Liz- I heard from other people the Cuban Interest NEVER answer the phones. I know this to be true for the office here in the states so I am sure it is true for the office in Cuba as well but keep trying and good luck!

mmoreu- She posted her story earlier.. do an advance search for key words cuba or look at her profile and click her posts.. There was no reason given why she was denied they didn't tell her at the interview either.

She provided all the documents required and had to get a congressman involved to find out what the status was.. that is when she found out her application was denied for reasons labled "not a bonified relationship"

I don't think you have to withdraw anything it was denied simple as that case closed. When you apply for the spousal visa it will be a new application nothing to do with the old one.

If your spouse is in Cuba how is he going to be able to travel outside of Cuba? Does he already have a visa to go somewhere else? To my understanding they need a visa to go anywhere outside of Cuba.. I might be wrong though..

I thought only Cali and Tex were processing those and that is why Tex is such a nightmare because they handle most of the US except west coast.

I would be the petitioner and have a criminal record of DUI charges.. would this be a problem? They are not felony charges.. I know they ask for criminal records..

My fiancee does not have a criminal record or anything that would hinder his approval. But two of you have now mentioned criminal records.

Thanks for the response. I was asking about the denials because I see Fiancee Visa's get denied so I thought maybe there were stories of SPouse Visa's being denied but now I see they come few and far between which gives me releif.

I only have concerns because as of right now I would not attend the interview and its Cuba so that alone is a concern because they might think it is fraud when it is not.

By the time I get married we will have been together for a year so there will be enough evidence to support the relationship. I guess I worry for nothing sometimes.

But again the stories for Cuba right now are not positive.

No I posted that because he was denied a visitor visa this week and someone had stated the reasons as to why it was denied so I posted a response.

No worries.. I just want to know what options are best the spouse or fiancee and thats why I started the thread to see if anyone has gone through a denied spouse visa and what steps they took after it was denied and what the final outcome was.

sarah- thanks for the response we actually waited for this interview to see what happened. I was there in March and he wanted to get married but we decided to wait. Now when I return I guess we will get married and then start the process. I just wanted to know if Spouse visa's can be denied and what are the steps taken after the denial?

Because I know fiancee visa's can be denied then people go and get married turn around and apply for the spouse visa. I was thinking of skipping the whole fiancee fiasco and just marry first.

I have the evidence that is needed for both petitions just trying to figure out which one will be faster and less of a hassle as well as getting him here quicker. There are pro's and con's to both VISA's..

 

He is young only 31 but he has kids, has been out of the country once and returned on time, has his entire family in Cuba and he is a priest over there so who knows why they denied him but most likely it was because as everyone says they thought he was not going to return in which he actually was because of his job he needed to return..

Anyone get married in another country and then come home to start the Visa process.. go through the entire process from finish to end and interview then be told your application is denied?

Just weighing my options - I know K1 Fiancee Visa's can be denied and people then turn around get married and file for spouse. Currently Cuba is not looking so hot approving things my fiancee was denied a visitor visa this week still trying to figure out the reason why but that's another story..

 

Wanting to know if it's best to apply for the fiancee or go get married and apply for the spouse.. There are pro's and cons to both..

According to your timeline, EB1. At that age EB1 would be very unusual.

That was a mistake I made on registration (lol the irony)

He's currently here on the VWP, not sure which course of action to take all we know is that we will be getting married in the following weeks.

Generally you can get away by using the VWP even as in this case when not eligible.

As long as you do not have some issue, such as an immigrant petition when it comes back to bite.

Have you discussed it with your Lawyer.

Fiance is currently in the USA, he has only ONE conviction on his record (took an abandoned bicycle when he was 19), and ended up being convicted of theft. At the time of application he was not aware that a petty offense constituted a CMT.

The offense was 4 years ago and he has never been arrested since.

Although he may be eligible for a petty offense exception, his interpretation of CMT means that he did not declare the offence on the ESTA/VWP application. For which he now wishes to put right.

The relationship has been ongoing for a year and marriage is on the cards. I fear that if he returns to the UK and applies for a CR-1 he may be denied re-entry. and I imagine AOD might be an uphill battle.

Indeed they do, JTLDN, although it does come with a hefty price. After nearly four years of fighting our battle, my husband is here with me. We both lost a lot through this process and are only now picking ourselves up, dusting ourselves off, and forging onward in our new lives.

I PMd the OP, although I'm not sure how much help it will be. I know others have been successful in overcoming this on their own, but I would wholeheartedly recommend contacting an attorney experienced in handling these matters.

wow a 4 year battle, I too would appreciate more information on how you overcame and won.

I was arrested, I know I was cautioned but don't recall getting any paperwork. It showed up on an enhanced CRB check 2-3 years later. I agree that getting the ACPO certificate would shed some light on it - if I'm lucky enough to get "no trace" then I think erasing the incident entirely from my memory might be the best option, regardless of the various pressures to be "honest". If I get "no live trace" then I will have to disclose it and risk getting the "misrep" against me.

Another question for anyone who may know about such things - if an ACPO says "no trace" then is there any other check that could be made behind the scenes to reveal something like a caution?

Also - does anyone know of anyone who has had a misrep for a caution and NOT had it work against them? I read up on JustJ's situation and her husband was tagged with a misrep as well as (unfairly) an overstay, the both of which together caused issues. I'm wondering if the misrep alone (and if explained as a mistake/misunderstanding at interview, therefore not willful misrepresentation) is enough to get denial of a K1 visa.
