The DS 3032 is the choice of agent form. This form the beneficiary completes and generally will appoint the petitioner as the agent. That means that the petitioner will receive all correspondences from NVC.

The DS230 is a 2 part, 4 page biographical information form filled out by the beneficiary. The beneficiary will sign part 1 but NOT part 2

Correct. They can just type up the info that's on ds 3032 form in the body of the email, and that's it.

Geez, has anyone really ever gotten an RFE because they didn't properly submit passport photos?!? I mean, seriously...
I understand if you get them the wrong size, exposure, or whatever, but they way you package them or if you forget to write name in the back of the photos? Really?
As far as I know, spousal visas are not being processed for same sex partners, so what if I send them pictures of me and my husband and do not write names in the back, what are they not going to know who's who? laughing.gif
I would like to give USCIS/NVC just a liiiiiiiiiittle more credit than that.
I think the petiotioners/applicants stress a little too much over nothing, just my two cents. Relax and just submit the damn thing.

I wanted to leave an update here for another poor soul who goes through this process, so that you may know how long it takes ...
We sent in W-7 application and tax return on 28.May, and my husband just received his ITIN yesterday, 26.June.
Just waiting on our tax return to be accepted now ...

What we sent in:

W-7 that husband signed and mailed to me - not notarized or anything

Certified copy of his passport biographical page

A statement which we both signed and dated in which we have written that we would like for husband to be treated as US resident for tax purposes
We also declared in that letter that husband is currently a student, that he had no job in 2008 and therefore no foreign income to declare.

Marriage certificate

Tax return (1040)

w-2 forms for me

arrrrrrrrgh those IRS agents are F-ing useless, what ever question you ask them they read something off of the information that you can see yourself online. I can read, I don't need you to repeat it to me lady, I am calling because it makes no sense to me, frickin' clarify it for me!!!!!!!!!

I am reading over the info that accompanies W-7 application, and it says that any visa information showing in the passport must be entered on line 6c.
My husband came to US only once in 2007 on a B1/B2 visa, which expired last year. He left before it expired, of course.
I called to ask whether I need to put that info onto W-7 even if it is expired because it is in his passport, or does that question pertain only to visas that are still currently valid.
The IRS lady did not know, she kept reading that script and at times sounded like yes I should enter it, but it was not clear at all... she was very mean.
I mean, it only asks for entry date to united states, nowhere does it ask for when he left US, so if I fill out the form like she is making it sound then it will sound like my husband entered US in July 2007, has not left, and expiration date on visa was August 2008.
I don't wanna cause confusion on that form to raise flags, but if it is important that I put the visa info, then I guess I should.
I am just so confused.

Dealing with immigration visas and taxes sucks, I am so ready to throw in the towel, I cannot deal with it any more, I am exhausted and no one can help when you call them, they just make you run in circles.

What should I write in on this damn W-7 application, should I just write NONE since his visa has long expired and he has not overstayed his visit, and just not think about it any more? I am so lost...

They will talk to either the petitioner or the beneficiary. When you call you'll have to confirm both of your names and dates of birth (and the case number of course).

As soon as you have your case number, call and speak to an operator and give them both of your email addresses. They will then email you everything rather than send a hard copy. This will save you weeks.

And yes you probably should make your husband the agent, assuming he'll be the one paying the fees.


It's really weird but we never called NVC to give them our case number. They must have gotten it from the cover sheet of our packet, because one day out of the blue they emailed us choice of agent form and invoice number...

Canadians do not need a visa to travel to the US. In the early years many times the CBP simply waived us through and we were never even stopped. I listed what I could remember to the best of my ability (I had a student visa as well and traveled numerous times on that). I know sometimes NVC and USCIS people seem to us like blood sucking leaches, here to suck the life out of us for no reason, but they are actually pretty flexible. I had some holes in our documentation, and for everything where I was unsure about something (dates, places) I would make a statement and list what I knew for sure, and I would write: this information is true to the best of my knowledge bla bla bla
I would explain why I do not have exact dates (no one would have record for the last 30 yrs of travel, I think they are only concerned about maybe last 2-5 because who would work on fraud case longer than that, you know smile.gif)
And then sign the bottom of the sheet and write: I declare under the penalty of perjury that the information submitted is true and complete to the best of my knowledge. Copy the pages of passport where she does have dates, or find her travel info and that's it ...
In my humble opinion that should be enough, but you can always call NVC and speak to someone to ask for their advice what to do.

I don't think they are that strict with photos, to be honest. My husband's photos were some kind of weird size, muuuuch larger than the photos I had taken here in the US and we didn't have any problems ...

But if it worries you so much, I mean she lives in Mexico, not some God forsaken country. It takes less than a day to take new photo and what... couple days for mail to arrive to US ?

