K-1 Fiance(e) Visa Process & ProceduresG-325A question
I would scan it and send it in, but in the meantime have your fiancee sign an original and mail it back to you. If they send you a RFE for the signature, you already have the signed copy and can respond right away.

K-1 Fiance(e) Visa Process & Procedureslost my job
If the question comes up at the interview, then your fiancée must know to respond truthfully. I assumed you already submitted your job letter and tax return transcripts, etc. Even if it doesn't come up, then you're okay until you have to file your AOS. Despite all this, the right thing to do is tell your fiancée and inform the CO during the interview. I'm sure they've seen something like this before. Stuff happens.

Depending on your state and your field, you may be able to find a job soon. Could you find a co-sponsor for the AOS?

K-1 Fiance(e) Visa Process & ProceduresVermont vs California.

If you live in the following states you must file your petition with the California Service Center:

Alaska, Arizona, California, Colorado, Guam, Hawaii, Idaho, Nevada Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin and Wyoming.

Vermont Service Center

If you live in the following states you must file your petition with the Vermont Service Center:

Alabama, Arkansas, Connecticut, Delaware,Florida, Georgia, Kentucky, Louisiana, Maine, Maryland, Massachusetts,Mississippi, New Hampshire, New Jersey, New Mexico, New York,North Carolina, Pennsylvania, Puerto Rico, Rhode Island, South Carolina, Oklahoma, Tennessee, Texas, Vermont, Virginia, U.S. Virgin Islands, West Virginia, and the District of Columbia.

Send original copy of documents with signatures but make sure you photocopy your I-129F packet and send the copy to your fiancee for her study but it's not very necessary. My fiance didn't send me any photocopy but I got through the interview successfully.

You don't file your petition with any service center. K1 applications are sent to a Lockbox in Dallas Texas and they assign the service center. Sending it to one of them directly will only delay your application.

K-1 Fiance(e) Visa Process & Proceduresletter of employment

My workplace only does employment verification via a number to call or website to go to, and so they can get the info there. I will have a paper with my social sec number and employment number, and the site and number, but has anyone else done the verification this way? I know the embassy expects to see a paper with it all laid out with a signature, so will they not be able to take the time to do either method mentioned above? As always, thanks so much for your help

My company also does verification through a website and phone call, but I plan to type a letter and have my manager sign it. The Embassy will not call to verify anything.

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?

im going to be frank, im a jamaican man and if your really feeling what you said you are, chances are that your right and its best to end the relationship and withdraw the petition. No normal person in jamaica apply for a Visitor Visa 7 times just because he wants to visit. A friend of mine went twice and he got denied and dont wanna go back.....now 7 times seems a bit strange. All you just need to email the consulate @(KingstonIV@state.gov) and make sure you put in the case# in the subject line telling them you want to case close because you suspect you might be a victim of immigration fraud and they will contact you within a day or two. Makes no sense dealing with that stress in the USA, a lot of these guys dont care, they just want the visa which is a gateway to the US, after which they can survive on their own because of the large jamican community there in places. I was surprise to learn of the amount of undocumented jamaicans living there right now. Thank God for VJ it helps a lot of people to see the light

Yep.

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?
If he already said when he gets his visa you won't need to bug him anymore and the repeat applications, chances are your gut instincts are correct. What he probably doesn't realize is that he'll still need you even after he gets the visa (marriage, AOS, etc). I think you're lucky that he's showing his colors sooner than later. Other K1 filers are not so lucky to get obvious and concrete hints as to their fiance's intentions. As with any relationship, other K1 filers just hope and pray that their fiances mean well and they aren't being used.

I'm just curious, how did you find out about the numerous denied applications? Was he the one to tell you? Regarding your baby, you'll definitely have to consider the fact that he may not be around. There will also be some animosity there if you intend on bringing the baby to meet his dad, etc. Although he'll probably find another unsuspecting soul to sponsor him at a later time and make it to the states anyway (if those are truly his intentions). Sigh.

