Not doubting the veracity of your relationship, but do you really want to consider a life time committment to somone who: a) willfully will lie about their children or :b) does not understand the ramifications of such actions?

If she can obtain an authentic CENOMAR (Certificate of No Marriage), then go forward but be sure to include any minor children on the application. Otherwise, I believe she would be considered abandoning her children and subject to immediate deportation once discovered in the US.

hey guys! couple questions regarding my fiance and her son:

heres our situation:

my fiance and i are planning to finally apply for her k1 fiance visa at the beginning of july. She is from the philippines and we met almost 1 year ago while i was studying abroad in manila. Anyway, im done with school now and we're planning to get married. I'm 24 with a new job that is projected to earn me about 30-35k per year. Shes 26 and works as a supervisor for a call center in the makati. Heres are the issues.

1. I currently don't meet the minimum income requirements at the moment, Since during the last 6 years, i have been a student none of my previous tax returns show sufficient income. Also since i had been studying abroad for the past year, i have no income whatsoever from june 2008 - may 2009. however with this new job, i will definitely exceed the minimum 125% poverty level (just not by the end of this year). I've been told by some people and noteworthy attorneys (tod schlosser) that it is indeed possible to use co-sponsors (close friend or relative). Schlosser was almost arrogant in his insistance that i would be able to use a co-sponsor. Then also, i've read and heard from other attorneys (allan and lolly) that the philippine USE will NOT accept co-sponsors. Should we just go with Schlosser and cross our fingers?? I don't know what to believe or go by? so any help with that would be awesome! =)

2. My fiance has a 2 year old son from a previous relationship (they were never married). We decided that maybe it would be best that in order to ensure financial stability for her son, it would be best to only include her in our k1 visa petition. Then after she is able to find a job and we can establish ourselves financially in the states, we can start working to immigrate her son here. In order to avoid further conflicts with income requirements, would it be better only to include her in the k1 visa petition? what are our options for bringing her son along without having to file for the both of them at the same time in the k1 petition? Im pretty open to all other options and if we have to go through the k2 route, then that would be ok as well. However, if there are any other options (different petition, visa, etc.) available after our marriage, let me know. T

would receiving any kind of financial aid from FAFSA (federal student aid) towards school affect the USE's decision on a k1 visa? I qualified for a grant for this school year totalling 3600 dollars....hopefully not, since its not welfare, but any feedback would be helpful since i didn't see this particular issue come up on the countless guides that i have read/skimmed =p

hey guys. one question for everyone. I just sent in my I-129f package for K1 visa last tuesday october 6th! finally =) anyway i know that the guides here say that it normally takes 2-3 weeks before we receive the NOA1. However it seems that most people on this forum have gotten theres within 1 week? just wondering if anyone had any feedback on this? Should i call the office to find out? I do have delivery confirmation that they received it the next day after i sent it. guess i'll just have to wait a bit longer =) thanks for your help! god bless

sorry to hear that! i was having the same concerns not too long ago. However, i just found out they received it! Just call the bank that issued your cashiers check for the application fee. Then ask them to transfer you to the department that can track whether or not the cashiers check has been paid to the recipient. They'll need some info from you, like the date issued, the amount, etc....they should be able to give you a date as to when the check was paid to the USCIS....if/when you find out that the check was cashed/paid out, then you should be all good (it obviously means they received your petition papers!)......next step is to wait for the NOA1 hard copy in the mail =) once that comes in, its time for the even LONGER waiting period for the NOA2 =/ have faith and be patient, we'll get there...good luck to you!

hello again friends =) Anyone use the USCIS website to check on their visa status? I just had a quick question about mine. So my NOA1 date at the VSC is October 9th. Whenever i logged into my account at the USCIS website it says my application was "last updated" on the october 15th. What exactly does "last updated" signify? So far, no RFE notices or approvals. Its been over a month since our NOA1! hopefully VSC continues to move as fast as rumored =) thanks for ya'lls advice!

