We included letters like that - my fiance & I met when I was a Peace Corps volunteer teaching some classes in the hospital where he worked. I had a letter from Peace Corps saying I worked in that hospital as part of my volunteering, and he got a letter from his employer stating that he worked in that hospital during the same time period. I don't think it can hurt!

I wouldn't worry about it even if it turns out it was misspelled on the forms. If it was YOUR name misspelled, could cause a minor issue. Your mom's name with a one letter misspelling will not be an issue at all. It won't be brought up during the interview...relax :)

I would put your full name in your letter of intent. As for affadavits from family/friends I would have them put your full name the first time it's mentioned and then they can refer to you by your middle name if your name is mentioned again later in the letter.

The guides actually say a front & back copy of your birth certificate OR copies of every page of your passport OR your naturalization certificate. If you are using your birth certificate to establish that you are a US Citizen you don't need to copy every page of your passport - just the relevant pages with entry stamps if you are using that as evidence that you have met in the last 2 years.

It shouldn't affect the K1 as long as it the reason it was denied was just your standard - like they feared that he was intending to immigrate. As long as it wasn't for a misrepresentation or something he should be fine! My husband was twice denied a student visa and was approved for the K1 with no problems :)

You can make photo copies of the G-325A for your copies to keep at home. They won't need originals at the interview - they have the originals. I think the idea behind having the copies is just that if something is to go wrong you can reference...you shouldn't need another original G-325A.

As for passport pics, I put a page in my copy that just said "Katie - passport pictures." They won't need YOUR passport pictures at the interview, they will just need new ones for him.

Well, if there government was not so corrupt she would be able to take care of her family mush better. She has eight sisters and three brothers and their still having financial shortage. One of her brothers is mentally ill.

Remember I've been there and seen their poverty status. There worst off then the US. Not all! But, too much of it is bad! So, for them not want to recieve outside help is far beyond me.

The government is not saying that you shouldn't support her family or that you giving them money is a bad thing. The US government needs to know that when your fiancee moves to the US, you can support HER. If you choose to also support her family, that's your business. The I-134 is in place to make sure that you make enough money to make sure that your future wife does not become a public charge of the US government. If you make more than 125% of the poverty level you don't need a co-sponsor. If you don't make more than 125% of the poverty level then you may run into a problem since the Manila Embassy does not look highly upon the petitioner (that's you) requiring a co-sponsor (ie, you don't make more than 125% of the poverty level, so someone else has to say they will support your fiancee if necessary) and may not accept one. They are in no way saying that you can't help support your fiancee's family.

All the Philippinos I know her especially the mothers love it that I do that! So you must referring to the government?


When your fiancee has her interview she will need to take a form (the I-134) that has been filled out by you (and including evidence such as pay stubs, tax returns, etc) showing that you can support her financially (ie, that you make over a certain amount of money per year - 125% of the poverty level for your family size.) If you don't make over that amount, some Embassies/Consulates will allow you to arrange for a co-sponsor - another US Citizen who agrees to support her in the event that you cannot. SOME Embassies (including the Manilla Embassy, from what I've seen here) frown on co-sponsors & often don't allow it. Check the Phillipines forum for more info/advice.

This happened to me too...I think the problem you'll have is that their system shows that it was approved and the NOA was mailed to you. Their policy is that if it was lost in the mail that's not their fault, so they charge you an obscene amount to get a duplicate. Ridiculous. When it happened to me the adjudicator just "forgot" to update it in the computer, so an NOA2 was never generated. I called USCIS several times and finally spoke to someone competent who got it updated in the computer and mailed to me on the same day.

I've heard some people have been successful just calling and catching someone nice on the phone...otherwise I'd do what the previous poster said - write a letter, include the letter from NVC saying it was approved and mailed to the consulate, etc. I have no idea WHY they need the NOA2 for AOS - obviously it was approved, otherwise your fiance(e) wouldn't BE HERE. But it's USCIS...I'm finding that little about them makes sense.