Another idea that someone already suggested is to withdraw the application and if anything re-do it at a later time. The only problem with this is that he'll harbor resentment because of what you did before and for sure he'll skip when he comes later on.

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?

Very few claim to be experts. Most advise given on the visa process is from personal experience gained, reading other people's experiences and what they did, and studying the process from start to finish. The OP asked for opinions and advise on 2 basic questions; Her titled post "Is my fiance a fraud?" and " Can I withdraw my petition?" Opinions have been given on the fraud issue. Facts have been given on withdrawing the petition. Advise was not given to compel the OP into action, but rather food for thought.

Did you read the part where he said this??

That is not stress, that is just plain mean.

Ummmm, 7, count them... 7 attempts at tourist visa all ending in denial.. Nothing more needs to be said.

Now, who is giving bad advise? The K1 is not a test drive from the dealership to check out the interior. Everybody who has ever been in a questionable relationship knows that when "The proverbial defecation comes in contact with a rotory motor" that he will say whatever necessary to overcome the moment. The question remains, "how long will it last"?

The OP has been given some good advise about questions to ask herself. I am sure the OP is not going to fly off the handle and act, but rather reflect on what she needs to do. Whatever the decision she makes, she now has information as to what she can do should she choose to end this, or not. The onus is on her.

Kristina, I do not envy your dilemma. I am empathetic with your situation. Take time for yourself and think this all the way through.
The answer will appear...
Best wishes and good luck with your future...

Agreed

K-1 Fiance(e) Visa Process & ProceduresTax question

Hello Vjer's can anyone tell me if i should admend my taxes to add more for the adjustment stauts? I have a 1099 that has 60k in wages, but i never filed it because it came later after i had already filed. My previous income was less 19k. I have a household of 4 including my fiance, would be 5. My current job is 36k. I just don't know what to do??? :help: Thanks

So you weren't planning on amending if you didn't file AOS? How can you forget or not know that you'd have an additional $60k in income? I can see $100 or $200, but $60,000? Wowzer! For sure that needs to be amended and the appropriate taxes paid.

I will give you the benefit of the doubt, but one has to admit, it really looks strange you are already seeking knowledge about how to get married.
If I just broke it off with my fiancé, I would still be grieving the loss, not asking how to get married in Turkey where I just got denied a K1 and already have another younger guy lined up. It does look suspicious.
Hope you find the happiness you are seeking.

K-1 Fiance(e) Visa Process & ProceduresVSC: 2/7/12 NOA1 FILER AND STILL NO NOA2 FOR K1

K-1 Fiance(e) Visa Process & ProceduresVSC: 2/7/12 NOA1 FILER AND STILL NO NOA2 FOR K1

Soooo....I am really trying to remain positive and keep the warm fuzzy feelings going. HOWEVER....it is VERY, VERY, VERY disheartening to see that fellow VJ'ers who applied either a week/few days before me or AFTER me received their NOA2 from the VSC back in August (and I don't mean LAST WEEK AUGUST or the week before last AUGUST...I'm talking early to mid-August), for fiances who just so happened to be from either European countries or from Canada. (Check the topic "Any Feb. 2012 filers" under the K1 forum.

I have been following this topic for a little while now, and using it to give me courage and hope about my own personal journey w/ VSC. I know there are HUNDREDS of us, if not more, who have been patiently waiting over 6+ months (it will be 7 months on 9/7/12 for me) for the VSC to get their act together, and to start sending out those NOA2's...I mean really...we've been patient, we've been praying and staying positive, but now it's getting a little RIDICULOUS!!! However, when going back to that same exact thread just a few minutes ago, I felt a little anger starting to set in once I started noticing which countries had been approved within the reasonable processing time, and it just made me wonder and give a STRONG SIDE EYE to that revelation.

At any rate, don't get me wrong...I am very happy that those folks mentioned above received their NOA2. I am by no means a "hater" or "hating" on their blessing...trust and believe me. However, the observation could not be overlooked.

