Thanks for the input. He has not physicaly abused her and I understand that this may be a weak course of action trying to adjust on her own. They already sent the AOS in and recieved a request for additional proof and was given a deadline of july 11 to submit them. He will not open a joint account or anything like that. I really don't understand why he would have spent all this time bringing her and the kids over just to give her the finger, but stanger things have happened. I am just attempting to get an idea of her chances of success if he is still unwilling to complete the adjustment process.

PhilippinesPinay in trouble
Hey all, Since my wife got here we visited her sis-in-law. They live in the boondocks and he is very verbaly abusive and won't let her go anywhere and now as they started her AOS(she is on K-3) he is refusing to provide proof of relationship such as bank acct, ect.She is here with her two kids who both have their 10yr grn cards. Anyway, the husband has kicked her out of the house when they argue about needing the proof for AOS. The kids are staying with us for now. How can the Mother adjust status without the other proofs? Does the ongoing abuse come into play? Thanks for any input.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions about taxes
hey mel,
its up to you,but i am in the same boat this year and last year.i did not want to confuse some IRS employee by submitting any overseas finance docs.so i jus filed normal 1040EZ.besides you dont want your return flagged and sitting in a pile waiting for a supervisor to review them when you may need a speedy file completed. I will need these docs to send to my wife for her interview and dont want them tied up.I may be alittle paranoid but I jus dont have alot of faith in the IRS's ability to promptly deal with something "different".Besides, will you really come out on top doing this. I figured it out and for me the gain was nowhere worth it. Good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresMaiden Surname for Police Certificate
hey ruth,
if i understand correctly, Yes it sounds good. the italian will need to use the name u used while there. ur maiden name!the NVC will have ur maiden name on the forms ur hubby submits and will have copies of ur passport(s) coz u have to send those also(if i understnad the process correctly). It is normal to take ur hubbys' last name, so all the pieces of the puzzle should fit together jus fine.if i am incorrect bout any of this i'm sure someone here will point it out. none of us like/need misinformation.my wife will be getting her police clearance from HongKong so it will also have her maiden name on it.good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice Clearance for NVC
Hi All,
In researching things I see that I must Submit Police Clearance to NVC from Hong Kong for my wife,as she worked there for 4yrs, if we intend to follow CR-1 route. How does She get the required letter from the US Embassy in Manila to send to HK requesting this. The HK police say that the letter must come from the US embassy stating that she is under visa visa process and that she needs a police report to be sent to the embassy. Thanks for any help or even just clarifying things if I am misunderstanding this.

you can register for an account at the USCIS website.they may or may not send you update emails.seems alittle hit-or-miss.many people use this account to monitor thier "touchs".for whatever it is worth this can provide you with alittle idea if anyone is handling your file from time to time.Hit or Miss.

Somtetimes I love this site becuase of the helpful people and sometimes I cannot stand it becuase of the judgmental ones. We are all going through difficulties due to this situation, some of us more than others. Some of us have a abundance of patience and some of us have none. Some of us go insane waiting on this process to see completion some of us are already there blink.gif But all in all we all are waiting and suffering becuase we do not have our family members here.

I do not believe calling the RFE line to get information is holding up anyone elses case just as I do not believe that "not" calling if you do not have a RFE makes you "RIGHT" But just like everyone else this is just what I think. But really as long as you have satisfied your own conscience that should be all that matters! Get a grip people and lets try to encourage one another instead of always beating each other down over pettiness!

"Getting a grip" means not abusing a process put in place to help petitioners with legitimate RFE concerns over you just trying to 'satisfy your conscience'.

WOW!!! Look Ma, the caged animals are turning on each other.Get the hose on 'em,quick!!

Hey,

We are trying to prepare the packet for NVC with the letter from my husbands job etc.
However, there´s a small problem.

My husband has not filed taxes with the IRS for several years, and theres not really any valid excuse why he hasnt. Is there any suggestions to how we can deal with this??? blush.gif

Also, will the uscis just send the approved petition on to NVC without further notice and when should we expect to receive the first bills and packages from NVC???. I checked on the USCIS page where we have created an account to receive emails and it hasnt been touched since May 22 when we was approved, so I really have no clue whether or not the case has been sent on to NVC.

