My (now) husband was denied for student visas twice and we had no trouble with the K1. As long as the other visas weren't denied for something serious (like misrepresentation or something) and were instead denied for something like intent to immigrate to the US, you should be ok. Just get your relationship evidence in order and go read up in the MENA forum to get info about what your consulate wants to see.

If Chile allows the petitioner to be present for the interview, I say go for that. There is, in my opinion, no greater proof of an ongoing relationship than you standing there next to your fiance for the interview. I went with my (now) husband to his interview and it lasted 5 minutes - the CO looked surprised to see me, asked Sifa two questions, glanced at some pictures and did not want to see any of our other giant folder of proof of ongoing relationship. Obviously it will vary by consulate, but there's my two cents. I really do think it helps to be there for the interview if you can (and it certainly doesn't hurt!)

We used an accordion file - different sections for each thing (ie, Skype records, pictures, emails, etc.) Be aware that most likely you will be standing at a window with a small slot to slide things through - we were glad we used something that it was easy to remove documents from, because a big book would not have fit through the slot.

I made 1 complete copy of the packet we sent in, but it took very little effort on my part beyond the work put into doing the original petition. I put everything together, took it to Office Depot and just stuck it on the copier and copied it all in black & white. I put it in a binder (which is also where we kept all of the NOAs and any other correspondence from USCIS regarding the I-129F) and carried it with me to Kenya when I went for (now) husband's interview. We liked having it because it helped him prepare for the interview going through it and try to figure out any possible question the CO could ask.

We still have the binder, and a binder containing a complete copy of the AOS application and all correspondence from USCIS regarding that petition, and will keep them until after he becomes a citizen at least. You never know when you might need to reference it (we liked having the I-129F stuff for the AOS application as it had a bunch of the info so we didn't have to go looking for it again), it's just not that big a deal to make a copy of it.

I know you're kidding, but FYI, petitions from Texas are adjudicated at Vermont Service Center, not in Texas even if that is where they are originally mailed now.

You can use sticky notes if it makes you feel better - I put stickies on a few things just to clarify. But yes, don't put anything in a binder - I just separated various sections using paperclips then bound the whole thing together with a big binder clip.

Yes...the I-134 and I-864 are both financial support documents based on family size. No matter where she has the baby it increases your family size by one. Congrats btw :)

Same thing happened to us - I got a letter from NVC saying they had received the approved petition, (now) husband got Packet 3 in the mail, etc, but no NOA2 ever showed up AND the online system for USCIS continued to say "initial review" or whatever.

I called USCIS at least 3 times (several times I was told that the petition had not been approved even though by the last time I called my husband was IN THE US on a K1!!), finally requested to be elevated to non-script reading person and it turned out that the problem was that the adjudicator had approved the petition but neglected to do whatever needs to be done in the computer system for it to register with USCIS as "approved." The person I spoke to on the phone said that ONLY the original adjudicator can do this, so she had to put in a request for that person to update the computer, and once that was done an NOA2 was automatically generated and mailed to me. You WILL need the NOA2 for adjustment of status, so be persistent!

Print them out (we literally copied and pasted the VJ example, just inserted our names etc.) sign them, put them in the packet. There is no need to have them notarized (someone said this was required up thread, but it is not.)

You're talking about the USC traveling to see the beneficiary, right? In that case I doubt you'll have any problems and shouldn't need to bring any documentation. If you want to be safe maybe bring the NOA1? I visited my fiance in Kenya, and answered (as I always have when going there) that I was going to visit my boyfriend & other friends when they asked why I was coming to Kenya. The only hassle people usually report is when the beneficiary is coming to the US to visit the petitioner, not the other way around.

Correct. The initial petition (not the visa) can be approved while your fiance is visiting you here in the US. However the visa cannot be approved until the interview, which has to take place in his home country (along with the medical exam.)

Yep, the 3-6 months wait for the petition approval begins now. Hopefully it will go faster! But like I said...just try to be patient. Getting to be with your sweetheart is worth it :)

You still have a few months to go until you'll need to provide anything. In a week or two you'll get your NOA1, which is just a receipt saying that they received your paperwork (and cashed your check) and they are processing it. In a few months (right now seems to be 3-6+) you will hear something from them - hopefully NOA2, which is the petition approval notice. Then it will move on to NVC for a few days, then to the consulate for the interview. You don't have to provide any additional information until you get to the interview (unless you get an RFE, which still probably wouldn't be for a few months IF you get one.)