Just throwing it out there.....

I feel your frustration believe me. It's not even those countries approvals that ticks me off, it's the 2 month approvals from CSC that hurts more. People who applied in JUNE and was lucky to be sent to CSC is getting approved. THAT HURTS when people like you are still waiting.

K-1 Fiance(e) Visa Process & ProceduresFood stamps

Hi everyone,

This has probably been asked before.. Is it possible (or wise) to apply for food stamps after the fiance visa is approved and my fiance is in America already? She'll have no work yet so any help is needed while we wait for her authorization to work.

Also, I heard from others we should not go on a plane when going to our honeymoon because she has no ID yet. Is this true? I really wanted to go to Hawaii for our honeymoon.

Huh? Food stamps? Hawaii? Wow. Anyway, Hawaii is a part of the United States of America. No passport needed if you leave from the mainland.

K-1 Fiance(e) Visa Process & ProceduresJust got back from my Congressman's office

I am currently at day 179, which I know is slightly under the 6 months I read you should wait, but I couldn't take it any more and the office is just down the street. I felt like I needed someone on my side... Unfortunately, that person is certainly not going to be in Congress. I didn't so much want someone to bump my application to the top or the like, but I wanted to hear that my wait was normal and my time was close at hand. OR, that I had done something grossly incorrect that I needed to fix. It was a government office, so I wasn't terribly shocked at the lack of kindness but it plainly set the tone for my experience.

I, with great hope, gave the immigration person my reference number and she went to work. After a short while she returned and told me that my application was with an officer and that was all she could provide... which is fine. I asked her, from her experience, what she thought was a reasonable timeline. She informed me that I had probably 2 more months before my NOA2. To which I balked because, from all my research, VSC is processing at around 6 months. She then asked if I was lecturing her on how to do her job and I politely responded in the negative but it didn't get much better from there. She asked why I was in such a hurry. "I was hoping to have my fiancee and her family over for Thanksgiving and I don't feel like displeasure with a 6-8 month wait is vastly impatient", I responded.... She laughed and said that I would be lucky if she made it over by new year and that I was indeed simply being impatient. She then began to quiz me on what I included in my I-129f packet. I passed everything except for the personal references she mentioned. She said that I should have included 3 personalized letters from my peers and because I didn't I would positively receive a RFE. Does anyone know if this is true? My packet was extremely detailed with ample proof but no letters from friends or coworkers...

Ok, I think that's it for my rant. Really just a long post asking about references but I would appreciate and thoughts on this. Thanks as always, Team.

Best,

Josh

Wow what an experience. My local congressional office is much more pleasant. She did an inquiry on my behalf at 4 months and 5 months... I actually contacted them at 4 months to complain about the way VSC was handling cases overall while CSC was on a roll. The first response from USCIS said normal processing time, blah blah blah. The last one received a response from USCIS stating that they're processing at 5 months + 30 days and if I don't hear anything from them by then, to contact USCIS again after the 6month mark. My local congress rep told me to "keep my head up" and "hang in there" and let her know if I don't hear anything. I plan on contacting her on Monday morning.

Regarding the "letters from friends".....that's plain BS. The I129f application doesn't require that. The only letter that's required is one from both the petitioner and the beneficiary about their intent to marry. It sounds to me like she was being a witch.

All that you need to travel within The UNITED States of America is a valid government issued ID. It's considered domestic travel, not international. Nevada is a state, so no AP required.

K-1 Fiance(e) Visa Process & ProceduresG-325A for K1

I am a Peace Corps volunteer in China and I would like to marry my fiance, but I can't because it is forbidden by Peace Corps. So I am filling out the K1 visa application from China and then sending it to the United States where my friend has agreed to send it to the Texas lockbox. I don't know if this is the best way, but if anyone has a better suggestion, I would love to hear it.

I was also wondering about form G-325A. The example form on Visajourney is expired and so I went to the state department website and their form expired August 2012. Is this a problem or am I still able to fill it out?

