K-1 Fiance(e) Visa Process & ProceduresQuestion about prior spouse name on I-129 F petition

i just check i-129f and my questions was regarding part7 no 9  other names used i wrote her name full name with her ex husband last name is that ok?

Yes, of course but this thread is about what name to write for a former spouse, not for your current fiancee.

what is a maiden name i google it says is her name before marriage? i wrote her full name the way it was when she was married...

Yes, her maiden name is the name she was given when she was born. If you did it wrong, change it. If it's too late, it's too late. Simple stuff.

On question #9 on the the I-129F petition, about the names of prior spouses, what name should I put there? Should I put her maiden name or her married name?

Use the maiden name, just like on the G325a.

It occurs to me that both names will be on any tax returns provided as supporting documentation for affidavit(s) of support.

I should add that it is quite common for the applicant to be asked about the relationship to the sponsor. You should count on that happening and be prepared with a truthful answer.

I hope to be working again by that time... Using my family is a no go :( It's been 6 years since I converted to Islam and they still have not come to grips with that.... And when they found out I was marrying someone I met online they thought I had lost my mind..... Would it be posible to use his siblings spouses only?????

Yes, if one of them qualifies. If they have the same family name, it would hardly make a difference though.

K-1 Fiance(e) Visa Process & ProceduresWondering????

As Salaamu Alaykum,
Happy New Year to everyone I pray we all are reunited with our loved ones in this new year....

I have a question I hope someone will be able to answer. I will be going to Morocco to legally marry there. I will be staying for about 3 months. I am wondering if it is ok to prepare all of our papers for CR-1 and then send them back to the states to have someone send them in for me???? Or do I have to wait until I return to the states????? Also I was recently laid off my hubby has 2 siblings here in the states both have received their 10 year green cards. Can they and their spouses be listed as sponsers????

You do not have to wait until you return to file the petition. Sponsorship issues are dealt with after the petition is approved months from now. Yes, permanent residents can act as joint sponsors but I would avoid using the foreigner's family members if possible. Using those family members in the USA to sponsor adds to the suspicion of a fraudulent relationship and you're already dealing with one of the more difficult Consulates. A job of your own, or using your own family as sponsors if needed would be a better choice.

K-1 Fiance(e) Visa Process & ProceduresK-1 to 'travel' visa?

I thought about that too, but then I realized that she also owned the business when she left to come to the US with a K1 visa. I don't see why a consular officer would accept it as a "strong tie" if she'd already walked away from it in the past in order to immigrate to the US.

Just sayin'...

Good point.

K-1 Fiance(e) Visa Process & ProceduresK-1 to 'travel' visa?

In my 3 attempts to obtain a tourist visa my husband & I learned that the above is exactly correct. I was denied 3 times. My husband tried the logic you indicate. It doesnt apply when you understand the policy & procedures.
We have houses, land & business in Thailand. Doesnt matter. What does matter is the stongest ties rule. Your wifes ties are to you when you enter the USA. That is exact what they officer explained to my husband. Its impossible to over come that fact. At the POE they would turn her away if she did have a tourist visa & an American husband. We were told they would never issue a tourist visa to anyone married to a USC.
As a Thai female I would stongly suggest you follow rsns' advice. Ask her to give this new life in a new country a chance to succeed. What he suggests are basic to our happiness here. Ask her to try this until next summer.

Sounds like wise advice. She can certainly visit Thailand for extended times, even up to a year and potentially more without losing her US Permanent resident status. If she can use Thailand visits of less than six months until she's been a green card holder three years, she can become a US Citizen. Then, if you want to move to Thailand, there's no issue. As Citizens, you both can come and go from the USA as you please.

K-1 Fiance(e) Visa Process & ProceduresK-1 to 'travel' visa?

Slim and none? Hmmmm. Why? If she qualified for a K-1, we marry, she DOES NOT overstay, returns to Thailand (where she owns an established, successful and legitimate trucking company), I am a US citizen in good standing, then why why why would it be difficult to obtain a visitor's visa? With upwards of 20,000,000 illegal aliens running around the US you think they'd give some consideration to a person who has already met the requirements. Am I being naive?

Everything others have said is legitimate but if she actually has substantial holdings and an ongoing business in Thailand the chances lean more towards the slim than the none. It's still iffy but the chances are better. If YOU also are involved in her business or have permanent employment in Thailand, it moves more in favor of success. You just have to be prepared for the strong possibility that she won't obtain any visitor privilege.