Thanks guys! yea definitely not postponing anything with the k1 no matter what! Even if it means going the I-130 route. However, i'm almost 100% positive we'll be able to have her 3 year old son follow within 1 year that her visa is issued....We just need a couple months to get on our feet and perhaps save a bit of money before bringing him over. Anyway thanks for all your input =) hopefully the 2nd half of the k1 process (post-NOA2) will go just as smoothly for us as the first! God bless

from my understanding of what i've read so far about k2 visas for our fiance's sons or daughters, i know that the k2 visa must be issued within 1 year that my fiance is granted her k1 visa. If for some reason we cannot process her 2 year old son's petition in that time frame, he will no longer be eligible for the k2 visa correct? That being said, what would the next route/option be for him in this unlikely event and roughly how long would it take to get him here? thanks for everyones input. I would also like to add that our petition has been approved as of 12/10 and that precious and i are very excited to have come this far this quickly. sent i-129f package visa express mail on october 6th, they cashed the check on the 13th, and i received the hard copy of the NOA1 in the mail on the 16th. So about 10 days....a bit longer than a lot of the people here, but at least i now have it in hand..so be patient and yes the waiting game is torture, but at this point, the best thing we can do is hope and pray for a swift and smooth process....make sure u create an account and portfolio on www.uscis.gov so you can track your petition's progress (you'll need the receipt number printed on the NOA1 hardcopy)!....Good luck!

hello again....just wondering, come time that my fiance goes to her interview at the USEM, will my status as a dual citizen of both the US and philippines come into place at all? I was born in dallas texas. However when i studied abroad in the philippines last year i was able to recognize my filipino citizenship since at the time of my birth, my mother was a still a filipino citizen. In turn, i was entitled by philippine law to natural born citizenship. Essentially, i am both a natural born american citizen and natural born filipino citizen =) I really doubt this fact will come into play. However, i just thought i should ask to be safe since my lawyer is USELESS and never replies.

btw: if at ALL possible avoid the use of lawyers when filing for K1 visas. I really should have taken the advice of the other "VJ'ers" and taken care of it myself. Everything was pretty much done by me. Since he took so long to respond, i pretty much filled out the forms online myself, signed them and sent them to him and he sent them to the service center. SO to those asking about lawyers regarding k1 visas, i really recommend to the the majority of you to take the advice written on some of the posts here. For the most part, all they do is proofread, delay your filing dates by not responding in a timely manner, and charge you way too much money. To be more specific i hired Tod Schlosser and his RHC Visa services to handle my case. He promised me quicker approval and sounded quite cocky on the phone. Me, being desperate and so excited, took this cockiness as confidence and truth. IN reality, it really just seemed like he was hounding me for money. Truly more of a salesman than an attorney. Anyway this was mid-August 2009. My answer to him was to give me some time to come up with a down payment for his services which cost ($2000). In the one week leading to the day that i paid the down payment, he called me everyday asking for information and when i would be ready to start letting his firm handle our petition. If i had a question he'd email or call me back within the hour and was really on top of things. He even bragged by saying "see how fast we respond?" Little that i knew, after i paid him on the 27th of August, he didn't respond to me AT ALL until almost October. When he finally decided to respond and apologize (cited travel reasons) all he did was email me a questionnaire for him to "fill out" my forms. TOO bad precious and i had already filled them out and signed, we had also gathered all of our evidence 1 WEEK after hiring rhc visa services. Anyway, after over a month of wiating for his stupid firm to reply, and waiting for them to "proofread" they finally sent our petition to the VSC on October 6. Although we are very thankful to have received our NOA2 now, I wonder if all the trouble with waiting for rhc visa service to respond had been worth it. My answer, is no. However, what can you do? We just have to take what God throws at us sometimes. It was definitely a lesson learned. Overall my opinion on lawyers is unless you have extenuating circumstances regarding any legal history here in the US, you will almost always be better off doing it yourself. They have no abiliity to speed up your processing times nor do they have any kind of "pull" at the embassies. Believe it or not, all they really do is proofread, mail your documents to the service center, and make thousands of dollars doing it. I'm not saying that NO ONE needs a lawyer, i'm saying that MOST of us DON'T need them. I honestly felt like Todd Schlosser and RHC Visa service really just offered their best services to lure me to pay them, then as soon as the payment is received all customer service flew out the window =/ Read the posts, ask questions here on VJ, follow instructions, and you guys should be quite alright by yourselves. God bless everyone on their visa journeys and thank you VJ for helping me through the process! Anyone who has a story about using lawyers for their k1 visas please feel free to share =) Good or bad!

