arrival is on the form but it doesn't have a date it will expire on it. Should we leave the expiration date blank or list the date we sign off the ship, which is the practical date on which it expires?

I take it she's also a "crewman" meaning that unless, she's planning to stay ashore for at least three months after your marriage takes place, a K1 fiancee visa is probably not the way to go for you. I would suggest you consider marriage first and a spouse visa. Once the spouse visa is in hand and she uses it to enter the USA, she will be free to enter an exit as she pleases and continue to work on the ship.

Does the petitioner have to use full name for k1 visa petition? (forms, letter of intent, etc).
He is a naturalized US citizen and even though he only uses one name and one last name, in his naturalization certificate appears full name.

When a form asks a question, it must be answered truthfully and accurately. Names can be changed but the questions refer to current legal name.

Consular services are NOT provided at the respective Embassy. They are provided by the Consular section which may be housed in the same compound as the Embassy. In Kiev, the Consular section and the Embassy, though in the same city, are separate physical addresses though close in proximity to each other.

As for countries whose consulate in the federal capital city does NOT provide IV visa services include Mexico, Brazil and Australia to name a few more



That's correct. Consular services may or may not be housed in the same compound as the Embassy. This is why I prefer to refer to Consulate instead of Embassy. The exceptions I was asking about were not the list of countries the do family visas in a different city than the Capital, as that would be a very long list indeed. It was about which countries provide such services in more than one city.

As an aside, the location in Guangzhou where the Consular IV unit provides services, is NOT the actual Consulate, so in this case the IV unit isn't even housed at the Consulate, much less the Embassy.

It's not a China thing. Any country only has one Embassy in another country and it's always in the Capital City. Consular services are provided at both Embassies AND Consulates. India and Canada come to mind as exceptions to the general rule that petition/family based visas are handled by only one Consular unit in each country. Are there other exceptions?

Today, I sent the I-129F to the USCIS lockbox in Dallas. My fiancee in China, Zoey, placed the Guangzhou embassy as the one she would use (I-129F Question 20). Someone told her it was the only one that performed K1 visas and medical exams. Just noticing this (unfortunately) today, it somewhat concerns me as the Shanghai embassy is much closer to Zoey's home. Does anyone know if it is possible to change the embassy from one place to another after the I-129F has been submitted?

Whomever told her the Guangzhou (Consulate not Embassy) was the only one that would interview for and issue a K1 visa was absolutely correct. However, unless something has recently changed, I'm pretty sure she can get the medical in Shanghai.

Hi - We sent our paper work in last week and received an email with the a case number which when we looked on the USCIS website gave this status ... :

INITIAL REVIEW - "On December 3, 2010, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice...."

Question ... does this mean we reached NOA1 on December 3 ? If so, it seems very fast!

Their visa application ($350) and medical exam fees will be the same as their mother. After arrival and marriage, their adjustment of status fees will be lower than their mother if all are filed together, so $720 for each child and $1070 for your then wife.

Employed people state their current income which may or may not match any tax return. For salaried, state the annual salary. For full time hourly, multiply the gross hourly by 2080.

It would seem that is a time window when you could accomplish the fiance visa process. You can file before you start working and then be sure to be working at the time of the visa interview so you can declare sufficient current income.

Sometimes here we bluntly say, "No money, no honey." There are practical aspects to marriage and often those practical matters influence our practical life decisions. Each of the members here has gone through or is going through a similar process with similar financial issues, and it IS expensive to bring a loved one from abroad. The sponsorship requirements reflect the reality that you and your foreign loved one are responsible for your own financial needs, not the US taxpayer.

Hello everyone :)

I just want to say everyone in the community is so helpful (I've been lurking here trying to find more information about the fiance visa).

This is my situation. I have been dating my fiance for the last 3 years and we really need to see each other more often. It's extremely hard to see each other for about a month or 6 weeks a year... it's extremely difficult :(.

The problem though is that I'm currently a medical/PhD student and I graduate in 2017. Can a fiance visa be approved if you are such a student? I have great grades so I don't see myself dropping out anytime soon. I've also urged my fiance (who lives in Germany) to save up money for a student visa, but in Germany salaries are low and he only makes VERY LITTLE. It wouldn't be enough for a year of studying with a student visa. Plus, could he even live with me if I'm renting out a place (ie. single bedroom apartment)?

Another idea is that in 2012, I've gotten approval for 1.5-2 years off to do paid research work to finish my PhD degree. I could file a fiance visa then (since I can show I have funds to support him and since I've been reading it takes about a year or more) and if it goes approved we could finally live together. But then I'd go back to finish my medical school and won't be able to work until I finish my clerkship years (2 years). After that I'll be working again. Would this be feasible?

Also, his mother (who lives in California with his 3 siblings--who were able to come to the U.S. because they were under 21, while he had turned 21 the year they moved to the U.S.) filed a visa for him (I'm not sure which one, but I think it's the one where you request your unmarried son 21 years or older to come to the U.S.), but that could take YEARS.

He's also entered the dv-lottery...but the chances are not that great.

I just wanted to know my options, because my fiance and I are at our wits end and we just wish to be together. So please help me out with any kind of input. I would LOVE it and very much appreciate it! :)


If you will marry within 90 days of his arrival, I would simply file the petition now and when the time comes, use a cosponsor who qualifies financially.