K-1 Fiance(e) Visa Process & ProceduresK-1 to 'travel' visa?

. After we move to Thailand is there any way she can travel back with me to the US for short periods of time...i.e. a 'travel' visa? Is there any path from a K-1 visa to a travel visa?

Is there any way to legally extend her stay after we are married without filing for a change in status? Is there any point in filing the I-485 if she does not intend on becoming a US citizen?

Probably not to the first question and no to the second. Probably not, because with a USC husband she will always (by law) be assumed to have immigrant intent. She would need to show extremely strong ties for both of you to Thailand to be granted any visitor visa. From Thailand, chances are slim and none, IMO.

K-1 Fiance(e) Visa Process & ProceduresHow to present Proof

Thanks for your replies. So do I just make copies of the boarding passes and then write on the copy what they are or do I write it on the back. If I ue real photos what size should they be and do I write on the back of them.

Legible copies of boarding passes will need no explanation. The reason I suggest EVERYTHING be on full sheets of paper is to avoid anything falling out and being lost. If you include anything smaller, you're assuming the risk of loss.

K-1 Fiance(e) Visa Process & ProceduresHow to present Proof

Hi,
I am just starting to get my USCIS packet together. I was wondering if anyone had good examples for the best way to present the proof of meeting and ongoing relationship information. I looked at the example forms but I guess I did not see what I was looking for. I guess I am a more visual person than reading it on the directions. I have tons of proof, but just do not know the best way to present it. Do you us actual photos or do you print them on paper? Any help would be appreciated.

Bear in mind that what you have is "evidence", not proof. That said, I suggest printing multiple photos on full sheets of plain paper. As long as the two of you can be recognized, the photos are clear enough. Photos are secondary evidence of meeting in person and when submitted with the petition have some minimal impact at the interview stage and zero impact on petition approval.

Primary evidence of meeting in person is critical and needs more focus at the petition stage than photos. Good legible copies of boarding passes and passport stamps are the best primary evidence of meeting in person.

K-1 Fiance(e) Visa Process & Procedurescertificate of citizenship number

i'm a naturalized citizen. Do I put my old A# or unknown? This is confusing.

As I said, your A number is not your naturalization certificate number. The Naturalization certificate will have it's own number PLUS your A number on it. If you don't know your Certificate number write Unknown.

It isn't asking for it. Just write N/A if you were born in the USA. You provide the certificate number only if you check the naturalization box. It's a confusing section.

K-1 Fiance(e) Visa Process & Procedurescanceling k-1 petition

Being engaged is not a issue with Immigration only that you intend to marry within 90 days on entry using a K-1. They really are not concerned if you are engaged or not; you don't have to provide proof of that .

If you can sign a letter of intent to marry, you are engaged, at least by any definition used in an immigration process. All it takes is, "Will you marry me?" and "Yes." to be engaged.

K-1 Fiance(e) Visa Process & Procedurescanceling k-1 petition

i just got the receipt of k-1 applicaiton, now waiting, but now i heard that applying for Student visa for my girlfriend might be better off so she can stay here as long as she is in school and we won't be rushed in to marriage decision.

so I want to know is it bad to cancel the petition and have her apply for student visa? will the petition leave a record and immigration will notice and reject her student visa?

thank you, just want to know the pros and cons.

The decision that you'll marry within 90 days of entry would have been made prior to signing letters of intent to that effect, right? Having a petition filed for her and her having a US Citizen fiance will both be evident to anybody making a decision about a student visa. Those two facts will demonstrate clear immigrant intent. People with immigrant intent are ineligible for non-immigrant visas. All student visas are non-immigrant visas.

This is a discussion that should have been completed prior to filing the I-129F petition. You're asking for a lot of trouble to go down this road. Each step will dirty the previous one so that when the student visa process fails the previous I-129F and the student visa attempt will both tend to lead a Consular officer that getting to the USA was the real issue, not your relationship, regardless of whether it's true.

Since you've already filed and it will be several months before any visa is issued and several more months before it HAS to be used, that you use that time to build your relationship as best you can. That way, perhaps neither of you will ultimately feel rushed into marriage.

K1 is a fiance(e) visa. By definition, the couple has already made the decision to marry.

