Hello,

I have read here several times that it is a good idea to include a copy of the child of the beneficiary's birth certificate in order to prevent an RFE. However, this also leads me to a few questions

1.) Is it necessary to include the child's birth certificate in the intial petition of I-129F or no?
2.) On the birth certificate the put the mother, my fiance, under a different address, that of the father, although she did not live there. I don't want to say she lived somehwere she didn't, but don't want to coause problems on palces she lived in the past five years.
3.) Also, we sometimes refer to the baby with a nickname. Should we avoid letters with the nickname or explain this in the cover letter?

So, I am performing my last check through beofre send off my I-129F and noticed one thing I want to be clear on certifications. On the website it is a bit ambiguous as to whether they want one certification for each document or one that goes for all the documents. On the website it says:

Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

Certification by Translator

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

Why do people complicate their process by these pseudo marriages? Not trying to be snarky, just really curious.


Well, I know for us, we are talking with her parish priest and the simple reason is her family wants to attend her wedding, and can't come to the US. So, simply a religious ceremony there (we were quite clear to the priest that it CANNOT be a civil) and a civil blessing up here. Yes, we'll have to do a switcharoo of rings at POE when it comes to that, but it seems a lot more fair to both of our families.

I used receipts, and asked for handwritten receipts at the hotel with both of our names, both of our boarding passes, five fotos, my passport visa stamps, itineraries. Also, because we were robbed, I used a the police report (highlighting that we were victims lol). It helped that it had both of our names and listed us as each others fiance. I don't know whether this was acceptable as I am far from being approved, but perhaps it can give you an idea.

So my fiance just went to the post office to submit the I-129F package and he thinks that in the rush (post office was about to close), he might have misspelled a word, instead of writing: Department of Homeland Security, he wrote: Deparment of Homeland Security, leaving out the first "t" on Department...
Will this cause a problem?


I wouldn't worry. Although, it wasn't DHS, but the Treasury Department last year they had absolutely no problem cashing my check when I misspelled Department of Tresaury (como ese). Although, everytime I write out a check to the gov't, I always want to put the UNITED STATES OF AMERICA, and not the actually department :unsure:

Well, I can't say whether or not they will approve or deny it. Personally, I included two colour copies of my passport twice, once with the Proof of having met and then one for my proof of citizenship. In addition, I made a second copy of the page of my visa stamp and put that on top of the passport copies on proof of having met.

That said, I don't think I'd worry about it. However, if that's the only problem, then it's easily to me remedied.

I haven't seen my fiancee for two months now, but it also doesn't help just do to expense, I probably won't be able to fly down until the interview. I know for us the uncertainty is the hardest part. However, one thing that has helped us is we talk every day, sometimes twice and send many emails. Also, we've made many contingency plans. Now before other people jump on me for this, the biggest reason is just to regain some sense of control in life, but plans such as, okay, if by some miracle VSC returns to processing times of a year ago, we'll do this. If there's a year wait, we'll do this and this. If I get laid of and/or the visa gets rejected we'll do this. If our daughter doesn't get permission, so forth. And hey, why not move to Trujillo!? ;)
The biggest thing is just to get some idea of control and normally. One of our favourite things for example is our family to watch a youtube movie on yahoo and eat pizza together. Another is singing and dancing. To be honest, the situation really sucks. Expect fights and expect arguments. Before we both left in Lima, I said, Listen, this is going to be very hard and we're going to go through one of the hardest times, however, if we'll always be there. If we can't do it now, how can we do it in our marriage. Thus, I know one thing that works is making a schedule, find ways to do normal things together (like I mentioned), never go to sleep on an argument, remind the person (and yourself) daily of the feel of their hand against yours, and remember each day longer is one day that has passed.

Anyways, it's going to be hard, but and it is hard and I wouldn't wish this on my worst enemy, but I hope it helps.

Finally, I'll put this down here as I know many people are not religious and I particularly do not like being evangelised to, but find some way to just relax. We are both Catholic and during my lunch break every day I call her and we say a short two minute prayer entrusting everything to the Holy Family. Also, in the evening we say the Rosary together. I know for us, it really has made a difference and taken the edge off.

Do you by any chance have a police report or something filed with the State Department. My bag got stolen last time I was in Lima with my fiancee except, it was the otherway around, I lost my boarding passes. Since I was carrying some of my fiancee's gear, I first went to the police department and had a statement drawn up of all that was stolen with BOTH of our names on it, and then to the Consulate where I reported it, again receiving a notice with both of our names. If you have that it could be a great asset. In the very least, a document from the US when you reported the theft of your passport.

