K-1 Fiance(e) Visa Process & ProceduresQuestion about fiancee's visit to U.S.
QUOTE (ELW @ Oct 13 2007, 06:08 PM) <{POST_SNAPBACK}>
Like Rob and Jin said, it is risky. The authorities at POE will know that she applied for a fiancee visa, they may deny entry thinking she will just stay on in USA. Is it a multiple entry tourist visa, because you said she used it once already? I think the tourist visa will be valid until the K1 visa is granted.

Since you just received the NOA2, the interview will probably not be scheduled until December or later; certainly not in November. so I would not worry about that.

If she decides to go ahead and make the visit in November, it might be good if she brings along paperwork to show at the POE in case she has a problem of questioning, paperwork showing that she has definite plans to return to India (letter from employer about vacation time and when she is returning to work, or anything showing that she has to return to pay bills, etc..

Many people try applying for tourist visas while their K1/K3 visa applications are pending, but they are usually denied. So we don't have much knowledge of what it is like visiting on a tourist visa while other visa applications are pending. I hope others with experience will answer!

-------------------

Thank you for your valuable insight. Her tourist visa is a multiple tourist visa and she did use it indeed once to come to the U.S. in March of this year.

I will advise her to take all proof/documentation that she can that shows she will be returning. She is employed so she shouldn't have any problem w/ being able to prove that. She is currently scheduled to return back on Dec 2nd. When can I expect her to have her interview scheduled? She is only coming for 2 weeks and I am not sure how far in advance they typically tell you when your interview is scheduled.

K-1 Fiance(e) Visa Process & ProceduresQuestion about fiancee's visit to U.S.
Hi all--

My fiancee is an Indian citizen and I applied for her fiancee visa in June and just received the NOA2 recently. Prior to receiving NOA2, she had planned a vacation here in the U.S. in mid November for 2 weeks. This is simply a vacation for the both of us and we will not be getting married during this trip. She already has a tourist visa which she obtained months before I applied for a fiancee visa and has travelled once on it already.

I was told by someone that since I have now applied for the fiancee visa, her tourist visa is no longer valid. I am trying to find out if there is any reason I should be concerned about her trip or if I should cancel it altogether.

I am also concerned if her interview date is scheduled by chance to be on a date when she is in the states. Anyone know if you can re-schedule those quite easily or if that is not advisable?

Thank you for your assistance!

K-1 Fiance(e) Visa Process & ProceduresExpired Forms
Hmm...just makes me a bit nervous. We had our entire I-129F packet sent back to us because the I-129F form expired in mid February (I believe) while it was sitting on someone's desk at TSC. Then we were transferred to the dreaded CSC. I'm sure I just missed some of the fine print telling me to do the updated one because we did take a couple of months to fill out all of the forms, but I did see that the form was still current at the time of postmark. Ahh well. Learned our lesson. Always read fine print.

I was just checking out the state requirements online. Looks like Texas requires the SSN, but I checked out surrounding states...Arkansas seems to have almost no restrictions whatsoever. No waiting period, either! Thanks for that link.

Haha - yeah I made a copy of the back of mine even though it looked blank. I thought perhaps there was a watermark I just wasn't seeing. Sure enough - plain white sheet of paper. So we mailed in the plain white sheet of paper with a little note at the top "back of birth certificate." Looked ridiculous, but then again - so much of the stuff you send is quite personal. I'm sure they get a giggle or two out of some of those packets.

Yeah - the fact that 80% of the petitions are going the black hole they call CSC is cause of a great deal of frustration around here! Also - you'll find the numbers that USCIS publishes are absolute worst case scenarios just intended to keep people off their back! (Either that or it's just where the dart landed when they were throwing it - not sure which). The numbers compiled for us by wonderful people like kengumbo are much more accurate. Welcome aboard!

K-1 Fiance(e) Visa Process & ProceduresImportant question regarding our wedding date before visa approval

Good news everyone! Ian had his interview today and was approved for his visa. He should be getting it in the mail this coming week and will be here next Saturday (one week before our wedding)! It was close but we made it :) .

For the person who is concerned about having everything in time for your August wedding, my thoughts to you is to have everything done early, order his police certificate now (that was the one thing that held us up). If timing is starting to look bad, call your congressman's office, this is how we were able to expedite Ian's interview by a month. Sometimes when you're desperate, you have to do whatever it takes. But it can be done and I wish you the best of luck for your August wedding!