Thank you!

As long as the form (G-325A) is taken from the USCIS website, it's okay for use even if it has an expiration date. Usually there will be a note to that effect on the top of the page.

When are you finished with Peace Corps? Have you factored in when the application will be approved, etc and the timing of your return to the states? Is having a relationship also forbidden by Peace Corps? If so, won't the government know that you were involved while in Peace Corps? I'm just curious as I'm clueless about Peace Corps rules....

K-1 Fiance(e) Visa Process & ProceduresNOA 2

Admittedly my nerves are shredded after waiting so long for approval, so bear with me:

I logged onto the USCIS website case status tracker on October 8th to discover notice saying that my Petition had been approved and that they had mailed a notice that it had been approved on October 5th. It is now October 21st and I have yet to receive notice. My attorney has yet to receive notice. I know that it supposedly can take up to 30 days to receive it, but how normal is it to take this long?

Maybe I'm taking the USCIS a bit literally when assuming that when they say they mailed it on October 5 they actually sent it then, but as I said, my nerves are frayed and I don't want something to go wrong so advanced in the process.

Thanks!

I'm in Texas and got approval Oct 11, received hard copy 3 dàys later. Call Uscis and request a duplicate of your noa2.

K-1 Fiance(e) Visa Process & ProceduresK-1 Past 5 Months, Should We Contact Senator?

Hello everyone,

I’ve been perusing VisaJourney for some time, and I’m grateful that a supportive community like this exists.

It’s been over five months since I mailed out my K-1 application (before May 1st). Under the advice of my lawyer, about 3 months into the processing time, I submitted an expedite request based on an emergent situation. Two months have passed since my expedite request was received by the Vermont Service Center, and I have heard nothing back yet(not even a denial.) Furthermore, the last two times I called the NSC, they told me that normal processing time was 5 months. When I called again yesterday to find out the status of my expedite request, (which they still had no answer for), I was informed that the processing time was now 7 months. They are still working on Feb. 28th applications!

I’m not sure what else I can do. My SO and I really don’t want to needlessly wait 2 more months, when we definitely know that some couples who submitted at the same time as us have already had their application approved. Is it worth asking a senator for a letter at this point? Could a senator’s letter possibly annoy anyone at the service center and cause more harm than good? Some insight would be deeply appreciated. I don’t want to rock the boat if there is the risk of it tipping over.

:time:

My congressional office told me to wait until December (after a couple of inquiries) as they should get to my file by then.

K-1 Fiance(e) Visa Process & ProceduresVaccination Requirement Waiver

I don't want to start here a discussion about the medical advantages or detriments of vaccinations. There are better places to discuss that (i.e. www.mercola.com). However one basic fact about vaccination seems to be misunderstood here by few posters claiming the requirement is to protect United States citizens from infectious deseases. If a foreign citizen caries an infection with her/him the vaccination will not heal that desease, it would be too late for that. Vaccination only protects during the time after not before. So if the person enters US after the vaccination those vaccines can only protect her/him from getting infected by US citizens.

The worst part with this requirement regardless if good or bad is that it chips on ones personal rights. It trains future US citizens to give up their rights right at the very begin by harassing them with lengthy processing times if they try execute their rights.

Apply for the waiver, wait a few extra months or years for a response and be done with it... Don't listen to what anyone here tells you.

K-1 Fiance(e) Visa Process & ProceduresTurning a Wedding Into an Unofficial Ceremony As a Backup Plan

Seems there are a lot of people trying to play around estimated time frames in order to plan a wedding when the process is not even half over. I understand it can be complicated when families are spread between two countries a half a world apart, but the simplest thing is to GET THE VISA first, then make plans. You have some 6 months after the visa is issued to use it. Then another 3 months to get married once she arrives. That should give you ample time to get a venue and make concrete plans. Too often something stupid happens and then everyone gets really stressed out and you really do not need to go there.