K-1 Fiance(e) Visa Process & ProceduresPassport Question

I am having trouble comprehending what it means by "Validity of atleast 5 years" , does this mean it was valid for atleast 5 years when it was issued, IE, I got it in 2002 and it expires in 2012, or does this mean that it had a life time of atleast 5 years, in this case mine had 10 years.

Someone please clarify.

It means the passport when originally issued, had a validity of at least 5 years. Adults are issued passports with 10 years validity. Evidence of citizenship can be accomplished with any US passport issued with 5 or 10 years validity even if it would expire next week. Take this to the bank and discard the speculation that conflicts. Ain't my first rodeo.

K-1 Fiance(e) Visa Process & ProceduresAffidavit problems

He wasn't naturalized. He got his citizenship through his parents, which would be option "b".

I agree, though. His citizenship has been established or his petition would not have been approved.

florin3k3, you probably shouldn't overthink this. You don't need a certificate of citizenship in order to prove you're a US citizen. If you like, in the space after option "b" you can write "U.S. passport #xxxxxx". Or, you can just write "n/a". You can probably even leave it blank. The I-134 isn't one of the forms which are required by either statute or policy, so consulates tend not to be ####### about how you fill it out. Their main focus is going to be on the financial numbers you provide, and the income evidence you submit. Your citizenship has already been established, and the consulate will not deny the visa for this reason unless they are absolutely convinced that USCIS made a mistake in approving the petition.

If you end up needing a joint sponsor then you'll still need to submit an I-134 for yourself, but your joint sponsor will have to submit proof they are either a US citizen or LPR and domiciled in the US.

i applied for a k-1 viza and have been approved. now i have to file the affidavit of support to show that i can support my fiancee when she arrives here. i started to complete it when i noticed it asks for either:

a. if a citizen through naturalization, give certifiate of naturalization number ______________
b. if citizen through parents, give certificate of citizeship number ___________
c. if citizenship was derived by some other method, attach statement of explanation _______
d. if lawful poermanent resident, give A-number _______
e.if lawfully admitted nonimigrant, give fom i-94 number ______

problem is, i got my citizenship through my parents but never got my certificate :((( i haven't needed it so far and was planning to get it this year. i put it off because of the holidays since i didn't have the 600$ it costs to spare. what can i do!?!?!? the processing time is 5 months!!!
can i somehow choose option "B" but specify that only have a pasport and put the passport number? will that work or am i sh** out of luck?
please let me know if there are any options i might have.

cn i get a diffeent person to be the sponsor or am i obligated to be?
any help would be awesome...thanks

In the space for a. enter "Unknown" As the petitioner, your citizenship status has already been established. If you qualify as sponsor based on your own current, ongoing income, you don't need a cosponsor.

K-1 Fiance(e) Visa Process & ProceduresDealing with my RFE

Boarding passes are good. If the official looking at the evidence sees the itinerary and boarding passes (matches them up) that's good. Pictures aren't considered primary but they help. Out of the things you sent, only the boarding passes would be considered primary. When I wrote my "how you met" I mentioned the itineraries among other things. Wrote something like "Traveled and met from XXX to XXX, then YYY to YYY etc, Itineraries and boarding passes for trip XXX, Trip YYY etc are included in evidence of meeting section."

Depends on the officer you get, whether or not you will get an RFE (Request for Further Evidence). Either way, an RFE won't reset the whole process, it will mearly delay it 2-4 weeks (average), depending on how quickly you respond and how quickly they get to it. Just have copies of the passport/passport stamps ready to go just in case you get an RFE

The actual boarding passes will be sufficient primary evidence of meeting.

K-1 Fiance(e) Visa Process & ProceduresDealing with my RFE

Another thing that could work (well, it worked for me anyway) is sending in bus tickets with your names on them, if you had travelled long-distance by bus in the US or other countries. My ex-fiance and I had sent in bus tickets with the date and time on them, as well as our names, to prove that we had travelled together. If you had travelled together in the US by airplane, you could also send in the boarding passes since your names would definitely be on them and the dates would coincide with each other.

Sorry in advance if my suggestion is not valid, but it worked for my ex-fiance and I, we had no RFEs and our NOA2 came in a little over two months.

*Edited some info.*

With your names on tickets taking the same bus, train or plane, that's primary evidence. Actually better than passport stamps and boarding passes but few actually have such evidence. Good stuff.