Much thanks!! Already decided if we don't have NOA2 by end of May/first of August, we're going to change the wedding date. :crying: The thought isn't a happy one at all. He has already ordered his police certificate and scheduled his doctor to do his vaccinations (so he won't have to have them at the embassy). Glad your interview went well!!

K-1 Fiance(e) Visa Process & ProceduresImportant question regarding our wedding date before visa approval
We are facing the exact same situation. We planned our wedding long before finding this website (or knowing any better). The wedding is planned for August 11 with invitations printed and money already going into the ceremony and reception. I know it's still 4 months away, but we've only gotten the NOA1 so far. It would be so disappointing not to be able to have "the real thing" on our wedding day. I know it shouldn't really matter, but after all that we've been through - I can't stand the thought of him having to go back to the UK again after the wedding. I'm not in panic mode yet, but...May...YIKES! Best of luck to you guys!

K-1 Fiance(e) Visa Process & ProceduresDid they lose our petition packet?: UPDATE

My fiance is going to call his congressman tomorrow morning.
I hope we get some help!

To Dan&Tiffany: my fiance already sent copies to CSC about two weeks ago with a note stating the office manager's name who had been dealing with our case. The office manager told my fiance to do that so that he could personally process the case, and he said he would let my fiance know when he receives the copies. That was the last conversation my fiance had with that person. My fiance kept leaving messages for the last week with no calls returned. And today, he finally got to talk to a supervisor there and the supervisor told my fiance that the office manager no longer works there....

I saw that - was referring to additional copies. I'm also anxious to hear what your elected officials have to say. Hope they give you some help! Best of luck to you!!

Oooh boy. Getting knots in my tummy. This is not making me feel better about all of the recent slow downs at CSC. I've done press release searches for USCIS...nothing. Apparently if anything ever does happen there, they don't advertise it. I just don't know. So sorry to hear about your situation, guys. Hoping you made copies of everything to resend ASAP!

K-1 Fiance(e) Visa Process & ProceduresWedding Dates

So, I think I have decided that I will probably start making serious plans once we have secured an interview date. I received NOA2 last week (which is about a month earlier than I thought it would come through, based on current timelines). If he has his interview at the end of July/August, I think booking a late October/early Nov wedding date will be safe enough.

I know it is still is a bit of a risk - but I think as long as we are well prepared, everything should go smoothly. I am planning on having a 200+ wedding with people from all over the world - so I really would need to start booking things. I would hate to wait so long and cant find a venue, etc.

Best of luck to you! Hope all goes smoothly.

So how many of you out there have booked a wedding without yet being approved and how much time do you have left to get the K1?

I am so tempted to start booking things - but I know it is best to wait... ugh!

Sounds to me like they were asking what other were doing. Not what they should do. You guys, as always, were great to share experiences, etc., but PLEASE don't be so judgmental of what others decide to do with that information. You really are a great resource of knowledge, but once the facts are on the table - it's up to each of us what to do with them. We all do things a little bit differently, that's what makes this site so great - the diversity on it. Yeah, pre-booking is risky. If I wasn't a BIT of a risk-taker, I never would have met Dan, and he's the most wonderful thing that's ever happened to me.

I was just responding to the comment made about "the worry, or the scorn" that robburnsefc made, and trying to be supportive of the decision made.

I did it. See some thread that took over the world when I started to panic. I am still panicking! But we have resolved to go ahead one way or the other with the planned wedding for a whole host of reasons. My fingers are tightly crossed as we speak as I am counting down to the end of July. If I had found VJ just a week earlier I would NEVER have planned the whole deal.

I dont know what is/was worse - the worry, or the scorn that is poured from a great height on this forum for doing it!

Best of luck to you both! You know...if it makes the two of you happy - I think it's absolutely perfect! Don't let others' opinions of your decision get to you. It's YOUR wedding and YOUR decision. No one else's opinion means a damn in this one!

It's about losing $$/deposits, not opinions.

There again, their decision. I'm sure they know the risks involved. They've been repeated time and time again on this thread.

it seems after all, I will be there 4 my birthday, and probably hve the wedding on the same day

 Just an update for us as well... We are sending back packet 3 tomorrow and expecting an interview in the next month or two. So I've put money down for our cake, which we can't move and put $ down for the hall which we can move. Since we are doing it on a Thursday evening, everything is available and a lot less than on a weekend. All the people I really want at the wedding can make it on a weekday, so that is the perfect compromise for us.