Hello again! =)

just want to let you know that we are finally sending in our I-129f package for a k1 visa tomorrow! My only concern was the evidence of having met. I spent almost 1 year in the philippines under a student visa and and met her soon after arriving there in 2008. I know to show evidence i need to show receipts of trips we've taken hotel keys, boarding passes, etc...heres the thing. unfortunately, i didn't think to save any of that stuff. Everything we did was paid in cash so i kept no receipts (me being dumb). Also, i lived in the guest house of my family so we never stayed in a hotel. I hope i have submitted enough evidence! if not, what else could i possibly send??

heres a list of what i have ready to send:
1. US Passport with stamps including: departures, arrivals, visa extension, student visa, and quarantine stamps
2. Letter from Philippine immigration stating approval of my application for a student visa (university of the east)
3. Emails from delta and american airlines showing payment info and trip itinerary (arrived in PI on 5/08, back to texas 10/08, back to PI 11/08, then back home 5/09)
4. copy of my ACR-I card (kind of like a green card) showing my student visa status and serving as my official ID in the philippines
5. a discount card for a hotel, mall receipt with my signature, and an entrance pass to a comedy club in the philippines
6. NUMEROUS photos of the 2 of us together (some with friends and others with just us)

I got to the interview and the consule said that my fiance did not meet the required income and asked for a co sponsor and so after a week i was able to go back and showed them the additional documents and i was approved! and without knowing the person who took my additional documents told me that i am very lucky because the US embassy in the Philippines dont asks for co sponsor but since the consule asks for it then they will accept it.. and here i am in the states! married and happy with my husband :)so just pray and there must be a way for you to be together :)

If it is killing you to wait...you will die before it is over.

Attorneys CAN NOT speed the process and can only slow the process. There is no way they can complete forms faster than you can do the same thing yourself.

Unless you have been notified by USCIS that you have some sort of problem, an attorney is a waste of money and time. Even then, there is very little to nothing an attorney can do. Generally they pay a clerk $12 an hour to fill out forms on a computer, the same forms you can download here for free, with information and documents YOU provide. Then they call you back to sign it and stuff it in an envelope and mail it. After that it is in the service centers hands. The process time will depend on the backlog of work at the service center and nothing else. Your attorney cannot even call the service center, they do not even have incoming phone lines open to the public and certainly not to attorneys. If he says otherwise, he is a liar.

Read the pinned topic at the top of the K-1 forum regarding my interview with a director at the VSC, he addresses lawyers in that interview.

The ONLY people that can get through to the service centers are congressional representatives, each service center has a congressional liason that works only with congressional people. They wil not call unless something is out of the ordinary or outside normal processing times. Usually 6 months for a K-1.

Calling the 1-800 number is completely worthless for you or an attorney. That line is answered by contracted phone operators. You will never get a viable or worhtwhile information from that info line. USCIS does not do business by phone, they do not have a tracking system like Fedex, there is really very little you can do or information you can get. You will be notified if they need something and when you are approved. In your case, your attorney will be notified.

Before your interfview, you will realize the attorney was a waste of money. They do not go to the interview with your fiancee. Aks him NOW for a copy of everything he sent to USCIS, you need that.

First off, I love this site like I would a family member.

Second off, I have an opinion question--I've filed the K-1 earlier this month (May) and I've spent time since then obsessively going over the process. We're trying to figure out when would the best time to set a wedding date, since his family does have to fly over from the UK, and would need advance notice. Plus I need to book a place. Anyway, what do you think would be the best part of the process to try to set a date--after the embassy has received it, or once you get the interview letter, sometime like that? Or just wait to see if you're completely approved and go from there?

Also I'm afraid I'm heavily confused about what's going to happen once we get the second NOA--I know I need to gather some documents and send them to him (that I'm clear about), and then he'll have to take documents in to the interview and OH LORD I DON'T EVEN KNOW. Will the communications we get clearly state what it is he needs to do on his end?



hi! yes you may want to set your marriage date after he got approved from the interview coz thats the only time you'll be really sure..
after the NOA2 you will be sending ur I-864 to him and other supporting documents and he needs to bring it with him to his interview..

Sorry to re-tread areas, but reading through the plethora of message strings, I have specific questions that I would appreciate answers for:

I am a US citizen and my fiancee is a Venezuelan with permanent resident status in Canada. She is currently in the last stages of attaining her Canadian citizenship - hopefully 3-4 months away.

1. Having read a few posts, it appears to be a "no-no" for her to come to the US on her valid tourist visa and for us to get married as this would effectively be "visa fraud" - using a visa for a different purpose than its intention. Is this a valid statement ?

2. As her citizenship will be changing in a few months from Venezuelan to Canadian, is it worthwhile waiting for the change in her citizenship before submitting the I-129 paperwork, or does it not matter ? i.e. is it better to have Canada on the paperwork rather than Venezuela ?