Im not sure if I got it right, but from what Ive read on here, we will both receive a packet. Is the package I will receive out here in Europe full of papers I will have to send back to NVC or is that the papers I will need to bring along to the embassy for my interview???.

I noticed that the choice of agent formular I will have to return to NVc or can do by email, but what about the rest???

hello Ya,
I am only going to reply to your most immediate problem:TAXES!!! Your visa approval will not take place until the tax issue is dealt with. This is very serious sh-t here in the U.S. I had not filed my taxes for a few years before i met my wife and after realizing the impact this ignorant act was having on not only my life but now my wifes' life I called the IRS and threw myself to the wolves. Note to self:Begging does note help. Penalties&Interest accumulate very quickly. All said, I filed my back years And set up a payment plan so that i would not be "Not in compliance". Many people have their own stories about dealing with the IRS. I got some advise from a tax pro and i followed it:
1. Start by filing the last 3 years returns(if you have more than that only file the last 3 yrs initially)
2. Don't be aggressive, rude or a smart-### to whoever you are talking to on the phone.(good advise for day-to-day life).Remember your the one that Screwed the Pooch, not the Shmuck on the phone.
3. If you dont owe, they will just take some penalties out of your returns and send you the rest, however most serial nonfilers owe for each year.Odd how that works!!
4. If needed set up a payment plan that you know you can deal with. If you can pay them off in full,GREAT!!. Do it. Because if you are doing a payment plan with the IRS aka. "THE MAN" and you miss a payment your agreement with them is Null and Void ...payment in full due immediately.
5. If you are really in the weeds "owe alot of back taxes" get a tax attorney. Your attorney can negotiate with the IRS. They dont like to negotiate with the average guy.
Please, Please, Please! Get this behind you as fast as legally possible. I let mine got on way too long. Sticking your head in the sand does not work. Trust me on that one.
I hope you get this all worked out soon. Good Luck!!

It is my understanding that it must be sent to the police.Someone told my wife she recieved her cert from HK after she had her interview and got paper from the CO to request the cert.the cert was then sent directly to the USEM.Meanwhile she was on adminreview. After the USEM got the cert they ok'd/released her visa. This is second-hand info from a friend of my wife so I will continue to search for more reliable intel. When we are at the USEM july7 for our son's CRBA appt I will ask aboiut this and post asap.

Hi rm,
You may also need to look into the need for sending finger prints along with the other stuff.I dont know about Brunai but most countries require these to process the Cert.I am researching this for my wife also coz she worked in HK for a few years and needs a cert also.Good Luck & Good Hunting

VSC seems to have slowed down on approvals since they started working on Dec'07 filers. Coincidentaly, that's the month VSC started to receive applications transfers from TSC. So far, they approved around 50% of cases from December in the last 30 days. If this keep this pace, their backlog will back up to 13-14-15 months in Jan, Feb and March next year.

PhilippinesTransportation Question
I agree with each of the above.... I have never had any difficulty getting a taxi from the airport going to the same hotel area that you are. I feel at that time of night it is simply safer and less stressful to grab a metered airport cab and enjoy what should be a less than 30 minute ride. Enjoy your time!

PhilippinesVia KOREA?
Well let me explain how this just recently worked for me..... Jezzieca has family in South Korea that we were interested in visiting on our way back here to the USA. I had all the same concerns that have been brought up here so I had Jezzieca go speak with someone at the South Korean embassy in Manila. They informed her that since she had a US VISA and a onward confirmed flight ticket to the USA that she would be permitted to enter South Korea for a stay of up to 30 days. I was skeptical of this simply based on some things I had read, but figured we would give it a try. I arrived in Manila on December 16th via Asiana Airlines ( for whatever that is worth) On December 19th we both boarded a Korean Air flight from Manila to Seoul. We landed that afternoon and when asked by immigration about her Korean visa she explained what the embassy had told her and about 3 minutes later they stamped her entry and we proceeded on for a 3 day stay. We just arrived here in the USA this morning via a nonstop flight on Korean Air from Seoul to Dallas, Texas. POE process in Dallas lasted maybe a total of 15 minutes (due to line) with no problems and we are both here now at the house. So I dont know if any of this relates to what is being discussed here , but just wanted to share my experience in regards to transiting through S. Korea.
