If your name is on the BC, you're seen as the father (end of story; so to speak lol)... But if it helps, here is a quote from your research, A stepchild if the marriage creating the step-relationship took place before the child reached the age of 18 so you can sponsor the child (unmarried or married and under or over 21 years of age). You will need tax returns, W2's, 1099's and schedules for each year. 2009 is not required until April 15, 2010. It can't hurt to send just the w2's for 2009, and the above mentioned for 06, 07 and 08. I personally prefer IRS transcripts and they are free to obtain. Up to you though. ** Also, this qn has been asked and answered several times. Had you entered I-864 into the search bar up the top you would have found several topics that answered this qn. Try to send IRS 4056, I believe. You can get transcripts of previous three years in 10 days... If she has it, then you should check the requirements for marriage in your state. Once you have your marriage certificate, you can file the I-130. It'll be a CR-1 visa. She goes home to wait for the I-130 to be processed all the way through. She'll have her interview, get the visa, then she can come to the US. After that, the green card and social security card will arrive at your home after she has been here about a month. Then she can work in the US. No EAD. No AOS. You'll file for ROC 90 days before her green card expires. Then she'll get the 10 year green card. If she wants to go for citizenship, she's eligible after she has lived in the US with a green card for 3 years. Good luck! ITS CONSIDERED FRAUD TO ENTER THE UNITED STATES AS A VISITOR WITH THE INTENTIONS OF GETTING MARRIED- THIS COULD RESULT IN A LIFETIME BAN... Yes, you can go the CR-1 route if you so please or the K-1 route. It does not mention the filing of form I-485 anywhere in the guide. If the goal is to get a Green Card for the beneficiary at the time they arrive in the US, is the I-130 sufficient or does one need to file I-130 and I-485 concurrently? If you really think about it, you dont have an A number so it is all zeros, like when I was added to hubby's benefits they had to put numbers (zeros) in the space of my SSN so the system could accept it.