3. Related to 2, our plan is to have a party/celebration/church wedding in Venezuela, so once the I-129 is granted and we are legally married in the US, how long does it usually take before the married visa recipient (my fiancee) is eligible to travel outside the US. I am aware that we can apply for a I-131 (Application for Travel Document), but wanted to avoid that if possible.

4. What is the next step in the process after the I-129 is granted and we are married ? Is it a case of applying for I-485 (Permanent Resident Status) and I-765 (Application for Employment Authorization) ?

5. If anybody is aware of Canadian paperwork, how long does it take to get a Canadian police report - my fiancee had to get this paperwork when filing for her Canadian permanent residence and it took her 4+ months to get it back. I believe that we need this for the I-129 - is there a quicker way, or is this a typical timeline ?

HERE WE GOOOOOOO!!!! Just sent in my I-12F packet today (USPS overnight) and now comes the fun. The information I found here was very helpful and I think I got everything right. This is my second go-round. My ex-wife is from the Philippines (as is my next wife biggrin.gif ) and the first time, about 10 years ago, I didn't have any problems so I'm hoping it all goes as smoothly this time.

Thank you both for your responses. I agree that it makes most sense to write down the most stable address to get mail at and change the address when we have one that's more permanent. Has anyone had a problem doing it this way?

Hi, I'm a Canadian engaged to an American. We're almost ready to send in our I-129F, but a couple questions remains: On the I-129F, question 14 asks for, "Address in the United States where your fiancé(e) intends to live." Well, we don't know yet. My fiance plans to move in the next couple of months, so it won't be his current address, and he's living with roomates, so it won't be the next address either. Should I write his current address because I intend to live with him? Or maybe his parents' address for some stability? On top of that, because he intends to move, it would be horrible if all the documents for the next step of the application got sent to the wrong address, or returned. Is there a way for my fiance to specify the address he currently lives at versus the address he'd like to receive mail at?

Hey everyone! I'm new here, and just starting the K1 process... My fiance is originally from Rwanda, but we're both living in Botswana, Africa at the moment. We each have pretty limited internet access, which makes this that much more interesting. I'm sorry if some of these have been asked many times before, but I'm hoping someone out there can help!

1) My fiance has no middle name. Should I put "None?" I'm just afraid they'll think that IS his name.
2) I've heard from other people who have filed that they did a criminal background check for their foreign fiance. I can't find any mention of it on the forms or on VJ. Am I missing something?
3) For proof of meeting, can we send in copies of our individual Botswana resident permits? Will that prove that we both live in the same country?
4) As for addresses, can we put down a PO Box? That's how all mail is delivered in Botswana.
5) If a parent is deceased, how should we handle their "current residence" on the G325a? Leave it blank? Write "deceased?"
6) How specific should we be on our occupations on the G325a's? For example, can I just write Teacher or Coach? Or should I put what he teaches or what he coaches?

...and lastly...
7) My fiance technically has refugee status in Botswana. Will this slow down the process or hinder us in any way? For instance, we don't have his birth certificate or immunization records or any of that...

Often they tell you of the interview date at least a month beforehand, often 1.5 - 2 months before, so I would not worry about it. Hopefully she will receive Packet 3 and return it before she leaves to USA for the visit. If not, she can always prepare Packet 3 before she leaves and have a relative send it in (or hand it over herself at the Consulate if she knows they received her case).

Our interview was scheduled over 2 months after our NOA2, and Chennai is typically the fastest Indian Consulate. I would make a wild guess that the interview might not be until January, but maybe Delhi applicants can offer more insight here.

Since you just received the NOA2, the interview will probably not be scheduled until December or later; certainly not in November. so I would not worry about that.

If she decides to go ahead and make the visit in November, it might be good if she brings along paperwork to show at the POE in case she has a problem of questioning, paperwork showing that she has definite plans to return to India (letter from employer about vacation time and when she is returning to work, or anything showing that she has to return to pay bills, etc..

Many people try applying for tourist visas while their K1/K3 visa applications are pending, but they are usually denied. So we don't have much knowledge of what it is like visiting on a tourist visa while other visa applications are pending. I hope others with experience will answer!

Thank you for your valuable insight. Her tourist visa is a multiple tourist visa and she did use it indeed once to come to the U.S. in March of this year.

I will advise her to take all proof/documentation that she can that shows she will be returning. She is employed so she shouldn't have any problem w/ being able to prove that. She is currently scheduled to return back on Dec 2nd. When can I expect her to have her interview scheduled? She is only coming for 2 weeks and I am not sure how far in advance they typically tell you when your interview is scheduled.