I noticed that I made an error in my fiancee's DS-156, and went back online to fill it out and correct it; however, it is not appearing correct. Furthermore, have had a couple of other people try and they are having the same errors. Is anyone else experiencing this? Can I use the downloadable form sin barcode? Any suggestions?

I agree, CSC, by Igor's lists, works now about very end of May and very beginning of June. It means that just 2-3 weeks later amount of petitioners with 5+ months of waiting will start to grow up very fast with every day, and USCIS will start to get A LOT of phone calls, letters, complaints to the Senator's offices, etc., about work of CSC from mad petitioners who paid money, patiently waited for a 5 months and still got nothing. I don't know if that's what CSC trying to get... We're waiting for almost 3,5 months since NOA1, and my fiancee Amy told, that if we will not get NOA2 earlier, right after 5 months mark she will start to bother USCIS and Senator's office by phone and letters as much and as often, as she will be able to do it, till they will give us NOA2, and answers like "emmm, wait 20 more days then call again" will not be accepted. :)

I remember earlier last year when I had filed, a lot of people were hitting the 6 to 7 months mark, and after about 6 weeks of that, there was a sudden rush in VSC. We came very close to five months ourselves, and to be perfectly honest we had resigned ourselves to a full year of wait. However, just keep hoping and praying that it will speed up soon, as it should. Hoping for the best and absolutely use your representatives when its avaialb.e Also, as others have mentioned, even those who are before or after the K-1 petition stage, write your elected officals. Enough people can make a difference.

Okay, first it is the petition. The application will be separate. No, you do not have to fill out a seperate petition for a K-2 visa, but be sure the child is listed on the forms. Secondly, with my daughter (technically step-daughter), the US gov't didn't ask for anything over custody. They didn't care. However, we did have to go to court to get permission from the Peruvian gov't (which is one of the two time the dirtbag saw her, the other after leaving and refusing to pay the hospital for the birth). We did that to leave the country and to make it easier for me to adopt her here. So, I would check Philippine law over custody permission.

my husband and i applied for my AOS last may 24 and just waiting for the approval. my question is after i get my green card i believe i have a two year probation period right? correct me if im wrong but as i understand it i cannot get out of the country unless its less than 6 months? but what if i need to get back in the Philippines to study and it will most likely be more than 6 months, would that jeopardize my green card? we're thinking of doing this june of next year.

Do you have some way of checking this with the US Embassy in Manila. I understand the circumstances might be quite different since you were never married. Normally the US Embassies in any country will be very strict and have their own requirements about permission to take the child out of the country. But as mentioned, that might just be in the case of their being a marriage.

Please try to check before hand. Normally, with a known marriage and father their should be a letter of consent not only granting full custody to the mother but also granting permission to take the child to the United States permanently with no promise of the child ever returning home and this should be accompanied by ID such as a copy of the National ID card and be notarized.

.. im a k1 visa and my son is a k2 visa were just waiting for the nvc to send out packet in the manila embassy..as far as i know if you are not married then theres no need to provide a consent from the father..my son is also using his father surname and his father sign in the back of the birth certificate but we are not married my son is 5yrs old now its been 3yrs since we did not see his father,,i did not prepare any consent from the father,i know we will have a hard time for him to sign it..and i know that it wont needed..so no need to worry..

My name's Prescilla and I just got here in the US last March but my son is still in the Philippines and he's actually going to have his interview on Aug 16..
His name is Geoff and he's 3 yrs old. My husband now is not the biological father of my son but i was not married before..
I believe I need to get a letter of consent from the biological father of my son which will not be a problem..My question is,
is there any particular way of making this letter required by the USEM? Or can he just make a simple letter stating that I have the full custody
of my son blah blah blah.. and sign it? Does he need to attach any copy of his ID?

and pray that during the interview, they will ask for a co sponsor just what happened to my wife. because most other counries do not accept co sponsors.

i dont know how it works if the K2 arrives with the K1..
i have a k1 visa and im here in texas already but my son is still in the philippines. so he is a K2 follow to join situation. what i did is i called the US embassy in manila and set an interview for my son who's by the way only 3 years old. he had his medical exam yesterday and his interview will be next week. you need to fill up some forms for the child and you will get the list of requirements for the child's interview when you call to make an appointment. you have to pay $18 using your credit card to get a pin number to use whenever you call.
im not good at explaining this but its really simple.what you should do first is get the phone number of the US embassy in your fiance's country.then just follow the voice prompt how to buy the PIN and from there you can set the interview for the child and you can ask them for the information about the requirements.
and in regards with the schooling, they can definitely go to school once theyre here but you should apply for their adjustment of status first :)
if the k1 and k2 entered the US at the same time you can apply for their AOS at the same time. im not very familliar with this process yet but i think if the k2 is a follow to join then you have to apply for his/her AOS once he/she gets here.