That's great! Congrats to you!

Don't make plans. You're trying so hard to control a situation you can't control.

 Any shred of control went out the window the moment the government became involved in our relationship. We just both really want a "proper" wedding with both of the families there. Simple as that. Just because we're an international couple shouldn't mean that we don't get to have this. You all know how long it can take to plan a wedding.

I will admit that it is a nice distraction, but it's also added stress - even switch there I'd say.

I guess it just all comes down to preference, really. Luckily, my family lives in a fairly small town. Booking for venues and vendors isn't quite the fiasco it would be if we were doing it here in Dallas or some other large city. Many of the vendors are actually personal contacts of family and friends - that helps - they tend to be more flexible!

As I said before - if we have to move it, we can. Not that it would be an ideal situation, but hey - is ANYTHING about the whole immigration process ideal?

So, for those of us crazy enough to pre-plan a wedding - best of luck to us all for getting that visa before the planned "I Do's."

K-1 Fiance(e) Visa Process & ProceduresWedding Dates

We actually have went ahead and booked things (against all of the advise of every single person on here), but all of the vendors we chose are ones that will reschedule for no fees. Of course picking a new date would be a nightmare, but hey - that's only gambling a bit of stress, not thousands of $$$. All of the people we've ended up going with are very understanding. Like you say - our road to the alter is MUCH different than most.

I'm still hoping with all my heart that he's here by mid-August. Whether or not it happens remains to be seen. If London keeps up the current pace and CSC goes back to work - it very well may. Then again - if not - no airlines book for his family or anything like that. The dress will work regardless if it's a month or so late - it's always damn hot in Texas. Worse case scenario - an extra alteration there.

We're waiting to order invitations until closer to time. Truth is we'd already ordered them once and had to toss them because we changed venues for the reception. ALL weddings have stress, but HA! most brides have no idea, right ladies?

Yeah, seriously. Those bridzillas on TV should try adding this immigration stuff to their planning!

Yeah, I was thinking that most vendors would let you move the date (except maybe the receiption hall? or maybe just charge you a smaller fee) if you had to rather than canceling. Can I ask when you what date you were planning on?

We plan for August 11. Already got flamed for posting this before because "oh no, never going to happen." So, bring it again! If we have to change it, we have to change it. Que sera sera. I have definitely learned not to sweat the small stuff so much in this whole process.

And actually our reception venue has been AMAZING. Considering it's a reception for 300+ people, I've been amazed at how flexible and helpful they've been. The coordinator even offered to call me before they booked any other event in th general time frame - just to check on the visa status to see if it's on "average" timeframe (whatever that is, right?)

K-1 Fiance(e) Visa Process & ProceduresMarriage other than in USA

The quick answer to your question is yes: if you have a K1, then you must legally marry here in the US and nowhere else. The name of the visa tells you what you need to know - it's a fiance visa. There are also spousal visas/processes, if you want to be legally married elsewhere.

You can, however, have a wedding somewhere else. Don't confuse a wedding with a marriage. If you make sure that under the laws of the place you want to have the wedding party (whatever part of Canada, etc), that your ceremony does not constitute a legal marriage, then go for it. Also important to note: at the border, if the agent says "so you're married then," the correct answer is "No." It isn't "no, well, not really, 'cause see we had a wedding in Canada but we didn't get married for reals, 'cause there was no certificate or whatever, so we aren't, like, really married, but we did have the party and stuff, okay?"

That's unnecessary information fools would share to make sure they have a longer chat at their port of entry.

If you do not get married, then you are not married. Deceptively simple, no?

Apply for no license. Sign no documents. Post no notice. Whatever would make it a marriage in Canada, DON'T DO IT. And then you'll be okay.

I'm so sick of seeing this advice I could gag.

You're so clever Daisy. I can't wait for the poster who comes back saying they took your advice and now their SO is back home in their country, the couple separated while they process a spousal visa.

Actually I don't see a problem with this advise. So daisy said go for a wedding if it's what will make you both happy and then when the K1 comes in do the registra thing. People do this all the time so where is the problem???

Are you sure this isn't another one of those lets jump on people and show how self important we are Dev and Reb????