This was just my experience and that's what I sent. I did not even send passport stamps as CBP did not stamp one on my passport.

USCIS tends to be pretty lax on meeting evidence for Canada due to proximity AND seldom getting passports stamped. But that's Canada, not the rest of the world.

K-1 Fiance(e) Visa Process & ProceduresDealing with my RFE

You could also send proof of payment for the flight, such as a bank or credit card statement, along with the itinerary:)

You COULD send pretty much anything but paying for a ticket or printing an itinerary are evidence of actual travel, so not primary evidence of meeting.

Did you book your air ticket online? Do you still keep the email confirmation from airlines that matched your dates of travel?

Aaron and I had visited each other few times before we filed but we did not keep all boarding pass stubs coz we had not planned to step forward at that time. What we sent was air ticket confirmation emails from airlines, one boarding pass, some movie tickets matched the dates of presence. Our photos were not "film-dated"

Airline email confirmations are not evidence of actual travel. Passport stamps, boarding passes and receipts in country ARE evidence of actual travel. That's what's needed.

'Film-dated' is a function of many digital cameras.

No, it is not. Film dating is a function of SOME actual film cameras. Digital cameras can put a date on the digital file but not on "film" as there is no "film". When USCIS says "film dated" they are not referring to digital photos. It's actually an outdated term.

Got my hard copy for my RFE yesterday, basically I did not send primary evidence that we met in the last two years. What I did send were pictures (not film-dated), and airline stubs (had date but not year). I have a feeling that all they are going to want are copies of all my passport pages, which the RFE did state was wanted, and I feel really dumb for not sending this in the first place. And what is a "film-dated" picture anyway? So will the passport pages be enough? I had someone tell me outside of VJ that I should have them notarized. Thanks!!

I would send a color copy of all pages of you passport. No need for notarizing them.

It depends on your state.
Try doing a google search for '<insert state> marriage license cost'.
For instance, in Illinois it costs $30.00 for the marriage license.

Right, and depending on who officiates at the wedding, they may charge a fee or expect a contribution, etc. but those costs have nothing to do with immigration or visas.

K-1 Fiance(e) Visa Process & ProceduresMeeting requirement question

Hello I'm new to VisaJourney.com but have read many posts but couldn't find my specific question. My question is about the meeting requirement in preparation of the I-129F form. I have met my girlfriend face to face in the Philippines although I had not met her prior to going there. My best friend was going there in order to be married so I went with him to assist him (he's in a wheelchair) with everything, and I stayed for 21 days. My best friend's wife's cousin came along as a chaperon and that is how I met her. We started a relationship while in the Philippines and it has blossomed into love. It's been about 7 months now and I'm going to propose to her soon. I have my boarding passes, passport stamps, hotel receipt, and photos of us together. I also have cards/letters she has sent me as well as phone records, Yahoo chat logs, and Moneygram/bank receipts (remittance).

My question is, does my meeting her on that trip satisfy the I-129F meeting requirement even if she wasn't my fiance at the time that we met?

Thank you in advance for any comments or opinions as all are appreciated.

John

Yes, absolutely and your boarding passes and passport stamps will be your primary evidence of meeting.

K-1 Fiance(e) Visa Process & Procedureswhat is "file number' in the g325 a form??

For the g325 form, if you are a US citizen, you do not put anything next to the "A", just write the word "NONE". That is for legal resident aliens, they would have an A-number.

my fiance also had a national ID, he does not need to put that number, instead a translated copy of it should be sent when the embassy asks for it (they did for my fiance in Packet 3).

for your last question, were you born here? those questions pertain to you if your were NOT born on US soil. If you were not, you're going to need a copy of your certificate. Its going to be worth having because they will ask for copies of that. If i remember, there is another option where you will have to type a statement where you explain how you got your citizenship. But it would be very wise to have that certificate.

Good luck on filling that form. You know what really helped us filing out all that governmental jargon? Go to your local library and find the book "Fiance & Marriage Visas - A couples guide to US Immigrations" by Nolo. Nolo Book this book explains everything very clearly step by step in simple to understand English.

Best of luck to you. :)

The OP doesn't need a citizenship certificate if he has a US Passport. He can just check the box for citizenship through parents and leave it at that. Everything after that answer in the Citizenship block is N/A. The correct answer for A number or file number in this case is "Unknown" not "NONE" but if you type those words the form will just enter all zeros. No problem.