We started the I-129 on August 18 and now Im waiting for the NO2. My fiance in Philippines is leaving next month (October 22) will be going to Australia for vacation (approximately 3 months) will be back on January.

Now my concerns are - would there be any problem/ or should I ask, will the Immigration in the Philippines wait for you at your own phase to prepare all the requirements to be passed? or should we start to prepare all the requirements now and let her relative send the requirements to the immigration because she is out of the country? (Original passport would be a problem if needed to be passed. and medical examination)

Anyone could tell us any advise on this please. Would there be any problem?



i believe there would be no problem since the only time you need her to be in the Philippines is for the medical exam and interview in the US embassy which both will be scheduled by you or her..but you might want to ask her to leave atleast a copy of her passport to her family just in case you might need it but actually all paper works will be coming from you once you receive the NOA2..if anything else you'll need from her most probably would be her signature on some forms which you can just send to her in wherever she's going and she just have to send it back to you..

Hello everyone,

its been a long time since i've posted, and i do appreciate all the past support with getting my wife here with her k1 visa! FINALLY her son (3 yrs old) is now here from the philippines. I just wanted to know what steps we need to take to get his adjustment of status taken care of. We assumed that all we had to do first to was apply for a social security first like we did for my wife back in june. However, the social security office said he was not eligible to receive a social security without a work authorization document. Really didn't make sense and we've been having trouble getting answers from both the social security administration AND the USCIS. If anyone has gone through the process, any advice or help would be awesome! hope to hear from you all soon.

Yes, as with most things having to do with the K-1 interview, it is consulate specific. Mexico won't even offer the opportunity for those applying for a K-1 to get the vaccinations at their medical so they have a completed DS-3025. Vaccinations are not a requirement for a K-1 visa, but they are for AOS once in the US and married.

To the OP> If you can get them at your medical in Manila and have your DS-3025 complete, then it is best. It saves you from having to find a civil surgeon later and possibly go through another unnecessary medical and pay more than you should for a simple vaccination transcription onto the I-693. Many civil surgeons insist on another medical, even though USCIS instructions clearly state you do not need one. They also overcharge people all the time, simply because they can. It takes a lot of time and effort to track down one that will do the I-693 correctly and at a reasonable rate for a K-1.

But do things like that really matter, seeing as they just prove we speak (ongoing relationship) rather than we have met??

You know when we write the statement of intent. What address do i put on for the centre ill be sending the forms to? It all goes to the Dallas lockbox, right? How do i know which service centre it will go to, and therefore which address to put on the letterhead??

Hi guys, my names Ben and im from the UK, me and my fiance are curently about to send off the I-129F and accompanying forms for the first time.

I just wondered if we're sending enough evidence in as ive read on different posts and websites of people sending 80-100 pages or even more in!!
Basically she will be sending,
*cheque for $455
*cover letter and table of contents
*form i-129f
*declaration of how we have met in the last 2 years (may is when we met, then july, september and october this year - should she have described each time???))
*Statement of intention to marry on entry of k1 from me
*Statement of intention to marry on entry of k1 from her
*Evidence of having met
- 5 photos (one from each visit, and one of me, her, her dad, and her sis all together in sept)
- boarding passes from each trip
- copies of the stamps in my passport
- receipt from a meal we had in sept
- skype chat log
*form g325a filled in by myself with passport photo attched to sheet behind
*form g325a filled in by her with passport photo attched to sheet behind
*copy of her origional birth certificate
*copy of her passport

And thats all we've done.... is it enough?? its only about 30 pages!!

I have loads and loads more evidence i can use, like tickets for both of us from 10-15 different things we've done. (eg, ticket each from a football game we went to, and we have a pic together from is that ill be using)

Is it worth putting each visit in a section, so for example in one part i put boarding passes with photo from that visit and the tickets, and do this 4 times for each visit.
Or should i just keep the photos together, the boarding passes together etc?

im kind of assuming there is no right or wrong, but any advice from what i have already done would be awesome

Basically, is my evidence of 'having met' enough? or would you add anything else??

ive been looking at the timelines from a year ago, onwards just now, and petitions filed last jan and feb only seemed to take a couple months before noa2 in most cases. Like everyone is saying it seems June onward is where it has slowed down. Ashley and I are sending our petition in first week in Jan, so im hoping that last years trend continues! Maybe because very few people take any vacation in the first few months of the year so everywhere will be fully staffed :~) sounds logicalm but im sure it doesnt actually work like that haha!!
