If it is not an IMBRA crime or an AWA crime it will not have an effect on the petition.... FWIW, AWA crimes are the only crimes that cause a USC to be ineligible to petition


If the crime is not an IMBRA or AWA crime, will my name come up on a criminal background check list when they do the search?

Hello to all of you. I am new to this forum and perhaps this question has been asked before. I have read the IMBRA regulations and I cannot find the crime I was convicted of in 2005 (Theft by a bank officer or employee) is relevant. But I am wondering if this will have an adverse effect on my K-1 Visa filing. An immigration attorney is aware of the Felony conviction (I have completed my sentence and probation) and says it should present no problem but may need clarification if my name comes up on a criminal background check (I am assuming it will).

I have no criminal record to speak of, but I wonder if disclosing in the application is wise. I would probably just answer exactly the questions asked. Gary makes a good point about covering any criminal record with the SO, but I would only list charges and convictions that are asked about in the documents - where they are asked about. I have also read that interviewing officers at AOS will discuss criminal records sometimes, just to see how well you really know each other. Again, not our experience, but you could do a forum search for that. Also, you might write the State Dept., USCIS, or ask your Congressional Aide that deals with immigration (every office has one) about the effect of your record, and advice on that kind of disclosure..

I have a Felony Theft conviction from several years ago. It is not related to any of the crimes listed on the IMBRA form, has nothing to do with the crimes from the AWA and it is not named on the I-129F section. How do I disclose this in the package when I submit it since I am sure my name will pop up on the Criminal Records Search? I want to be up front with the processors to avoid delays and conflicts because of it.

Hello to all again. I have a new question for the experts on the forum. My Fiancee's daughter (age 13) had a bad leg as a very young girl. She was operated on by orthopedic surgeons and she is completely normal now and one would never know that she had this problem at one time when she was very young. For all intents and purposes she is normal and leads a normal teenager's life. The girl is certified by a Ukraine doctor to receive disabled benefits from Ukraine as a subsidy. The benefits will run out in March 2011. My question is whether this situation will complicate the K-1 Visa process for my Fiancee and her daughter to come to the USA next year. They would not be filing a claim for any disability as US residents or citizens.

Thanks to everyone who has answered my posts on this forum. I really appreciate the generosity. I have a new question to ask the experts. I will apologize first in the event this question has been previously answered on the forum.

My fiancee and I will apply for the K-1 Visa most likely in September of this year. Judging from the experiences of the other people who have applied for K-1 VISA for travel from Ukraine, it seems to take about six months or so from start to completion and travel being legal. My fiancee has a 13 year old daughter who will also come to the USA. The daughter will not finish her school term in Ukraine until the end of May, but my fiancee wishes to come to America as soon as the VISA is granted to her from the US Embassy. That may be some time well before the end of the daughter's school term. Can the fiancee come to America first and have the daughter follow at a later date?

Unless somebody is intimately acquainted with you, your capabilities and aptitudes as well as all about your case and relationships, they are not qualified form a meaningful opinion about whether YOU need professional assistance in ANY matter, much less an immigration matter. Most of us have done it ourselves but it's not for everybody.



I want to thank everyone so very much for your kind, informative and quick answers with information for me. It is surely appreciated.

Before I started this process I visited this forum and asked questions during the summer (2010) and also some other forums. Many people advised doing this myself. I believe I am fully capable of doing it; however given that this has the potential to be a long tedious process that is fraught with peril for the least little overlooked items, I thought it best to engage a professional immigration attorney with outstanding credentials and recommendations. Not to mention that his legal assistant is also from Ukraine and speaks Russian and Ukrainian.

I would rather not spend the money of course, but in this endeavor I would rather be over prepared and over "gunned" should any problems arise that might need smoothing out and speeding up the resolution to a successful happy ending.

Hello, I do not know if this question has been addressed in the forum before, but I do apologize for being redundant if it has. I have been carefully gathering my documentation for my K1 application and when I went to my Immigration Attorney to present it, they told me I will need some Affidavits of a Relationship. I did not find this requirement in the list of documentation from this website. OK I can get several of these so called Affidavits of Relationship completed by friends and family, but the real kicker is that the attorney is saying that the person who completes the Affidavit of Relationship will have to provide a Birth Certificate or a Passport to prove US Citizenship. This is ridiculous. This will take WEEKS to get from these people and not to mention that some may not want to provide this Affidavit if they have to go to the trouble of giving a Birth Certificate or copy of their Passport to some unknown Government Office for my benefit. Can anyone tell me about this bunch of malarky?

Hello again to all of you members. On November 28 I posted a topic about our situation with the Kiev Embassy. My fiance had her interview on November 16 and all was great. They took her delivery address information for the Visa Packet and gave her a pink card stating that it would need "additional processing". THey said the package was so large it needed additional time for processing. Good excuse huh?

She was told everything was positive but sent home. She did not get the packet.

Now we are finding out they are still "doing processing" with the package, of course they will not tell us what it is. Our attorney has received an email to their request to find out the status of the Visa being issued, the embassy states it is now having "administrative processing" done. What in the heck does this mean?

The package was very thorough and complete, checked and double checked. We meet all the criteria for the Visa being issued. She has no criminal records and owes no one any money in Ukraine. She is free to go. I have committed no Adam Walsh Act crimes. I could go on and on, but I just am dumbfounded. Anyone have any input?