K-1 Fiance(e) Visa Process & ProceduresDecree Absolute

Forenote: I've read the guides and searched the forums and have not found this specific question, so here goes:

We've been waiting ages for my fiance's Decree Absolute from the UK and it looks like we'll probably have it issued there by 7/20. Obviously, since the fee increases are taking place at the end of the month we'd like to get the I129F in ASAP. I know we need him to bring the original or certified copy with him to the interview at the London Embassy, and that it would be nice if we included it with the packet to VSC, and that photocopies are OK in the I129F packet, BUT do you think a FAX copy would be OK? Does anyone have any experience with whether this is acceptable or not? Or would a scanned then emailed copy from the solicitor be better?

The bottom line is, time is of the essence and we want to be in the K1 process ASAP!

Thanks in advance for your help!

Given that you don't send the original anyway so long as the fax is clear and readable and of course it has been stamped you will be fine. I would maybe cut the header and footer with the fax details off and then re-copy so that it looks like a standard photo copy.

Your biggest problem is finding a fax that prints absolutely legibly and I don't think that exists.

They probably won't ask for the x-ray...my husband was told to carry it too and to give it to the immigration official, but they wouldn't take it. We still have it here in the house, just set it aside just in case. Still not sure what to do with it!

Confused with this one... Here it is, I got married in March 15 in San Diego and my wife would file the petition. However, when I came to see her in May, we decided to stay together. Now I am worried sick, because I have no intentions of committing fraud.

Moving to the US on a non-immigrant (and not a K-1 or K-3) and less than a month later having everything ready to mail in for AOS probably will raise some eyebrows...

At any rate, agreed that you probably should start your own thread.

OP: Best just to wait it out with the CR-1 as others have said. There were many times growing up that I started a new school a few months into the school year...it's not such a terrible thing.

IR-1 / CR-1 Spouse Visa Process & ProceduresIs it worth it to include a letter with my I-864?
I had the same exact situation. I actually did include a letter - I put my 2007 W2 from Peace Corps and a short paragraph just saying I didn't file taxes in 2007 because I didn't make enough money to have to file that year. I probably went a little overboard and also included my 2007 taxable income worksheet that PC sent me at site (I happened to have it in a folder) and a document from the 2007 tax forms that said how much you had to make in order for filing to be required. Probably not necessary, but...that's what I did.

Edit: Just realized you are doing a CR-1, this is what I did when we filed the I-864 for AOS from a K1.

We are applying for a CR1 for my spouse in India. We are both divorcees from past. I have the marriage certificate of me and my spouse's marriage together.
I also have the marriage certificate and divorce decree of me and my ex-spouse. However, my spouse only has the divorce decree with ex-spouse but
not the marriage certificate. According to US consulate in India:

"Any applicant who has ever been married must provide an original and a clear photocopy of the marriage certificate(s) for all marriages. "

I looked everywhere and cannot find a way in India where someone can register a marriage after divorce and even if we did find a way, why should we expect
the ex to be so cooperative to come from out of town just to get past marriage registered when you don't like your ex. We are stuck?

Has anyone been in similar situations and what are our options? Please help. I am very worried about this document.

Martin09,

If the passport was issued within past 6 months then you need to get PCC from Local Passport Office.

If the Passport was issued more than 6 months then you need to get PCC from both Local Passport Office and The District Police Office serving the applicants place of residence.

Based on what i read on the forum if you have submitted one PCC then you will not get RFE but you will get an email to produce the other one at the time of Interview.

I submitted only one PCC issued from Passport office for both my parents and my Case is completed and waiting for the interview email. My parents have the other PCC ready which as issued by the local District Police too.......so get prepared with both of them.

Good Luck! Thanks, Raj

Do we need to have police clearance certificate from both the local police authority and the passport office for the interview.

I had sent only the police clearance certificate issued by the local Police Authority with the DS-230 package.

I haven't applied for the PCC from the passport office. Is it required?

Can you please share your experience?

Good Luck!!!!!!! Thanks, Raj

IR-1 / CR-1 Spouse Visa Process & ProceduresCover letter from NVC
boy1980,

I am from Hyderabad and applied for my parents. My parents applied at Passport Office in Hyderabad for PCC without any letters from NVC or USCIS and this was done even before the case was transferred to NVC. They went to the Passport office, filled out an application, paid the fees and submitted Original Passport and within a week they received Passport (stamped on the passport) and also a letter from Passport for PCC (in the letter they mentioned it is for USA.....).

