IR-1 / CR-1 Spouse Visa Process & Procedures	Could my visa be refused?	Hello, Congrat avec le marriage... First of all, y cannot move to the usa without a visa even if yre married to a usa national. Y can travel to the usa with the waiver program but y will need to leave after three mth. In yr case, the officer might ask y deep questions as yre married to a usa national? then they will try to determine if y are attached to the country where yre from or where y live. Therefore, if y have a job, why are y coming here, whats yr plan, where do y live with yr wife...etc any answers which makes the immigration officer believe y will try to stay can cause y troubles. In the end of the day, it will depends of the officer during that day if she/he is in the good mood, if he/ she follows immigration rules, if they are busy..etc etc nobody in here can tell y the outcome. The only thing we can tell y is if y tell them, yre married to a usa national and y try to move straight away there yre not following the rules and y will be refuse to enter the country If y decide to travel there, i will advise y to travel with a return ticket, proof that y have money to survive there, a letter from yr parents in law to confirm y will be staying there when in the usa and they aare happy ab seeing y and their daughter and maybe be honest ab the fact that y do not intent to stay in the usa yet thaty might apply for a visa when y leave the country but y are just coming to the usa to see if y like the lifestyle...etc Ps: do not speak ab looking for work....y have few wks to think ab the reasons so think well. When accpeting new nationality , russian citizens must abandon their russian nationality. I know some russians keep their passport when getting a new nationality but it is act illegal. They can go to jail if catch at russian airport except if law has changed in the last two years.then sorry. 2- y will need to get father consent plus a copy of his passport/ id if y want her to get a visa. Note that for obvious reasons, u cannot get anywhere without his consent... Too many children traffics and children kidnapped by force i suppose. The fact that y are from two different countries shld not be a problem until y get the right docs and letters. Are the child parents were married and divorced then? Hope it help. Yet y have a file trying to stay in the usa. Whatever it is always at the discreation of the border officer. Y can travel but if the officer has a doubt y will be staying without a proper visa y can be refused. Be honest to the officer when he/she asks y the question and travel with yr return ticket prebooked,It will help. This is true for every country even when a visa is issued. Hope it help. K-1 Fiance(e) Visa Process & Procedures	proof of income for self employed	Hi, Regarding self employed or director, y can choose one of the three entity to provide this letter: - yr lawyer who has been knowing you and deal with yr business stipulating how long they have be dealing with y( date), yr title and name of company and how much y earn a yearsplus tax return or last three bk statement depending of country. - yr accountant stipulating how long he has been dealing with y etc etc plus last three bank statement and tax return depending on country whre yre from or work - yr bank manager who has know y for more than 2 years or who has deal with yr business acc plus extra papers. Each document needs to be dated and stamp or sign( the letter of the banker needs to sign and stamp by the bank). Hope it helps. Tax return is not three mth sorry is the last two years but bring more docs if y can...but this letter can be replace by one of this with my experience with dealing embassy. Crew visa are different than any type of visas, ask the embassy by email or in person.bec it s them who will hold yr passport and cancel it if they have too. Do not worry ab it and ask the right questions to the right person. Yr only issue will be to have two calid visas which the usa might not accept. The embassy might request y to finish yr work , travel and post back ur passport to issue yr visa and y can request this when y have yr interview. The usa embassy is very flexible inlondon if y have a good case and y show proof of travel and work. The only issue for the last year is they use a private company to post and answer queries on the phone. I was living in london for 10y and worked as a visa consultant for 7y. The only issue i can see is to have two valid visas on yr passport which the usa might have a problem.As i said i will advise y to email them instead of speaking as y have proof. When clarify, make sure they do not cancel visa by putting a post it note. When y are travelling in the usa, are y in transit or y leave the airport? Sorry to ask but just want to give y a good answer. The usa embassy in london is very helpful and nice so y will have no pb to deal with them. I used to deal with them alot. If something goes wrong y have that print out on yr side. In my experience, they might reply witha vague answer but at least y can back yrself up. Crewmenber