I told my wife just now!
So it looks like we have to start getting ready for the interview now.
I'm flying to Japan next week so I'll get to be with her not only for our daughter being born but for the interview too!

This is great news.
I just would like to personally thank Loto for your time saving document.
I really appreciate the time you spent on it. I highly reccomend it to any new people who aren't sure what they should send. To be honest this last step at the NVC was the most confusing for me. The whole, James Barcode, DS-230, AOS, etc etc.

My advice, take a step back, take a second to read as much as you can, then start one document at a time.

My wife and I would also like to thank everyone on VJ that has helped us get through this. Without forums like this one we would have made a ton of mistakes I'm sure. Thank you thank you

I didnt do the same form as you because I just filed the I-130 but this is the format I used for my wife's address. I had to dig up a copy of the form I sent.

I'm sure others can validate if that's right or not.

That's actually not a bad idea at all. As a matter of fact I DO intend on returning to Japan with her on the same flight when she leaves and then staying until our baby is born. Maybe a couple months after she gets back to Japan.

My wife is planning to visit me here in Texas for about a month.
Ive heard\read mixed results. I know every place is different regarding POE.
Im hoping that she will be allowed to enter with no problems. There are several draw backs to this visit though. I would like to hear your opinions on if its a good idea or not.
1) Ive heard that some people bring papers from their work place or copies of their apartment leases showing they will return to Japan after the visit. Unfortunately my wife lives with her mother and doesnt have a job now because she is pregnant. Do you think its possible that they wont ask to see these things and still admit entry.

2) she is about 19 weeks pregnant. By the time she comes her belly will be pretty difficult to hide. Would the immigration officer see her being pregnant as intent to immigrate?

3) I've heard from another poster, Justin and Masako, that the officer was already aware of the pending I-130 before she even told the officer. I told my wife she should be honest about everything and let them know that we applied for her I-130 visa in December and have recieved the NOA1 and now are currently waiting for the rest of the process. I plan to mail or fax her a copy or the original NOA1 to show to the officer. I hope by doing this they will realize that she does intend to go back to Japan for the interview. She is just simply wanting to visit me and my family again for a short visit to help ease the pain of being apart. Do you think this will matter?

I just returned from Tokyo from a two month visit with my wife. When I passed through customs I asked one of the officers a few questions and he said he didnt think there would be any problem since Japan has the VWP. Im still nervous.

Any advice would be great

Called NVC tonight and they say her interview is set for 9:30 on Sept 29th.

She also had with her an employment certificate showing when she started at the company, her flight itinerary (showing her return flight), and copies of our NOA1 and Marriage certificate, though she never showed them to him as he didn't ask for additional evidence.

She said they were much nicer then the people at Detroit, and we decided that would be her POE from now on, even though its not as convenient and costs more because of the train to Tokyo. But the flight is also about 3 hours shorter which helps. She returned to Japan going from Minneapolis to Detroit to Osaka and had no issues there either as they only take your I-94 (I think) slip from your passport as you get on the plane.

The visit was great but far too short. I hope this can give hope to those of you looking at visits during the immigration process. smile.gif

I know every place is different but I think Dallas, Texas is really laid back too and maybe there is a chance she wont have any hassle.
You said he already knew about the I-130 in progress and asked if she was moving here but did he ask to see the employment letter and stuff or did your wife just offer it to him?
Unfortunately my wife is not working now because she is pregnant. I wonder if she just brought a copy of her rental agreement or bills or something like that if it would be enough.

Second, Man.... I can totally related with your previous post. I feel the same way about being away from my wife for so long. I was lucky in that my work let me take a couple of months off to come stay with my wife here in Japan but I go back to Texas in a couple of weeks and then its no telling how long it will be before I get to hold her or kiss her again. I saw her in November and then didnt see her again until January 17th and I felt like being away even for that long was stress on our relationship. I totally understand everything you wrote man. If we had a finish line to look forward to then things would be so much better.

Of course I asked her not to volunteer any info to the immigration officer, but that she should have it if any questions arise. I am also hoping that if something does go wrong that she will be able to contact me either by her cell phone (US one) or by asking to have me paged or something.

How have visits during immigration proceedings worked out for others here who have Japanese spouses? Has anyone done this lately through the MSP POE? If so what was your or your spouses experience like?

We decided on MSP because we usually fly to Detroit from Osaka and then to MSP but the immigration officers at Detroit are real jerks. On my last visit to Japan (Dec 07 - Jan 08) I came back via Narita to MSP and the immigration officers seemed much nicer. That and, as I said before, I can be right there if there are issues.

Hello all, December I-130 filer here.
I just had a quick question for the other fellow nihon filers.
I keep reading everyone's timelines in the signatures and I never see anything about sending in the I-130.
I was always under the impression that you HAVE to send the I-130 petition regardless of if you are going the CR/IR, K-1/K-3 route.

Was this step just left out of the timeline or did most of you guys just start with the 129f and that's it?
If it was left out, how much time passed before you started the 129f process or was it done at the same time?

I filed for my wife in December and now I'm still trying to decide what I should do next.
Should I ride out the I-130 and go the CR\IR route or should I start getting her K3 packet ready to send...
I'm going to Tokyo to see her next week. I guess we will decide then.

Just a quick update,
Got Ako's NOA yesterday in the mail stating that her resident status has been extended one year! PHEW!!
So it was just that I sent too much money the first time around. I got the notice back really quick too, thank god.

So now I need to get this to her in Japan so she will have it with her when she goes through customs.
I wanna ask you guys advice. Should I send the original or send a copy and then take the original with me when I go to meet her at the airport?

I cant decide which is the smarter thing to do.

Ok, maybe a bit of a snag.
I received a packet today in the mail stating
"This Service Center cannot accept your I-751 petition without the proper fee. The base fee for an I-751 is $465 plus a $80 biometric fee for each person included in the petition.

If you have children listed in Part 5 of your I-751 who became conditional residents (CPR) either on the same day as or within 90 days after the CPR listed in Part 1 of the I-751, the child(ren) are eligible to be included in your petition. Failure to submit the biometric fee for any eligible chile listed in Part 5 of your petition will result in removal of that child from your petition. Removal of an eligible child from your petition will result in the termination of status for that child unless a seperate Form I751 is filed for the child with a $545 fee."


So if Im reading this right, it means I just need to mail all this back with the $80 I left out for my child? I didn't think my daughter needed any of this because she already is a dual citizen. Is it just because I listed her on part 5? If so Ill gladly overnight this back to them with an extra 80 bucks. I just want to make sure Im missing something else.

She will need the NOA1 that extends the validity of her (then expired) green card for 1 year in order to re-enter the US.

Assuming that the submission is correct you should receive the extension letter prior to her return date. You could then FedEx the extension to her so that she can present it at US Immigration.

Well, I'll be honest, it's been a while since I've visited this forum and made a post.
Actually, I haven't been around much after my wife got her visa and completed the move here to the States. I appoligize for not contributing more, like I used to.

Now it's been almost two years and my wife is leaving next week to visit her mother in Japan.
I just so happened to be updating her flight information on American Airlines website and was entering her Green card number when I saw that the card is set to expire at the end of this month. She will be returning to America on November 25th, well after her card has expired.

So, I've filled out the form and I should have all the documentation together and ready to mail out by tomorrow but I'm waaay past the "mail in 90 days before expiration date".
Is this going to cause problems? Has anyone else run into this before?

I was actually wondering this same thing.

Does anyone know about how long after the case is completed that NVC mails the documents to the embassy? The interview is scheduled by the embassy right?