I submitted this PCC (received from Passport Office) to NVC at the time of DS-230 and my case is completed but when the case was at NVC i read the forums about that i need PCC for local District Police....so i asked my parents to apply one at the local police station and they went to the local police station submitted an affidavit (as stated by police) and submitted that and in a day or two they did verification and the local Police station gave PCC letter to my parents and luckily i did not get an RFE for this PCC but they will be taking this PCC issued by the local police that to the Interview.

Hope this helps. Good Luck! Thanks, Raj

1. I received the RFE from NVC for missing police certificates. I took the RFE email to police officials to apply for Police certificate.
2. My local police officials (Hyderabad,India) refuse RFE letter and asked the beneficiary to get the cover letter from NVC.
3. My question/request is,
3a. Did anybody went through the same situation in Hyderabad,India? If yes, please guide.
3b. I need a good format email to write to NVC requesting for cover letter which can be used as a proof to obtain for police certificate.

Early response is very much appreciated.

7 AM - Waited in line outside the embassy.
7.45 am - Allowed inside as I had an 8am interview time.
7:50 am - my file was checked by a security girl at the entrance.
8 am-8.45am - waited inside till an Indian lady at the counter called me.
8:45-9am- Indian lady asked ques and checked all my docs and took my wedding pics, Church marriage certificate, copy of tht, wedding card, husband’s employment letter, 2 passport photos, passport, medical report, then W2 forms( I was not having it).
Asked questions like - have you traveled outside india? Is this first marriage?

Took my right and left hand four fingers print on the machine and then both the thumbs together.
Then gave me pink slip with a number and asked me to wait till am called for my interview.
10am - Called by the American guy for my interview. Took a look at my docs then asked
To take an oath. When you got married? how you met ur hubby? When did u last meet him.. Explained my whole story. Then asked about my profession. Which domain? Which client?
Answered then he typed something in the monitor. Then gave me a chocolate and said tht my visa is issued and I will receive it in a week.

Received my passport in two days.. ?
Flying to US this weeknd… ?

As a whole it was very good.. and most of us got it approved. luckily very smooth.

All the best for everyone. Dont worry, If u have submitted all docs then nothing to worry.

IR-1 / CR-1 Spouse Visa Process & ProceduresQ: Related to PCC in India
I submitted PCC that i received from PASSPORT OFFICE and did not submit the LOCAL PCC and got approved. I think atleast one of them will work. In case if they need the Passport PCC they will ask you to submit at the time of Interview(based on what i read on this forum). So submitting one PCC should work either from local PCC or Passport PCC.

You dont need any documents other than Passport, photos and the application that passport office provides you and a nominal fee. My parents applied and received Passport PCC within a week. You have to submit Original passport to the passport office and they will stamp on the passport and also send you a PCC letter within a week through courier.

Hope this helps...Good Luck...Thanks, Raj

I have couple of PCC related question.

1> If you include local PCC with DS-230 with a note that you will present Passport office PCC at the time of Interview, does it work?

Question for persons with local experience.
2> What documents do they need at passport office? Do they have to have Original local PCC or some kind of True copy works?
Because if <1> is true, and my spouse sends me original local PCC to save time, I don't know how to get Passport office PCC other than using photocopy!!!

Thanks in advance for sharing your experiences and opinions.

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Exam (Apollo,Chennai OR Vijaya Diagnostic, Hyderabad)
If you are in AP and close to Hyderabad i would suggest you to go to Vijaya Diagnostic Center in Hyderabad.

If you are close to Chennai and would like to make 2 trips then you can choose Chennai.

It is your convenience. But my vote goes for Vijaya Diagnostic Center in Hyderabad as my parents visited this center and they praised the doctor and his staff. I responded to you earlier too in one of the other posts where you asked the same.

Good Luck! Thanks, Raj

I need to go for Medical exam, the consulate website says you can go to apollo in chennai or Vijaya Diagnostice center in Hyderabad. I am confused.
I need your help in deciding. Which one is better?

If You want to vote for APOLLO IN CHENNAI, Just answer (AC)
If You want to vote for VIJAYA DIAGNOSTICE CENTER IN HYDERABAD, Just answer (VH)

Please answer