visa might be needed for y when in transit so y dont have to pass immigration or pass with yr team.it is another story if yr final destination is the usa.Y might as well qsk yr airline as they will be aware of the immigration law and have immigration companies work for them Will all do respect of the menbers of this forum, please answer this question only if yre in the same situation than the applicant. IR-1 / CR-1 Spouse Visa Process & Procedures	mary status update petition for spouse	Hi all , well I got the 2nd rfe for the I-130 they said they did not have the signed photos for me the petitioner and i know my spouse and I sent them all in the packet and both reviewed it so probably they lost them so now they inn the mail .OKay we filed originally April 16th 12 I was a LPR the I became a USC notified them they updated my status and petition .Any idea when this I-130 will get approved or a decision made. I dont see any reason for it to be denied but?? :-) any experiences with this much appreciated .WE just filed the I-130 and as I said its pending my husband is hesitant to file the I-485 ??? he says ok the I-130 has to be approved to file the I-485 so what's the point in case the I-485 gets denied he's not a negative person just cautious .. Okay and now when the photo arrives back at USCIS will it just sit in a pile on someone's desk for months :-(( or will they just receive it and move forward immediately ? with the processing .. Middle East and North Africa	Need Advice on What to Expect from Casa Consulate	Hi everyone, I am looking for advice and info from those who have gone through the Casa Consulate. I hear its a killer, but I am keeping my fingers crossed that things will go smoothly for us. So, we are still at the very beginning stages of the process, and luckily I am still living here in Morocco, so we don't have to be apart yet (hamdulilah), but I have been looking at all the estimated wait times (VSC) and anticipate that we will get our NOA2 sometime in late June or the first half of July (in sha allah!!) I will actually be in Oman all summer (June through August...completely encompassing the expected time of NOA2), and want to make sure that I have everything ready for Simo's interview before I leave for Oman. I have read that there is debate over whether the Affidavit of Support is required for Casa. What are your experiences with that? Because that will be the hardest for me to prepare (complicated finances from living abroad). Also, are their any forms he can start doing now? Any surprises with Casa? I know some he will have to wait for because of the 3 month limit to notarizing. Also, what sort of timeline should we expect? How long is the wait between the NOA2 and the Consulate interview? I looked at someone else's profile and it seems to be a bit long (3 months or more?) One more quick question, I have excellent contacts (friends) at the US Embassy (unfortunately not at the Consulate but nonetheless, quite high up) here in Morocco from living here for a year and a half, and was wondering if you think that they could put in a good word to speed up our process once it reaches the Consulate phase. I hear about people contacting their Congressional representatives, and I don't want to do anything of the sort, but we all know how 'knowing people' is quite helpful in this country. So, I know that we may be impatient, but I am hoping that, assuming everything goes smoothly, he will be able to come in mid-to-late September. Is that reasonable at all? Middle East and North Africa	Visitor Visas from Maroc	Hi Carolyn, I can't speak from personal experience (as we are still waiting for the K-1 visa) but from my experience living in Morocco and talking with families, including my fiancé's, you are right, it should not be an issue. I am quite positive that none of his brothers could get the visa, and it is not even worth trying, his sister also might be difficult, but parents and grandparents, especially ones who have families, houses and/or retirement benefits in Morocco (and presumably speak no English) are not considered flight risks. The first time she gets a visa it might be for just the exact dates of the trip, but if she returns and applies again, she should probably be able to get the 10 year visa, which allows for unlimited travel for 10 years (this is what my fiancé's grandmother has, his Aunt lives in Florida). And you should take comfort knowing that applying for a tourist visa is actually a lot easier than what we are going through! Middle East and North Africa	Important Question on Finances for K-1 Through Casablanca	Hi, We are waiting for our Packet 3 from Casablanca (our packet arrived on August 18th), and have heard from others who have gone through the process that we might not have much time to get everything together, so we are working on that now. I have an important question for other K1 petitioners through Casablanca, I have consistently read and heard that Casa is exceptional in that it does not required any financial information to get the visa (i.e. no affidavit of support