Also I wouldn't fill out the I-134 or ask your parents to until much closer to the interview date. The embassy will want to see up to date info, not pay stubs and a letter from employer dated 6+ months prior to the interview. Just try to be patient :)

To poster Barbiedoll, who posted today...you can continue with the K-1 route as long as you are not married. Your pregnancy will not have any effect on the process. It is unlikely that he will be here by December, but if you file NOW...maybe.

Yes, that is correct. They will still need to file the birth with the consulate though so that the baby can get a US passport.

Am I right in thinking that the Adjustment of Status should work out fine too, as long as we have that co-sponsor? It's a bit early to worry about that, but we're trying to make sure we won't have any major issues later on down the road; I read somewhere on the forum that AoS is likely to be declined if your primary sponsor earns less than the projected minimum, but that seems sort of counter-intuitive (why would they give you a visa, let you get married, then deny you?)

My girlfriend and I are trying to get the visa process started, but we're not sure what our best option is right now. We'd prefer to go for the K-1 visa, but unfortunately her income alone isn't enough to meet the poverty criteria.
Fortunately we have a willing co-sponsor whose income more than exceeds the required level; but I can't seem to find hard info as to whether a co-sponsor is actually allowed on the K1 visa's Affidavit of Support [i-134?]. Some people seem to suggest it's not possible at all, others suggest it depends on the consulate you go through.

Can anyone shed any light? I (the benificiary) am from the UK, if it helps -- so nearest embassy is London.

Also, she previously applied for food stamps (in the winter) but it expires next month (before we plan to apply). Is there any chance this will affect the proceedings?

We sent off the I-129F a week or so ago and got our NOA1 already.
I (the foreign fiancé) am actually in the USA right now and on Question 12 (I think it is — asking for your I-94 number) we just put "VWP entrant" and the date stamped in the passport below.

Is this likely to cause any problems, whether with the application or leaving the country or something?

Yes, it's possible!
They don't have to live with you. You will have to factor in any of the sponsor's dependents into the equation re: meeting poverty guidelines, however.

Pretty easy to spot the Americans who've never left the country. They're far more naive than their globe-trotting counterparts.
It's hard for someone who's been raised in America and never left its borders/been introduced to members of other cultures to understand the mindset behind scamming in Lagos and RUB, for example, and thus avoid it.

I'm just remembering the issue of a girl who married her guy and thought no problem and applied for AOS to her spouse. Even though her marriage was valid in the state she got married in, USCIS didn't allow her spouse to get LPR because her home state didn't recognise her marriage (she had a 6 month waiting period from her divorce that she ignored). I believe her state's rules even said that as long as the marriage was legal in the state it happened in her state would recognise it but USCIS wouldn't budge.

Like I said, I would hope it will be okay. Maybe AOS is different to a CR-1 visa? But just making sure the person is aware that this COULD happen.


K1 gets fishy with this stuff. I know of people who didn't any problems, some who did. I should say, it the marriage should be valid in the state in which you intend to live.

Though, CR1 should avoid all this mess completely.

You all must realize that marrying your cousin is not a grounds for denial. I have gone over this very clearly with my lawyer as it is my situation. The K-1 should have been fine so long as the state in which you intended to wed in allows first-cousin marriage. Because I live in Texas, a state which forbids such matrimony, I chose to go the CR-1 route, which recognizes a marriage so long as it is legal in the beneficiary's country.

The only problem that should arise is 1) the state in which you intend to wed and 2) proving that your relationship with your "suspected" family member is, indeed, valid.

I would really be sure and clear that the reason for denial is because you are suspected to be cousins. Because like I said, first-cousin marriage is not a reason for denial unless the above stated are part of your situation.

It might be something else...

Hello,

I have read here several times that it is a good idea to include a copy of the child of the beneficiary's birth certificate in order to prevent an RFE. However, this also leads me to a few questions

1.) Is it necessary to include the child's birth certificate in the intial petition of I-129F or no?
2.) On the birth certificate the put the mother, my fiance, under a different address, that of the father, although she did not live there. I don't want to say she lived somehwere she didn't, but don't want to coause problems on palces she lived in the past five years.
3.) Also, we sometimes refer to the baby with a nickname. Should we avoid letters with the nickname or explain this in the cover letter?