K-1 Fiance(e) Visa Process & ProceduresRejection Notice. One or more of the following field(s) were not completed: 'Part B Address'

Thank you, I hope so too. I abbreviated the months too, that's how it was on the example form and I checked back and on the I-129F example form, in Part B when it asks State/Country, it says Australia (so I put only GERMANY) and when it asks for State or Province in Question 15, it says NSW (so an abbreviation as well, that's why I put RLP). I thought the example forms where pretty trustworthy *sigh*

Thank you for your help, I'll keep you posted. If everything went fine, we should get something in the next few days...unfortunately the servers at my fiancé's bank are down and so he wasn't able to check if the cash was checked since Jan 14th

Abbreviation of the Province is fine but the country must be clear to a US government worker. The country is entered multiple times and in many fields, long country names, like PHILIPPINES won't fit. I recommend spelling out the country name completely in ALL CAPS wherever possible and when there isn't enough room, spell it as completely as possible. They'll see it spelled completely very nearby, so will understand.

Certain abbreviations, like USA, or UK are clearly understood. GB might be but I have no experience doing it that way. The Scottish, and Welch can use either Scotland, Wales or UK without issue for country name, nationality and citizenship,

For "mail" only the country name must be clearly readable but there's a different standard for getting correct information into a database by a government worker.

For instance, we always address mail to China in Chinese. The only thing the US Postal Worker can read is CHINA. That wouldn't work for an immigration form except where the name and address in native characters is asked for.

K-1 Fiance(e) Visa Process & ProceduresRejection Notice. One or more of the following field(s) were not completed: 'Part B Address'

Hi fellow I-129F'ers,

So after 15 days of sitting, waiting and hoping everything was going fine with my petition, I've received the dreaded rejection notice in the mail today including the uncashed check and original I-129F packet I mailed to them on the 3rd of January. Reason given: 'application/petition has not been fully completed: Part B Address.' Talk about incredibly horrible luck!

Now the thing that has me scratching my head is that I've gone through the entire section of Part B with a fine tooth comb and have come up with only minor details they might be referring to. But it's all up to interpretation.

These are the possible reasons I've come up with:

Under Information about your alien fiance(e),
- Question 2 Address, Apt. # was left blank. Perhaps an N/A was necessary?
- State or Country: I put "MIDDX, GB". This is the abbreviated form used on all posts. Should it be written out as Middlesex, Great Britain? Also, as it says State or Country, should I just leave the Middlesex part out all together and just put Great Britain? Or put both as Middlesex, Great Britain?

On to the next page, Part B. Information about your alien fiance(e) (Continued),
- Question 15. Your fiance(e)'s address abroad, under State or Province I put, "MIDDX, GB" as before. Perhaps maybe it was the GB that threw everything off as it did not ask for country. Should I just leave it as Middlesex?
- Question 15 continued, for Country I put simply "GB", however should this be written out as Great Britain?

To me, these seems a bit nick picky, but then again I was prepared for this. Or at least I thought I was. Weeks going into the preparation of this packet and it's sent back with a minor detail wrong or missing in the address.

What are your folks take on this? And would it do me any good to give them a call to see if they can offer any specific help? Or would I come up empty handed? You'd think and hope they'd be a bit more specific, especially since two people's futures and a very special day is depending on this!

All the help you guys can offer in this matter is truly appreciated.

PS - Each page returned to me has numbers printed vertically along the right side. Will I need to redo each page all over again, or leave things just the way they are, only including the changes made to 'Part B address' on the form?

Spell out the city where asked and use UK for the country and send it back in. Leaving apartment number blank is not a problem. The address is to be understood by an American, not a British postal worker. Down in section 15, there's room to spell out the complete address, city and province but still use UK as the country or United Kingdom, if it fits.

Out of ease, is it possible to just submit a copy of the W2?

Thanks,
KK

If the return isn't filed yet and there's a history of good income from the same job, that would probably do, particularly for London but it's best practice to file the return ASAP and provide a copy.

Thanks for all your answers! I still don't know about the 2010 forms. Let's suppose the interview will be in March. Can we take the 2010 forms?
Blah... I hope I'm making sense...

Forget about "which forms". You take a copy of the complete tax return. Simple.