Since he's put himself in a situation where he is staying here illegally, not working for 2 years and depending on wifey, I am assuming that he was not well off in his country of origin, which leads me to believe that the option for wife to accompany him to his country and work on visa from there may not be a feasible option.
If he leaves and there are children involved... poor babies living in a separated family because their parents did not think things through, were selfish or just plain ignorant or lazy to arm themselves with information about something so important as one's legal standing in US ...
I don't know, I just keep thinking and hoping that there are no children at this point ...

Evidence of relationship is given to USCIS, and you are already done with that process.
NVC stage deals with providing proof that you are able to support your beneficiary when he/she gets here.
Evidence of relationship may be needed again at the time of interview, but definitely not for the NVC phase, so you have plenty of time to get that ready.

Why not go and stay for the time you can. If you can bring SO back at the same time GREAT if not, you know they will join you soon.

This is what I am doing. I fly to Senegal on the 3rd and fly home on the 7th. I'm HOPING they will issue visa the same day (they issue on Tues & Thursdays and our interview is on Thursday the 6th), but if they don't then he'll get the visa on the 11th and fly home on the 12th.

Just my humble opinion.

Also Remo has an interview on Wednesday next week in Islamabad so we'll know soon enough smile.gif

I remember when I was calling to check on our status they kept telling me that it takes 6 months for approval, so definitely once it hits the 6 month mark you can dig in with your teeth and request to speak with supervisors, senators, whoever ... Because their "standard processing time" IS 6 months as they state, before then you really don't have any grounds to request that they look at your case. 6 month mark, however, is a whole 'nother ball park
I wish I can be of help, but it seems all you can do for the next couple weeks is just wait...
At least you are all complete with NVC stuff, because that phase is a breeze if you got all documents ready!

All you can do is wait. DON'T rely on the emails from USCIS. My case is already complete and I have an interview scheduled and the USCIS site STILL has the last info as of 3/5 when the NOA1 was generated.


Armin, I second this. Exact same thing is with my case, USCIS site is useless and so is their personnel.
However, you can research the next phase, prepare your documentation (birth certificates, marriage cert., taxes, financials,... do all the translations needed, etc. Be as ready for NVC as you can be by reading the guides and reading the forums.
Most importantly, work on your relationship with your wife, this process sucks the life out of you, my husband and I were so many times at a braking point since we started this process, we have never felt more distant to one another than through this process. At the same time, when we tried to make it better, then it was never as good as it was when we would successfully complete a part of it. So, just keep in mind to talk to her openly and calmly about everything and don't let the wait suck you two dry.

I don't think that the annual income you present on I-864 has got to match what's on your W-2.
Mine did not, because my W-2 shows my past income, and for annual income I wanted to show how much I will be making this year, so I got paperwork from my employer that shows my annual salary and I submitted some paychecks that show same bi-weekly amount I receive, so my annual income is not the same as what I earned last year (i.e. w-2).
So, I don't think that the problem with your I-864 is that the numbers simply don't match, you really should ask to speak to a supervisor and ask to clear that up for you what exactly is not jiving on your form...

I am not sure I understand your question ...
If you're filing taxes married jointly, then you both need to sign the tax return forms. At least, that's what I was told by IRS when I called and HR Blok reps I talked to.
Have you already received ITIN, or are you applying for one?
I sent my (well, ours smile.gif) 1040 form to my husband (beneficiary) to sign, and I signed also. He returned the form to me, and then I sent it in to IRS together with the W-7 application (husband signed), copy of his passport and W-2 to accompany the 1040 worksheets. I also sent copy of our marriage certificate juuuuust in case smile.gif
No problems, just got our tax refund this week.

Instead of waiting to get all your questions answered, fill out the forms, mail them to her and then wait to get them back, why don't you have her sign several blank copies and mail them to you right away. By the time you receive them you should be sure of everything, then just fill in the forms and send your petition. Plus, in case you make a mistake somewhere, it is good idea to have an extra copy or two signed by her, and then you can make last minute corrections before you send it of to USCIS.

Sorry I'm just dropping in here like this, I'm not a Dec '07 filer. I am freaked out to see so many of you pple who have waited a year already?!
Were there any problems or issues with your cases, or is this normal time line? I don't think I can wait a year for my hubby to get here, and I am just now ready to file our I-130, we have a looooooong way to go:(
Maybe I should go for K3 after all, because 1year and still waiting, my gosh....

The information required about the parents in the forms, from what I remember, asks for their DOB, place of birth, their address or if they deceased, the year they deceased, residency. Maybe social security, not sure...
Since your fiance is living under her parents' roof but is doing all this shady business behind their back, then I don't see why she hasn't gotten through their things and found their birth/marriage certificate to find out this information? Or does she think that would be unethical? biggrin.gif

You two don't strike me as very mature, hopefully the interviewer doesn't come to the same conclusion and denies your visa!

maybe you shouldn't dismiss honesty, no matter how impossible it may seem at times.
I come from a veeeeeeeeery conservative and strict family, but I have been honest with my parents (live with them) every step of the way, no matter how big of a tear it made in our relationship at times, and it has made all the difference! They came to be a very big support system later in the process for us.