required). Because of that, I have not been preparing that information at all (I know I will need it for adjustment of status, but I have just returned from living abroad and am starting a PhD program in September, so suffice it to say I really am in transition and am not really ready to fill out all that information quite yet) So, my question is for those who have recently gone through Casa, did you fill out the affidavit of support or not? Did you think it would help your fiancé at the interview or are we fine without it? Or do I really not need to worry about it? Also, how long was it between when the packet arrived at the consulate, how long you got Packet 3 and how long the interview was scheduled... Thanks for any tips! Middle East and North Africa	Phone call from the Consulate	Hi everyone, I just wanted to ask a question to other MENA applicants -- my fiance had is interview at Casa on October 15th (Wed) and he said it went really well -- just a few questions, how we met, what I did in Morocco, what I was doing in the US now, where else he had traveled. She did not ask for evidence or documents of financial support at all. He said he felt really good about it -- she gave him a form that said they have to do mandatory AP, nothing else required of him, and the CO actually told him that it "wouldn't be long". So all this is great news of course! Then on Thursday, the very next day, I get a call on my cell phone (the number we had provided) from a Bethesda, MD area code, but the lady says she is calling from the Consulate just to inform me that my fiancé's visa has been approved and that he would be getting a call from the Embassy shortly (a day or two). Have any of you had a similar experience? I was kind of suspicious actually that his AP would only take a day! I got the feeling that they might be 'testing' us almost....I guess we will know if he really does get that call on Monday or not.... Just asking for anyone who has had similar experiences. IR-1 / CR-1 Spouse Visa Process & Procedures	Track NOA2 to NVC	Hey, We got our NOA2 on 7/21 and I just called the NVC hotline today and they said that our case was there at the NVC, no indication of when it would get sent to Morocco. But my USCIS account hasn't been updated at all -- it just says the last time it was touched was 7/22, does anyone know how we keep track of this stuff now? I have a similar question (sorry no response) but I am freaking out now, because we already sent in our whole packet and I was very careful with all the evidence and photos and what not, but I didn't know how careful I had to fill out this form. I lived in a dorm through 06/06 when I graduated college and moved abroad to my next address in 09/06 but for those three months in between, I did not have a residence at all (travelling, couchsurfing) so I left those three months blank on the form. Now I am really worried I will get an RFE asking me for more info. Also, I filed my taxes at my parents address (my long-standing permanent address) but filled out both the g325 and i129-f with my current residence (I receive a lot of mail there, but some I still receive at my parents' address, because I have been living abroad for the past 2 years since I graduated college) and now I am worried that when they cross check me in all these 'databases' they will find that I these different addresses and will want an explanation, especially if I have to send in the Affidavit of Support Form with my taxes filled out. Any help from someone who knows what exactly they are looking for and what could get me an RFE or not would be really great? Is there any way I could send in an additional form now to add to my packet before it gets processed to avoid any confusion? Thanks! K-1 Fiance(e) Visa Process & Procedures	Does too much documentation slow the process down?	I do wonder whether this might depend on the Consulate/Embassy you are filing with. I had this same debate when mailing our petition in, but everything I read about the Casablanca Embassy indicated that you have one shot -- they don't even glance a the evidence you bring in on interview day -- so you need to make a strong case initially in the I-129F. I don't think we did overkill at all, but I did send in about 6 emails or so to show proof of an ongoing relationship (which is required as well). The interview with a Service Center employee (lost the link) here on VJ did also mention that while huge amounts are unnecessary, you do want to include evidence of ongoing relationship. Those are my thoughts. Hi, My fiance and I have been dating for 3.5+ years and I have actually lived next to him for the past 18 months in Morocco, so I am not too concerned about establishing validity, but I was wondering if we could put PDF files of some of our emails/chats and even a video of us together and burn it onto a CD instead of creating a larger paper burden.... Have any of you tried this/thought of this? Do you think that it would be accepted? Thanks! We are hoping to get everything into VSC ASAP to take advantage of those amazing processing times!