Yes, he can stay up to the 6 month point with you - you can mail in the application now, and then once he gets his interview (or gets to the 6 month point, whichever comes first) he will go back to Canada to complete the medical exam and interview process. You don't need to put an A number if you never had one.

You cannot hold two visas at one time, so I would think once you get the K1, your L1will no longer apply. It may be difficult to get the L1 with a K1 pending anyway, as they will presume immigrant intent. Your best bet may be to try and speed up the K1 as much as possible.


Problem is though - even if you can speed up the K-1, you can't work on it once you enter the US until after you go through AOS & get your EAD or green card.

This is incorrect - the fee is non-refundable. At most embassies you pay the fee before you even interview.

As for K-1 vs. CR-1, we are happy with going the K-1 route. Sifa had never even been able to meet my family, which was very important to me before getting married. Since it costs an arm and a leg to fly to Kenya, they weren't able to go meet him there and it's also next to impossible to get a tourist visa for a Kenyan so...K-1 it was! And we haven't regretted that decision. Also ditto to what others said about starting married life TOGETHER instead of a zillion miles apart. Worth it!

Correct - diabetes & high blood pressure would not be reasons to deny the visa. ETA: You also shouldn't need to take any kind of paper saying that you are taking treatment. I don't even think they tested my husband for any of these things at his medical exam in Kenya...

Speaking of filing DCF... I've been searching the Forum (just found out about it - it's great) to try to figure out how to file for our K1... I'm American but have been living and working in London permanently since 2007. Fiance is British. Can we file DCF.. or...? Consulate website has been less than helpful thus far.. :-/


Can't do a DCF for a K-1 - it is only for the spouse of a US citizen, not a fiance(e). You would either need to get married (probably fastest option) and file DCF or use a US permanent address (parents, etc) and file a K-1 based on that if you are really wanting to get married in the US (though you could both visit the US, get married here while on vacation from jobs, etc and then go back to the UK and apply for DCF.)

Nope, once she's here she's here for good (or as long as you both want to live in the US :)) Basically once she comes in (has to be within 6 months from the day the visa was issued - it will have an expiration date on it) she will get an I-94 which is a paper they will staple in her passport at the airport when she lands. After that you have 90 days to get married. After that you apply for adjustment of status (ie, the green card.) She does not have to return to Japan after she gets here (nor should she until she either gets advance parole or the green card - otherwise she won't be allowed to come back in!)

I noticed that the majority of petitions getting approuved for VSC for K-1 visa are OR around october 20th, OR around december 15th... How come am I not approuved yet, if my NOA1 was on november 17th? I don't understand why a lot of people from mid-december are getting approuved before me? Does anybody know why?

The interview and the embassy process comes AFTER the I-129f is approved. The I-129f is not the visa, it's only giving you the right to apply for the visa at the embassy. The petition will be forwarded to NVC then to your fiancée's embassy, then they will send her forms to apply for the actual visa. You still have a while to wait!

As others have told you, as a practical matter, you must meet in person. I highly recommend against a third country if at all possible to avoid. Learning about family and the other party's life now, is very useful in the decision making process. A vacation together lacks "reality".
I agree with Mike and others, it is not only practical but required as part of the petition process (K1 I'm assuming). I also highly recommend that you have many photos of you with him and his family.

The "RFE trick"... 1-800-375-5283 Then hit 1,2,2,4,2,1 Then enter receipt number, then 1 a couple more times... If you call the USCIS number and answer honestly, you will get a customer service rep with no clue.


Phone trick didn't work today. Seems that after the '4', there is NO '2' choice... you either pick 1 or hangup, or 8 to 'return to the main menu'.

MEA CULPA... I was calling 'after hours'. Seems they only want to work until 6pm... and I would speculate that is Eastern time.

Not doubting the veracity of your relationship, but do you really want to consider a life time committment to somone who: a) willfully will lie about their children or :b) does not understand the ramifications of such actions?

If she can obtain an authentic CENOMAR (Certificate of No Marriage), then go forward but be sure to include any minor children on the application. Otherwise, I believe she would be considered abandoning her children and subject to immediate deportation once discovered in the US.