You send a letter to "WITHDRAW" the existing petition. Then you go to Nigeria again, get married and start over with a spouse visa process. This time be very prepared. Since they are in Nigeria, you will k=have to do K-2 to follow visa OR CR-2 visas. I would try the K-2 to follow if you can. AFTER your fiancees visa is approved, the petition needs to be sent to the Lagos consulate and you can make an interview date for them there. The interview there will need to be within 12 months of when your fiance's visa was approved. Discuss this with the London consulate and they should be able to forward the petition to Lagos. I qm not sure if they need to go through NVC to do this or not. I did work with a similar case where the fiancee was in Canada (Vancouver) and her children were in Manilla. It worked out OK but I am not sure of the exact details or forarding the petition. Start with the London consulate visa section.

Well there is a code stamped on his passport, but when I looked it up it said it only had to do with the fact that he was denied entry. He admitted to wanting to marry and stay in the US. You need to find out if he was allowed to voluntarily withdraw his entry application, or was subjected to expedited removal. If he was allowed to voluntarily withdraw his entry application then he is not subject to a ban, and no waiver would be needed to reenter. If he was subjected to expedited removal then he was effectively summarily deported, and he's got a five year ban. An I-212 waiver would be needed to reenter.

This is possibly a silly question, but why Make TWO copies of the entire package?
I understand one is for security reasons, in case it gets lost in the mail, but for the interview, will I have to hand over an exact petition package replica besides all of the originals? (like my divorce certificate, k2 birth certificates, etc.)


One copy is for you and the other for the foreign beneficiary. They need to know exactly what's in the package for a number of reasons including to study the petitioner's G325a and to have available a copy of anything that may have gotten lost during the process.

I recommend scanning the whole stack and burning a single PDF file of it to a CD. Keep the CD but also upload it to your computer. That way, you have a soft copy as well as hard copies. You want it to be a single file, so you can scroll through each page instead of a a separate file for each page.

Until she answers the question about signing anything or having some codes stamped in her passport, we don't know if her lie is on record. Being denied entry, in and of itself will not impact the process but a record of misrepresentation is a serious issue impacting US entry for a lifetime.

No, the I-129F petition (not the K1 anything) is to be sent to a lockbox facility in Texas but it's not the Texas service Center. Check a map for the physical address of the lockbox in Lewisville and the service center in Mesquite.

To what are you referring to as a "cover sheet"?

You aren't filing any applications. If you're mailing to a service center, you're filing a petition. You'll be mailing to a special "lockbox" facility where they'll do intake on your package, then forward the petition to a service center.

Hi guys, we´re finally puting together the petition package!
We have a question. Since all the stamps are in my fiance´s NON US passport, does he has to write a note or something to clarify why he use his US passport to enter my country?
First three times was because he still wasn´t a US Citizen, but last time he chose not to to avoid entry request fee (based on reciprocity).
And just to reconfirm, since the Proof of Citizenship we´re sending is his Naturalization Certificate, we do not need to send copies of the US passport, right?.

No need to send the US Passport but your question contradicts itself. You say both that he did and didn't use the US passport to enter your country. I take it he didn't, so his US passport contains no meaningful evidence.

I don't understand your question. A visa to visit China will be in both Chinese and English. The visa, along with the stamp indicating entry and exit from China will serve as primary evidence of meeting in person. When the Chinese fiancee receives her K1 visa, it will be in English as well.

Please clarify your question.

If you haven't met yet, be sure to keep your boarding passes and send copies of them as well.

So she gets a visitor visa and comes to the US. And what? He has to PROVE he can support her financially TWICE during the K-1 process. Having a passport revoked because of non-payment of child support will mess that up. Unpaid child support and/or unpaid taxes ARE counted against whatever income you make.


See bold above. It is not true that having a passport revoked for child support arrears will disqualify a sponsor. As you well know, debts are not considered unless there's an IRS lien. I'm intimately acquainted with a case where the petitioner's passport was revoked after the meeting and marriage and was still revoked when the I-864 was executed and visa issued. Shortly thereafter the child support was caught up and all is well. The petitioner is an honorable mane who manages money well but fell behind due to a 90 six month period of layoff. He paid, but not in full and California has a $1,000 threshold instead of using the higher federal one.

Unpaid taxes are only an issue if the IRS has invoked a lien and you cannot show you've made and are keeping a payment arrangement.

None of this applies to the case in question at this point because they haven't met in person. I'm just correcting incorrect assertions.

If you have enough income that will continue from the same source once you move to the USA, that can be stated on an I-134 and documented. If you have three times the income requirement in liquid assets in your own name, that can be stated and documented as well. Regardless, the US Citizen must provide an affidavit of support. In come that will not continue from the same source is not counted.

The USC does the financial sponsoring, the immigrant is out of the picture.

I had my fiancee mail the (1) G-325A, the (2) Intent to Marry letter, and (3) a signed additional sheet to the G-325A. It has not arrived yet...and I'm ready to file my I-129F except for these docs. Also, I think her letter of intent to marry should be re-written...so I'm seeking a fast (but approved) way to recreate it without dealing with slow snailmail.

My question is, can any of these forms/statements be submitted as scanned copies with my I-129F petition I'm about to file? I have a feeling that the answer is "no"...so...just thought I'd ask. I know they can require you to produce the original later, but does such a move subject my petition to rejection or delay? If so...which of the 3 documents mentioned above is critical that it be original?


You can get by without a signature on the foreign beneficiary's G325a but it must be on the letter of intent. Snail mail is a choice. You can use a courier.
